The dock structure is located on the line at one point. The committee recommended that the applicant obtain a letter from the Minnetonka Boat Works stating they were aware of this encroachment. The Rivers submitted a letter dated November 14, 1981, from the Boat Works stating they were aware of this encroachment. The Marina Committee advised the applicant that at each annual license review, the City will require a new letter from the Minnetonka Boat Works. The committee noted that this request was consistent with the City policy in dealing with commercial dock encroachments on neighboring property lines. Frahm moved to recommend approval of the 1982 commercial dock license for Windward Marine formally recognizing the 0 lot line setback of the southern most docks on Tanager and approving the setback variance of 10' based on the written approval of the Minnetonka Boat Works. Goetten seconded. Vote: Ayes (2), Nays (0). Abstention (1). Richard Anderson and John Vogt were present, Mabusth questioned the increase of 20 boats over last year's approved total count of 136 units. Vogt stated that the boat units ^are the same as last year and that there was a misunderstanding ^hat he failed to call attention to in last year's review. The 20 boat units belong to Fahlin's fishing and canoe boat rental inventory stored at point designate #135 on the formal site plan. Anderson stated in fact that they were not even there last year because of the repair work done at that location. They both advise that this was part of their contract obligations and that Fahlin may not even use the allowed 20 additional units this year. Hurr asked if there was any connection between Sailors World and Fahlin's new operation across the road. Vogt and Anderson stated that there was none. Anderson asked if the conditional use permit for the station would permit sometime in the future boat storage and boat repair for Sailors World. The committee advised that this would require more review and a different application. ft Hurr questioned if the marina could meet the deadline date of May 1, 1982, for the installation of parking posts for each designated stall and traffic flow signs. Applicants responded that they could see no problem and that they had great success with the parking attendant on busy days during the 1981 season. They also stated that they made use of the City parking lot on weekends. ^fcjetten moved to recommend approval of a 1982 commercial dock license for Sailors World subject to the applicant completing the required parking plan improvements by May 1» 1982, and that the parking variance be granted for the 1982 season based on the condition that 52 parking arR alwav/s to be availahlR for cnsfoTnRr narVina.
