As tha saptic raviaw mamo suggests, va will ask for a raalignmant of lots 3, 4, and 5's lot lines in order to make tha most efficient use of tha land area. Tha developer will be given tha choice of several altamativasr but care must be given to assure t»ia 2 acre minimum lot standard. As for tha school district boundary question, this will be a matter for tha schools to reconcile and will have no bearing on lot line determination. %>■ As for Outlot B, we should note for the public record that three individual residential units exist on a 4.7 acre lot and that at final approval time of the Holly Acres plat. Council assumed that Outlot B would be subdivided at the same time Outlot C was subdivided. Two residential units would be permitted if divided based on total dry buildable area. Hollander - Subdivision ' .'f -I- m Z have reviewed the on-site evaluation for the proposed subdivision and wish to make the following comnentst m s: mt ral - All lots have sufficient areas of sandy or loamy i soils to allow the use of standard drainflelds. Each lot ‘ contains sosm areas of 18t or greater slopes where drainfielde could not normally be placed. Also unique drainage patterns on each lot act as a limiting factor in locating drainflelds rV building sites. With careful nianniwa. there should ' ^ ^ septic problems with this division. Let 1 - Average perc rate 1. S ng>l. The "Heyder coiqplex” soils here heve layered lenses of sand and gravel mixed in with clay loam. Steep slopes to the rear of the lot limit drainflelds to the areas nearer the road. iV *'^ - Average perc rate 5.9 iqpl. Drainfield sites are in the northwest portion of the lot near the road. Same general conments as for Lot 1. The northeast quarter of the lot is lower, flat land in a drainage area. Septic system should be kept to the tested area or somewhat uphill from it. 1^ 3 - Average perc rate* 2.5 mpi. Same loamy/sandy/gravelly soils as Lots 16 2. Testing was done across the lot about halfway back. ■v> 7 ■n? ^ Hi***; A - Average perc rate 14 nq>l. The secondary site is at the top of a hill near a flat area where perched water table may require a shallow trench system. i Mi f Lot 5 - Average perc rate 13.9 mpi. Primary site is on high | ground, alternate downhill. Mote that Oronberg has suggested that the line between Lots 4 6 5 be mov^ westward and the line between 3 6 5 be Mved southward to allow more useful area for drainfield. Z have attached 5 possible configurations which trould accosq>lish this - Z'm sure others might also be acceptable. This change will create better drainfield sites for each of lots 465. (■ V r Z note that Ward Krueger, a general contractor, has a sign up advertising these lots "will build to suit". He should be advised that a qualified designer must design a septic system for each specific lot and house before permits will be issued. The CMP finds limiting urbanisation of the rural areas of the watershed to be the key factor in controlling quality of water. Aquatic vegetation in %retlands or marshes has been found to function only during muaumr months because of the freeslng winter temperatures, much of the filtration value of the natural marsh process is lost during the annual spring snow melt. It further notes that marshes that have dryer areas, which have water in them only interImittently, absorb a greater amount of phosphorous and have an assimilative rate of 20 Ibs/acre/year as opposed to imrshes with permanent standing water with an assimilative capacity of 4 Ib/acre/year. I have been in contact with Clifford Reap of the M.C.N.D. who advises that if approved by the City a permit would be required. McDonald noted that this is a designated %«etlands Mabusth stated that it is designated on the City wetlands anp but not on the approved Orono Oaks plat. Ophein asked which one governs. Mabusth stated that the wetlands ordinance applies to designated and undesignated wetlands - all wetlands within the City. Goetten wanted to know the dimensions of the proposed excavation. Hineline stated about 6,000 yards of dirt frosi the pond would be reaoved. He noted that the plan and proposed is based on DNR standards. Movegno stated that this was 4 acres of wetlands on City naps but that it wasn't designated on the plat. Applicant stated that be has owned the property for 12 years and that sonatinas its wet and soaMtines its not. bovegno ashed if the drain tile doesn't work and why hasn't it been repaired? Mabusth stated that this was not the City's responsibility for tbs old agricultural drainage tiles are located within private properties. Ophien stated that the pond would probably fill in if nan would leave it alone. In other words if nan left it alone it would probably become dry land \inless they do soswthing to keep it wet. Applicant stated that he would be upgrading the property. OMH stated they had no problems with it. He noted that the City Council didn't detersdne that it was wetlands in 1978 when they approved the plat. The wetlands were never designated on the plat but Council still approved it. bovegno questioned the buildability of the two lots involving the wetlands. Kelley stated that it is a tretlands and that it should be enforced under the tietlands ordinances of the City. Hineline asked why they were against the wildlife pond. He noted that OMR and NCND approved of this why wouldn't the City Council approve of this. Rovegno noted this only wetlands application which was approved was ths Orono Schools^ which was used for educational purposes. A poll was taken by the Planning Oosnisiion as whether they thought the application could be reocsssended for approval. Kelley felt it was a wetlands area and should be enforced through the wetlands ordinances. Goetten stated that this was definitely a wetlands area and that excavation and alteration of wetlands is not allowed. She noted that 6,000 yards was a lot of dirt to be renoved. Opheie felt the wetlands should not be disturbed. Rovegno questioned if it is a designated wetlands - he doesn't believe that these two lots are even buildable. Bineline noted once again that the Council approved of the plat in 1978 and these are officially buildable lots. Butler, 4685 North Shore Drive, for a conditional use perm' , dated March 7, 1980, which states: CONDITIONAL USB PERMIT 4685 North Shore Drive #537 David Butler Mr. Butler has taken a one-time cabin and expanded it into a very large year-round house. In 1976, he received a variance (#194) to add an 18* X 30* addition onto the existing 540 sq. ft. house. In 1978, he received a second variance (#382) for a second addition of 1,620 aq. ft., plus a three-car garage. He now finds that he cannot use the drive- way year-round because of its slope so is requesting {armission to construct an additional 10* wide driveway down the hill to Rest Point Lane. — - ■ i-.- . a f.'''•w-' r .=• rz.. The original cabin had all parking located on the top of the hill perpenducular to County Road 19 in an attempt to reduce the grade (we have no County permit for this drive either). ■ V! 'I We do not have engineering drawings, but the a.:i.ey location has been surveyed and staked. It is apparent that grading and filling would be required to construct the driveway and the erosion and drainage control details would be important. The embankment around his house %»ould require a significant excavation and/or retaining wall. V. It is equally obvious that the existing driveways are too steep to be usable and that they exit onto County Road 19 in a hazardous aumner. There is no landing on top of the driveways and the slope, coupled with cars parked in the parking stalls, reduces sight distance to nil. The Rest Point access %#ould be safer with better sight distance and less traffic. The slope is still steep, however. glK ■.'l The proposal has been reviewed by Chief Kilbo, John Gerhardson, Alan Olson, Jean Mabusth, Tom Jacobs, and the Planning Cossiission. We all feel that the Rest Point driveway is reasonable, providing it is constructed according to approved plans. The only issue is the existing entries onto County Road 19.(Continued) . A preliminary approval resolution is expected to be adopted at their August 23, 1982, meeting setting out all the iMny details involved. I eill send Planning Commission members a draft copy of that resolution before the Council meeting for your information. The layout approved on August 9, 1982, is essentially the same layout approved by Planning Commission on July 19, 1982. The obvious change is replacement of the cul de sac with a thru street connected to Lyric Avenue. This design was suggested by neighborhood residents in meetings they had with individual Council members. Also on August 23, 1982, will be a public hearing called to discuss various public improvements in the Mavarre areat A.A trunk sewer bypass line Intended tot 1) alleviate existing capacity problems 2) allow connection of the Schlee.Builders plat (and in the future the Tonka and other adjacent vacant land) 3) allow connection of Northern Avenue properties B. STREET DESIGN OPTIONS - Preliminary Subdivision - 4 The neighborhood continues in its opposition to the July 19, 1982, design with a single plat entry on Livingston Avenue. This plan was designed to minimize the amount of street/utility construction and to conform to the Livingston Avenue connection required in the most recent review of the #671 48-unit plan. Several alternative street layouts are still being proposed including direct access to County Road 15, offset intersections on Blaine, and most recently, a suggestion for eliminating the cul de sac by extending Lyric Avenue through the plat. This later suggestion is the only one not directly reviewed in regard to this 24-unit design. It should be noted for the record, as Council is aware, that extensive detailed traffic studies have been made during which all possible street alternatives have been reviewed, compared and evaluated including the extension of Lyric Avenue. Neighborhood concerns and ideas have been considered, and have been weighed against existing facts, standard traffic engineering principles and general public safety concerns, especially as this relates to County Road 15. Direct access to County Road 15 has been ruled out by Council because of poor intersection sight distance characteristics, and because of a desire not to increase intersection conflicts on this busy road. Offset intersections on Blaine continue to be opposed by engineering, planning and public safety staff because of the inherent safety problems caused by increased/often-conflicting turning movements, because drivers have lessened awareness of other driver's presense or intentions, and because the offset intersections would increase noise, light and safety problems for the existing residences on Livingston and Lyric Avenues. Offset intersections would not necessarily decrease traffic through the existing neighborhood. (Offsetting Lyric Avenue north would reduce ROW requirements on the Kullberg/Harding property. But Lyric could not be offset more than 15 or 20 ft without seriously affecting necessary servicing functions at the water plant - and this H width offset would be tertibly confusing and dangerous for drivers. It is definitely not recommended). #585 Schlee Builders Page 2 Street Design Options The Lyric Avenue extension idea has merit and should be reviewed thf time. Extending Lyric reviewed during w ” design traffic analysis. It was not recommended then because of several adverse factors involving existing Lyric Avenue. The overwhelming reason was that the internal 48-unit design would have tended to funnel a large portion of the new traffic toward Lyric, which is not as good a route as ® multiple plat access was already provided to Northern Avenue. j t' ^ With the existing 24-unit design, there is no immedi.ate connection to Northern Avenue, thus extended Livingston is the only plat access. By also extending Lyric, an alternative access would be provided thereby increasing public safety and dispersing traffic better. The second plat access is not really "needed" because of traffic volume. There are only 20 units internal, or 160 trips per day. But it does provide a viable alternative. The extra street does not adversely affect plat layout or building location. It may improve access to the City water plant and Kullberg/Harding commercial property. It would apparently allay the traffic fears of the existing neighborhood. On balance, staff feels that extending Lyric Avenue as well as Livingston is a good idea and one that should be approved by the Council in their preliminary plat review. Through street is easier/cheaper to maintain (snow plowing, etc) Disadvantages 1.Requires extra street construction costs (Engineer's Estimate: $13,600: Note that high cul de sac cost is avoided thus offsetting some of the cost of the added street length). 2.Requires extra right of way land a) Land taken within plat will raise the net plat density above 3.04 units/acre to about 3.2 units/acre. b) About 15-20 ft strip from City water plant (would not adversely affect useability) c) About 30-35 ft strip from Kullberg/Harding (3500 sf±) would reduce parking and buildable square foot area resulting in higher easement acquisition costs. 3.Would put more traffic on Lyric Avenue which is substandard as follows: a) Existing pavement is only 16 ft wide b) Has a very poor intersection with Navarre Avenue. Time and actual use will determine whether or not mitigating measures need be takne. None is considered necessary at this time. This project consists of four parts. The total cost of all proposed improvements is estimated to be $444,798.00. PART D of the project consists of constructing a lateral sanitary sewer lj.ne to serve properties abutting Northern Avenue for its entire length between the railroad crossing at Blaine Avenue and the western City-limits of Orono, including all or a portion of Lots 6, 7, 8, 9 & 10, Block 10, Towns!te of Langdon Park; Tracts B & C, RLS 763; and that part of Lot 8, Block 2, Wiley's Park which abutts Northern Avenue. The estimated cost of this part of the project is $72,740.00, which cost is proposed to be assessed to said properties. A feasibility report is available for review in the City offices during normal business hours.
