Hake. Menfcers Hann^, Noolley, Dunlap, McDonald and Pesek. (Dunlap arrivii late) Assistant Zoning Administrator, Rosalie DeGrauwe. Absent: Members Guthrie and Van Nest. ATTENDANCE - 7:32 P.M. CITY HALL Hannah moved, McDonald seconded, that the Minutes of the Plan ning Commission Meeting held Decenber 2, 1975, be approved as amended. Motion, Ayes (5) - Nays (0). APPROVAL OF MINUTES MEETING OF 12/2/75 Hannah moved, Woolley STOon^, that Paul Pesek be appointed as Planning Commission Chairman for a six month period ending June 30, 1976. Motion, Ayes (6) - Nays (0). APPOINIMENT - CHAIRMAN PLANNING CCmSSIO^ JfcDonald moved. Hake seconded, that Plane Dunlap be appointed Vice-Qiaiiman of the Planning Cornidssicn for a six month period ending June 30, 1976. Motion. Ayes (6) - Navs fOl. APPOINTMENT - VICE-CHAIRMAN PLANNING (EMISSION Denm.s Ulmer, representing the Ulmer Construction Company in their application for a subdivision, rescinded his previous Toposal to divide the 70 and 190 Willow Drive tract into ree parcels. Instead, he proposed that the tract be divided to two 3.165 acre lots. Hake moved, Vfoolley seconded, that the Plaraiug (}omnission reconmend to the Council approval of the division of the Ulmer Gonstniction (jon^any property ijjfco two ecmal parts and that the Park Dedication Fee be based on the forthcoming fee amendments. Nelson appeared and made his request for a variance of 1 1/2 ft. frcm the required 10 ft. side yard setback require ments in order to constnict a 16* x 40* addition to his house. After review of the survey submitted by the applicant, McDonald movea. Hake seconded, that the Planning Comnission recommend to the CkTuncil approval of the variance as submitted by Thomas Nelson for an addition to his home at 3245 Caiman Road b^ause it was simply a reasonable proposal. VARIANCE 8 RIP RAP The Conmission reviewed a letter from Jay Becker of 3145 North Shore Drive regarding the variance requests of Fred Rogers, Jr. Qr his lot at 1410 Bohns Point Road. Mr. Becker asked that he N;® infoimed of any variance at the property and that the Plan ning Cbmnission not overlook the hazardous condition at the site because of the remains of an old cottage foundation having open spots into vbich a person could fall and be injured. The Coninission directed that a copy of the Becker letter be siib- mitted to the City Council. Hake moved, Pesek seconded, that ^fr. Fox be informed that because of the applicant's lack of representation and because the hazardous conditions at the pro perty site had not been corrected the petition be tabled. Motion, Ayes (6) - Nays (0). H^e moved, Pesek seconded, that the variance application of Vincent Johnson be tabled due to lack of representation at the meeting. Motion, Ayes (6) - Nays (0). WU Q: Jerry's Construction Conpany, representing Odd Rovick, pre sented a fill and drainage plan for the property at 1055 Fem- dale Road West. The plan included svredes in the front yard area to divert drainage away from the lake. A retaining wall in the back lot area was included, for the purpose of diverting drainage across the road, into a natural poking area on the other side of the street, instead of it flowing into the ad jacent low area of a nei^iboring property. The men stated that 35 truck loads of fill would be needra on the vhole site of i*ich 5 tiudc loads would be needed within the 75 ft. lake- ore setback in order to mate a 25 ft. taper from the house. ey also noted that there used to be five cabins at the site and \dien they were taken down the natural drainage was des troyed. The Coninission felt that the retaining wall could be the means of blodcing a natural ponding area. McDonald moved, Woolley seconded, that the Planning Coninission recom mend to the Council approval of the fill and drainage plan of Odd Rovick with the following stipulations: (1) That the plan allow only the noxmal fill and grading requir^ for the house plan previously presented to the City. (2) Only natural fill materials be allowed in the house construction. (3) That the City Engineer approve the plan (4) That the retsdning wall be taken out of the plan and the area left in it's natural state.if the Engineer deemed this necessary. Motion, Ayes (6) - Nays (0). IXnlap moved, Pesek seconded, tiiat the variance application of Doug Heinsch be tabled due to lack of representation and asked that the applicant qipear at a forthcoming meeting to discuss the reason for the variance and the consideration of possible alternatives that would comply with City codes. Motion, Ayes (6) - Nays (0). The Planning Coninission directed that a Public Hearing be held Februaiy 2, 1976, at 7:30 P.M. in the Orono City Hall on the Hildur P. Hollander for subdivision of her pro perty at 345 Spring Hill Road.
