The Asst. Zoning Administnitor presented the Notice of Pii>lic Hearing and the Affadmit of Plhlicatian. Mr. Olson stated that the City had recently been infonaed that this area was being used for swinning and docking of boats. Notification was given to reaove the dock. Neighbors then approached the Council requesting that the City open this area as public access. As a result of this discussion at the Council neeting, a Public Hearing was scheduled for this evening. He further stated that the Conndssion should have received a copy of a letter to Biuce Nalkerson fxoai Janes Lane ^o is the attoiney representing Richard Nurlow^i. The letter defines the legal status of Ivy Lane. Mr. Lane stated that it is hnportant to distingui^ between a dedicated street and a nere easenent for such street use. The Asst. Zoning i^tadnistrator stated that our City Attorney agrees with what is put forth in this letter. Several con cerned neii^ors were present at this meeting. The follming CM forth to identify themselves: Robin Crmford, Donna Cnwford, Lew Capron, Dick Murlowski and George Olen. Mr. Crawford stated that the nei|fibors in the inmediate area have enjoyed the use of this beach for swlming and would like to continue ^e use as such. There is room for only one dock and Mr. Crawford has been the only one docking a boat. He stated that the City had been taking care of this area idien he moved in 5 or 6 years ago. Mr. Hirlow^ then aqpproached the Coenission. He stated that he had been living here since August of this year. He is: familiar with what has been happoiing and wants no hostility from this action. After talking with A1 Olson and Attorney Lou Oberhauser, he feels this should be a restricted area and would like the privacy. He presented several pictures of this area to the Gonmission. George Olen informed the Coenission that he had living in this area for 10 years and felt it was a public access. He mentioned that there weren't any problems until Rev. Westerdahl, the previous owner of Murlowski*s property, com plained. They hM been using it mainly for the enjoysmnt of the dhildren and have been keeping the area clean. Mr. Crawford then explained about the day Mr. Westerdahl com plained. It was very hot that day md they had been cleaning up the beadi area. They were drinking beer, but were not having a party. Mrs. Crawford mentioned that idien they pur chased their property the real estate agent from Roger Fazendin Realtors told them they would have lake access. Hannah moved. Van Nest seconded, that the minutes of the October 4, 1976, meeting be approved with the following correction: Page 2, Michael Cloutier, Item (1) corrected to read as follows: 'That staff se^ a letter to the Hennepin Comty Park Reserve District requesting that they present a long range plan at their earliest convenience in regard to their expectations for the land they have purchased in Orono. Motion - Ayes (8), Nays (0). Menher Van Nest reported to the Planning Conmission on the status of the sewer plan. The plan is now finalized and ready to sidnnit to Council for their approval. The present sewered area is our uxban area. We have no plans to extend this service outside of this area for the next 25 years. Mr. Van Nest pointed out this area on a colored map he had prepared for the Coamission. There is no sewer interceptor capacity ;or the rural area. Our obligation is to see that cn-site ic systems woik in this non*sewered area. This plan will be referred to the Council for their approval. Council will then submit this plan to the Metropolitan Waste Control Conmission for their review before the scheduled Public Hearing on Novenber 10, 1976. A copy of this sewer plan has been sent to our legal staff for their review also. Hake moved, Pesek seconded, that the Comprehensive Sewer Plan be stbmitted to the Council for their approval. Motion • Ayes (8), Nays (0). The Planning Commission comnended Brad Van Nest and John Guthrie for the fine job they did in compiling this report. APPROVAL OF MlNinhS »€ET1NG SEPDEMEER 20, 1976 APPROVAL OF MINUIBS MEETING OCTOBER 4, 1976 OOMPREHB6IVB SE«ER FLAN v‘x;. This rezoning came about as a result of a law suit concerning Mel Olson, Qark Oil, Hart Properties and Tonka Corporation, Etal. It had been stipulated as settlement to the suit that the 187* deep strip in front of the Hennepin County Garage and other scattered parcels be rezoned to B-5. This is a new comnercial zone vhich contains B*4 zone plus an addition for such things ^ d^ cleaning, rental, pet shops. A draft of this B-5 ^ing is being prepared for adoption into our code. At this time, it was also decided to consider any other >4Qezoning that miijit be necessary in the Navarre area. The >J.ty must coaq;>lete action on this rezoning within 60 days. Zoning Administrator stated that Mr. Becker had sidmiitted a revised plan. He had purchased additional land allowing all five lots to meet the necessary recmiiements. Each lot contains at least 2 acres of dry buildable land (87,120 sq. ft.). Hannah moved. Hake seconded, to approve as submitted subject to a Park Dedication Fee and easements be granted for the roadway which is noted as 50 * wide with a 50* radius cul-de-sac, with the easement marrowing to 30* along the north side of Lot 5. Motion - Ayes (7), Nays (0). The Asst. Zoning Administrator eiqplained that no ad^tional material had been submitted; however, Mr. Jim DeSplinter had just approadied him and stated he had just signed a purchase agreement for this property. Mr. DeSplinter requested that the Planning Conmission give him a futme time limit to submit necessary information. The Commission informed the new applicant that he should provide information on the proposed driveway and what he intended to build, and to also provide a survey.
