Also present: Asst. Zoning Administrator A1 Olson. Guthrie moved, Pesek seconded, that the minutes of the Planning Conmission meeting of May 16, 1977, be approved. Motion - Ayes (6), Nays (0). ATTENDANCE - 7:30 P.M. APPROVAL OF MINUTES MEETING OF MAY 16, 1977 study lems) Chairman Hannah announced that this was the time and place for a Public Hearing on the petition of Engner Johnson for a subdivision of property located at 360 North Arm Lane. The Asst. Zoning Administrator presented the Notice of Public Hearing and the Affidavit of Publication. Mr. Olson stated that the applicant is requesting approval to subdivide a 6-acre parcel into two lots both of which would meet the 2-acre minimum zoning requirement. This 6-acre parcel was a result of a subdivision approved in 1975 at which time the park dedication fee was waived. This proposal should then be assessed a park dedication fee for all three lots that have resulted from the two ibdivisions. Mr. Olson presented a letter of approval _jom four adjacent properly owners. Plamiing Conmission should also consider dedication of additional width for North Arm Lane. The original plat indicates it to be 33 ft. wide. Our standards are for a 50-60 ft. width for a public road. Mr. Johnson was present. The Planning Conmission discussed his proposal with him. ^!r. Johnson was concemed about requiring a 50 ft. driveway and was informed that it was the public road which should meet these standards. The private drive width need only be 30 ft. or^wider if he so desired. The Planning Conmission felt that this was ^ opportunity for meeting the necessary road width require­ ments. Also present was Dchi Sjostrom representing Mr. White who has property on the same channel running through this lot. Mr. IVhite was concemed about the intent of the channel as far as dredging and dockage of a boat on the addition property was concemed. Mr. Johnson stated that he has a docx off the channel now and ;vould like to use it for a new house on the eastern parcel. Their general feeling was that there were no real problems with this subdivision. *esek moved, Hassel seconded, to recommend preliminary approval with the follo^^g provisions: Property line between Tract B § C be moved. The buildings that are in disrepair be tom down prior to final approval. County access approval to Tract B. No new access points to Tracts A or C. Septic system evaluation on Tract B if the applicant chooses not to connect to the sewer. Paiment of a Paric Dedication Fee. Motion - Ayes (7), Nays (0). The Planning Commission continued discussion concerning this matter. They were concerned about the width of the public road, lakeshore access and payment of a park dedication fee for the previous subdivison in 1975, along with the Appropriate fee for the current proposal. ./ Dunlap moved, Pesek seconded, to reconmend preliminary approval of the subdivision conditioned on the following: Each parcel at *-.ast 200 ft. wide and 2 acres in size. Access to east parcel at least 30 ft. in width. Dedication of 17 ft. additional right of way along North Arm Lane (or applicant's ability to negotiate with the neighbor across the street so that the additional right of way requirements can be shared by all affected properties). One riparian lot only. Septic system testing for the eastern parcel. Payment of park dedication fees - current proposal and subdivision in 1975. Motion - Ayes (7), Nays (0). Asst. Zoning Administrator stated that a variance is requested for a detached garage. This is a special situation due to the location of the existing platted road and buildings. Proposed location of the garage so close to the house was necessary in order to avoid removal of a large tree. The large hill across the driveway prevents locating it there as extensive excavation would be required. The Asst. Zoning Administrator also commented that this is one parcel now witii two dwellings and has been for the past 40 years. . Moran was present. Commission discussed proposal with Applicant had submitted a letter of approval from adjacent property owner most affected. (2) Hardships demonstrated in that alternate location would require removal of one large tree and location across driveway would interfere with hill. Motion - Ayes (7), Nays (0). Member McDonald requested that an amendment be made to the motion concerning the Johnson subdivisicm. She moved to recommend that "riparian rights" be striken from the motion so as to make no determination that the charael running through this property is navigable. ^fotion to read: Should the channel be designated as navigable, only one lot would have lakeshore access. Seconded by Pesek. Motion - Ayes (7), Nays (0). Mr. Kallestad was present. Planning Conmission reviewed final plat vhich indicated the requested access easement along the north property line. After a brief discussion, Guthrie moved, Pesek seconded, to recommend final subdivision approval subject to a ^rk Dedication Ffee. Motion - Ayes (7), Nays (0). Nfr. Gullickson, Sr., Gordon Thonpson and attorney Roy Haglimd were present. The Asst. Zoning Administrator reviewed the history of ownership for Lots 1, 2 and 3. It appears they were in single, separate ownership since 1967. Mr. Gullickson, Sr. stated that Mr. Thompson owns Lot 1 vhich is the subject lot. He further stated that his son was trying to buy this lot and was requesting approval to build a home. He has since abandoned this application. A lengAy discussion followed. There seemed to be some confusion as to what was being proposed at this time. ^fr. Gullickson, Sr. stated that he wanted a decision on the build^ility of his lot which is Lot 2. Mr. Thompson advised that he wanted to take over the application on Lot 1, but that the application before the Conmission ivas not his. commission advised that the application before them was for Ix)t 1 and that is what they are addressing at this Those present were advised to make official plication to the City with the required documents before the Planning Commission would discuss their situation. JAMES KALLESTAD 140 BROWN ROAD S. ajBDIVISICN (FINAL) (#243) JOHN GULLICKSON 920 FOREST ARMS LANE VARIANCE - LOT AREA (#250) nUMiilllfitriiirnf II I I Dunlap moved, Hosfield seconded, to table this application for John Gullickson, Jr. for purposes of allowmg the Applicant to reriew his application, provide evidence of ownership of the property by virtue of purchase agreement or etc. and to come before us again to rule on the applica tion for the building permit according to the plans that have been submitted. Motion - Ayes (7), Nays (0). Mr. Gustafson was present. Conmission reviewed application with him. He is proposing extensive landscaping to regrade around existing building and add a duck pond in front. Also proposing to remove some of the existing berm between the main property and the shore of the lake. Applic^t stated that the reason for the grading is that this is a low area and the basement does take up water. He would like to remedy this situation. He is proposing to take out the existing driveway and restore with an underground watering system and grass. He indicated that he would be investing approximately $10,000 in shrubbery, trees and a holding pond. There is a mound of dirt on the property and he would like to move a little of this dirt down toward the house to the retaining wall. He would not be changing the drainage flow. The retaijiing wall would be constructed near the house to prevent water from coming into the base- lent. The Planning Conmission was reluct^t to approve any grading within the 75* lakeshore conservation area, but indicated agreement with the remainder of the proposal. After some discussion, Pesek moved, Hann^ seconded, to table this application to allow for another on-site inspection. Motion - Ayes (7), Nays (0). Asst. Zoning Administrator stated that the applicant is requesting approval to replace and add additional stone riprap to avoid further erosion. Planning Ccmmissicn reviewed letter from City Engineer recommending approval. McDonald moved, Guthrie seconded, to recommend approval based on engineer's report and sii)ject to using the standard 12" minimum rock riprap cffi the proper base and approval of the other agencies.
