He noted that the State Building Code will require it at a certain level, but right now it does meet the code. Callahan asked the architect e,vHctly what they were planning to put in the church - Johnson stated that the auditorium/gymnasium and classroom space would be future kitchen area. Also the toilet area now could easily be converted into locker rooms. Planning Commission asked the applicant if they were proposing any other public uses for the building. John Qucun stated that they were considering a daycare center. He stated that sprinkler would probably be put in when water would be serviced out there. Also right now the total parking area would be too large for the membership, but they would pave the parking area when the membership grew. Mabusth asked the applicant why he wanted the City to use the ratio of 372 seats with only a 100 members. km stated that they wanted the auditorium. Jacobs also noted that the ratio is determined by square footage per person. Mabusth asked if they were proposing any other type of public use besides the daycare center. Quam stated that basketball games would be held but that this shouldn't have any affect on the parking requirements. Rovegno noted another location on the site plan in which they could relocate the parking lot. Johnson stated that the distance would create problems. Hammerel noted for the applicant that the code requires paving of the parking lot and that if the architect could move the parking area over 65' or 75' then it would be satisfactory. Johnson stated that he would then probably create a "ring" type parking lot. ^egno noted for the applicant why the City requires Sifing so that they don't create any future problems. He also asked staff if they would have to apply for a conditional use if any changes in the structure were ip^^made. CHURCH (CONT) Goetten stated that she felt that 54 stalls was more than enough parking area so why require paving? Mabusth stated that the gravel parking area also includes the required loading berth. Callahan stated that this proposal might excel and grow very much but on the other hand it might go the other way and then the City would have a non-conformin building with no paving. If they are going to grant a conditional use to them now they should conform to all the codes. v ' v:: Rovegno asked why they were assessed 1 sewer Uiilt? Mabusth stated that the entire 50 acre parcel was asse 1 sewer unit and that the church was to receive that unit. Rovegno asked if it did need another sewer unit would they have the pipe capacity to do this? Also with all the expansion they have planned for the future, how ^yiy sewer units will they get to?V' Mabusth stated that if Council approves an additional unit for the church it would be taking away units from school. • ■ Rovegno asked if Michael Gaffron had look at the property for septic purposes? Mabusth stated that because of the area of the lot, Ga was not asked to do an in depth review. Goetten asked when the Long Lake and Medina hookup would be completed? Mabusth stated sometime this summer and that that line runs right by the church.M y'\ . t:‘ . v: ' • Rovegno moved to approve the conditional use permit for the New Life Bible Church to permit construction o a 136' X 72' church building subject to the following conditions; V' X. *. Location of parking area should be moved and also paved. 4 -Drainage information designated on site plan for staff review prior to Council action. Traffic flow and signage to be designated on site plan prior to Council action. Council should consider formal request of applicant to connect to City sewer. 7 -Applicants to follow any further suggestions of City Engineer. 8 - Landscaping to conform with City ordinances and staff recommendation. Hammerel seconded. Vote: Ayes (4), Nays (0). Doug DeMalignon was present. Philip Kaley of 1395 South Brown Road was also present for this application. Mabusth stated that she had two phone calls from surrounding property owners and they were all in favor the variance.C Rovegno asked if there were no requirements for rural areas on hardcover? He also noted that there was a vacant lot next door. Mabusth stated that the ordinance does not require hardcover consideration for rural areas. Mr. Kaley asked the applicant how he was going to get a well truck down to the back of the property because it would be difficult to get any kind of trucks down there. He noted that the drainfield covers the whole front of the lot and then turns the corner. Mabusth noted that Gaffron*s report reported it as being located only in the front yard and that the driveway was very close to the septic tank. Mabusth added that- a well rig could never get back to the existing house. Jacobs noted that last fall he remembers going out on an inspection where that septic tank was backing up and that the contractors were looking for the tanks. He noted that they did find them and pumped them but that they still might have problems with the septic especially if the house has not been lived in all winter since pumped last. CHURCH (CONT) r i DOUG DEMALIGNON 1380 Arbor Street Variance #681 Jacobs stated that that was possible but the real issue was that no one has lived in the house since it was pumped. He noted that the building had ^^en vacant since this last winter. He felt the ''%:ainfield was ok but that he didn't know if there was any real septic tanks. DEMALIGNON(CONT) Mabusth stated that there couldn't be any other expansion of the building if there was already existing septic problems. Applicant stated that he would prefer that the Planning Commission approve the addition and then they could take care of the septic problems. Mabusth noted that if the Planning Commission approved a holding tank that they would need a variance to the code. Rovegno asked the applicant what the extra space would do for the applicant? Applicant stated that right now it is too small and that it would help the resale value. Goetten moved to table the application of Doug DeMalignon pending additional information from staff regarding the septic problems. ^^llahan seconded. Vote: Ayes (4), Nays (0) . Applicant asked the Planning Commission to reconsider their motion because of his pressing time schedule. He felt that the proposed addition wouldn't have any affect on the existing septic system and that the septic problems could always be worked out. Planning Commission noted for the applicant that they can not approve any addition for the building until they have all the correct information about the "failing" system. Roger Wolthe represented the applicant. Roger noted that Lyle Johnson still lives in Wisconsin and that this house had been in his fcunily since 1901. JOHNSON 1398 Rest Point Road Variance #682 : i .>A Pat Walsh of 1396 Rest Point Road was present from the audience for this application. He stated that they were delighted that they were proposing to improve the house but that he opposed to the side setback variance. > ' ^ j Roger Wolthe stated that they would add to the upstairs a guest room and a sewing room and that the Jpbvse would be resided too. Pat Walsh stated that if this variance was approved that it would block his view and his plans for future expansion plans. He stated that he felt that the house MINUTES OF THE PLANNING COMMISSION MEETING OF MAY 17, 1982 Page 6 should have never been approved 1' from the lot line JOHNSON (CONT) the first place and asked that the Planning Commission make the same mistake. Wolthe stated that the garage would be lower than tba rest and not 1' from the lot line but 3'. Goetten asked Woolsley why he couldn't just move it over 7*? Wolthe stated that this would cut down on the required turning space. Rovegno stated that turnaround adds a .lot to hardcover problems. He asked if Woolsley couldn't be creative and save on hardcover at the same time and move the garage somewhere else. Wolthe stated that this 2 story addition which was added next door and that their proposal was far less imposing. Rovegno stated that anything they could do to move the garage over and make Mr. Walsh happy then he would have no problem with approving a street setback variance and then this would ^Jfive on hardcover. Mabusth stated that with no turnaround provided on the site that it would, be very diffidult to reco.Tunend approval of the variance* Rovegno stated that the 3' setback creates the turnaround which in turn creates much hardcover. Mabusth stated that they could easily move the garage over to meet the 10' setback line. Hammerel asked what affect that would have on the interior of the house? Wolthe stated that he would redesign it and why weren't these same points taken into consideration when there neighbors were allowed to do this which had a lot more impact on Miis addition rather than what there were proposing. Goetten stated that the City doesn't want to continue this tradition. Hammerel moved to table Lyle Johnson's variance jUpplication for further design changes to meet Vhe 10' side setback. Rovegno questioned the applicant about the NSP wires and advised him that this problem should be NSP's problem and that it shouldn't be a consideration in this application. Also he noted that NSP should have an easement over his property for those wires. BRUCE HAUGLID 2245 Bayview Place Variance #684 Mabusth stated that there was no such easement. Applicant stated that the slashed area is a oroposed 12' X 24' deck. Mabusth stated that a deck is considered hardcover and that he was allowed 35% hardcover but that her calculations did not include the deck. m Callahan stated that with the included deck it would bring the total hardcover to 21% over the allowed amount. .# Rovegno noted that the length of the driveway was what was really eating up all the hardcover allowance. He noted that if they were able to move the garage closer to the street the driveway wouldn't have to be so long. Jjpplicant stated that he wanted enough room to have fB>th vehicles parallel rather than screunbling them around. Goetten stated that their main concern was with the excessive hardcover proposed. Callahan noted that the applicant wouldn't be able to put a boat and two cars into a 1 stall garage anyway. m Callahan moved to table the variance for Bruce Hauglid to give the applicant to think over his present application and try to revise and come back with a different plan. Mabusth noted the Engineer's recommendation that the retaining wall should continue 8' more along the steep bank. Rovegno asked if there would be any cutting down of the bank at all.
