REGULAR RLANONG OMaSSION ICBTING HELD JULY 19, 1976
Hie Omio Planning Gcmdssion met on the above date with
the following mmd>ers present: Chaixwoman Hiane Dunlap,
Meot>ers George Hosfield, Join Guthrie, Gregg HEonah,
Gloria McDonald, C. Paul Pesek and Zoning Administrator
Hank Mdiich.
Chairwoman Oinliq[> omounced that this was the time and
place for a Pii>lic Hearing on the petition of Robert Wyatt
f6r a sii)division of property located at 4220 Watertown
Road. The Zoning Adunistrator presented the Notice of
Ptd>lic Hearing am the Affadavit of Publication.
The Wyatt's are requesting a sid)division of their 9.49
acres into 2 parcels. They are also requesting a
Conditional Use Permit to move in another house and
garage onto the south lot Wiich is already occupied by a
residence. Mr. wyatt would like a period of 18 months to
remove the existing residence. He explained to the
CcHidssion that his mother had died recently, and
because he works and is a student he does not have the
time to reapve her belongings before this time.
Qiairwoemn Dunlap called to order the Regular Meeting of
the Orono Planning Gcamdssion.
Hannah moved, Guthrie seconded, that the minutes of the
Planning CoaiBission meeting of June 21, 1976, be qiproved.
Notion - Ayes (6) - Nays (0).
Guthrie moved, Hosfield seconded, that tiie Planning
Goaadssion recoamiend to the Council approval of this
subdivision nd to grant the 18 months needed to remove
the existing residence. The Zoning Adtadnistrator
I iJiatmentioned that this would be sii>ject to the Park
Dedication Fee. Motion - Ayes (6) - Nays (0).
The Zoning dnistrator presented the hardshell to
Hannah moved, Pesek seconded, tothe Commissii
recommend approval of this final plat subject to the
Park Dedication Fee. Motion - Ayes (6), Nays (0).
The Zoning Administrator presented the nylar to the
Coandssion. Pesdc moved, Gutiirie seconded, to recomnend
approval of the final plat sii>ject to the Park Dedica*
tion Fee. This approvid does not constitute approval
of the proposed Piw developnent as the necessary plans
and data have not as yet been submitted for review.

Hank Mihich stated that a meeting had been held earlier today
at the Village Offices between John Holnquist of the Minnehaha
Creek Watershed District; Rod Hillstrom, l^^an Construction;
Rick Sathre, City Engineer; Dick Benson and Hank MJiich. The
Minnehaha Creek YiKatershed District was concerned that the
proposed grading and drainage plan could result in hi^er rate
and lower quality nnoff than now exists. At tiiis meeting, it
was agreed tl^t a french drain system would eliminate this
problem. This system would consist of digging 4-5' trendies
and adding a layer of 3" rode throu^ the lower area under
the surface grating. Quality would be controlled by grading
down to a finer material bf going into the storm sewer.
Rod Hillstrom and Frank Zelley of I^an Construction were
present at the meeting. They submitted a statement regarding
fulfilling M.C.W.D. requirements for the rate and quality of
runoff. They will work with this system and submit for
approval. Hillstrom informed the Conmission that there would
be some water retention on the roof, but only for a short
period of time.
Pesdc moved, Guthrie seconded, to approve site plan and
elevation based on the stipulation that it satisfies the
Minnehdia Creek Watershed District and our city engineer
as an adequate filter system. Dmlap suggested that any
erosion problems be corrected as they come up. The Zoning
Administrator informed Ifyan Construction and the Coamission
that the unpaid sewer and water unit charges assessed against
the property would have to be paid before the building permit
is issued.
John Lanbin, contractor, and George Hanson were present.
Lambin presented the plans to the Coamission for the con
struction of a new home. They pleaded hardship to the
land because of an approximate 25* drop. There was some
discussion regarding moving the street. Dunlap moved,
Pesek seconded, to approve this variance subject to
changes in the plan vdiereby the two remaining substandard
parcels would be eliminated. TVx> alternative suggestions
were made:
(1) Move location of inplatted street and conbine all
three parcels, or
(2) Grant to the City a conservation easement over the
two substandard lots.
Motion - Ayes (6), Nays (0).
The Zoning Aiiministrator informed tiie Comnission that
because of the cancellation of the July 6th meeting, he
had conducted a telephone poll of the Council and
Conmission Menbers to get the necessary approval of
this variance. Guthrie moved, Hannah seconded, confirm
ing the telephone poll idiich was taken last week by
Hank Mibich and approving the request for variance.

It was detexmined the best solution was to install a
nu^cip^ s^r sys^ in the area. After eliminating
this pollution problem, the CoincU agreed this district
could be rezoned to LR-IB (1 acre) residential.
The Party’s were reminded of the Paric Dedication Fee
subdivisions. Ihey were also infbimed that
charge of fi?jproximately $3,800
ISS against the property as only two units
on the property on the original assessment
role. This actional unit diarge would have to be paid
subdivision, along with the
tok Dedicatim Fee. The City could not afford the time
and expense of adopting a new assessment role. After
leanOng of this, the Parten's requested we withdraw the
original prqpos^ and change it by eliminating the third
lot on the southeast corner of the property.

August 16, 1976, at 7:30 p.m. ^

that his plans were not canplete, and the Coamission
infoxmed him that they would have to be complete and
conrot by Friday, July 23, in order for the Planning
Comnission to be able to review before acting on ^e
proposal at their next meeting.

$30 applicatim fee be returned. Hank recomnended the

Council *s original referral of Planning Gonmission
proposals in oirder to expedite the proceedings.
The Commission feels this would promote better
public relations. Motion - Ayes (6), Nays (0).
Steve folsenberg of the David C. Bell Company was present
and asked the Commission if he could discuss sometning
that was not on the agenda. He informed the Planning
Commission that Drs. Zinn and Dale owned 13 acres of land
near Watertown Road and County Road 6. He was interested
in knowing how they could subdivide this property. After
some discussion, the Planning Comnission advised that he
could submit a subdivision applicaticm for 2 lots of 5+
acres.
Hosfield moved, Guthrie seconded, that the meeting be
adjourned at 9:55 p.m.
