Paul Pesek, menbers Gloria McDonald, Brad Van Nest, John Guthrie, Gregg Hannah, and Zoning Administrator Henxy Muhich. Absent: George Hosfield, Diane Dunlap, John H^, and Eugene Hooley. The City Council convened simultaneously to open the Pift>lic Hearing in regards to the proposed Ring Route in Orono at 7:50 P.M. Maj^r Searles called to order the two public hearings as per pii>lication: 1) the Ring Route proposal, and 2) the consideration of a Multiple-Fanil>' Zoning Ordi­ nance. The public Hearing on the consideration of adopting a Multi- Family Zoning Ordinance was teaqxnrarily defend mtil the Pii>lic Hearing regarding the Ring Route was concluded. The Pid>lic Hearing on the fSng Route was concluded at 9:00 P.M. The Planning Conmission reconvened and Chairman Pesek com­ menced with the Pid>lic Hearing with regard to a Multiple- Family Zoning Ordinance at 9:05 P.M. The Zoning Administra­ tor produced the Affidavit of Publication. Mrs. Schroeder, who was in attendance, expressed an interest as to whether ai^ provisions were made to include low and moderate income housing. Attention was directed to these provisions with Whidi she concurred were adequate. Mr. Roberts suggested a change in the maximm percentage of two family structures in multiple zones. He reconinended a change from 20% maximum to an 80% maximum. The Planning Commission felt more review would be necessary befbre any dianges to the proposed draft could be agreed upon. They were concerned about any possible conflict withupon. They were concerned about any possible conflict witn our Comprehensive Plan or our ori^al intent with regard to adopting a Multi-Family Zoning Ordinance. After all conments were discussed and considered the Public Hearing was closed at 9:25 P.M. In order the expedite the issue Pesek moved, Guthrie seconded the Planni^ Commission reccnmend adkiption of the Milti- Family Ordinance, subject to obtaining a statement from John Bergley of Wehrman Chapman Associates as to any impact any change in deplex percentage might have on our Comprehensive Plan or original intent of the ordinance. Motion, Ayes (5) - Nays (0). Chairman Pesek called to order the regular meeting of the Planning Conmission at 9:30 P.M. Van Nest moved, Hannah seconded that the minutes of the Planning Conmission Meeting held May 3, 1976 be approved. Motion, Ayes (5) - Nays (0). ATIENDANffi - 7:30 P.M. PUBLIC TARINGS - 7:30 P.M. A copy of the deed conveying the subject property, revised plans and aerial photos of the area were presented. Ine Goanission discussed resolving of maintenance responsibility and lack of adequate detail for obtaining conclusive approval of the PRD proposal. Van Nest moved, Hannah seconded recoioiiending conceptual approval for 3 single family uiits on the PRD parcel (1). Siifce this particular parcel is presently occupied by 2 living units consisting of the existing duplex, only one additional single family laiit could be addM until such tine that the existing duplexes were reaioved from the property. Motion, Ayes (5) - Nays (0). The CoBBdssion continued with a discussion on the duplex credit proposal. The question was raised as to the conflict between the ordinance provisions for duplex credit and 1< lakeshore setback for sultiple construction. Ill Pesek moved, Guthrie seconded to lecoamend approval of duplex credit in lieu of the single family units or the PRD proposal. Mr. Pesdc express^ the presence of deliv­ ery trucks, gaibage trucks, gaibage dumpsters, damaged autos for repair, etc. would create a nuisance and result in a dindnuit&on of value of the residentially zoned district. He also stated that the duplexes would pro­ vide an appropriate buffer zone from the existing single family residences to the south and therefore justify a Duplex credit. The recoanendation for approval was mam with the following conditions: 1) Maximum boat docking - 2 boats per living unit or 4 boats per duplex. 2) All 3 duplex units to be located within 200 feet of the oomamrcially zoned district. 3) The 3rd duplex unit would not be erected until the existing d^lex on the property was removed. Motion, >^s (3) - Nays (1) Van Nest - ^stain (1) McDonald Van Nest moved, Guthrie seconded recomnending approval of rezoning of the 20* strip along north end of the property from B-3 to LR-IB. Motion, ^s (5) - Nays (0). After reviewing Mr. Sweetser's revised subdivision pro­ posal >4iich included individual parcels for the existing two dwelling wits, Guthrie moved, Hannah seconded recom­ mendation for approval of the preliminary plans of the subdivision pro(x>sal. Motion, Ayes (S) - Nays (0). Nr. Van Nest moved, Guthrie seconded to reconnnend approval of the Conditional Use Permit to keep horses on the property as the proposal does not conflict with conc^ts set forth in our Land U^e Plan and to approve the variance for the accessory building GMim) without a main structure as this parcel is directly across from Roessel's existing residence with future j^lans of building a new residence on this same lot. Also to approve the variance from the lot line setback requirement as the proposed location would meet all minimum setbadcs from adjoining proper- ties and Watertown Road would provide adequate setback from the property across the street. Motion, Ayes (5) - Nays (0). Mr. Lani>in presented his new plans for the Burger King proposal. These included an approach from Goisity Road #19 located north of the power pole through an agreement Tdth the church. The following changes were noted on the new plans: 1) Ingress and egress from Couity Road #19. Ingress only from County Road #15. Moving the northeast pr^rty line toward the south west to the top of the hi^ ground to permit re zon­ ing of the lower elevations from B-1 to LR-IC. No filling of low areas. 60 parking spaces. "Enter Only" sign on Couity Road #15. Utilizing of vacated Navarre Lane as part of ap­ proach and diurdi parking. 2) 3) 4) 5) 6) 7) brad Van Nest informed the Comnission that he had attended a recent Miimetonka Beadi Couicil Meeting with regard to their view on this request. They showed some concern about traffic generation, lighting and litter along lafayette Bay and possible grease problems. Mr. Laniiin explained he had removed the drive-in, take-out concept of the establishment to minimize the litter possi­ bility and that grease was not a major problem with Burger King as most of the service is done on throw-away dishes. Pesek moved, Guthrie seconded to recoamend conceptual ap­ proval subject to adequate landscaping from residential areas in Minnetonka Beadi and Orono, resolving grease ques­ tions through referral to City Engineer, ingress and e^ss approach from County Road #19 to be located north of the power pole, ingress only from County Road #15, and moving t'le zoning line and prt^rty line to the southwest. Motion, Ayes (3) - Nays (2) Van Nest and McDonald. After approval of the concept Mr. Gene Block voiced some objection because of the possibility of consumer traffic through the residential streets. Motion, Ayes (S) • Nays (0). Mr. Vickeiman presented his proposal to grade a narrow strip from the hi^ enbahkment for access to the lake and a Conditional Use Permit and Variance for removal of 11 trees within the 75* shoreline setbadc. Van Nest moved, McDonald seconded to recommend approval of the variance for access to the Idee, providing it does not extend any further than what is absolutely necessary for a reasonable grade to constrict a stairway of ties (not rail­ road inqpregnated type) filled with gravel. Mr. Vickerman was also instructed to replace the 11 trees removed with 11 new trees with diameter of IV* to 2V' and Add the evergreens as shown on the plan. Motion, /yes (5) - htays (0). The Planning Conmission scheduled a Pd>lic Hearing for 7:30 P.M. Jme 21, 1976. Mdkxiald moved, Guthrie seconded to recomnend approval of the final plat on condition an access easement is granted across Lot 1 to Lot 2 and siibject to payment of the Park Dedication Fee. Motion, Ayes (5) - Nays (0). Hannah moved, Pesek seconded to recommend approval of the fianl plat subject to payment of the Park Dedication Fee and conpliance with all county r^ommendations listed in the letter of April 29, 1976, which includes dedication of an additional 10 feet of ri^t-of-way along County Road #6. Motion, Ayes (5) - Nays (0). The Sidwells appeared to discuss their subdivision proposal prior to the Public Hearing which is scheduled for June 8, 1976. No action was taken. Mr. Hagen requested reconsideration of his grsuiling pr^sal vdiich was denied at the last Planning Gomnission Meeting at abandoned tennis court. Van Nest moved, Pesek seconded to reconmend approval of the grading of the ridge resulting from the abandmd tennis court, removal of the hazardous pump house, and rip rap along the entire shoreline to prevent fur^er erosion. Huhich J\ine 3, 1976 Stewart Perry - 2975 Casco Pt. Rd. Mr. Perry has already completed extensive grading and terracing vithin 75* of Lake Minnetonka. A "Stop Work" order was issued iosiediately after %re became aware of the project. All of the upper sections of the tie terracing have been filled. The log tie seawall along the lakeshore has not been filled, however. The ties used are treated and would definitely oontributa to the pollution of the water in Lake Minnetonka. In the past we^have, with the exception of the one metal seawall, always insisted on 12" rock rip rap along the shoreline. The treated tics used for terracing ****^^^probably have less affect on the water quality but nay contribute somewhat to pollution through runoff. Bill Siae of 4051 Highwood Road called ae and stated he aaa very confused about what had to be done to his property in order to get approval for a penait. 1 inforsad him my only concern was the drainage, and anything else would involve Mr. Hank Muhich of the Zoning and Inqpeetion Departaent. Mr. Sime stated that this is what concerned hia the SMst, that no one could tell hia exactly what steps to take so he could get approval. He felt once he completed the requirements the City would tiiink of something else. Mr. Siae had talked to Brad Van Nest, Planning Coaaission aeaber for Orono, about the problem. I contacted Mr. Van Nest and asked if he could tell ae what Mr. siae had to do r.o get a permit. He told me Mr. Siae irould have to satisfy ae on the drainage prob lea, protect two trees, guarantee that no wore fill «»ould be added, stabi­ lise the bank with black dirt and some type of planting to prevent erosion and coabine the t%io lots. Nr. This letter is n^ification that the above described situation is in violation of tte Orono Zming Code, Section 31.700 which prohibits the filling of any Und 2f ^ Jjteration of ^ existing natural grade within the City of Orono without first obtaraing a taditional Use Permit from the City Gouicil. Since this purchase he has obtained several building permits for remodeling and garage addition. Excavation from these projects has resulted in some excess fill. He is now requesting a Conditional Use Permit to transfer this excess fill into a lower water retaining area south and west of the residence on his property and grade sasm. The water line on the trees area confirm this to be a water retention basin and the excessive fill ever the tree roots would undoubtedly ham the existing trees.
