Also present: Asst. Zoning Administratoi A1 Olson. Qiairman Hannah amounced that this wa^ the time and place for a Public Hearing on the petition of Donald Scott for a subdivision of property located at 200 South Willow Drive. The Asst. Zoning Administrator presented the Notice of Public Hearing and the Affidavit of Publication. A1 Olson stated that the applicant is requesting a][^roval of a sibdivision of one parcel into six lots. As presented on the drawing, each lot meets the minimum width and acreage requirements. Mr. Olson presented a copy of a letter received from the City Engineer concerning utility and drainage easements. Mr. ^ Mrs. Scott were present. They also received a copy of the engineer's letter recommending that a 10 ft. utility easement be provided along the fnmtage of all lots and that the drainage flow <m Lot 4 be directed to a ditdi running iP the low area which would channel the water from there. le Scott’s commented that they have plans for a residence on Lot 5. After all the public were heard, the public hearing was closed at 7:40 p.m. The Commission continued discussing this subdivision proposal. The Asst. Zoning Administrator advised tiiat this application would be subject to a park dedication fee and an underlying access easement. Dunlap moved, Guthrie seconded, to recommend approval of the preliminary plat subject to the following: (1) (2) (3) (4) 10 ft. utility easement on the frontage of all lots. Drainage swale to take care of runoff on Lot 4. Underlying road access easement on Outlot A. Park D^ication Fee. Motion - Ayes (6), Nays (0). The Planning Comnission reviewed the n^lars and harebells with the applicant. Final plat is the same as preliminary except for minor dimensional change ^long south line of Tract A (change from 180 ft. to 179 ft.). Hannah moved, Guthrie seconded, to recommend approval of the final plat subject to the following: (1) (2) (3) (4) Payment of one water unit assessment in the amount of $580.00. Payment of one sewer unit assessment in the amount of $3,859.05. Receipt of Park Dedication Fee in the amount of $2,000.00. Title opinion addressed to the City. Motion - Ayes (6), Nays (0). Mr. Gullickson, Sr. was present and suggested that his son's application be tabled until the next meeting. Dunlap moved, Hosfield seconded, to table this matter pending receipt of further information. Motion - Ayes (6), Nays (0). d Tom McRierson, landscape architect from Badiman's, appeared for the applicant. He presented a cross section drawing in small scale showing tlie relative difference between the xisting grades and the proposed grades. The proposal con- ists of a proposed 2H ft. cut into the existing berm and cutting the driveway down thereby allowing the water to flow back into a holding area. Project would include truck ing in an excessive amount of fill. When asked, Mr. McPherson stated that there are certainly other ways of grading around the cottage to effect positive water runoff without having to use sudi a large amount of fill. Planning Commission agreed with the general concept of the proposal and felt this project would be an improvement to the property; however, they were unable to justify any hardship requiring work within 75 ft. of the lakeshore. Commission did indicate, however, that they would have no objections to the removal of the stone wall and earth berm along the grape arbor. laki licant is also proposing to resod within 75 ft. of the l^eshore and to level off some existing potholes. This would involve stripping the present sod and smoothing out the area with a small tractor. MINUTES OF A PLANNING COMISSICN MEETING HELD JUNE 20, 1977 - PAGE 3 After some discussion, Hannah moved, Guthrie seconded, to recomncnd approval with the stipulation that we do not approve any grading within 75 ft. of the lalceshore except ^fpT a small area around the existing grape aihor, and that ^4ne proposed sod removal and replacement be done within an 8-hour period and in such a manner so as to control any siltation during the work. Motion - Ayes (6), Nays (0). Applicant was not present. As:»t. Zoning Administrator informed the Coirmission that a John Waataja, son of the owner of Lots 10, 11 8 13, was in the City Office to check on the require­ ments for these lots. Mr. Waataja was informed of the present variance request and advised to contact Home Federal Savings 8 Loan to try and arrange a combination of properties. McDonald moved, Dunlap seconded, to table this application pending receipt of further information. Motion - Ayes (6), Nays (0). Asst. Zoning Administrator advised thac the applicant is requesting a lot area and width variance for an addition to the existing dwelling as well as an attached garage. Proposal indues removal of existing garage and founda­ tion. The existing building and proposal meets all the quired setbacks.0 Applicant was not present. Mr. Lorenz, neighboring property owner, was present. He had no objection to the proposal. After a brief discussion, McDonald moved, Dunlap seconded, to recommend approval given the fact that there is no other land available, proposal meets all setback requirements, and sid)ject to the removal of existing garage. Motion - Ayes (6), Nays (0). Mr. Hall arrived and was advised of the action that was taken. Mr. 8 Mrs. Ki^asch were present. They are requesting approval of a variance for an addition to an existing home on a substandard lot. Survey indicates the addition to be located on the west or rear of existing home. The existing dwelling is located extremely close to the County right-of-way. However, the proposed addition would not reduce the existing setback conditions. Asst. Zcxiing Administrator informed the Commission that this dwelling is in the sewer district, but there is no record of any swer connection. This connection is required. Mr. J^asch stated that when he purdiased this home he was ^^fonned that they were hooked up to the sewer. He Deen paying a quarterly sewer charge. The Asst. Zoning Adninistrator recommended that the City conduct a dye test in order to determine if they are hooked up and that the test be conducted prior to tne Council meeting of June 27, Applicant agreed. 1977. Motion - Ayes (6), Nays (0). Heibert Hankinson and Tom Nelson, representing the Caiman Cove Association, appeared before the Planning Comnlssion to discuss their dredging application. They are requesting approval to dredge an area of Carman's Cove for navigable access to the properties in question. Approximately 2,500 cubic yards would be removed from an area 2 ft. deep by 45 ft. wide and up to 750 ft. long. This would include an area of approximately 130 ft. into the Lake. This is the only lake access for these properties and currently there is no boat access at all. The applicants informed the Comnission that the east side of the diannel would be made approximately 20 ft. wider. They would be coming in at somewhat of an angle south and west of the swimming beach. The marsh on the east side would not be disturbed. Generally in the spring, the channel has been passable. However, for the past 10 years around the first of August there begins to be a problem. In the last two years, it has been an extreme problem. The original dredging occurred here about 25 years ago. Mr. Nelson stated that even if the lake were at its normal level, the proposed dredging would still be necessary. Thft spoils from this dredging project are proposed to be Q^ved from the lake by barge to a drying area in Bccelsior. The drying area is a riprapped section adjacent to tile lake. Mr. HanVInson informed the Comnission that the barge company is a reliable firm and he felt they would do everything necessary to conform. Mr. Olson also commented that Mr. Niccum, owner of the barge ccjmpany, has been very cooperative concerning other proposals involving Orono. Planning Commission determined this is maintenance dr^ging required to maintain riparian access to these properties, and that the spoils removal system proposed would have the least effect on the lake. After some discussion, Dunlap moved, Hosfield seconded, to^ recommend approval of the redredging and maintenance dredging request subject to the following conditions: (1) That the spoils are removed directly frcxn Orono. (2) Subject to approval of other agencies. (3) Redredging of existing dredged channel to provide riparian access only. (4) Area to be dredged is 2 ft. deep by 45 feet wide by 750 feet long. ^Stion - Ayes (5), Nays (0), Abstain (1) - McDcmld (opposed the spoils not being removed from the Lake Minnetonka shoreline. Zoning Administrator Olson stated that the applicant is requesting approval to replace existing home with a new dwelling. Proposed location of the new structure would be in gg|ie same general area as the existing house. Planning ^wjiiiidssion noted the uncertainty of the actual proposal. Applicant was not present to clarify. Approval would be subject to combination of Lots 6 and 7 and the required sewer connection. After some discussion, Dunlap moved, McDonald seconded, to recomnend appi'oval subject to the following: (1) (2) (3) (4) Maintaining the 10 ft. side yard and 35 ft. front yard setback requirements. Proposed structure not be located any farther forward to the lake than adjacent dwellings as indicated on the survey. Combination of Lots 6 and 7. City sewer connection. Motion - Ayes (6), Nays (0). Comnission discussed this matter and were in general agreement with the intent of the memo. TVo members were concerned that there would be considera­ tion of any marsh removal anywhere in the City, whether not identified in the Stomwater Management Plan. Uieir concern was that in the future we may need to use all of our marshes. Ihe comment was made that there is an abundance of open water available for water fowl and the possible future need to use all the marsh for stoni^rater filtration would supercede this. The Asst. Zoning Administrator reminded the Commission that there is approximately 100 days remaining on the moratorium. Hannah mov^, Hosfield seconded, that Jo Ellen Hurr be included on the task force consisting of Menbers McDonald and Hassel. Motion - Ayes (6), Nays (0). (#277), John Gullickson, Sr. (#279), Joseph Reycraft (#280) and William Stewart (#281). General discussion and comments turned toward unfinished business. Among the items discussed were the need to have a formal system of obtaining applicants for the Planning Conmission and notifying those applicants when there is a vacancy and when the vacancy has been filled. The menbers were worried about the liability arising out of their piblic duties. Because of their frequent visits to private property, the> discussed the desiri)ility of liaving some form of official identification to carry with idiem. Is this something the City coul'^ provide? John Guthrie volunteered to meet with the Council and inquire as to the Council policy for providing protection suc^ as liability insurance or the right to counsel if adverse situations arise. McDonald moved, Hosfield seconded, that John Guthrie be appointed to meet with Council to discuss this matter. Motion - Ayes (6), Nays (0).
