Paul Pesek and Zoning Administrator Hemk Muhich. John Guthrie arrived at 8:00 p.m. Chairwoman Dunlap announced that this was the time and the place for a Public Hearing on the petition of Charles Velie for a subdivision of property located at 2905 Fax Street. The Zoning Adninistrator presented the Notice of Pif>lic Hearing and the Affa^vit of Publication. James Boerhave of Bather, Ringrose, Bblsfeld and David Nitz presented a map of the proposed sidxUvision. TMs proposal is similar to the one proposed in 1974 with the exception that the outlet has been eliminated. Mr. Boerhave explained that an overflow pipe would be installed which would carry the drainage toward the sw^ in the lower area of this property. He felt that this system would take care of the runoff. Member Van Nest expressed his concern about the drainage to the south of this property. Mr. Lyman, a nei^bor, was also concern^ about the drainage. lie presented a map to the Planning Comnission of the area surrounding his property vMch would be affected by this proposal. Mr. Lynmi has been living here for 25 years. He explained that there is a natural flow of water in this area and there has been no change in the land for the past 60 years. Hay and other natural grasses soak up the water here and if there is any runoff, it is soaked up by the dense brush and trees. Mr. Lyman was interested in knowing if there would be a change in the flow of water idwi homes, driveways and tennis courts were to be built. Charles Kalstad, another concerned neighbor, mentioned the drop off down to the lake. Runoff after a rain now comes to the surface of his driveway. Another concern of his was traffic. The Planning COinnission felt that as much of this drainage as possible should be diverted to the east to eliminate any hardship to the surrounding property owners. There was some discussion as to idiether the road to this subdivision should be private or public. The proposal includes a 50* access easement for a private road. C ibke moved, Hannah seconded, to table this matter until the next meeting to allow the developer to produce revised plans for drainage to the south and east ai^ the method of drainage of the northwest corner down to the lake. Pesek moved, Guthrie seconded, that the minutes of the Planning Ccomission meeting of July 19, 1976, be approved. Motion - Ayes (8), Nays (0). Mr. Peterson explained to the Planning Gomnission that he had purdiased this property about 1 year ago. He under­ stood there were misun^rstandings, but felt that the problems had been solved. The Peterson's purchased this property in good faith. Pesek moved. Van Nest seconded, to approve this variance because it is after the fact and the pool has been there for the past three years. Pesek felt that this was not a violation by the Peterson's idio purchased the property only one year ago. They were unfortunate to inherit an existing non-confbming situation whidi was never before brought to the attention of staff. Motion - Ayes (8), Nays (0). Mr. Curtis was in attendance and presented pictures of his property. After a short discussion, McDonald moved, Pesek seconded, to grant approval of this variance because the proposed addition would be replaci^ the substandard leanto portion of the house and it would in no way encroach on the existing setbacks. Motion - Ayes (8), Nays (0). The Zonii^ Administrator presented the building plans to the Goonission. Mr. l^an was present to explain his plan for this addition. Van Nest moved, Guthrie seconded, to recommend approval subject to providing fire separations as required by the State Code and the coid>ination of all tlie ixidividual parcels and vacated street. The subject of the vacated street should be referred to the attomey to resolve its actual status. Mr. 6 Mrs. Smith were in attendance. Mrs. Smith explained to the Coamission that at the start of the construction they instructed the contractor not to disturb the trees that were on the property in order to build the house. The location of the house was then moved over to avoid removing the trees. The inspector was never informed of the change in location. Larry Shaw, a neighbor to the north of the Smith's was also present at the meeting. He expressed his dis^pointment with the building of this home. He mentioned that he conplained several times to the building inspector regarding the building location. The present location of the Smith's home bloc] of the lake. The Planning Conmission felt that the only ^- - - - - - - - - - -- blocks his view question here was the rear yard setback as the new location still met all sideyard setback requirements. Pesek moved. Hake ^ond^, approval of this variance because the house is finished. The Zoning Administrator inioxmed the Connission .and Mr. Laboysky that Mr. Norwood wdd requesi Ing fen approval of a variance of 176 sq. ft. in area to build a 42* X 26* garage. This garage would be used for storing his recreational equipnetit such as boats, casperi, snownobiles, etc. Van Nest moved, Hannah seconded, to recomnend approval on the basis there has been no com­ plaint on the proposal and all the individual parcels have been combined after having paid up all delinquent taxes* Motion - Ayes (8), Nays (0). There is no way the dimensions cah be increased. Hake moved, Pesek seconded, to approve this variance based on the fact there is no other land available and the area is seweted and has water. Motion • Ayes (8), Nays (0). Mr. Whitney is requesting approval of a variance to add to his existing residence. Van Nest moved, Hosfield seconded, to reconne^ approval in view of the fa^ that this house alrea^ exists on a non-standard lot and the proposed addition would not result in any encroachment of the exist­ ing setbacks. Motion - Ayes (8), Nays (0). The Planning Connission scheduled a Public Hearing for September 7, 1976, at 7:30 p.m. to. Richards was present and explained to the Connission that he was planning to remodel his kitchen and add a second story over that part of his house. Van Nest moved, McDonald ^conded, to recommend approval of this variance for lot size and width for this action inasmuch as it is consistent with the nei^ibors and on the condition that no additional variances will be required. Shaw explained to the Planning Comnission that he received a building peimit for his garage about three years ago. and at that time felt the garage was being built within the required setbacks. Hake moved, Pesek seconded, to recommend approval based on the feet rhat it was built throe years ago with the understanding that the location met all setback requirements. Motion - Ayes (8), Nays (0).
