At tha January 19, 1981 meatlng, tha applicants announced that thay
wara only intarested in proceading with a triplax and not a duplax as
raviawad by staff. Staff notad that a razoning to tha LR-lC-l
zoning district would ba necessary for a triplax application.
Tha applicant may proceed under the present LR-IC zoning and apply
for a Conditional Use Permit for a Planned Jtesidential tevelopoent. In addition
to tha variances noted at the first review, tha following variances may be
added:

Staff Recomnendations — i
To deny the condition use permit and variance application of John
Muehlberg and John Arnott based on insufficient hardship claims. The City
cannot accept financial hardship as a basis to approve the many variances
required to allow for a triplex. Applicants will continue to argue their
postion with Council but this body is obliged to relate to the standards
clearly set forth in the ordinance.

Area — 11.5 Acres
Mr. Kroger plans to lease the subject property to plant a shrub and
tree nursery. In five years, he proposes to sell the maturing stock on
the site. Kroger does not propose construction of a sales building. I
have enclosed a plat plan of Willow Run, note the approved access locations.
The eastern access must be moved further west as designated on plat. Lot 2
has a sizeable, designated wetlands located on its east side. The applicant
must be made aware of the limitations on its use by the Flowage and Conservation
easement. Review the enclosed easement — Kroger is limited to planting.
Kroger may not alter in any way the wetlands area.
Staff Recommendations
To approve the conditional use permit application of Jerome Kroger subject
to the following conditions:
1. Eastern access to be moved further west.
2. Designate! wetlands area on site plan and make adjustment for
appropriate plantings.

Action Item
Review of Application
The City was asked to inspect a proposed excavating and filling job
being performed by the Wayzata Country Club. The "greenskeeper" was asked
to stop all work until Council could approve the proposed land alteration.
Staff advised that the size of the project demanded Council approval and
did not fall with the scope of staff's authority.
The land alteration involved expansion of the designated pond to a third
the size of the existing pond. A portion of the bank to the north of the pond,
in the proximity of the tree nursery, was leveled three feet and graded. All
fill from excavation of pond and north bank will be placed In the fill area,
as designated on plan, to a hei^t of 3 feet and graded to meet the existing
grade. The piles of fill along Long Lake Road are within the City ri^t of way
If it becomes impossible to grade and level fill area, erosion control measures
should be taken to protect City right of way and surrounding area.
A speedy decision on this application will allow the contractor to reap
the benefits of the warm %ieatber and save needless expense of bringing the
excavation equipment back to site. Upon review of the Planning Commission's
recommendation, Dick Benson will poll the Council by phone.
Staff recommendation
To approve the conditional use permit of the Wayzata Country Club
allowing the expansion of the pond and use of additional fill creating a
3 ft. high bank to be graded to existing contours based on the following
findings:

will increase retention area in a low, collection drainage area.
All disturbed area to be protected by erosion control devices and
City right of way to be cleared as soon as possible.
Ponds banks should be graded to 3:1 slope.

Work Session
The applicants propose construction of a restaurant in the
southvest corner of the House of Carpets building. The owners plan
to offer a menu of Italian food and a carry out service only. The
total restaurant area will measure 18' X 18'. The ordinance is not
clear as to required parking. Planning Commission should review both
ordinances 38.312 and 38.316 and make a recommendation.
The total area of the restaurant is 324 sq. ft.
Applicants should designate the area and size of proposed sign.

Action Item
Review of Application
The City was asked to inspect a proposed excavating and filling job
being performed by the Wayzata Country Club. The "greenskeeper" was asked
to stop all work until Council could approve the proposed land alteration.
Staff advised that the size of the project demanded Council approval and
did not fall with the scope of staff's authority.
The land alteration involved expansion of the designated pond to a third
the size of the existing pond. A portion of the bank to the north of the pond,
in the proximity of the tree nursery, was leveled three feet and graded. All
fill from excavation of pond and north bank will be placed in the fill area,
as designated on plan, to a height of 3 feet and graded to meet the existing
grade. The piles of fill along Long Lake Road are within the City ri^t of way.
If it becomes impossible to grade and level fill area, erosion control measures
should be taken to protect City right of way and surrounding area.
■
A speedy decision on this application will allow the contractor to reap
the benefits of the warm weather and save needless expense of bringing the
excavation equipment back to site. Upon review of the Planning Commission's
recommendation, Dick Benson will poll the Council by phone.
Staff recoomendation
lo approve the conditional use permit of the Wayzata Country Club
allowing the expansion of the pond and use of additional fill creating a
3 ft. high bank to be graded to existing contours based on the following
findings:
does not affect drainage of neighboring property owners
will increase retention area in a low, collection drainage area.
All disturbed area to be protected by erosio i ccntrol devices and
City right of way to be cleared as soon ae .puS5iule.

Fairway of the golf course. The reasons for the proposed expansion are:
-to increase the water holding capacity of the existing
pond to alleviate drainage probleas in Twelfth Fairway.
-to make the IWelfth Hole a more demanding test of golf.
-by expanding the pond it will become visible from the
Twelfth Tee, making the hole more aesthetically pleasing.
The fill taken from the pond will be dumped in an area east of the Twelfth
Tee, spread to an average depth of Smo feet and graded to meet existing
contours.

SUBJECT: Preliminary review, Judd Ringer Proposal, Wayzata Blvd.
I have reviewed the soil survey maps and topographic site plan
of the above property. Generally, the existing and proposed
buildings lie on or near the best soils of the property for
drainfield use. These soils according to the Hennepin County
Soil Surrey are Hayden clay loam, with an expected percolation
rate of 30-100 minutes per inch and a water table usually deeper
than 5, These soils might be expected to accept a standard trench
system. The approximately 10 acre, relatively flat area north
of the buildings consists of Shorewood silty clay loam which has
a shallow water table (3*) and would probably be suited to use
of a mound system.

The proposed facility capacity of 24 residents plus staff could
be expected to use approximately 75 gallons per resident per day
with laundry, dishwasher, etc., plus approximately 15 gallons
per staff person per 8 hour shift. Assuming 4 staff per shift
this is about 4 staff X 3 shifts X 15 gallons * 180 gallons or
180 + (24 X 75) * 3000 gallons per day water usage for the entire
facility. Then if testing indicated a standard trench system
would work, using a 60 minutes per inch perc rate, would need
3,000 X 2.2 square feet/gallons per day * 6,600 square feet
of standard drainfield which would require about 15-20,000 square
feet of ground area or about 100X200 feet for primary and 100X200
for secondary or alternate site.
A mound system would be designed based on 0.83 square foot rock
area per gallon per day or .83X3000 ■ 2490 square foot rock area.
This translates (with sand bed underlying it) to about 7500
square feet and with an alternate site would need 15-20,000
square feet of area or approximately H en acre.
In either case, the parcel appears to contain soil types and
enough land area so that it is likely that suitable sites can
be found for some type of drainfield to serve the proposed facility
Soil testing for this project should first identify the depth
to seasonal water table with soil borings and include percolation
tests approximately every 50 feet over a to 1 acre area.
Ibe applicant should be advised to have his site evaluator contact
staff prior to doing any borings.

Review of Application
The City was asked to inspect a proposed excavating and filling job
being performed by the Uayzata Country Club. The "greenskeeper" was asked
to stop all work until Council could approve the proposed land alteration.
Staff advised that the size of the project demanded Council approval and
did not fall with the scope of staff's authority.
Ihe land alteration involved expansion of the designated pond to a third
the size of the existing pond. A portion of the bank to the north of the pond,
in the proximity of the tree nursery, was leveled three feet and graded. All
fill from excavation of pond and north bank will be placed in the fill area,
as designated on plan, to a height of 3 feet and graded to meet the existing
grade. The piles of fill along Long Lake Road are within the City right of way.
If it becomes impossible to grade and level fill area, erosion control measures
should be taken to protect City right of way and surrounding area.
A speedy decision on this application will allow the contractor to reap
the benefits of the warm weather and save needless expense of bringing the
excavation equipment back to site. Upon review of the Planning Commission's
recommendation, Dick Benson will poll die Council by phone.
Staff recommendation
To approve the conditional use permit of the Uayzata Country Club
allowing the expansion of the pond and use of additional fill creating a
3 ft. high bank to be graded to existing contours based on the following
findings:
1. does not affect drainage of neighboring property owners
will increase retention area in a low, collection drainage area.
All disturbed area to be protected by erosion control devices and
City right of way to be cleared as soon as possible.
Ponds banks should be qraded to 3:1 slope.

Nayzata Country Club has plans to expand a pond adjacent to the Twelfth
of the golf course. The reasons for the proposed expansion are;
-to increase the water holding capacity of the existing
pond to alleviate drainage problems in Twelfth Fairway.
I J -to make the Twelfth Hole a more demanding test of golf.
-by expanding the pond it will become visible from the
Twelfth Tee, making the hole more aesthetically pleasing.
The fill taken from the pond will be dumped in an area east of the Twelfth
Tee, spread to an average depth of tm feet and graded to meet existing contours.

At the advice of the Planning Comnission members attending the tour
the St. Louis Park, Parkview Treatment facility on January 20, the City
will schedule a public information meeting for review of the application on
March 2, 1981. Orono and Long Lake property owners within 500 feet of the
subject property will be notified. We will also place a notification in
the Minnetonka Sun. Public imput not normally sought at the conceptual level
become^ mandatory for this project.
At the Feburay 2nd meeting. Planning Conmission should concentrate on
the land use issues. Review Ord. 34.823. How does this application fit with
this conditional use permit? Note the standards - What additional standards
would Planning Commission recommend with this specific permit?

I have asked Michael Gaffron for a very preliminary review of the existing

Preliminary review, Judd Ringer Proposal, Wayzata Blvd.
I have reviewed the soil survey maps and topographic site plan
property. Generally, the existing and proposed
Duildxngs lie on or near the best soils of the property for
drainfield use. These soils according to the Hennepin County
Soil Sur^ey are Hayden clay loam, with an expected percolation
30-100 minutes per inch and a water table usually deeper
than 5, These soils might be expected to accept a standard trench
system. The approximately 10 acre, relatively flat area north
of the buildings consists of Shorewood silb/clay loam which has
a shallow water table (3') and would probably be suited to use
of a mound system.
The proposed facility capacity of 24 residents plus staff could
be expected to use approximately 75 ^’•llons per resident per day
with la^dry, dishwasher, etc., plus approximately 15 gallons
person per 8 hour shift. Assuming 4 staff per shift
is about 4 staff X 3 shifts X 15 gallons = 180 gallons or
180 + (24 X 75) = 3000 gallons per day water usage for the entire
facility. Then if testing indicated a standard trench system
would work, using a 60 minutes per inch perc rate, would need
3,000 X 2.2 square feet/gallons per day = 6,600 square feet
of standard drainfield which would require about 15-20,000 square
feet of ground area or about 100X200 feet for primary and 100X200
for secondary or alternate site.
A mound system would be designed based on 0.83 square foot rock
area per gallon per day or .83X3000 » 2490 square foot rock area.
This translates (with sand bed underlying it) to about 7500
square feet and with an alternate site would need 15-20,000
square feet or area cr approximately H an acre.
In either case, the parcel appears to contain soil types and
enough land area so that it is likely that suitable sites can
be found for some type of drainfield to serve the proposed facility.
Soil testing for this project should first identify the depth
to seasonal water table with soil borings and include percolation
tests approximately every 50 feet over a >s to 1 acre area.
Ihe applicant should be advised to have his site evaluator contact
staff prior to doing any borings.

Review of Application
The City received a call from a neighbor of Verne Hubbell that Hr. Hubbell
was doing a considerable amount of grading and filling on his property and
questioned if he had the necessary permit. Staff inspected the site and
confirmed the report. Hubbell stated he was not aware chat a permit was
required to grade or fill on your own property, but would apply ionediately
for the conditional use permit. The applicant was asked to submit the following
information:
a) Survey of fill site locating
1. designated wetland
2. area of fill
3. previous and present contours
Volume of fill • 2,900 cubic yards or approximately 250 dump
truck loads
General Comments
It would appear that 175 sq. ft. of wetlands at the bottom of the hill
has bean filled in. The wetland does not appear to be part of a designated
wetlands area but is subject to the same restrictions and standards. A
small portion of the fill area appears to run over on neighbor's property
to the east.
I will have the City engineer review the following before the action
meeting:

Mr. Kroger plans to lease the subject property to plant a shrub and
tree nursery. In five years, he proposes to sell the maturing stock on
the site. Kroger does not propose construction of a sales building. I
have enclosed a plat plan of Willow Run, note the approved access locations.
The eastern access must be moved further vest as designated on plat. Lot 2
has a sizeable, designated wetlands located on its east side. The applicant
must be made aware of the limitations on its use by the Flowage and Conservation
easement. Review the enclosed easement -- Kroger is limited to planting.
Kroger may not alter in any way the %ictlands area.
Staff Recommendations

Kr. Kroger is currently a Landscape contractor, holds a 3.S in Botany,
and was employed by Bachman's Inc. for 7 years.
'Ihe property is presently overgrown with weeds and unsightly tall
grasses and to no on 's benefit.
A nursery provides landscape stock and the cultivated rows of shrubs
end trees adds to the scenery. No structures are proposed
Stock will be planted as to variety in sub-plots aproximately
50* X 50'; ICO sub-plots are planned. 60,000 to 80,000 plants in
5 years, flew stock in as sub-plots are cleared.
Soil test shows a high water table. As I understand this makes home
construction difficult, except for certain designs.
A nursery will bo good use for this land.
