Members Diane Dunlap and Dick Hassel arrived at 7:35 p.m. Also present v;as the Zoning Administrator Hank Muhich. Guthrie moved, Pesek seconded, that the minutes of the Planning Conmission meeting of March 7, 1977, be approved as corrected: "Page 7 - Stubbs Bay ^^rina (#234) that the motion be changed from 5 Ayes, 0 Nays to Ayes (4), Nays (0). Motion - Ayes (4), Nays (0). The Zoning Administrator advised that Mr, Rhode had been in his office that day. He will submit a revised proposal in approximately one month. Pesek moved, McDonald seconded, that this matter be tabled until the necessary data is siibmitted. Nfotion - Ayes (4), Nays (0).© Mr. Muhich stated that no application has been submitted. However, he will continue to keep this item on the agenda. The Planning Conmission reviewed the revised proposal. The menbers were concerned about the extent of Ha (Hamel) soil on Lots 6, 7 and 8. They suggested a combination of Lots 6 and 7 as one parcel to provide adequate area for a septic system. Mr. Levering stated that he would be willing to combine these two lots with the understanding that he could split this lot at a future date. The Planning Conmission was also concerned whether or not Lot 8 could support an on-site septic system. After some discussion, the Conmission determined the area of qualifying soils was adequate, but the location was questionable. The Conmission felt that this lot should be approved as a separate parcel on the condition that no building peimit be issued for the lot until plans for a septic system and replacement were approved by the City Engineer. After a brief discussion, Dunlap moved, Hassel seconded, to recommend approval of the revised preliminary plat fject to the following: ATTENDANCE - 7:30 P.M. Ifriderlying easement on road and cul-de-sac and extension of roadway beyond cul-de-sac. Utility easement on Willow and along private road. Drainage easement and drainage plan as approved by City Engineer. Motion - Ayes (5), Nays (0). (f-fembur Pesek left during the discussion of this item and was not present for the motion.) Ihe Zoning Adninistrator made the applicant aware that a title opinion addressed to the City would be necessary for final approval. Applicant was not present. Several interested property omers were in attendance: Eonald Maas, Howard Soost and Stanley Cirsp^ki. The Zonii^ Administrator explained that the applicant is requesting approval to operate a kennel near the intersection of Hij^way 12 and County ad 6. This facility would be used for the boarding of “1 dogs. Approval of thi^ application would require rezoning due to the fact that this proposed operation is in a resi­ dential zone. Althou^ the Cornnission felt that tliii proposed deserved some consideration, they were not in favor of any rezoning at this time. The Zoning Administrator stated that he had consulted with the City Attorney as instructed for his direction concerning our ordinance on stock faims in relation to this application. He advised that there is no way to approve this request on the basis of a club or stock faim as this is definitely a coninercial venture. IXmlap moved, McDonald seconded, to deny this applica­ tion based on the reconmendation of the City Attorney. Motion - Ayes (5), Nays (0). Mr. Odden was present. Applicant is requesting approval for an addition to the east and north side of the existing house. The addition along the east end of the house would be 11 feet from the lot line with the extended deck approxi tely 10' from the lot line. The Planning Commission was concerned about the private easeiaent providing access to the lakeshore lot. They felt the proposed edition would conflict with this easement. Mr. ^I^den stated that the Engle’s were vacationing at this ^IjPune and that he wculd rather wait until they returned to discussed this matter with them. » IXmlap moved, Hassel seconded, to table this matter in order for the applicant to contact the neighbors. Motion - Ayes (5), Nays (0j„ Kathi Ellis arrived and the Planning Coninission advised of the action taken earlier. The applicant asked where a proposal of this nature could be approved in Orono. "Tie Planning Commission pointed out the commercial area west of Long Lake and also in the Navarre area. Mr. Hawley was present. He is requesting approval of a building permit for his property on Big Island. The Zoning Administrator pointed out the location of this property on the map. Mr. Hawley stated that the pro­ posed location for this structure would be the same as the previoi^ proposal in 1974. The structure would be a little bigger, however. The Zoning Administrator stated that the applicant was aware of the fact that no public services are available for Big Island. ^^yter a brief discussion, Hannah moved, Hassel '**!feconded, to recomiiend approval on the basis that the lots be combined and the septic system be approved by the City Engineer. Motion - Ayes (5), Nays (0). The Planning Comnission took action on the following work session item: The Zoning Administrator informed the Commission that the a^licant is r^uesting a lot area variance for an addition to his existing dwelling. Ihe proposed addition would meet all setback requirements and would not exceed the heights of the existing structure. IXmlap moved, Guthrie seconded, to recommend approval of this lot area variance on the basis that no other land is available and proposed addition meets «iii set­ back requirements. Also recomnended that inpervious material not be used in the construction of the deck. Motion - Ayes (5), Nays (0). Mr. Dick Freeborn and Clayton Bangs were present. They were informed that this was a work session only, /piZhe Planning Comnission was concerned about the \Jmership of the abutting property and instructed the Zoning Administrator to investigate this matter. After reviewing this application, the Commission felt that the conditions of this application were similar to those at 1865 Shadywood (#238) - 2 adjacent, substandard parcels under one ownership. Work Session only. Paul Kempf was present. After reviewing his proposal, the Planning Conmission requested uirt the applicant submit a report from the Minnehaha Creek Watershed District concerning the extent of buildup of the eroded material. The applicant was forewarned tlmt the only dredg­ ing that would be permitted was that portion that has eroded through the years. The Conmission also requested that the applicant submit a copy of the action taken by the IMCD at their meeting this week regarding dock lengths. The Conmission reconmended that the City Engineer supervise this dredging. Lou Obeihauser and Norman Nielsen were present and requested the Planning Commission’s view of this concept. The proposal consists of 12 units (6 duplexes) to be constructed on f^roximately 6h acres, 6 of which are in Orono and h acre ni Wayzata. S(Mne wetlands are involved. The proposed location of this complex is just east of the golf course. The Conmission expressed their concern over the density, sewer availability and marsh conditions. The location of the proposed access road and one duplex are in conflict with our Wetlands Ordinance #125. The Planning Conmission advised Mr. Oberhauser and Mr. Nielsen that they would discuss this concept with the Council and report their findings at some future date.
