The representatives will be appearing before the Planning Comnission
for approval of the proposal. The main portion of this campus is
locat^ in Medina. The area which will be in Orono will be used for
planting (trees, flowers and crops). The proposal includes another
access to the Medina Campus from County Road #6 through the property
located in Orono.•it
Gomcil recently granted approval of a Conditional Use Permit for a
fanning operation subject to review.

aThe developer has submitted revised plans showing the layout of the project
and the proposed drainage for the area. These revisions are a ^reat improve
ment to the original plans in that some of the hard surfaced parking lot
drains into the storm drain located on County Road #19. I've also suggested
to the developer that he might look into the possibility of draining the roof
of the structure into the same stonn drain on County Road #19.
lliey are anxious to get started with the excavating and grading and are there
fore requesting approval of these plans so we can issue a foundation pexmit.

robbers of the Council and the Staff and at this time believe we have arrived
at the best solution for all roncp»'ned.
Landscaping:
^roupinp of shrubbery are being provided on either side of entrance drives.
Other plantings will be provided on the east and west sides of the building.
All other areas which are not built on, paved, or left natural will be sodded,
sodded areas where slopes are steeper than 1:3 will be staked. On the west
and south property lines the first 20 feet of the property, in addition to the
right-of-way, will be maintained a natural lanci:.cape.

He met with Mr. David M. Feltl, P.E., of Hennepin County Traffic Department,
and resolved the driveway concerns. Mr. Feltl verbally approved the location
OT the drivG to County Rodd 19 f\s was presented and gave verbal approval of the
drive to County Road 15 providing that fifty feet is maintained between the
west property line and the near side driveway curb. Our drawings have been
changed to conform to that requirement.
Water Main:
Our drawings have been changed to stipulate that the water main along the southerly
edge of the property be located and a 7 foot minimum earth cover be maintained.
Site Drainage:
Yo maintain drainage areas et approximately their present size, we have redesigned
the northeast portion of the property such that about 0.50 acres can be drained
to the storm sewer system in County Road #15.

roof of the building, and to avoid overburdening the Kelley Avenue drainage
area, we have designed a holding pond. This pond will be able to hold approximately
40,000 cubic feet of runoff or another way of stating it - it will hold all
runoff from the site up to an accuimulated sum of 7" of rainfall. We anticipate
that with this approach the runoff problems relative to Kelley Avenue, will be
less severe than they have been in the past.
Watershed District:
We have met with Mr. John Holmquist of Minnehaha Creek Watershed District and
have rewiewed the above proposed drainage plans with him. Mr. Molniquist stated
that he didn't anticipate any problems from the Watershed District with our
proposed plans, however, a formal acceptance will be required.

CSoanission Chaitman Pesek ended his term as chaixman
and was succeeded by the previous Vice-Chaiiwoman,
Diane Dunlap, who will conduct the meetings for the
next six months.
INSTALLATION OF NEW
OiAIRPERSON
ChaiiwoBian Duilap announced the opening of a Public
Hearing regarding the petition of Kem Hoppe, Robert
Bathke and Christopher Dahl. The Zoning Administrator
read the Notice of Pdblic Hearing, presented the
Affadavit of Publication, and reviewed the proposal.
Public comment was solicited by the Qiair. Owier Hoppe,
Attorney Hassel and Builder Nitz came forward to review
the prc^x>sal wi^ the Commission and the Public.
Chudc Bauer, 2605 Mapleridge Lane, q^stioned the
addition of another access to the existing small bay.
The Public Hearing was closed at 7:44 p.m.

The Gonmission discussed the proposal: Pesek moved,
Guthrie seconded, to recommend approval of the lot
rearrangement. The na# arrangement will allow con
struction on the property while meeting miniimin lot
size and requiring a lot width variance of only 20 ft.,
whereas the existing arrangement leaves one lot
unbuildable due to setback requirements and a private
easement. Motion, Ayes (5) - Nays (0)
Chairwoman Diailap announced the opening of a PUblic
Hearing regarding the petition of James Sidwell. The
Zoning Adn^nistrator read the Notice of Public Hearing,
presented the Affadavit of Riblication, and reviewed
the proposal. Riblic comnent was solicited by the Chair.
Wayne Peterson of 1359 Park Drive stated that he was
concerned about placement of an additional dwelling
between his house and the existing house at 1375 Park
Drive. He said that if he could be assured that any
new house would be placed farther toward the street,
1m would have no objection to the proposed subdivision.

Mr. Sidwell blea^ieii hardships of lahd erdsion along the
existing drain^e vhich would be rectified by a new
builder, the visual appeal of a new dwelling instead of
an unattended lot, co^arison of the proposed lot widths
to existing lots in Saga Hill (he presented a chart
showing all Forest Lake lot frontages), and payment of
two sewer assessments.
The Planning Gomnission discussed precedence in approval
of a new subdivision where both parcels would be below
801 of the required lot width and just above 80t of the
required lot area. Also noted was that the Oak Street
vacation was meant to cut doiei on lot splits and sub
standard lot useage, not to encourage this.
Goincilman Welsh also discussed this precedence and the
intent of Gonprehensive Guide Plan in limiting the
density of lakeshore development. He stated that Gouncil
has established precedence for variances csi existing
substandard lot?, but would be careful of the establish
ment of new substandard lots. He added that there is
precedence for re&mding sewer assessments whmi they were
found to be incorrectly applied. The Riblic Hearing was clcsed at 8:11 p.m.
After continued discussion, Guthrie moved, Pesek seconded,
reconoitendation of approval of this subdivision because the
lot area meets 80% of the requirement and because the pro
posed lot width is similar to existing lots in the area.
Hake argued that the only hardship he could see was
economic and not of the land; that the owner could correct
the existing erosion problem and could maintain the property
without a subdivision. Motion, Ayes (3) - Nays (2) (Ihie,
Dunlap).

Discussion developed concerning the siibstandaid size of
this parcel coopared to smaller adjacent properties as
T*'ell as the generally undeveloped surrounding land.
Hake moved, Pesek seconded, to table the matter while
the spplicarit makes an effort to acquire some of the

Lot area - Lakeshore setback
Street setback - Hardcover restrictions
Mr. Hanson is requesting the above variances to build a new home to replace
the one that was recently completely destroyed ^ fire on Lot F. This pro
posal would be on improvement to the previous situation in that the new
location is fiiither from the lakeshore.
There should be some concern of precedence on Big Island, however. Mr.
Hanson also owns lots G and 3 which consist of an additional 17,771 sq. ft.
He could also consider vacating the street if access to other properties
would not be obstructed. The streets consist of an area of approximately
9,000 sq. ft. If all this area were combined, there would be a total of
approximately 55,000 sq. ft. (87,120 sq. ft. required). We could, however,
maintain the required 75* setback from the shoreline. These are only sug
gestions since I have never been on the island. A site inspection will be
necessary before detemining a reasonable solution.
The builder did indicate that the existing drain field for tlie septic system
is presently located in the street area.

The develoTier has submitted a proposal to subdivide the Velie property
located south of Fox Street and west of Crystal Bay Road.
A very similar proposal was made by Dicon in 1974 vdiich was conceptually
approved on September 10, 1974. The original proposal included an outlot
for lakeshore privileges. This outlot has been eliminated on this pro
posal, however.
This new proposal consists of 19 new lots, plus the exception idiich now
cm^ns a dwelling. All the new parcels exceed the 2 acre (87,120 sq. ft.)
minimin, dry build^)le area if the notations by the engineers are correct.
Several of the lots are less than the required 200 ft. lot width.
The proposal includes a 50* access easement for a private road. The
developer has been informed of the requirement of a park dedication fee.
I am enclosing copies of some of the Coincil and Planning Conmission
minutes regarding the original subdivision proposal in 1974.
A public hearing should be sdieduled.

Hr. Russell Lund, who resides at 905 Tonkawa
Road, requested permission to retain a 140*
short*wave aerial on his property for the
purpose of operating an amateur short-wave
radio. Mr. Lund presented statements from
some residents citing no objections. Other
residents stated that aesthetic values were
teing ignored. The legal department was
xnstructed to investigate all laws and
ordinances and report to the Village. Council
on September 24, 1974.

Robert Bathke represented himself in an
application for a building permit. The
Building Inspector read a memo to the
Administrator, now on file, giving the
sequence of action taken from August 1,
1971 to the present* Also shown, and on
file, is the list of people requesting the
permit be denied.

Attorney Jerome Rice, representing these
people, stated that on account of the lagoon
on the property, the lot could not be
built on without a variance. He also
showed there were private easements for
viewing and walking across the property
granted to the property at 2610 llapleridge
Lane, when Chris Dahl, the owner of this property
and 2610 liapleridge Lane, sold the residence
at 2610 liapleridge Lane. Members reminded
i4r. Rice that the City did not have to honor
private covenants. On studying the plat,
it was felt that the lot was buildable without
granting a variance; also, that the only
hardship shown had to do with the private
easements.
Curtis moved, Kallestad seconded, that no
variance to the 75* setback required be
granted and oimer should produce a new
site plan to conform to existing regulations.

William Dickey and his engineer showed the
plat of the proposed Farview subdivision.
Brought out was that the Lake Minnetonka
Conservation District has a moratorium on
multiple use of docks on properties serving
more than the owner. Hr. Dickey stated they
would abide with any regulation the L.M.C.D.
might come up with after their study. Van Nest
felt that regardless of the L.il.C.D. multiple
use of the outlot should be forbidden. The
Chairman read the engineer's report and
recommendation on drainage for the sub
division. Engineer Willis stated the geodetic
map did not show v/etlands for the area. Van
Nest stated the Hickock water study showed
that i'laxwell Bay as atrophic and the area
around it had one of the fastest runoffs,
®tated at 199.7 cu. ft. per second in heavy
rains.^ He felt with some added cost more
water could be diverted to French Lake than
shown on the plat plan. Van Nest felt that
the area should be kept as much as possible
in its natural state and that the road near
Leaf Street as proposed would affect runoff
contrary to engineer's report. (Continued)

Hr. Lynch, representing DiCon, opened the meeting
showing a series of sketches indicating that
subdivision along
shoreline on Maxwell Bay. The
sketches showed lot and road configurations,
slope analysis, green area and a drainage
pattern, showing 100% drainage into Maxwell
Bay. Proposed is: 19 lots with a minimum of

The Metropolitan Reorganization Act (Chapter 422, 1974 Minnesota
Session Laws) amended the Metropolitan Council Act (Minnesota
Statutes, Chapter 473B) and directed the letropolitan Council to
adopt as part of its Development Guide a ^onq-range comprehensive
policy plan on sanitary sewers for the metropolitan area. The
Metropolitan Council has adopted this Was*:e Management Policy
Plan in accordance with the policies established as part of the
Metropolitan Development Framework. Pursi'ant to adoption pf the
Waste Management Policy Plan, the Metropolitan Waste Contml
Coifmission is required to prepare a Development Program to carry
out the objectives and policies established In the Waste Management
Policy Plan.

A principal policy of the Development Framework designates urban and
rural service areas within the seven-county metropolitan area. The
urban service area consists of all portions of the i.ietropolitan area
progranmed for urban service up to 1990. The Commission's Development
Program will provide for extension of sanitary sewer service to these

It will be necessary for the Comnission to revise* the present Sewer
Service Area boundaries to be consistent with the 1990 urban service
area established in the Development Framev/ork Guide to carry out the
Waste Management Policy Plan and Program. The urban service area or
sewer service area in your community will be dependent uf)on waste-
water treatment plant capacity and population projections. This
information is a necessary part of a revised or updated CSP. tch
local government unit is required to prepare and submit for approval
to the Comnission a comprehensive sewer plan (CSP) whicu is consistent
with the Development Framework Program ^nd Waste Management Policy Plan.
-The approval of an updated CSP is necessary before improvements to your
sanitary sewer system will be recommended iPor approval to the Minnesota
Pollution Control Agency (MPCA)i Enclosed is a copy of the criteria
for the minimum information necessary for the preparation of a CSP, ;
and a review of your present CSP against the new miriiirum criteria.
Please study the minimum information in order to insure submittal of
a complete CSP.

Stewart Perry - 2975 Casco Pt. Rd.
Mr. Perry has already completed extensive grading and terracing within
75 ^ Lake Minnetonka. A "stop Work" order was issued inmediately after
wa becM aware of rhe project. All of the upper sections of the tie
seawall along the lakeshore has
not bm filled, however. The ties used are treated and would definitely
contribute to the pollution of the water in Lake Minnetonka. In the past
exception of the one natal seawall, always insisted on
5 along the shoreline. The treated ties used for terracing
would probably have less effect on the water quality but may contribute
soneiaiat to pollition through runoff.
Mr. Perry had aiso proposed to do some planting in and along the terraced
areas. I suggested he postpone this until the terracing matter was resolved.
PLANNING COMMISSION MEETING - June 8, 1976
RecoBBMnded following:
lanedlate (within 30 days) removal of the creosoted tie seawall.
2) Replacement of the seawall with approved stone rip rap.
3) Approval of the terracing subject to approval of the other agencies
involved.
OCXJNCIL MR£TING - June 14, 1976
Notify applicant by mail that newly installed seawall of creosoted tiidser
contributes to pollution of Lake Minnetonka and should therefore be removed
M replaced with approved riprap material (boulders). He should also be
instnicted to follow procedures for submitting application for riprap with
the City of Orono as well as the D.N.R,, the Watershed District and the
Aimy Corps of Engineers.
The Coimcil also instructed staff to withhold issuing a citation for
>^olation of the ordinance if the application for riprap is submitted before June 29, 1976.
