HELD AUGUST 16, 1976 - PAGE 3 The Zoning Administrator again reminded the Coimission of the County’s ccncem of the proposed access to this sub division. After some discussion. Hannah moved, Woolley seconded, to grant ^roval of this subdivision subject to a park dedication fee, approving solely the subdivision as stated, being cognizant of the letter from Donald Muxphy of Hennepin County, and that any concepltial approval or reasonable solution of this condition by the County should come back to the Planning Conmission. Motion - Ayes (5), Nays (0). ROBERT NllCm 3175 SIXTH AVENUE N. SUBDIVISION (PRELIMINARY) Member McDonald once again expressed her concern of the heavy amount of traffic that would be driving in and out of this mini mart. Wear stated that traffic was his busiiiess. He also told the Planning Corardssion that he had contacted the State Highway Department, and they did not feel there would be any traffic problem at this location. After some discussion, ^kDonald moved. Hake seconded, to table tliis application until the next meeting in order for Mr-. Wear to obtain a written I'eport from the State Highway Department on their view of the traffic situation. The public hearing would be continued to tliat time. Motion - Ayes (5), Nays (0). WILLIAM WEAR 2260 WAYZATA BOULEVARD CONDITIONAL USE PERMIT (SERVICE STATION) Councilman Noiman Paurus was in attendance at this meeting to inform the Commission of the action that was taking place on the following items: Gray’s Bay Dam - Project was started three years ago. A control dam near the freeway in Minnetonka had been considered. A major concern was who would control it for the flood in the spring and the drought in the fall. The new dam will be located down stream from j.'.o existing dam. Tanager Bridre - Mayor Searles, Dick Benson and Norman Paurus met with the County. Their plans are for a 36’ bridge which would consist of two 12' lanes and tv;o 6’ bike lanes. The southeasterly portion of the bridge would be in the same location. The north\\?esterly portion of the bridge would be moved someidiat which would cause cutting into the landscape. This would be kept to a minimum. Mng Route - The County would like to get into straighten ing out #110 before tlie City does anything on #19. The County's plans are north on #110, east on County Road 6 a year or two later. The City would support this. He understood that they had some probl«ns, and he did feel that they were trying to improve their property. However, he was wonder ing if they could make some effort to clean up the back part of the house. Among other things, he mentioned several cars and boats that were stored on their property. Mrs. Benedict was present and explained tliat they were storing the boats for a friend of their son’s until he could make arrangements to store them elsewhere. Her husband does have a couple of cars which he uses for spare parts. Because of the high cost of having garbage hauled away, they did accumulate a variety of different items of trash until they had enou^ for one load. Hake moved, Hosfield seconded, to recommend approval of this non-conforming lot size for the proposed addition based iq>on the fact that the lot area cannot be expanded, no setback variance is required, area is sewered, property owners tear down non-conforming garage prior to obtaining a building permit and that the owners make an effort to improAO the appearance on the outside of the house. ^fotion - Ayes (5), Nays (0). ROBERT BIRKELAND 4500 NORTH SHORE DRIVE VARIANCE - LOT AREA The Zoning Administrator informed the Planning Commission that Medina had decided to cancel the meeting between the two Villages. Someone from the Medina Commission had come into the Village Office to pick iq) minutes on our Planning Commission and Council meetings. They felt that Orono was in agreement with Medina on this proposed Vo-Tech School. The Medina Planning Commission will be sending the minutes of their meetings to Orono. The Metro area, including 7 counties, 139 municipalities, 50 townships, 49 scliool districts, will be issued system statements within the first six months of 1977 starting with 40 in the development fringe area in December or January. Metro Council would like first to hold informal discussions with local goveniments. ^'\n area discussion period has been scheduled to be held in Mound at 7:30 p.m. on September 16, 1976. System statements will be sent to all local governments by July 1, 1977. Grants and loans will be available to carry out the program, ’tiny meetings and workshops will lie scheduled. I believe we could review our current orciinancc, but we should consider possible negative results from too much of a change. Current zoning limits the size of residential accessory buildings to 1,000 sq. ft. whidi is also the State Building Code maximum for buildings without frost footing protection. There is no current limit on the number of such accessory buildings located on each lot, except for hardcover density regulations. Set back requirements are minimal 10 ft. side and rear (5 ft. rear for other tiian garages). The ablative effect of this is a proliferation of buildings whidi increases effective lot density, especially on many of tlie sii)st.mL'ird lots in already densely developed areas. M>' recommendations are to tighten the regulations involving accessorv' huildings with the intent to minimize the imoact of such buildings on adjoining proper ties, to limit tlie effective hardcover density and to stipulate policy for more effective administration. The two neighbors abutting the fire lane have objected to the group usage. They contend that at times larger groups do gather here creating a nuisance. These two parties feel they should have more privacy as this was the understanding at the time of purchase. a Khen we proceeded with the action necessary to stop the activity, 18 families fil^ a petition requesting approval to use the area as a public recreation area. Most of the people listed on the petiticm attended the Council meeting of September 13, 1976. After imich discussion. Council was unable to make a decision as tiiere wasn't enou^ time to review the new material submitted. The GOincil then referred the matter to the Park Board and Planning Coninission for review and recomnendations.
