Also present was the Asst. Zoning Administrator A1 Olson and Mayor Van Nest. Guthrie moved, McDonald seconded, that the minutes of the Planning Commission meeting of May 2, 1977, be approved. Motion - Ayes (5), Nays (0). Chairman Hannah announced that this was the time and place for a Public Hearing on the petition of John Burger for a subdivision of property located at 3700 Bayside Road. The Asst. Zoning Administrator presented the Notice of Public Hearing and the Affidavit of Publication. Mr. Olson stated that the applicant is requesting a sub­ division of 10 acres into two lots, each of which would exceed the S acre minimum zoning requirement. There is a sli^t irregularity in the proposed lot lines, and the one existing home on the property does not meet the set- ck requirements.a Mr. ^ Mrs. Burger were present. Mr. Burger explained that the irregularity of the proposed lot lines was due to the fact that he had designed the plans for his home before he divided the lot, and in order to get the 5 acre minimum they made an "L" shape around the wetlands. Mr. Burger also stated that an easement would be provided for the wooded area, or back lot. Mr. Burger owns four lots across the street and presently maintains a dock for iJie existing home. He woiHd like to use one or nx/re of his existing lots on and under Stubbs Bay for lake access and docl^ge for the proposed lot. Also present was Hazel Anderson, adjoining property owner, and her daughter. The Planning Commission explained the proposal to them. They had no objection to the subdivision, but were concerned about access easement for Mrs. Anderson across south edge of Burger’s proposed west lot. Planning Coiranission assured Mbrs. Anderson that the existing easement would be maintained to allow access to her lot. Mrs. Anderson’s daughter had some concern for the variance required for the lot width at the location of the existmg dwelling. The Planning Conmission explained that if this subdivision were approved, a variance i^^ld be granted for the lot width. A hardship would tnen need to be demonstrated. AT^E^mNCE - 7:30 P.M. JJe was wondering if the applicant was requesting sq;)proval #^o dredge. The Commission infoimed him that the only ^dredging that they would have a right to request would be maintma^ dredging in the existing 30* channel assuming that it is part of the lake and assuming that it was legally dredged before. Mr. Sjostrom also stated that his client prefers to keep the dock away from the channel because he feels that it would be one more step to get that channel deemed part of the lake. After all oomnents were received from the floor, the Planning Coninissian discussed this proposal. They were not in favor of the entire walkway extending alongside the diannel vhich they thou^t would lead to docking and general congestion. However, they suggested that it wtiild be more acceptable to have no more than 50 feet of loading dock on the channel if the remainder of the walk< way was setbadc at least 10 feet from the channel edge, ^iplicant agreed with this suggestion. Pesdc moved, Guthrie seconded, to reconmend approval of this joint use dock and walkway going to the channel subject to the following: 1.Six slips with a provision that they become seven at such time that Outlot A were to be conbined 2. 3. 4. 5. 6. 7. 8. with the existing 1-acre lot and that access to those slips by via a walkway from the siibdivision to the chumel. Access to the dock would be by walkwi^r throu^ the marsh directly to the diannel. Maxinum 50* section of walkway could be located on the channel to serve as a loading area only, beyond whidi the walkway should jog back at least 10 ft. from the edge of the diannel to avoid congestion. Loading area is not for permanent moorings There is no deteimination of die channel navigability. Loading area is for the applicant's convenience only without granting any permanent right of access (dredging) to the loading area. Subject to standards of LMGD and MCWD. Granting a variance to our wetlands ordinance for construction of the dock. Subject to joint dock use regulations. Motion - Ayes (5), Nays (0). VICTORIA GRAIN COMPANY (Continued)- (#200) - j i y mmwimmsM vV i MIMJTES OF A PLANNING COMMISSION MEETING HELD MAY 16, 1977 - PAGE 4 Jerry McCallum and Kurt Henrickson, representing the applicant, presented a newly executed purchase agreement for adjacent Q|U>ts 6 and 7. They agreed to conbine all five lots (6-10) ^*^into one building site granting an easement to Lucille Olson of 4784 North 9iore Drive. VIRGIL DOERFLER 4799 TONKA VIEW VARIANCE - LOT AREA (#249) The Planning Conmission conmended the applicant for their cooperation and con^liance. Pesek moved, McDonald seconded, to reconmend approval of any lot area variance conditioned on the conbination of Ix)te _6-10 mto one building site and provided the proposed that thebuilding will meet all setback requirements, and applicant grant and access easement to Lucille Olson at 4784 North Shore Drive. Motion - Ayes (5), Nays (0). A1 Olson stated that he had received no further word from the applicant. The ^airman asked if there was a repre­ sentative for Mr*. Gullickson present. A party sto^ and informed the COnmission that he was speaking as a friend of Mr. Gullickson*s who had asxed him to tell the Comnission that additional land could not be purchased. The Conmission discussed this information and decided tlwt they had some questions to ask of the applicant himself. Hannah moved, Guthrie seconded, to table this matter until Mr. Gullickson was present. Motion - Ayes (5), Nays (0). Mr. Rud and his attorney Roy Haglund were present. Applicant is current owner of four lots (Lots 3 8 4, Block 1, and Lots 3 8 4, Block 4). These four lots conbined slightly exceed-one acre for one building site. Applicantrds requesting to use his .property as two building sites.' Mr.'purchased-this property with — the understanding that there ivere two building sites. Lots are:^ cannon ownership but-4hey:are-assessed for two houses. Applic^t stated that the Council - grated a variance three years ago to allow for two building sites. After some discussion, Pesek moved, Hosfield seconded, to reconmend denial of variance to build on either parcel. The availability of conmonly owned, adjacent land would mean that granting of the variance request would be, in effect, granting of a non-conforming, substandard lot division. He is considering purchasing this lot as one building site. A lot area and width variance would be jl£ecessary. Mr. Jc^mson advised Planning Comnission that the vjtee owner of Parcel 8200, with whom he had a purchase agreement, was also the fee owner of adjacent, developed Parcel 8000 and had been owner of both lots in common prior to 1967. After some discussion, Hosfield moved, Pesek seconded, to recommend denial on the basis that it is unbuildable, was in conmon ownership with Parcel 8000, adjustment on Parcel 8200 be made as necessaiy. Motion - Ayes (5), Nays (0). Mr. Nicholson was present. He is requesting a lot area and width variance for his proposed addition. Motion - Ayes (5), Nays (0). A1 Olson stated that Christy Realty is requesting approval to move existing sign over to the new building previously occupied by Keaveny Drug. New sign would be put on the ^existing pylon. The proposed sign would extend over the ^)dge of ^e rijht-of-way when erected on existing pylon. Walsh of F.quity Construction was present. He stated they would sign a written agreement to move the pylon and sign at their own expense should the County ever request moving the i.igki f?jrther from the road. After^a brief discussion,-Pesdc moired,-Flos field seconded^'^^ to reconmend approval of the sign location with the condition that the owner of the sign and Jot agree to move the si^i and-pylon at their esqpense at which time ~~ the County or City would request moving the sign farther from the road. Motion - Ayes (5), Nays (0). Mr. Keaveny was present. He is requesting approval to utilize existing sign previcxisly used by Super Valu. He is not increasing the sign area, but it would exceed the maximun 100 ft. permitted in this zone. Planning Conmission reviewed final nylar and hardshell. Final plat meets all the require­ ments. Conmission again reminded Mr. Kobs that any A^ure division of the larger lot would result in only lakeshore lot. McDonald moved, Guthrie seconded, to recommend approval of the final plat subject to the Park Dedication Fee and with the understanding that any future subdivision of the larger lot would result in only one lakeshore lot. Motion - Ayes (5), Nays (0). A Public Hearing was scheduled for ^fonday, June 6, 1977, at 7:45 p.m. fk The Planning Conmission took action on the following work session item: Pandy Fredrickson was present. He is requesting approval for an addition to his existing home. A1 Olson stated that work had been started on this project and that a stop work order had been placed. Mr. Fredrickson siibmitted a letter of approval from neighbors Gustafson and Terp. When asked about the status of his septic system, Mr. /^drickson responded that it was functioning properly, '^t he had no idea vhiidea what kind of system it wee. Guthrie moved, Hosfield seconded, to leconmend approval on the basis that no other land is available, written letter of i^roval from neighbors idiidi was presented by the applicant,-addition would not require any setback-** variances. Motion - Ayes-(5), Nays (0). • Because this was approved as a work session item, surround­ ing property owners will be notified of the Council meeting. Sandy Ritter, owner’s architect, was present to discuss prop^al with ^e Planing Conmission. He was advised of materials and information required for proper analysis of the proposal, and he indicated that it would be im|x>ssible to have this to the City in time to hold the June 6, 1977, public hearing whidi has therefore been postponed. He did indicate that the lots would be sold as building sites only; that th^ would be sold fee simple with common association (^ership of open space; roads are to be private; wetlands and open space are to have conservation easements deeded to tt'5 City. Separate plats will be filed for each city. O R.
