The Minnehaha Creek Watershed Ustrtet, W wtition of the Lidce Minnetonka Conservation District, held a public hearing concerning tiiis project. They have a rather sizable plan to acquire large land areas in the Watershed District. They feel that danming iq> SOBM of the large land and releasing it at a controlled rate would help tostabUize the lake level and control the anoiiit of flooding into Minnehaha Creek. Because data had not been provided to aunicipalities affected, Orono requested that the records of the public hearing reaiain open iiitil January 20, 1977, to provide ■ore tine to state our position regarding this natter. Musengale requested the Planning Gonission to review the naterial and prepare for the Couroil any connents they ■ay find in their investigation. The Zoning Adsdnistrator pre sented the plan siimitted by Jin DeSplinter. The plan con sisted of a duelling and detached garage. A variance would be required for the ri^t of way setback. Mr. De^linter is now considering an attached garage idiere no setback variAces would be required. Satm regrading of the ri^t ^ way would be reared, but letters of no objection would be required fron affected adjoining neighhors. Bill Carlson and Jdai Gerhardson of the Pwlic Works Department inspected ^ site and reviewed Mr. DeSplinter's proposal. They both agreed with the proposal of regrading of the ri^t of way to two feet providing culverts are installed to provide natural drainage and manhole extensions be added by Mr. De%ilinter if the road grade is raised (subject to no objection from neighbors). Mr. Richard Tiegen, neighbor to the north, was present. He had no objection to the proposal, but was concerned about the drainage. The Zoning Adynistrator informed him that the applicAt had agreed to install a 12*’ culvert to Ain- the natural flow of the runoff as directed J<dn GerhardsA. Hank Hiiich presented a colored nap to the Coanission which he received from the Hemepin Couity ^ Conservation District. They advised against building on the blue area which contains soils not suit^le in maintaining on>site septic systems. Additional information received regarding proposed rerouting of Comty roadways revealed the proposed road is plarrsd throo^ most of the remaining hi^, buildable area of this plat. Ihe Zoning i^hiiinistrator informed the Gonnission that the applicant is aware of these reports and was very q»set after learning that tiiere might be some difficulty developing this area because of the existing conditions. Applicant felt he diould have the ri^t to develop the area or some way be reishursed. The Zoning Adninistrator suggested he contact Watershed, Flood- plain or Conservation Agencies or the Hennepin Goiai^ Kigh- y way Department. The City's primary objective through control of land use is providing protection of health, safbty and welfare of the public. Hake moved, Pesek seconded, to table this matter. The Zoning Adninistrator presented the letter from the Minnehaha Creek Water^ed District stating that they encourage the use of rode riprap for the control of shoreline erosion. Mr. Solie again stated that he had received the approval of the Pollution Control Agency ' the Minnehaha Creek Watershed District. After a brief discussion. Hake moved, Pesek seconded, to recommend approval for the request for a conditicnal use permit for grading and filling on the basis that Mr. Solie was acting on the approval of the MCMD and was not aware that he was in violation of the Orono code. Motion - Ayes (6), Nays (0). Hdoe also moved, Pesek seconded, that the Village immediately notify the Department of Natural Resources, Pollution Control Agency, UCD and the Watershed District concerning their Mocedures for approval of applications such as this. Planning Coandssion felt that fijture approvals should be based on the stipulation that Orono review applications before final approval is granted, or that any projects involving Orono be referred to us for approval. Mr. Ortenblad and adjoining neighbors Santella and Grundeen, were present. The Planning Comnission reviewed the tiiree plans that have been stibmitted by Mr. Ortenblad to date: 1. Original Plan • proposed house closer to lake than adjoining neighbors, 10* and 6' side yard setback requested. . Revised Plan - proposed house set back to average of two adjoining neighbors, 9* and 7* side yard seti>ack requested. Adjoining neis^ibors objected to any side yard variances. Planning CGonission felt that house could be designed to meet setback requirements as no hardship was demonstrated. Some of the Planning Coomission Menbers felt that remodel ing of the existing stmcture might solve the problem. The Zoning Administrator infoxmed the Commission and the applicant that an addition of more than 50% of the value of the house would constitute a new stnicture and, there fore, must meet zoning requirements or obtain necessary variances. After a brief discussion, McDonald moved, Pesek seconded, to table this matter iiitil the December 20th meeting to enable applicant to decide udiich plan he wanted to sidmdt. Motion - Ayes (6), (0). Oiaiiwoman Dunlap infoimed everyone present that she had received a phone call from Mrs. Gasdi saying that she would be late for the meeting and requesting that her item be delayed until later in the evening. Tvto adjoining property owners, Mrs. Ward Parten and Mrs. Harry Larson, were present. Mrs. Gasch also requested lhat the letters she sent to the CoBmission be read to the neighbors present at this meeting. Chairwoman Dunlap read these letters which contained the chain of events vhich led to the request to build a 12* fence. One such event was the location and positioning of Mrs. Parten's house. Mrs. Gasch had the understanding that when the permit was issued for the new house it was to be built on the same location as the one that was burned down. Mrs. Gasdi feels that the house is located closer to the lake and is positioned in such a way as to overlook her property when viewing the lake. Mrs. Parten's response to this was that die felt her house was in line with the neighbors if you followed the shoreline. Sie also explained that her house was positioned as such to utilize the sun for heat and light. Several Planning Comniission Members did feel that the Parten house was built peculiar to the lot and did, in fact, use the nei^or's lot for view of the lake. Mrs. Parten's proposal was approved as submitted by Council on July 26, 1976. The suggestion was rade that some greenery be planted to provide the necessar/ privacy vdiidi Mrs. Gasch is requesting. The (kmiiission felt this would be more appealing tiian the proposed fence. Mrs. Parten stated that she would be willing to work out some arrangeaient with Mrs. Gasch. After all the comments were heard, Chairwoman Dunlap stated that this matter would be continued vhen the applicant arrived. NARREN ORIENBLAD (Continued) #195 M6. The neigjibors were not presentat this time; however, Chaiiwoman Dunlap informed Mrs. Gasdi that tiiey were present earlier and had discussed them, (tee again, Mrs. (Sasch ennressed her feeli^ concerning the events idiich led to the evasion of her privacy and her request to build a 12* fence.
