Mabusth DATE:February 26, 1981 SUBJECT: #594 Bruce Dayton, 550 Long Lake Road Preliminairy Subdivision Staff Update ES i, Septic Review - Gaffron reports that all six lots conform to code - each primary site will support a standard drainfield system with adequate area for future expansion Both Gaffron and Gronberg concur that the septic site areas selected for Lot 6 be "closely adheared to" because the area remaining has heavy clay soils and steep slopes. Private Road - Staff has no problems with Dayton's request to construct the private road to the driveway of Lot 6 and install a cul de sac that abutts Outlet C. A completed private road serving open space area at the end is unrealistic when one considers the density ratio of 71 acres to 8 residences and the fact that the major new use of the road is limited to the southern portion. It is understood by both major landowners that future developement of Warner's property to the west of plat road and Dayton's property to the north will involve the upgrading of the entire road. Deeding of Outlot A, Wakefield Farms, to the City. The City of Orono was not aware of the applicants wish to deed this property to the City. Staff would request additional time for the Public Works Coordinator and the Park Commission to review the potential of the property and report back to the Planning Commission. Gaffron, On-Site Systems Manager DATE: January 21, 1981 SUBJECT; #594 Subdivision, Wakefield Farms 2nd Addition I have reviewed the soil testing report submitted for the above subdivision, and wish to make the following comments; According to the Hennepin County Soil Survey, soil types on the site include Burnsville sandy loan, Heyder complex (sands and clays), Glencoe silty clay loam, and Peaty muck over loam. Prom the survey and previous borings in this general area east and southeast of Long Lake, the report for this subdivision appears to confirm that the soils are in fact quite suitable for use of standard drainfield systems on a large portion or each propotted lot. The topography, soil types and lot line configuration of Lots 1-5 allows for reasonable flexibility in house and drainfield placement. However, Lot 6 not only contains somewhat heavier soils to the northwest, where slopes are greater, but also contains a large area of Glencoe soils to the rear, which are not suit able for drainfield use. I concur with the applicant’s engineer that the drainfield site for Lot 6 should be closely adheared to when the lot is developed. The creation of Outlot A does give a somewhat larger future^ drainfield expansion area to the existing residence north of proposed Lot 6. Should failure of that existing system ever occur, adequate expansion area is available. , tV* With reasonable care taken during development of these 6 lots, each should be able to function indefinitely using on-site sewage treatment and private wells. Olson, City Planner r«sbruary 25, 1981 #595 - Judd Ringer Sketch Plan This application is for concept or sketch plan review of a subdivision, nothing more. The review, however, has become centered on the proposed use of one of the parcels. Questions regarding this use and receipt of public input are valid and pertinent to the subdivision proposal, but staff and officials should be reminded that no application has been made for rezoning or for a conditional use permit, so it would not be proper to take official action on this matter. Also, the subdivision fketch plan fee does not cover the costs of an extensive use review, ^he City should not make a commitment, based upon incomplete facts, the developer first makes his commitment including a complete application. PARKVIEW USE Perhaps, the most immediate question for Planning Commission and Council members to consider is whether or not the proposed use is permitted by our zoning code, and, if so, under what provision. This will facilitate proper application and a more detailed review thereof. State Statute 462.357 provides some direction concerning group homes or facilities similar to the proposed use. Facilities for 1**6 persons are permitted single family uses in any single family residential zone. Facilities for 7-16 persons are permitted multi-feunily uses in any multi family zone, although, cities may apply controls via conditional or special use permit requirements. No mention is made of facilities for over 16 persons, so cities retain complete discretion concerning the larger facilities such as this 24 person proposal. Orono Section 34.823 allows hospitals, sanitariums, rest homes, and nursing homes in the RR-IB district by conditional use permit. Section 34.900 et. seq. provides a special RR-lB-1 subdistrict for non-profit study and research centers including live-in facilities. QUESTIONS 1. Does proposal conform to 34.823 use? if so, proposal is a CUP only, subject to those standards. 2. If it doesn't conform to 34.823, is it similar enough to be an RR-lB-1 use? if so, rezoning is required. #595 - Judd Ringer •February 25, 1981 Page 2 3. If it doesn't conform to 34.823 or 34.900, should an ordinance amendment be considered to: a) make these facilities a RR-IB CUP? b) include it in RR-lB-1 as a permitted or conditional use? c) create a new zone? Making one of the above determinations would not in itself be a commitment to approve this proposal under such an application. SUBDIVISION Until, and unless, all or part of this property is rezoned, any subdivision proposal must be reviewed as if it were a normal RR-lB two-acre residential division. This includes foresight to consider the effects of creating each parcel, including the real possibility that plans may chemge and that Icurge lots are prone to redivision down to the two acre density. Options should be kept loose and open to accommodate this eventuality. The property apparently consists of four separate parcels containing three residences, plus out-buildings. A question has been raised as to whether or not the north peircel and residence is included. This must be clarified. The proposal indicates combination and redivision such that two residences would be on the seune (Parkview) parcel and one residence on the remainder. Multiple residences on one parcel are not permitted without a guest house conditional use permit. Final subdivision review would have to be subject to prior removal of the one old house, issuance of a guest house permit, or some other zoning cunendment/approval for this specific proposal. Lot arrangement and access is my major concern with this proposal. As drawn, the Parkview parcel is landlocked. This is not acceptable without a platted public street or standard private road outlot providing access to this parcel and to all future parcels. This proposal indicates abandonment of the existing driveway, which is good, but Ringer's January 8, 1981 letter indicates that it will be "retained for possible future use". This issue must be decided upon at the time of this subdivision. When this property was reviewed by staff two years ago, it was felt that direct access to Highway 12 should be very limited or restricted altogether. The>concern is creation of strip development along the highway with multiple accesses required. Too many future options along Highway 12 are limited by the current design, almost forcing direct access if the southern strip is redivided—and it most certainly will be. J #595 - Judd Ringer February 25, 1981 Page 3 ii I believe that the developer must invest more design time to review other access options. This is not to say that the current proposal might not be the final chosen design, only that I believe other options should be explored. For exaunple, the attached sketches show: 1. 2. The existing road location and one possible replatting where direct access to Highway 12 would be the only option (short of building a second road). A relocated access road that leaves open the future option of allowing all access to be internal. Subd. 8. Permitted multi-family use. Unless otherwise provided in any town, municipal or county zoning regulation as authorized by this subdivision, a state licensed residential facility serving from 7 through 16 mentally retarded or physically handicapped persons shall be considered a permitted multi-family resi dential use of property for purposes of zoning. A township, municipal or county zoning authority may require a conditional use or special use permit in order to assure proper maintenance and operation of a facility, provided that no condi tions shall be imposed on the homes which are more restnetive than those imposed on other conditional uses or special uses of residential property in the same zones, unless the additional conditions are necessary to protect the health and safety of the residents of the residential facility for the mentally retarded or the physically handicapped. Nothing herein shall be construed to exclude or pro hibit residential homes for the mentally retarded or physically handicapped from single family zones if otherwise permitted by a local zoning regulation. Not only an I a resident of the cosnsmlty that Parkview West serves but an also a school counselor who has utilized the services of Parkview West. My experience with the staff and program at Parkview West has been exceptional. The quality of their staff and the program has been an asset to this community and to the persons It has served. Additionally the program and staff have been available to provide services to the community at large and to the school systems which I believe extend beyond the ordinary. As late as last year 1 was asked to Join the advisory board. Until that time I had refused to Join any advisory board. 1 agreed to Join this advisory board as I saw that their program Is designed to serve the community In a supportive fashion and Is an asset to the community. I believe that the addition of such a program to the Orono community would provide a positive model for the community as well as direct service to the needs of the comminlty and that the quality and caliber of the staff at Parkview West could provide programs With some positive outcomes for your community.
