HomeMy WebLinkAbout09-07-1976 Planning Minutesrw ■f m o o CITY OF ORDNO, MINNESOTA REGULAR PLA^fl^ING C0^MISSI0N MEETING HELD SEPTEMBER 7, 1976 The Orono Planning Conmission met on the above date with the following members present: Chairwoman Diane Dunlap, Members Brad Van Nest, John Guthrie, Gregg Hannah, Gloria McDonald, George Hosfield, C. Paul Pesek and Zoning Administrator Hank Muhich. Chaiivronian Dunlap announced that this was the time and place for a Public Hearing on the petition of Klaus Becker for a subdivision of property located at 511 North Femdale. The Zoning Administrator presented the Notice of Pid)lic Hearing and the Affadavit of Publication. Mr. Midiich stated that this subdivision was north of the Wayzata Country Club Golf Course. The proposal consists of 5 parcels with two of these lots less than the two acre ndnimuii. Lot area variances would be required on Ixot 1 and 2. Klaus Becker and his attorney, Bruce Thonqoson, were present at the meeting. Mr. Becker explained that he is in the process of purchasing this prope^ from Harold L. Holden. The nain road to this area is gravel and is maintained by the present property owners. It is their feeling that this gravel road does help to reduce speed and, therefore, there are no immediate plams to blacktop this road. Several members of the Planning Commission were concerned about the shortage of total acreage of this subdivision. The proposed 5 lots are approximately 25,000 sq. ft. short of the minimum requirement. A subdivision of 4 lots would be over the sq. ft. requirenwmt. The Planning Commission infoimed Mr. Becker that they do not want to create any substandard lots. Past experience in the Village of Orono reveals that on-site septic systems do not work properly on lots of less than 2 acres. The Zoning Administrator told the Planning Coranission that Mr. Becker had called the Village Office earlier that day to STO if there had been any negative response to this subdivision application. At that time, there had ^en none. However, later that day some menbers from Council had indicated an interest in considering adopting a policy that new subdivision meet zoning code requiremaits. Mr. Thompson asked that the Planning Comnission take their financial hardship ini'' consideration. They used the best characteristics of this land in developing this subdivision. They felt this was better than trying to do any changing around. Member Hosfield asked if someone was forced to buy this land. The answer was, no. Motion - Ayes (7), Nays (0). The Planning Conmission made the suggestion to Mr. Becker that he withdraw his original proposal and change it to subdivide this parcel into 4 lots instead of the initial 5. Mr. Becker agreed. Van Nest moved, f4d)onald seconded, to conceptu^ly approve this subdivision of 4 lots instead of the original 5 as all lots would meet minimum acreage. Motion - Ayes (7), Nays (0). Chaiiwoman Dunlap announced that this was the time and place for the continued public hearing on the petition of William Wear for a conditional use permit. The Zoning Administrator reminded the Commission that he had sent them a copy of letter that the State Highway Department had written to William Wear stating their approval of the design, location and sight distance of the two accesses to this service station. Mr. Wear presented his site plan to the Comnission showing the location of the gas pumps, ingress and egress and interior finish. In August 1972 Council i^roved the gasoline concept. Pete Rettinger and Bob Neddeimeyer were present and objected to the operation cf the gas pun^js. They felt that he was using these pumps as a leader to bring people into the shopping center. They felt it could ^rm their business and the other gas stations m the area because of the low cost Mr. Wear would be charging for his gas. Member Pesek advired Mr. Rettinger and Mr. Neddeimeyer that the Plemning Conmission cannot make any business decisions. After all the public were heard, the continued public hearing was closed at 8:30 p.m.. The Planning Commission continued to discuss this conditional use peimit. Guthrie moved, Pesek seconded, to approve this application because the property is located in a commercial zone, the letter from the Highway Department approving of the accesses to this service station and Council’s prior approval of this service station. Motion - Ayes (6), Nays (0), Abstain (1) - McDonald. Au^t corrections: O 1. 2. Onit the following sentence from report on Gray’s Bay Dam: ’The amount of water proposed to be storeis 1/16 inch.” Following comment should be added to the Hennepin County Vo-Tech item: All Planning Commission members present were opposed to the Hennepin County Vo-Tech proposal as submitted. Also present were Mr. § Mrs. Grandstand and Howard Soost. Mr. Maas stated that the days of operation during the week had been Tuesday and Thursday. This year, however, they added VXednesday to allow more hours of shooting for their 150-200 members. They are also open some Sundays for organi.zed shoots from 1-5 p.m. League shooting is finished for this year, but there are a few special turkey shoots scheduled for later this year. Da^oU was also present and expressed his dissatisfac­ tion with the hours and days of operation and the amount of noise resulting from this shooting. He felt that the activity at the Park On Club had increased this year with more days of shooting and longer hours. Mr. Grandstand stated that the Park Gun Club has been at its present location since 1951. He understands Mr. Daniel’s conplaint, but feels that only one complaint in 25 year is a good record. Van Nest moved, Hannah seconded, to table this application to allow the Park Gun Club to sumbit in writing a proposal ^dicatmg t^eir schedule of days and hours for the next 12 Hicnths and any potential things liiat could be done to O problems, such as developing some type of^ buffer. He was concerned about any future grading and the possible damage to his sewer line cover. The Zoning Administrator also mentioned that there were no irons on this property indicating lot comers. After some discussion, Pesek moved, Hannah seconded to table this variance ir order for Mr. Johnson to supply more information on the pxoposed location of the new residence and driveway, topography map showing elevation, and a survey including marking stakes at lot comers. Hank Mudiich presented a picture of the garage which Mr. Garlock would like to repair. Several neighbors were present: Hans Weiler, Mrs. Beito, Mrs. Carl and John Perkins. They all expressed their concern about the hazardous condi­ tion of this building. Their children have been playing in this area, and they were concerned about their safety. They also mentioned that he has not removed a diseased elm which has been partially cut through for sometime. Qiairwonan Dunlap was concerned about the debris that is stored up in this garage. She felt this could be a hazard to the neigW^oihoofl children. Van Nest moved, Guthrie seconded, to reccnmend approval of the variance subject to the following conditions: 1. 2. 3. 4. 5. Variance be granted to allow a new garage to replace the existing hazardous structure. Alio./ variance to front yard setback provided new structure is 2 car garage not exceeding the dimensions of 24’ X 24'. Existing structure and its contents be removed within 60 days of Council approval. Lots 9, 10, 11 be cotrbined into one parcel. Grant necessary variance so that new structure would be located no closer to front lot line than the exist­ ing garage, and the new structure be centered on the lot CO both side yard setbacks would be 8*. ^totion - Ayes (7), Nays (0). Pesek moved, Hannah seconded, to approve the final mylar as submitted upon receipt of data from Gordon Coffin confirming that the proposed split would follow high ground. Motion - Ayes (7), Nays (0). Niichel submitted a revised subdivision proposal to the Planning Commission. This revised proposal includes a new access to this subdivision \diich meets with the approval of Hennepin County. The Planning Comnission felt this was a great improvement. Pesek moved, Hannah seconded, to approve this preliminary plan based on the new access approval of the County and a conservation easement on marshland and landlocked dry land on east edge of Lot 4. Motion - Ayes (7), Nays (0). The Steward's are requesting a variance to build an addition to their existing home. They submitted a letter from their neighbor to the east stating that they had no objection to this variance. Pesek moved, Guthrie seconded, that this application become an action item and the variance be granted as submitted due to the fact that there would be no encroach­ ment to Ae east lot line as the steep grade to the east would eliminate the possibility of any future building by this neighbor. Motion - Ayes (7), Nays (0). Mr. Beno was present and explained that Ms. Allen of the Hennepin Cointy Welfare Department was in attendance and had to leave. He also explained that he and his wife have provided emergency shelter care to over 150 children most of which have b^ teenage girls. The Beno's have three children of their own and provide shelter for four foster children. They have four bedrooms in their home to accomo­ date these children. They are more than willing to have the Plaming Cormission inspect their home. The Planning Commission felt that the neighboring residents should be given the opportunity to express their views on tiiis matter and that a public heari^ should be held. Mr. Beno was quite insistent upon quicker action. He mentioned that a mother and her baby needed a home. After some discussion Van Nest moved, Pesek seconded, to schedule a public hearing for October 4, 1976, at 7:30 p.m. and that staff get legal opinion from City Attorney for the September 20, 1976, meeting. Staff would report legal direction at that time and, if necessary, the public hearing could be cancelled and action taken at the September 20 meeting. Motion - Ayes (7), Nays (0). Mr. § Mrs. Farley were present. They are requesting a variance to build an addition to their existing home. This is a work session item and Planning Commission requested that the Farley's submit a side elevation plan for the September 20, 1976, meeting.
