The Orono Pla<iaing CGnmi$si<m met on the above date with the
following menhers present: Oiairwoman Diane Dunlap, Menhers
Gloria McDonald, Gregg Hamah, Gene Woolley and Zoning
Adninistrator Hank Muhidi. John Guthrie arrived at 7:55 p.m.
ATTENDANCE - 7:55 P.M.

Qiaixwonian IXmlq^ amounced that this was the time and place
for a Pid>lic Hearing on the proposed land donation of Bruce
Dayton located at 475 East Lmg Lake Road. The Zoning
Administrator presented the Notice of Pijblic Hearing and the
Affadavit of Publication.
BxTKe Dayton was present. He stated he would like to give
this property to Orono. He has lived in Orono for the past
25 years and has enjoyed the area. When he first purchased
this property it was a resort. His main objective was to
dean up the area. Now he would like this to be opened up
for pid>lic use. Mr. Dayton stated that Herbert Peterson,
the adjoining property owner to the west, had future plans
for donating some of his land to the City of Long Lake.
David Pagel, a nearby property owner, wanted to know to
what extent this park land would be developed. He was con-
ceined Wbout the possible increase in traffic at the inter
section of East Long La3w Road and Old Long Lake Road.
Hank Muhich informed him that the City had no imnediate
plans for this area and wanted to keep this as a low profile
use. He then introduced Walt Lathrpp, Oiaiiman of the Park
Comnission, and requested his input regarding future plans
for this park land. Mr. Lathrop informed everyone in
attendance that this park land was basically intended for
Orono area residents. Some of the things that were
being considered were parking by permit only, closing up
of area at approximately 9:30 or so by the police, and
fencing the land to allow more control.
Mr. Dayton felt that it would be unfortunate to restrict
this area to Orono area residents only. Marjorie Boshane
expressed her concern for the need of restrooms and lighting
in this area. large nunber of residents have been using
the swinming beach. An increase in tiiis maiber would
require the use of restroom and lifting facilities. Bert
Gallistel was also present and expressed his appreciation
to Bruce Dayton for this generous gift. He felt that park
proper^ is getting scarce and Orono should take advantage
of this offer. After all the public were heard, the Public
Hearing was closed at 8:07 p.m.

Chaixwonian Dunlap announced thdt this was the tune
place for a public hearing on the MacVarre Area Rezon^.
^ The Zoning Administrator j^resented a copy of the Notice
of Pil>lic Hearing.
The Zoning Administrator state<i that the area of concern
is prrocrty south of the County ptcpBxty between County
Road 15 and 19 and the 2 lots north of #15 and east of
Blaine. This area would be rezoned from present LR-lC-1
(residential) to B-5 (Limited Neighborhood Business
District). Hank Muihich pointed out this proposed wzcning
to those in attendance. The following cane foiwaw to
identify themselves: (knrad Schinmelpfemig, Clifrord
Klapotz and Bert Gallistel. They were interested in
knowing udiat some of the proposed uses would re. (3iair-
woman Dunlap then informed toem that uses such ^
buildings» offices, clinics, locksmiths, hooby
shop, jewelry store, library, record shop, pet shop, eto.
would be permitted. After all the public were heard, the
public hearing was closed at 8:15 p.m.
Those people who were at this meeting did nre express aiy
objection to this rezoning. The Zon^ Administrator
informed those in attendance that this B-5 zone would have
to be established before proceeding with the Navarre
rezoning. At the present time, there are no plans for any
proposed building.
Woolley moved, Guthrie seconded, that the new B-5 zone be
granted and subject property be designated as B-5. Also
reconmsnded adopticn of zoning ovdinsneo amondniBnt#

The Zoning Administrator informed the Commission that no
new material had been sibmitted. However, the nw
of this property, Jim DeSplinter, was present and siiimitted
his proposed plans. After reviewing these plans,
discovered that all the necessary data was not included.
The Zoning Administrator informed the new applicant that it
would be necessary to meet with him to discuss this proposal
in order to meet the requirements.
Hannah moved, Guthrie seconded, to table this application
until the Zoning Administrator has a diance to review.
Motion - Ayes (5), Nays (0).
The Zoning Administrator informed the Comnissire tiiat he
did not have all the material requested. He did have a
conversation with the flood plain people and Hennepin
County (3onservation District will outline wetlands area
^ for us. We are also waiting for a feasibility report as
far as the septic system is concerned. Hennepin County

Plain people, they told him that the flood plain had no
bearing on the stWivision. Their only concern was insurance
which would be increased in a flood plain area, ^rie
noved, Hannah seconded, to table this matter until all
additional material is conplete. Motion * Ayes (5), Nays (0).
Mr. Solie was present and sibmitted a letter from the
Pollution Control Agency. Chairwoman Dinlap read this
letter which, in effect, stated that they were not
opposed to the use of creosote ties and felt the ties
would not have a significant impact on the surface MOtt.
Mr. Solie also mentioned that the MOW) had mentioned that
these ties were non-polluting. The Planning Conmssion
was concerned d)Out this as it has been their understand^
thdt creosote ties were polluting. In the past six months,
many ai^lications requesting the use of these ties have
been turned down.
After a short discussion, the Planning Coamission felt
they needi^ more time to obtain additional^formation.
Hannih moved, Guthrie seconded, to table this application
in order to receive documentation from the engineer
regarding the amomt of creosote in the logs and the
inpact this would have on Lake Minnetonka and any other
doasnentation that is appropriate and- make a decision at
that time. Motion - Ayes (5), Nays (0).
The Zoning Administrator stated that the aR)licant is
requesting a variance for the proposed addition to the
existing dwelling. The location does not appear to
conflict with any neighbor’s viw of the lake. There
is no other land available and addition would be an
improvement to the property.
Hannah moved, Woolley seconded, that this varimce be
approved given the fact of the configuration of the lot,
^s not interfere with nei^bor’s view of lake and no
other land is available. Motion - Ayes (5), Nays (0).
The Zoning Administrator informed the Planning Conmssion
that the applicant had telephoned earlier expiating that
he could not attend the meeting until 10:00. Mr.
Ortenblad is requesting variances for construction ot a
new dwelling on this lot. TWo
present and the Planning Commission heard their comets
at this time. Audrey Santella, nei^ibor to the south,
objected to the proposed location of this house
would extend closer to the lake than her home and felt
would obstruct their view. City Ordinance states that
houses should be in line and her feeling was that this
should be followed. She was also concerned about the

Hannah moved, Guthrie seconded, to schedule a public
hearing for Deceinber 20, 1976, at 7:3? p.m. The Plwaing
Gonmission requested staff to get legal opinion from
attorney conceming riparian rights in regard to this
applicaticn.
The Plying Ccmmission requested staff to obtain the
dimensions of present building and total amount of use{d>le
sq. ft. to be presented at the next meeting.

Mr. Keaveny was present. He will be moving his drug store
into the old Siqper Valu building. He is requesting approval
to use the existing sign which is O' from the front property
line and 8* larger than peimitted by our ordinance. He has
agreed to remove the 64 sq. ft. lower area and use only the
108 sq. ft. at the top vdiich is within 8' of the 100' per
mitted size. The Planning Comnission was concerned about
the stone planter in the parking lot. They felt that this
stone planter ^ould be removed. The Zoning Administrator
infoim^ the Planning Comnission that the P^lic Works
Department has consi&red removing this planter because of
obstruction to the walking traffic. Mr. Keaveny stated
that he would agree to remove the planter as soon as possible.
Woolley moved, Hannah seconded, to approve the area variance
of 8 sq. ft. and setback variance of 10' on the basis that
Mr. Keaveny remove the stone planter at his earliest
convenience. Motion - Ayes (5), Nays (0).
The Planning Comnission suggested that the Public Works
Department continue previous investigation for removal of
stone planter and possible erection of transit shelter for
that same location.
Applicant arrived at 10:10 p.m. The Planning Comnission
continued discussion of this application. Mr. Ortenblad was
informed of the concerns of the adjoining neighbors. Neighbors
were still presomt at this time. A leng&y discussion followed
concern^ the proposed location of the house. The Planning
Commission was also concerned about granting the 4' side yard
setback variance. They felt a dwelling could be designed to
fit on this lot and meet the required 10' side setback.
Mr. Ortenblad would like to use his present plans to build
this house and was reluctant to submit an alternative plan.
Woolley moved. Hannah seconded, to table this matter
suggest he suranit revised plans showing the front of
