CITY OF ORONO) City of ORONO RESOLUTION OF THE CITY COUNCIL NO. _ _ _ _ _ _ _ _ _ A RESOLUTIOr APPROVING THE PLAT OF JOHNSTONS FREiCH LAKE SECOND ADDITION WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City of Orono has adopted subdivision regulations for the orderly, economic and safe development of land within the City; and WHEREAS, the City Council has considered the application for a subdivision plat by Harrison R. Johnston, Jr. also knovm as H.R. Johnston, Jr. and Elizabeth Crosby Johnston, husband and wife, the subdividers; and WHEREAS, the subdivision has been approved as meeting all standards of the RR>1B zoning district finding that each lot is of a size and configuration that will allow its use as a single family residence to be located without the need of any setback variances; and WHEREAS, the City has agreed that a transfer of title via quit claim deed from the City to Harrison R. Mabusth DATE ; SUBJECT; May 14, 1982 #672 New Life Bible Church, 830 Old Cryr.wal Bay Conditional Use Permit Zoning District RR-IB Area - 8 acres Application - Ordinance 34.022 - Conditional Use Permit 3rd review meeting List of Exhibits Exhibit A - Building Elevations Exhibit B - Site Plan The Church has submitted revised building plans that will no longer require a sprinkler system with water supply demands that would have necessitated a holding tank or connection to municipal water system. The facility can now operate with an on site well. At some time in the future when the water capacity in the area has been increased, the church may petition the City for service. The church plans to proceed with building this year and formally requests a connection to the municipal sewer system when the sewer capacity would permit such connection sometime later this year. One sewer unit has been assessed against the property but remember the church with a 372 seat capacity will require 2 sewer units. Council must approve an additional sewer unit for this proposed use. As Planner's memo of April 8, 1982, (included in previous packet) suggests recommending a special exception to Rural Sewage Treatment Policy #7 to allow this limited connection based upon the fact that the property does meet all current Rural zoning standards and that it was previously served and assessed prior to creation of the MUSA line. Ai Site Plan Review The architect has submitted a master plan and a first stage of development site plan. Very briefly, I see no problems with the master plan; all accessory physical improvements meet the required 30' setback and all structures meet the required 50' setback. The proposed uses appear consistent with accessory uses associated with a church use. r' N hi' I 7- • #672 New Life Bible Church Page 2 Conditional Use Permit Review of first stage siteolan The building is 136* x 72* consisting of assembly/gymnasium room, offices, kitchen and classrooms. The building inspector reports he has no problems with the revised plans. Note as required by Ordinance 34.022 the structure has been placed 50* from the lot line. Access The access location has been approved as the only acceptable, safe access to the site. It will be located directly across from the most southern access from High School parking lot. Landscaping Landscaping appears to consist of grass and use of existing tree line along southern property line that appears to be on property to the south. Ordinance 37.090 does not require lemdscaping where parking lots are 30* from residential lot lines. Ordinance 32.430 would suggest that the City may ask for additional landscaping. Loading Area A loading area has been designated in the gravel parking area next to the kitchen. Signage The sign has been designated at a 10* setback off street property line. The sign's area measures 4' x 4* but the height has not been noted. Once again, the drainage has not been designated on the plan. This information must be reviewed by staff prior to formal action on application by Council. Parking 372 seat capacity required 93 proposed 42 gravel Ord. 38.244 requires surfacing of parking areas. 54 paved Total 96 The church proposed a gravel parking lot in an area designated for future building expansion. We can certainly understand the economics of this request but what is the real time schedule for future building plans. We could be looking at a 10 to 20 year building delay. If Planning Commission approves a temporary gravel parking lot this would require a variance to Ordinance 38.244. : »672 New Life Bible Church w Page 3 Conditional Use Permit I have no problem with the 60® angle parking stall designation in the paved parking lot as long as the architect includes a one way parking lane traffic plan. Arrows should have been designated on the plan with adequate signage located on site. Although the face of the application does not note the proposed use, I have been advised by the applicant that it is an expansion of the living room area. As Gaffron's memo (Exhibit F) advises the expansion cannot involve additional bedrooms. Applicant should be asked to review the building plans at the meeting. The addition will not interfere with the existing septic system but care must be taken during construction to protect the existing drainfield for there is no other area on the site to satisfy septic needs. Mabusth FROM:Michael P. Gaffron DATE: May 13, 1982 SUBJECT: Proposed Living Room Addition at 1380 Arbor Street The applicant wishes to extend the above house 8 feet to the south. Based on all the information we have available, this addition will not encroach on the existing septic system, nor will it reduce the non-existent septic expansion area on the lot. Please note that building plans should be reviewed to ensure that no additional bedrooms are created. The existing septic system is substandard in size and capacity, but we have no record of failure (the drainfied was replaced in 1976). I Also, should variances be granted, the applicant should be warned to keep all construction traffic off the drainfield. Johnson Page 2 Variance In 1965, the City approved a variance setback allowing a 18' x 15' addition to the original house to be placed 1' from the side property line. The reasons for the approval were given as follows: 1 - The principal structure on the adjacent lot was located 24* from the lot line. 2 - The owner of that adjacent lot approved the proposed location. No comment The hardcover on the site is located to the rear of the lot - 85' from the lakeshore. The 17' x 14' addition to the principal structure will be for a new kitchen area. The entire remodeling project involves a general upgrading of the original structure - a firewall will be constructed along the side of the building involved in the 3' encroachment. The actual increase in hardcover produced by the kitchen addition is 171 sf (238 sf - 76 sf of existing paved area). All drainage from the roof will be directed to the rear and sides of the property. To approve the variance application of Lyle K. Johnson for the following variances: 1 - Side yard setback variance of 6.8' or 68% 2 - Street setback variance of 24* or 69% 3 - Actual hardcover increase of 465 sf or 12% over existing 52% hardcover. The hardships are as follows: 1 - No adjacent lands available. 2 - Location of house on site - variance setback approved by City in 1965 allowing a 1' setback from side line. At first, we recommended attaching the garage to the rear of the house but that interfered with his plans for a first floor addition and would use up most of his grassed rear yard. We recommended a second story addition but the applicant advised the addition involved an expansion of the kitchen area and a dining and family room area. He also noted that the existing house consisted of a total of 768 sf of floor area. NSP requires 8' separation from top of structure and 15' clearance for driveway. The proposed location of the detached, single stall garage and storage shed will meet the NSP requirements and allow the owner to save his mature tree and preserve major portions of his grassed yard. The extended driveway and structural additions require the above noted variances. As for the hardcover variance, all the developed lots in this neighborhood would require hardcover variances. Staff Recommendation To approve the hardcover and setback variance for Bruce Hauglid to permit the construction of a detached garage and addition based on the following hardships and findings: 1 - Location of house on lot prohibits attaching the garage to the side. 2 - Topography to west side of rear yard. 3 - No additional land available. 4 - Location of overhead power lines. 5 - Location of mature tree in rear yard. 6 - Written approval from both neighbor property owners involved with the encroachment. Staff issued a stop work order advising owner to contact staff immediately and obtain the necessary permits. Cloutier had constructed a retaining wall approximately 30” high dividing a sandy beach and the grassed area. A pile of fill was placed along the lakeshore. Owner explained the proposed work was to protect an existing sand beach from the eroding grassed bank to the immediate rear. The pile of fill consisted of portions of soil released by the cutting into the bark and the sand from the beach area. This pile has been removed and hay bales installed along the lakeshore. Staff issued a citation the following day in consideration of Cloutier's conditional use permit application reviewed earlier that year. We concurred that this applicant was aware of the ordinances that deal with lakeshore improvements. Olson DATE; May 11, 1982 SUBJECT: Proposed Zoning Amendments - Suntanning Equipment The attached ordinance draft has been revised according to the Planning Commission's direction at the April 19, 1982, meeting. Language and numbering have been revised. The B—4 conditional use permit has been omitted, allowing either conditional or accessory uses in the B-1, B—3 and B~5 districts only. The suggested parking ratio of lb spaces per booth is probably higher than our 1 space/150 sf retail requirements. It was suggested at this ratio because of the stated turnover rate where booths are reserved on short 15-30 minutes schedules. A ratio of tanning booths to barber or beautician stations is required in order to legally define what constitutes an accessory use as opposed to a principal use requiring a conditional use permit. The 1 to 4 ratio was suggested by the interested parties. To date we still have not received the expected conditional use application. Perhaps we never will. The accessory use is continuing low-key until this ordinance is considered. I recommend that Planning Commission do act on May 17, 1982, making some recommendation to the Council, so that they in turn can act by the end of May: 1. 2. 3. Approve revised draft as presented; Approve ordinance adoption with modifications; or Recommend m adoption. This would have the effect of continuing the status quo where suntanning booths are an unpermitted use. Separate suntan studio businesses ^ would not be allowed. A separate business engaged in offering to the public use of equipment designed for indoor suntanning, subject to special provisions or conditions including but not limited to the standar'^G listed in Section 35.0295. Section 5. Chapter 35 of the Municipal Code of the City of Orono is hereby amended by adding Section 35.438 to the list of B**5 Accessory Uses as follows: 35.438. Barber and Beauty shops may include equipment for indoor suntanning as a permitted accessory use provided the amount of such accessory equipment shall not exceed a ratio of one suntanninq booth to four barber chairs or beautician stations without a conditional use permit. Section 35.0295 e and f standards shall apply. Section 6.
