Bia^ey Steinman of Holiday Station Stores was present. He si*mitted a copy of the site plan and stated that the double------------------- CUM Uliat UW access proposal had been approved by the County. The pro­ posed plan indicates there would be two access points to wis station fiom Gomty Road 15. Mr. Steinman felt that because there are three stations at this intersection alre^ Holiday should be granted this conditional use l^mdt. Conditional V w pennit approvals are subject to the conditions set forth m Section 32.460 of our Zoning Ordinance. The Planning Commission was concerned about the traffic probleais that could result at the intersection of County Road 15 and 19. Traffic studies indicate that a great TOTtion of this traffic would be coating to the station from the northern part of Orono. This would mean that traffic would be turning left on to Couity Road 15 and then left into the station. The public hearing was closed at 7:40 p.m. 0h Chairwoman Dunlap announced the opening of a public hearing regarding the petition of Tom Ifyan for a subdivision of property located at 1060 Tonkawa Road. The Zoning Adninis- trator presented Ae Notice of Public Hearing and the Affadavit of Publication. Mr. Ryan is requesting approval to subdivi^ this parcel into two lakeshore lots. The Zoning Administrator stated that consideration should be given to stoxm water nnoff. Tom Ifyan and Attorney Douglas Carney came forward to review the proposal with the Comnission and the Public. Mr. Carney told the Planning Comnission that there is a ditch running from Ae ponding area to the lake. Mr. Ryan was asked what he planned to do with the dirt that was stored on this property. Any unused portion would be removed. The Planning Conmission also asked Mr. I^ran if he was suing the City on tiie 73-1 sewer wsessnent. He stated that he was not. The public hear­ ing was closed at 7:55 p.m. r ^ 1 Tfte Planning CoRmission continued to discuss this proposal. Member Van Nest felt that this parcel should be subdivided so as to create only one lake^ore lot as both lots would then meet all code requirements. Mr. Ryan felt that two Iweshore lots were not unreasonable as they would be con­ sistent with the other lots in the area. Also, the sewer is in front of the lots. Mr. Ward Parten and Harry Larson, neighbors present at this meeting, agreed with Mr. Ibran. After continued discussion, Pesek moved, Guthrie seconded, to ^rovB this subdivision based on the following: (1) It is consistent with the nei^bors. (2) It is the only logical way to subdivide. (3) Consists of ^ acres with two sewer assessments. (4; Lot IS not wide enough to conform with the two lots on either side. (5) Conditioned on the fact that Mr. Ryan is not ^ ^ 73-1 Sewer Assessment.(6) ai)ject to a Park Dedication Fee. Motion: Ayes - 2 (Pesdc, Guthrie), Nays - 3 (Hosfield, Van Nest, Dunlap), Abstain - 3 (Hake, Hannah, McDonald) pe naming Conmission then tabled the matter and suggested to Mr. iqran that he submit a revised proposal which would meet both lot area and width requirements. Chairwoman amlap announced that this was the time and for a public hearing on the petition of Hu^ Harrison for a si^ivision of property located at 1305 Sixth Avenue N pe Zoning Administrator presented the Notice of Public HeariM and the Affadavit of I\iblication. The proposal is to split off 8 acres from the original 42.7 acres to remain as the site of the presait home. The remaining 34.7 acres would be left as the site for a new home. The access to the new house would branch off the existing private drive. Don Umd, George levering and several other neighbors were present and interested in knowing how this land was going to be subdivided. No one had any objections. The public hearing was closed at 8:35 p.m. 4 short discussion. Hake moved, Hannah seconded, to recomiend approval of the preliminary subdivision proposal based on the fact that no variances are required, subject to the fact that the new structure require no variance and subject to a Park Dedication Fee. Hie Planning Comnission felt this was more than a service station and would generate more traffic into this area. Mr. Steinman stated they would be willing to close off the access closest to the comer of County Road 15 6 19 which they feel would help eliminate some of the congestion at this intersection. Van Nest moved, Hannah seconded, that this mplication be denied based on the following: (1) Traffic Hazard resulting from traffic generating business. (2) Application is for additional service beyond normal service stations in the area. (3) Two relatively new service stations on comer now. Rirther r^omnend that staff be instructed to have this application reviewed by legal counsel and after City Couicil reaches a decision, the City Attorney draft up resolution to be reviei^ by the Planning Comnission at next meeting. Motion - Ayes (8), Nays (0). The Planning Comnission delayed iqjproval of the minutes until later in the meeting. The Planning Comnission reviewed proposed schedule of shooting dates and hours for 1977 submitted to staff on Septenter 17, 1976. Hie Planning Comnission felt there were discrepancies in this proposed schedule and that it was very confusing. Mr. Maas, President of the Parh Gun Club, explained the lade of sufficient time to submit a more detailed schedule. Mr. Coffin would do the survey during the first two w'eeles of October. Mr. L. Laidlaw and Mr. Earl Hanson, nei^ors to the Park dm Club, were present. Hiey felt the Park Gun Club was a good cause and they had no objectioi to the hours of operation or the noise. After some discussion, Hannah moved, McDonald seconded, to table the matrer until the October 18 meeting to allow the Park am Clih rare time to provide more detailed mfonnation regarding the survey, schedule of dates and hours, and future pl^ for some type of sound buffer. The Planning Comnission also recomnended that the shooting permit ^ extended to allow them to comply until a decision IS reached. Request Council approval of this extension. Motion - Ayes (8), Nays (0). Hake moved, Hannah seconded, to table this matter until the next meeting as applicant was not present and had not suimitted the necessary data. Indications on the sketch are that the additim would be 5* hi^r than the existing house. The Farley’s were present at the meeting. O o m The Nelson’s are requesting approval to replace their garage vhich is badly in need of repair. ffcDonald moved, Hai^ seconded, to recommend approval to replace ,5 u garage based on the feet that the new structure would be located at the same setback points and ai'*' other l^ation for this garage would require more fill. Also, this new garage would be a great improvement to the property ^ we existing structure is badly in need of repair. Motion - A>es (8), Nays (0). Jie Olson’s wre present. They are .requesting approval fcr m addition to an existing non-conforning situation. Pesek moved. Hake seconded, to approve this variance based on ^ feet that the proposed addition to the existing TOsidence would meet all setback requirements mid the Olson’s have sufficient lot area. Motion - Ayes (8),Nays (0). Coaxil previously approved a 15’ variance (#133) so an addition could be made to the existing dwelling. Mr. Jansen 2’ width for his kitchen reducing the side yard setback from the originally approved 15’ to 13’. Dunlap moved, Pesek seconded, to recommend approval of this variance to a 13’ side yard setback so the jSsen’s could build the addition as originally designed but had mis­ calculated on the dimensions. They felt there was a good possibility that four lots would have been the result. The Planning Gomnission felt that Council acted against Ordinance Section 39.200 which is as follows: *yianning Conroission Procedure. The Council requires that ail proposed subdivisions shall have the prior approval of the Planning Coomission before receiving final approval by the Council. It is, therefore, necessary that certain steps be taken and data asseal>led that will enable the Planning Coomission to stu^ the proposed subdivision in the li^t of its relation to ^e City plan for growth and development, and in the lifiht of the general topography and the character of tiie development." Hdoe moved, McDonald seconded, that Council reconsider their decision on this matter. Motion * Ayes (8), Nays (0). The Planning Commission then asked Hank Muhich to draft up a memo to the Council concerning this matter to be pre­ sented at the Council meeting of September 27. Dunlap moved, Hannah seconded, that Brad Van Nest and John Guthrie represent the Planning Commission at this Septenber 27 Council meeting. Motion - Ayes (8), Nays (0). Hannah moved, Guthrie seconded, that the minutes of the Septenber 7, 1976, meeting be approved. Motion - Ayes (8), Nays (0).
