Regular Meeting of the Orono Planning Commission,
November 15, 1982
Z;30 P.M.
The Orono Planning Commission met on the above
date with the following members present: Chair-
man Hammerel, Members Callahan, Goetten, Kelley,
McDonald, and Rovegno. Also present: Zoning
Administrator Mabusth and Councilmember Butler.

items on the Consent Agenda*. Motion, Ayes (6) -

At 7:30 P.M., Chairman Hammerel announced that now
was the time and place for the public hearing to
consider the preliminary subdivision request of
Raymond Kloss, 3775 Togo Road. Zoning Administrator
Mabusth presented the Notice of Public Hearing,
Certificate of Mailing, and Affidavit of Publication.

Mr. Kloss was present to review his application.
Zoning Administrator Mabusth stated that the sewer
project must be ordered before final plat approval.
If the sewer improvement is not ordered, Mr. Kloss
would have to reapply for a new subdivision.4
Chairman Hammerel closed the public hearing at 7:35 P.M.
Goetten moved, Kelley seconded, to approve the three-lot
plat of Raymond Kloss, 3775 Togo Road, and in addition,
to approve the lot width variance of 15 * for Lots 2 & 3
based on finding that both lots could be platted
meeting the lot width standard and that the proposed
plan is more consistent with current pattern of the
neighborhood development.
Approval is subject to the following conditions:
1.Dedication of right of way for Northern Avenue -
maximum width of 30'.
2.Dedication of utility easement for water line that
intersects the Kloss property.
3.

Approval of one additional water unit to the property.
Payment of Park Dedication fee in the amount of $880 -
two lots at $-«40 each.
5.Advise o%mer/applicant that final plat approval cannot
be granted by the Council until the sewer project for the
Schlee Builders project in Navarre is ordered.

At 7:45 P.M., Chairman Hconmerel announced that now
was the time and place for the public hearing
to consider the preliminary subdivision request of
Victor Norton, 3580 Bayside Road. Zoning Adminis-*
trator Mabusth presented the Notice of Public
Hearing, Certificate of Mailing, and Affidavit of
Publication.
Mr. & Mrs. Norton were present; also present: Gerald
Gustafson, 200 Bederwood Drive, and Alvin Balgaard,
3560 Bayside Road.
Discussion included the motive for the subdivision to
be used for riparian rights only; that the division
does not create two unbuidable lots; that it be made
in^ossible to build on; the relation of Mr. Balgaard's
property to the property for location of his dock, and
that a precedent not be set for such subdivisions.
Chairman Heunmerel closed the public hearing at 8:00 P.H.
Member Goetten moved, Rovegno seconded, to table the
preliminary subdivision request of Victor Norton,
3580 Bayside Road, for review and advice from the
City Attorney concerning the question of platting the
property to achieve riparian and buildability controls,
and the possible need to realign the lot lines of
Parcels A & B so that portions of Parcel B are located
directly across Bayside Road. Motion, Ayes (6) - Nays (0).

was the time and place for the public hearing
to consider the preliminary subdivision request of
James Hartzell, 2987 Casco Point Road. Zoning
Administrator Mabusth presented the Notice of Public
Heaucing, Certificate of Mailing, and Affidavit of
Publication.

Mr. Rick Sathre was present representing Mr. Hartzell.
Zoning Administrator Mabusth explained the need for
the 30* right of way.
Discussion centered on the 30* right of way, some of
which is already on the subject property; and that the
tennis court on Lot 1 contains the majority of the
hardcover allowed, so that no principal building can be
located on Lot 1 at a future date without the need for a
variance.
Chairman Hammerel closed the public hearing at 8:30 P.M.
Member Callahan noved, Kelley seconded, to approve the
three-lot plan as presented for James Hartzell, 2987 Casco
Point Road, finding that all lots meet the standards of
the LR-IC Zoning District and to approve the existing
6% hardcover variance on Lot 1 created by the tennis court;

and to further advise any future owner that if
the lot is to be built on, the tennis court must
be removed. Approval is subject to the following

proposed resolution regarding the final subdivision

Zoning Administrator Mabusth reviewed with the
Planning Commission the request of David Slavik,
1913 Fagerness Point Road, for a variance to build
a detached 24' X 22* garage. Mabusth stated that '
it would not be feasible to relocate the detached
garage to the west because of the intersecting sewer
and water lines. If the garage were attached, it would
block bedroom windows of the house. Mr. Slavik was
not present.

Member Kelley moved, Goetten seconded, to approve the
6' variance request of David Slavik, 1913 Fagerness
Point Road, subject to the removal of the existing
parking area on Fagerness Point Road and providing
all access and parking to a site off of Webb Street.
The entire disturbed area abutting Fagerness Point
Road should be seeded to cut down on the hardcover.
Motion, Ayes (5) - Nays (0). Member McDonald left
the meeting before this item.
Zoning Administrator Mabusth reviewed with the
Planning Comndssion the request for a Vcuriance of
Gary Beito, 1169 North Arm Drive, to construct a
22* X 22* detached garage. Mr. Beito wishes to
maintain the s£une side setback line of the existing
house of 6.9* so as to minimize further disturbance
of the front yard and make use of the existing gra^
drive. Mr. Beito was present.

Member Rovegno moved, McDonald seconded, to approve
the request of Gary Beito, 1169 North Arm Drive,
for a side yard setback to construct a 22* X 22*
detached garage, based on the following hardships
and findings:
1. The interior design of the house would not permit
attaching the garage to the front of the house.
2. To permit the garage to maintain the same side
yard setback as the house, will prevent further
disturbance of the front yard, make use of the
existing gravel drive and cut down on addit:.onal
hardcover.
3. Due to the slope of the land.
Motion, Ayes (6) - Nays (0).
The Planning Commission discussed the proposed
ordinance for changing the zoning district
designation for Big Island, Mahpiyata Island,
and Deering Island. Fire extinguishers, fire
fighting equipment, and sprinkler systems
were discussed as to which type would be necessary
for seasonal and year-*around dwellings. Council-
member Butler explained that new wells as stand-by
sources for fire fighting would be necessary for
year-around homes.
Mr. Joe Backes and Mr. Roy Ahern, Big Island
property owners, were present. Mr. Backes stated
that 120 sq. ft for a deck or screen house was
not large enough. He felt that 300 sq. ft. would
be more appropriate. Mr. Backes also stated that
he is in favor of the ordinance. Mr. Ahern was
concerned about the status of his six lots on
Big Island. Each of the six lots is a separate lot
with four of the lots across the road. Mr. Ahern
has concerns of his lots' status after the passing
of the ordinance.
Conditional Use Permits for overnight Ccin^ing and
overnight docking were discussed. Member Callahan
stated that the Planning Commission should have a
final ordinance, not just a draft, in order to
take any action on the proposed ordinance. Member
Callahan stated that after changes were made that
had been discussed at the public hearing before
the City Council, the final ordinance should be
delivered to the Planning Commission for their
review emd recommendation, which could be done
over the telephone to Alem Olson, City Planner, or
Jeanne Mabusth, Zoning Administrator.

Member Rovegno moved, Goetten seconded, that a
final ordinance be prepared for the Planning
Commission regarding the zoning for Big island,
Mahpiyata Island, and Deering Island, to be
delivered to them before the Council meeting of
November 22, 1982, in time for the Planning
Commission to review individually and telephone
in their vote. Motion, Ayes (6) - Nays (0).

The Planning Commission members will meet at
the Orono Police Department on Saturday,
November 27, 1982 at 10:00 A. M. to have their
identification photographs taken.
