REGULAR PLANNING GOMUSSION fCETING HELD MAJf 17, 1976
Ihe Or6no Planning Conmission met on the above date with
the following raerabers present: Chaitman C. Paul Pesek,
members Gloria McDonald, Brad Van Nest, John Guthrie, Gregg
Hannah, and Zoning Administrator Henry Muhich. Absent:
George Hosfield, Diane Dullap, John Hake, and Eugene
Wcoley.
Ihe City Council convened siimilthneously to qp^ the Piiblic
Hearing in regards to the proposed Ring Route in Orono at
7:30 P.M. Mayor Searles called to order the two public
hearings as per pid>lication: 1) the Riiig Route proposal,
and 2) the consideration of a Multiple-Family Zoning Ordi
nance.
Ihe Public Hearing on the consideration of adopting a Multi-
Family Zoning Ordnance was temporarily defend until the
Public Hearing regarding the Ring Route was concluded. The
Public Hearing on the Ring Route was concluded at 9:00 P.M.
The Planning Conmission reconvened and Chairman Pesek com
menced with the Public Hearing with regard to a Multiple-
Family Zoning Ordinance at 9:05 P.M. The Zoning Administr
tor produced the Affidavit of Publication.
O Irs. Schroeder, who was in attendance, expressed an interest
as to whether any provisions were made to include low and
moderate income housing. Attention was directed to these
provisions with vbich she concurred were adequate.
Mr. Roberts suggested a change in the maximum percentage of
two family structures in multiple zones. He recoomend^ a
change from 201 maximum to an 80% maxinun.
The Planning Commission felt more review would be necessary
before any changes to the proposed draft cxxild be agreed
upon. They were concerned d)out any possible ccmflict with
our Compr^iensive Plan or our original intent with regard to
adopting a Multi-Family Zoning Ordinance. After all comments
were discussed and considered the Public Hearing was closed
at 9:25 P.M.
In order the expedite the issue Pesek moved, Guthrie seconded
the Planning Conmission reconmend adoption of the Multi-
Family Ordinance, subject to obtaining a statement from John
Bergley of Wurman Chapman Associates as to any impact ai^
change in duplex percentage might have on our Comprehensive
Plan or original intent of the ordinance. Motion, Ayes (5) -
Nays (0).

Von Nest moved, Hannah secxmded that the minutes of the
Planning Conmission Meeting held May 3, 1976 be approved

proposal fbr a sidxlivision for Rezoning and Conditional
Use Pennit applications for a PRO and duplex credit on
parcel for structures within 200* of comiercially zon^
district. A copy of the deed conveying the subject
property, revised plans and aerial photos of the area
were presented. Ine Gondssion discussed resolving of
maintenance responsibility and lack of adequate detail for
obtaining conclusive approval of the PRD proposal.
Van Nest moved, Hannah seconded racoanending conceptual
approval for 3 single family uiits on the PRD parcel (1}
Since this particular parcel is presently ocoq;>ied by ^
living units consisting of the existing duplex, only one
additional single family mit could be addM until sudi
time that the existing duplexes were removed from the
property. Motion, Ayes (S) • Nays (0).
The Goandssion continued with a discussion on the duplex
credit proposal. The question was raised as to the conflict
between the ordinance provisions for duplex credit and H
lakeshore setback for multiple construction.

Pesek moved, Guthrie seconded to recommend approv.il of
duplex credit in lieu of the single fmiiily units or the
proposal. Mr. Pesdc expressed the presence of deliv-
^^^^ery ti^j^ks, garbagage trucks, garbage dunpsters, damaged
autos for repur, etc. would create a nuisance and result
in a dmir.uition of value of the residentially zoned
district. He also stated tiiat the duplexes would pro
vide an appropriate buffer zone from the existing single
family residences to the south and therefore justify a
ruplex credit. The recommendation for approval was
made with the following conditions:
1) Maximum boat docUng - 2 boats per living mit
or 4 boats per duplex.
All 3 duplex units to be located within 200 feet
of the oonmercially zoned district.
The 3rd duplex unit would not be erected until the
existing diplex on the property was removed.

Van Nest moved, Guthrie seconded recommending approval of
rezoning of the 20* strip along north end of the property
from B-3 to LR-IB. Motion, Ayes (5) - Nays (0).
After reviewing Mr. Sweetser*s revised subdivision pro>
posal which included individual parcels for the existing
two dwelling units, Guthrie moved, Hannah seconded rerom-
^^jnandation fbr approval of the preliminary plans of the
V,_jubdivision proposal. Motion, Ayes (S) - Nays (0).
Mr. Roessel presented his proposal for a Conditional Use
Permit to keep horses in a residential zone and Variances
from the code requirements of principal structure fbr

the Conditional Use Pendt to keep horses on the property
as the proposal does not conflict with concepts set forth
in our Land Use Plan and to approve the variance for the
accessory building (bam) withwrt: a main structure as
this parcel is directly across from Roessel*s existing
residence with fiiture plans of building a new residence
on this same lot. Also to approve the variance from the
lot line setback requirenent as the proposed location
w^d meet all miniman setbacks from adjoining proper
ties and Watertown Road would provide adequate setback
from the property across the street. Motion, Ayes (5) -
Nays (0).
Mr. Lani^in presented his new plans for the Burger King
proposal, these included an approach from Coixity Road
#19 located north of the power pole throush an agreement
with the church. The following changes were noted on the
new plans:
1) Ingress and egress from County Road #19.
Ingress only from Ccwty Road #15.
Moving the northeast property line toward the south
west to the top of the high ground to permit rezon-
ing of the lower elevations from B-1 to LR-IC.
No filling of low areas.
60 paricing spaces.

Utilizing of vacated Navarre Lane as part of ap-
proadi and church parking.

Brad Van Nest informed the CoiRdssion that he had attended
a recent Minnetonka Beadi Council Meeting with regard to
their view on this request. They showed soaie concern about
traffic generation, lighting and litter along Lafayette ^y
and possible grease pr^lems.
Mr. Lanhin explained he had removed the drive-in, take-out
con^t of the estd>lishment to minimize the litter possi
bility and that grease was not a major problem with Burger
King as most of the service is done on throw-away dishes.
Pesek moved, Guthrie seconded to recoainend conceptual ap
proval subject to adequate landscaping from residential
areas in Minnetonka Beadi and Orono, resolving grease ques
tions through referral to City Engineer, ingress and egress
approach from County Road #19 to be located north of the
power pole, ingress only from County Road #15, and moving
the zoning line and property line to the southwest. Motion,
Ayes (3) • Nays (2) Van Nest and McDonald.
V^^ter approval of the concept Mr. Gene Block voiced some
objection because of the possibility of consimer traffic
throu^ the residential streets.

Nest moved, Guthrie seconded to recaamend iqpproval of

Use Plan, subject to obtaining written approval from the

Mr. Vickeiman presented his proposal to grade a narrow
strip from the high enhahknent for access to the Idee and
a Conditional Use Pendt and Variance for removal of 11
trees within the 7S' dioreline setback.
Van Nest moved, McDonald seconded to reconnend approval of
the variance for access to the lake, providing it does not
eoctend any further than what is absolutely necessary for a
reasond)le grade to construct a stairway of ties (not rail
road iiqnreffia^ed type) filled with gravel. Mr. Vickeiman
was also instructed to replace the 11 trees removed with 11
new trees with diameter of IV to 2h" and add the evergreens
as shown on the plan. Motion, Ayes (S) - Nays (0).
The Planning Comaission scheduled a Pihlic Hearing for 7:30
P.M. Juie 21, 1976.

the final plat on condition an access easeannt is granted
across Lot 1 to Lot 2 and subject to payment of the Paik
Dedication Fee. Notion, Ayes (5) - Nays (0).
Hannah moved, Pesek seconded to recoanend approval of the
fianl plat sthject to payment of the Paik Dedication Fee
and conplianoe with all coiaity reccBnendations listed in
the letter of April 29, 1976, idiich indues dedication of
an additional 10 feet.of ri^t-of-way along Couity Road #6.
Motion, Ayes (5) - Nays (0).
The SidMells aroeaxed to discuss their subdivision proposal

Mr. Hagen requested reconsideration of his grading proposal

the entire shoreline to prevent fiirmr erosion. Properly
