Hake moved, Guthrie seconded, that the minutes of the Planning Conmission Meeting of ^^arch 1, 1976, be approved as amended. Motion, Ayes (6) - Nays (0). Member Dunlap arrived in time for the next ^scussion. APPROVAL OF MINUTES MEETING OF 3/1/76 f « !l The Zoning Administrator reviewed the variance applicatyjn of David J. Kruskopf and called attention to a non-conforming situation on the neighboring property vJiere a house had been constructed so close to the property line that it did not even meet State setback requirements. This non-conforming situation resulted from construction years ago vhen surveys were not re­ quired when building peimits were issued. At the Planning Can- mission's direction, a letter had been sent to Mr. Kruskopf re­ questing that he, by private, negotiations, come to an agreement with his nei^ibor, Gaty Welsh, on an adjustment of the property line. Mr. Kruskopf then presented a map to show a revised line that would give Mr. Welsh 10 feet and both parties stated that l^**the plan wo^d be satisfactory to them. However, Mr. Kruskopf ^"Kiould have to alter his building plan by making a slight rota­ tion of the house on the lot. In addition to tJie change in the lot line, variances of 50 ft. on lot width, .3 of an acre on lot area and a 6" variance on the side setback on the north lot line, were necessary. Woolley moved. Hake seccndeu^ that the Planning Coranission recommend to the Council approval of the three variance^ and the lot line rearrangement request of David Kruskopf for 1200 Wildhurst Trail as presented in his revised application. Motion, Ayes (7) - Nays (0). Member McDonald arrived in time for the next discussion. DAVID J. The new plan showed the ALLgf VA^TIC^ q Lantto and Doubldee tracts as consisting of .50 and .58 acres, suBDlvibiuis including the alley vacation. Mr. Johnson stated that Lots 161 and 162 were to be sold to Mr. Gerald Haley and presented the followir«» letters for the Commission's consideration: a; (Dated March 9, 1976) In regards to the Lots 160, 161, 162, Winship Siib. Casco Pt. Rd. and Maple Avenue, I, Gerald S. Haley assume the responsibility of malcing a road to the above lots. I will assume all costs necessary to build a proper oad, but only to the above lots. However, the only condi- ion would be if I was to acquire lot 160 for a reasonable amount. (Signed) Gerald S. Haley. MINUTES OF A PLANNING OCMUSSION MEETING HELD MAR(3I 15, 1976 - PAGE 2. Mr. Johnson stated that Mr. Haley had received a verbal com­ mitment, from Jack Corl idio has been out of tow, to purchase Lot 160 and it was Mr. Haley’s intent to use the three lots as one building site. Johnson would keep for himself one site which would include part of Lot 72, part of Lot 75, all of 76, part of Lot 77, all of Lot 163 and his portion of the vacated alley. He stated that they planned to Torrens the entire pro­ posal. Van Nest moved. Hake seconded, that the Planning Com­ mission recomnend to the Council approval of the 18 foot alley vacation but that it be sold at fair market value to the peti­ tioners and that the market value be detemined by the City Assessor in con"’unction with the City Administrator and legal staff and that Mr. Johnson codeine into one site part of Lot 72, part of Lot 75, Lot 76, the Easterly part of Lot 77, Lot 163 and part of the vacated alley and that the subdivision be in the foim of a Registered Land Survey and subject to a Park Dedication Fee. Nbticn, Ayes (8) - Nays (0). Waii The CommissiQn again reviewed the ^f^C Bus Step in the Navarre MFC BUS STOP - NAVARRE area. Van Nest explained that the Super Valie Stores v/ere cemed about the situation beca^jse of their need for the aiking spaces in front of the new store, where presently ooDinuters were leaving their cars all day while they went to town. The Commission reviewed their proposaJ concerning a bus stop shelter in the Municipal Parking Lot. The bus would have to reroute by going down Shadywood one block to Lyric Avenue for pickup of passengers in the lot. Dunlap called attention to a seldom used play ground and expressed concern about back­ ing of busses and possible hazard to youngsters using the faci­ lities. It was noted that the play area was fenced a.id thought to be far enough av/ay from the probable bus route area. It was also felt that there would be no need to have to back the busses. Pesek suggested the area by the Good Shepherd Church and thought that a shelter could be built by the roadside. Van Nest suggested that the north side of the Municipal Parking Lot be designated as a ’’Park and Ride Area" and that the existing bus stop remain fixed. Woolley moved, Guthrie seconded, that the Planning Conmission recomnend to the Council that their first preference for a new bus stop in the Navarre area was the Mmicipal Parking Lot with alternatives being the Good Sliepherd Church area or the designation of a ’Tark and Ride Area" loca­ ted on the north side of the Municipal Parking Lot leaving the present route status quo. ffotion. Ayes (8) - Nays (0). The Planning Commission requested that John Lamhin appear at C**^e woik session review of his petition to erect a Burger King staurant at 3340 Shoreline Drive. They also instructed the Zoning Administrator to inform Itr, Lambin that the Plarning Conmission would be favorable toward considering the proposal if the service station were to be removed before tlie Burger King would go into operation.
