They uould both exceed the minimum lot width requirement Of 300'. No problem herer but a Public Hearing should be scheduled. With this proposal they are also requesting a Conditional Use Permit to move in another house and garage (guest house) onto the south lot# which is already occupied by a residence. The Guest House would require a Conditional Use Permit. The Wyatts, however, have submitted a letter assuring us they would remove the existing residence within 18 months. (We should include this as a condition.) The proposal as submitted would meet all setback requirements. Hake, C. Paul Pesek, Gloria ItDonald, and Zoning Administrator Hanl< Muliich. Brad Van Nest arrived at 8:45 p.m. Absent: Jolm Guthrie, Gregg Hannali and Eugene Woolley. Chairwoman Dunlap called to order the Public I fearing on the petition o£ Boeye-Anderson for a subdivision-l)t rearrange ment of the property located at 500 N. Arm Drive. The Zoning Administrator presented the iJotice of Public Hearing and the Affadavit of Publication. Tom V/illiams, a neighbor, expressed his concern of possible conflict in dock rights because of the configuration of the shoreline. Tliis is a very shallow area. PLANNE^G COtMISSION Jolm Hake moved, Pesek seconded, that the minutes of the Planning Commission meeting of June 8, 1976, be approved Motion - Ayes (5), Nays (0). APPROVAL OF MINUTES MnETE>JG JUNE 8, 1976 Lee Gresser, Director, Hennepin Vo-Tech Scliools, explained tliat tliey needed land for their operating prograin for grow ing orchards and crops and sought a land use permit from tlie Council. Me then introduced Peter Jacobs of National Biocentric who discussed the area surround5.ng the proposed campus \diich consists of 173 acres. The soil is mostly clay - 160’ deep bedrock. Mr. Jacobs indicated that certain points get a direct view into the campus and suggested tliat some type of buffer should be developed. There is a 75% hard surface drainage to the north. Some measure should be provided to retain water and release at a slower rate. Tlie wetland is natural for this. About 25% of hard cover drains to tlie south. Soil seems to be suitable for building, f.r. Jacobs tlien turned the presentation over the Mr. John Torseth of Armstrong, Torseth, Skold 6 Rydeen, tlie archi tects for this project. He informed the Commission that the west campus would have the same amount of area when completed as the otlier two campuses. The main approach is from the soutli. Highway 12 and County Road 6. Tlie main entry would be Old Crystal Bay Pc^ad and County Road 6 witli the secondary entry at Homestead Trail. Specialty crops best suited to this wet type soil would be grown. Open water area would be fenced in and trails (walking, etc.) would be developed. The Commission's main concern is that the majority of this can^us is in Medina, but Orono would be handling the traffic. The feeling now is that traffic is quite heavy because of the schools already in this area. Hie Commission expressed tliat the public services necessary for a project of this type are not available. It was agreed tliat tlie educational quality of the Vo-Tech schools is very good, but the feeling is tliat another plan site would be more suitable. Lee Gresser assured the Coiranission that the increase in public services at the other two canpises was very minimal and no problems arose because of the traffic floiv. After continued discussion Pesek moved, McDonald seconded, to disapprove of this project until the folloiving problems that mi^t result from the project be resolved: (1) Increased traffic (2) Conflict of ivetlands with proposed location of new roadway approach from County Road 6 (3) Increased public services Motion - Ayes (4), Nays (1) - Hosfield, Abstain (1) - Van Nest. John Hake suggested that the villages of Orono and Medina meet to discuss this proposal. HENNEPE4 VO-TEOi (continued) McDonald moved, Pesek seconded, to approve this variance (2 acres of tlie 5 acres required) because of many years of planing and because the area is large enough for an on-site septic system. The parcel was platted and under single, separate ownership prior to January 1, 1975. Letters were presented from two nei^ibors wliich stated that they did not want to divide up or sell their land which surrojnds this area. Motion - Ayes (6) - Nays (0). Discussion follw^ed. The Zoning Administrator suggested that the roof drains be brought down to utilize same drain on #19. Also mentioned was the fact that a proposed pond, if built, would destroy na^ral gro;rth screening to the south of the structure. This would require cleaning out area such as removing trees, etc., and could establish a future growtli problem. Motion was made by Make, seconded by Hosfield, to recomnend site and drainage which incorporates the foliating features of the two proposed plans: (1) The I'JE comer of tlie site be graded so drainage comes toward County Road 15 and 19 as proposed in latest plans. (2) Roof of building be drained into the same drainage system by underground pipe. (3) Retention pond be eliminated and minimum grading and distrubance of that 100' south and west be done as shown on tlieir earlier drawing. Hake seconded, to approve the variance provided all setback requirements are met and on the condition that the three conbined lots constitute one sewer assessment and no other land is available. I've also suggested to the developer that he might look into the possibility of draining the roof of the structure into the same storm drain on County Koad #19. They are anxious to get started with the excavating and grading and are there fore requesting approval of these plans so we can issue a foundation permit. PLANNI.NG O>WISSI0N MHETING - June 21, 1976 The plans as submitted designated a terraced ponding area to the south of the proDOsed structure. The Planning Ccimnission was concerned with tnih design because of the possibility of destroying the n.atural screening ares through construction of the ponding areas or through extended, excessive water reten tion periods. The Planning Commission recorinended approval of the rite plan subject to: (a) eliminating these ponding areas to preserve the foliage, (b) eliminating tlie asphalt spillway along Kelly Avenue, (c) cutting the length of the asphalt spillway along the bank property line, (d) diwrting roof drainage to stoim sewer line Cxxmty Road #19, (e) retaining the parking lot drainage as shown on the plan. COUNCIL MEETING - June 28, 1976 Revised plans were submitted as per Planning Conmission recommendations except that the roof drainage still went toward Kelly Avenue. The Council appro\ed the grading, drainage and foundatiqp plans provided the roof drainage is directed to the storm sewer and subject to a resolution to be drafted con cerning all aspects of the development. The remainder of tiic building will be presented for review wljen plans are completed. Trie current proposal to diveit most of the proposed hard-surface runoff east under C.S.A.H, No. 19, does not adequutely address the problems of increased runoff and degraded water quality. 4 Minnehaha Creek Watershed District Rules and Regulations require that stormwater effluent from a developed pro perty should be no greater in volume and no lower in qual ity than existed under conditions prior to development. To accomplish this owners must use facilities on-site to avoid transferring the problem to n downstream body of water. In the past the City of Orono and the Minnehaha Creek Watershed District have worked in close cooperation to solve such problems. Box 66 Crystal Bay, MN 55323 i!>oO Subject;Tyra's Super Valu County Road 19 and County Road 15 Orono, Minnesota Dear Dick: We have reviewed the revised plan submitted by Super Valu covering the subject site, dated 6/20/76, together with the recommendations of the Planning Commission from their meeting of June 21, 1976 and have the following comments. Since our last reviev; of this i)ro()Osal, which occurred on June 1, 1976, various changes have occuried to the plan. The original break in drainage in the northeast [portion of the site will now be retained thereby [tovLding for the removal of runoff from that area by the County Road 19 and 15 storm sewer which is presently in place. This change in plans is in our opinion very favorable. Since our lust review, a rock splash rip-rap area at the base of the bitumxnous sj;ill- way, to the south and east of the building, has been ac led to act as an energy dissapation device. We feel that this rock, properly placed, would adequately handle the flows antici[>ated and would protect the lov: lying area from excessible scouring during periods of high runoff. Grading limits to the west of the proposed store have been brought closer to the building w'ith the result being that an area of roughly 35 fee;t east of tlie Kelly Avenue property line is being left in it's natural state. As presently designed, this natural area would receive the runoff from the westerly portion of the i)ark^ng area. The plan as submitted does not call for any erosion control measures being taken in this...natural area to minimize disruption tlue to increased runoff.The Planning Commission has recommended the elimination of the bituminous spillway which had beevi earlier proposed through this area. In our letter of June 1, v;e had recommended that due to the increased runoff from the parking areas of the site, a provision be made for storage of storm water on the building itself v/ith removal of this water occurring normally through evaporation. This recommendation would stand unless storm water from the roof of the-building is diverted to the County Road 19 -• County Road 15 storm sewer v/hich seems to be practical. With the diversion of roof drainage to the storm sewer together v/it:h the drainage from the northeast nortion of the site, the net effect of this w’ould be summarized as follows: Presently approximately 2.6 acres of the site drain to the Kelly Avenue areas. Under the present plan this break in drainage would be retained and the roof drain carrying the storm water to County Road 19 and 15 would effectively reduce the Kelly Avenue drainage area by approximately .37 acres. This ecrease in the overall*Kelly Avenue drainage area would be offset by any increased amount of runoff duo to the hard cover in the parking area. The net increase in runoff to the Kelly Avenue drainage area would be approximately 20 percent (from this site) varying with the duration of the rainfall and the saturation of the soil. Tlje overall increase in runoff to the low lying Kelly Avenue area v;ouid be negligible, hov/ever; when compared to the overall drainage area of approximately along the East side of Kelly Avenue. Wo would estimate the net increase in runoff to be one to two percent. We would caution the City, however, that any in.rease in runoff from any portion of the drainage area will only serve to v/orsen the p<iriodic problems within the draina«}e area. At present the southerly portion of the site will bo covered by a conservation easement and as pro^>osed will be it’s natural state. Since this is presently a low lying area, it would continue to serve as an area in which the pollutants of the parking area runoff would be deposited. It also would serve as a buffering area for the building, since the underbrush and the trees would be retain d and would lessen the visual impact of development on the areas to the south. We both suggested other methods of razing the ^d struc ture to prevent anv type of pollution or damage to foliage. We suggested demo lition with heavy ^uipment sudi as bulldozers or cranes, or advertising for people interested in either moving the building from the site or in the used lumber material. Prior to our adopting the Comprehensive Plan and latest zoiing ordinance, we found, through studies of the reports of various agencies and fron experience, that parcels of less than 2 acre areas were not adcc^uate to support on-sire sewage disposal systems. Therefore, had the City not included the installation of a municipal sewer system along Tonkawa Road in its original comprehensive sewer plan, this area would have been zgned LR-IA C2 acre minimum area) rather than the current LR-IB (1 acre ininimian.i. Althou^ we have experienced seqiagc problems from private on-site sewage dis posal systems previously, I believe we will be eliminating this problem after all tlie dwellings along ’Tonkawa Road are connecteil to the recently ccmpleted municipal sewer line. It was indicated in said letter that local sanitary sewer extensions could not be reviev/ed until your community was consistent with tne Metropolitan Council's Waste ilanagc'inent Policy Plan. We also stiitei in our letter that the Coinmission had reguested that interim guidelines be established by the Metropolitan Council by which the Commission could continue to review and approve local sewer extensions prior to the preparation of a new CSP. Certain interim guidelines have been establislied and the Cor^iission is proceeding to process server extensions which are in co'fornance with the Metropolitan Urban Service Area (MUSA). If the proposed extensions are not fully in conformance with the MUSA boundary, they will be jointly reviewed with the Metropolitan Council on their individual merit. It is requested that the City submit the following information to the Coimission to permit the Commission to consider the f jture review of your sewer extensions as per your needs: 1)Three copies of your sanitary sewer construction program for the period June, 1976 through June, 1981; your best estimates by year will suffice. All such proposed sanitary sewer improvements shall be located within the MJSA as established in the Developfient Framework Guide. To allow the Coi.nission to make (?stimates of sanitary seua'ie flows to be used in our Cost Allocation Program, it is requested that you submit an estimate as to the annual number of sewc-r connections and flows that will be made for the next th>'ee years. Hither the owner or contractor changed this proposed locatidi to the opposite comer. When we made our first footing inspection the footing appeared to he set back tlie necessary 30*. Without the proper engineering instninents, it is impossible to measure the horizontal distance over mounds of dirt and into 4* or S' excavations. Since the building has been framed in, Mr. I.arrv’ Shaw, a neighbor, has turned in a complaint of encroachment on the rear lot line. We requested a new survey from the Smith's which they submitted on July 7, 1970. Hie new survey docs confirm the allegation of encroachment. Since learning of this, the Pith's have submitted an application for a variance from the rear yard setback require ment. Hie location of the house as built is 20'8" from the rear lot line v4iich is 3*4” short of the required 30* setback requirement. This parcel is one of the two resulting from the replatting of Fagemess Hreen Subdivision which was approved December 10, 1973. Please note the shaded shoreline area across the street from the siAijcct property as shown on the enclosed copy of the Fagemess Green S\/bdivision. Hiis .• horeline area was evidently not included in this plat, fherefore, I would like to remind the owner that no docks would be permitted along this shoreline as it is not part of the property. After the sewer line is installed and the property is restored to the satisfaction of the City of Orono* the City has the option to take over the sewer line at no expense to ,the City and if the City of Orono does take over the lino* the City of Orono shall maintain that line for the benefit of the Herrick Circle property. Nafstad, in his proposal to develop Herrick Circle in a manner as previously reviewed by the City Council, NOW THEREFORE, the City Council of the City of Orono sets forth the following statements: 1. The Metropolitan Waste Control Commission has approved Herrick Circlets proposed sewer line. 2. The City of Wayzata has agreed to accept the efflu ent flowing from the Herrick Circle property.-r : 3. The sanitary sewer line which is to be constructed on the Herrick Circle property may be used as a temporary holding tank for the effluent from one home, pursuant to plans acceptable to the City Engineer. This temporary holding tank may be used in the future as part of the complete sani tary sewer system line if said sower line is approved by the City of Orono. . • 4. The sewer line that is to be installed on public property and the sewer line to be installed on Herrick Circle property shall be installed pursuant to city specifications and shall be compatible with existing installations so that it can be maintained with the rest of the sewer system of the City of Orono. 5. No permission is granted Mr. Nafstad to hook up to the sanitary sewer lino to be built on public property and such permission shall be withheld until and only if the City Council approves the rezoning and platting of the property in the future. 6. Any utility construction, restoration procedures and alignmentf shall be reviewed and passed upon by tho City Council prioji^ to construction. ^ ' 7. It has called a public hearing for 7:00 p.m., August 16, : 376, M'^tro poll tan Council Offices, 300 Metro Square, St. Paul for this purpose. The document contains four sections, and depending cn your interest, you can obtain the complete document or parts of it free of charge by call .ng the Council’s Public Information Office at 291-6464. Please request only those sections you feel you need. Section I reviews the characteristics of housing in the region and describes the nur.oer of units affordable by low or moderate income people. It -estimates housr.ng needs—cost size, and subsidized units—and estabhsiie^ numerical Section II contains the regional policies for meeting area ncusir/j needs. It covers a wide range of policy questions. Section ni describes proposed regional distribution and allocation plans for new housing. It proposes the "fair share" of subsidized housing units for -ach *;ofr.munity between 1975 and 1985, and the number likely to be funded by .'nutucipality over the next three year period. It also leys out the share and dollar amount the Council viil be re comm end-.r^ that each community receive from the state rehabilitation loan end grant program. Section IV is the implementation program* and proposes the "how" o: carrying out the plan and the groups that should be involved. It also proposes the Council's housing review guidelines it would use to review housing-related plans and projects.
