regular planning OCMflSSION FCETING HELD JANUARY 3, 1977
he Oxono Planning Conmission met on the above date with
L Jie following roenijers present: Chairman Gregg Hannah,
Men^rs Gloria McDonald, Paul Pesek, Gene Woolley who
arrived at 7:45, George Hosfield who arrived at 7:55 and
Diane IXmlap who arrived at 9:30. Also present were
Zoning Administrator Hank Miihich and Mayor Van Nest.
Chairman Hannah announced that this was the time and place
for a Pihlic Hearing on the petition of Donna Martelle
Stangler for a subdivision of property located at 1365
Tonkawa Road. Ihe Zoning Administrator presented the
Notice of Public Hearing and tne Affadavit of Publication.
Mr. Hihich informed the Conmission and those in attendance
that the applicant is requesting approval to subdivide the
existing 2 acre parcel into two lots of 1 acre each. This
is a 1/2 acre zoning district and boHi lots would exceed
140* at the location of the house. E«*seinents shcxild be
included. The Zoning Administrator also stated that the
applicant is requesting that we waive the procedure of
mylars and hardshells.
CXirt Laughin^ouse, representative for the applicant, was
present. He could not understand the procedure for mylars
hardshells. He felt tiiis sididivision was exempt.
Hannah told him that the Planning Ccximission
fi^gnized his position; however, the Planning Conmission
and Council strongly believe in this procedure as a pro
tective measure, ffr. Muhich also stated that this is an
established policy for all subdivisions wiA the exception
of subdivisions of two 5-acre parcels. Dan Reegan, an
adjoining property owner, was confused ^out the lot lines,
and the Zoning Administrator explained this to him. He had
no objections to the subdivision.
Mr. Muhich told the Planning Conmission and Mr. Laughinc^ouse
that ^ere should be an easement for public utilities. Mr.
Laughinshouse said this would be no problem. After all the
public were heard, the public hearing was closed at 8:00 p.m.
After a brief discussion, Pesek moved, Woolley seconded, to
approve the preliminary sii>division on the basis that nylars
and hardshells are sub^-tted for final plat approval to
include utility and road easements subject to a Park
Dedication Fee. Motion - Ayes (5), Nays (0).
Chairman Hannah announced that this was the time and place
for a Riblic Hearing on the petition of William Dickey for
' subdivision of property located at 2645 Watertown Road.

Administrator explained that this is a simple siib-
Wttivision procedure. Prooosed divisia_ _ _consists of dividing
property mto two parcels of more than 5 acres each.
Zming Administrator mentioned that it had been brought to
his attention ^t the party purchasing the south half of
TOis property is considering giving approximately half to
the IMR. This abutts the luce line. Although this has no
bearing on this particular sii>division, Mr. Midiidi felt
that the Planning Ca^nission should be aware of this fact.
Mr. fidiich received a call from the County stating that
the ENR has already filed this property. Several surround*
ing property owners attended this public hearing. Among
them were William Wear, Judd Ringer and R. W. Wagnan. They- ^ — —— —— — — —^ • ■' • w W ^ W
were concerned abwt the intended use of the property to
• that thebe given to the ENR. Gomnission informed ther__
land would be t^ed for recreational purposes wl*ich is a
permitted use in this area. However, Onmo is reluctant
to let land such as this go off the tax roll. Planning
Gomnission requested Zoning Admiiustrator to consult witii
legal counsel to determine if City has any right to deny
the Park Reserve and other state agencies to purchase land
to take off the tax roll. After all the public were heard,
the Public Hearing was closed at 8:20 p.m.
After a short ^cussicn, Pesek moved, McDonald seconded,
to approve subject to a Park Dedication Fee and to waive
l^lars and hardshells because of the size of the land
involved. Motion - Ayes (5), Nays (0).
Woolley moved, Pesek seconded, that the minutes of the
rianning Gomnission meeting of Decenber 20, 1976, be
^]proved ^ correct^: Pg. 8 under Planning Gomnission
and Couicil Processing Procedures - The Zoning Administrator
requested that the previously mentioned day of Friday for
calling in be changed to Monday. Motion - Ayes (5), Nays (0)
Representative ww not present. Zoning Administrator reminded
Planning Gomnission of the copy of a letter he sent them \diich
was frm the Watershed District giving their approval for this
subdivision. Letter fron the Watershed District was dated
after our letter requesting all agencies to confer with us
before approving any such problems in Orono.
Hosfield moved, Pesek seconded, to table until we receive
further information. Motion - Ayes (5), Nays (0).
Pesek moved, Hosfield seconded, to table as we have not
heard anything further from the applicant. Motion - Ayes fS)

reports will te the basis for our resolution of denial.

were submitted prior to resolution. ^
