SUBJECT: #444 - Road Vacation
Hennepin County Park Reserve District - Big Island
This application is made to vacate all of the public roads in an
area of the west island which is now owned by the Park Reserve.
The area is platted into ten (10) separated lots which are divided
by the subject roads. The Park Reserve's intentions are to have
the roads vacated to permit combination of the lots into one
buildable/saleable loti
In the past, Orono has declined to vacate any public property on
the island pursuant to Resolution #446 calling for eventual public
ownership. This application appears to be contrary to this intent
with the Park District actvially divesting itself of land. Their
intention appears to be a land trade between this parcel and another
unidentified parcel on the west island. Perhaps a "trade" of access
should be considered to justify any vacation.I
As to the buildability of this "lot" after vacation, there is a
small area of wetlands along the inlet but the remaining area would
exceed two acres. Septic testing would be required prior to any
building permit application.

As you know, the Hennepin County Park Reserve District currently owns
a parcel of land located on the west Island of Big Island on Lake
Minnetonka described as Lots I - 10 inclusive of Kate B. Plummer
Subdivision, of Lot 2 Ketchcl's Subdivision of Government Lots 5 and
6, Section 22, Township 117, Range 23, City of Orono, Hennepin County,
Minnesota.
Enclosed Is a half section map identifying the above-described
property.
On March 8, 1978, the District's Board of Commissioners established
boundaries for Big Island Regional Park. The proposed park will be
located entirely on the eastern island. At the same time, tlie
District's Board of Commissioners declared the existing land holding
on the western island as surplus and authorized the Superintendent to
petition the District Court for approval to sell this property. District
Court approval has been obtained and we are proceeding to put together
a transaction for the sale of this property. The sale of this parcel
is tied directly to the District's purchase of a parcel located within
the park acquisition boundaries.
In order to combine Lots 1 through 10 of Kate B. Plummer Subdivision
into a single marketable building site, the District hereby requests
the City of Orono to vacate the platted roadswithin the subdivision.
Enclosed is a completed land use application form, a map depicting
the plat, a certified property owners list of owners within 300 feet,
a petition of concurrence from the abutting land owner and stamped
pre-addressed envelopes.
We hope to be able to proceed with this vacation at your earliest
convenience in order to meet a property closing date of on or before
October i, 1978.

Dear Dick:
A short time ago, I spoke to you regarding the waiver of the
City's application fee for processing the District's request
ror vacation of roads within Kate B. Plummer's Subdivision
located on the west Island, Big Island. As you know, this
property was purchased by the District a few years ago when
the intention was to eventually acquire the entire Big Island
area as a regional park.
On March 8, 1978, the District's Board of Commissioners
officially established boundaries for Big Island Regional Park.
These boundaries were established after considerable discussion
and review, including a joint public InfonnatPon meeting held
with the City of Orono in February of 1978. The proposed park
will be located entirely on the eastern Island. Since the parcel
located on the western island was no longer within the proposed
boundary, the Board declared this land surplus and authorized the
Superintendent to-petition District Court for approval to sell
this property.
Subsequently, an acquisition was negotiated whereby the District
would trade its ownership on the west island for property located
within the proposed park boundary on the east Island. Included In
this negotiation was the stipulation that the District would attempt
to have the roads vacated on the surplus property located on the
west island.
The District Board feels that in view of the heavy expenditures
the District is making to acquire parkland on Big Island that Orono
could show Its interest in this project by waiving the fee.

Variances & Conditional Use Permit (Revised Plan)
The second plan submitted by Mr. Noble Is basically the same as
the original submittal minus the excess paving. The house and
pool remain the same. The house has been turned around so that
the garage is now on the east side of lot allowing for a more
efficient entrance with less paving.
The holding tank and well must be relocated because both fall
within the Flood Fringe Area. In relocating the well, consideration
must be given to the location of neighbor's septic dralnfleld to
the east. The applicant should consult with staff's septic inspector
before locating the new sight.
Staff would recommend against the hardcover violation of 75' lakeshore
setback in favor of moving the house further north. We would prefer
granting a variance from the 26' wetland setback than waiver on the
75' lakeshore setback.

Mr. Loughlin requests a front yard setback variance for a proposed
addition to his home. The addition involves adding an additional
stall to the garage and a study to the west side of the existing
house, "niere exists now a 29.31'setback at the northeast corner,

The development conteuqilates that the occupants of the Individual structures
would own the bricks and mortar comprising their structure, but would lease
from the Wayzata Country Club, l.e., the owner of the property the common
space and underlying property and by the terms of the lease the Wayzata Country
Club would maintain the common space, the Ingress egress road and sewer lines
and water lines to the anmlclpal system.
It Is suggested that because of the unique nature of the property and the
fact that clustering of the units and the use of common walls would be produce
a more aesthetically pleasing and envlommentally sound structure, that the
necessary variances from the existing zoning laws of the City of Orono could
be granted under contractural rezoning so as not to create any precedent for
future development.
Tour preliminary views are solicited prior to submission of formal plans because
of the enormous expense associated with the development of preliminary plans.
Any questions that the City or the Council has concerning this development would be
cooperatively answered on request.

SKETCH PLAN REVIEW
Mr. Scott, the developer of the Longview plat, proposes subdividing
a four acre lot (Lot 2, Block 1, Tongview) into two lots. Both lots
meet the zoning requirements for the RR-IB District. 1 have checked
the files on the original Longview plat (#270) and find Mr. Scott
has fulfilled all items sited in the final resolution. There was
nothing in the records that would prohibit the platting of Lot 2,
Block 1.
Please review the septic Inspector's comments regarding the septic
reports submitted with the application. Staff would appreciate
a recommendation concerning this matter.

Soil testing data for this s .* division has been reviewed. Orono
code requirements for testing have not been totally met. Three
(3) borings per lot are required to show the depth to existing
and seasonal water table. Only one boring was taken per lot, and
in both cases data shows the water table at a 10* depth; the boring
logs Indicate no soil mottling; and my Inspection on November !6, 1978
revealed water table at a depth of 3'*6" on lot 1 and 9* on lot 2.
Additional borings showing depth to mottling will be required.
Orono soli testing requirements and methods are enumerated on the
subdivision application forms. The applicant has only to read the
Information contained therein to find out what Is required.

SKETCH PLAN REVIEW
Mr. Olson has submitted an application for a ^o lot subdivision
originally submitted and approved by Council (May 28, 1974) by
Harold Anderson, 4665 Bayside Road. The original application
was never finalized because Mr. Anderson did not complete specific
obligations to the City.
The two lot subdivision now involves a 1.9 acre lot and a 17.3 ®cre
lot. Mr. Olson requests an area variance for the 1.9 acre lot and
a setback variance for the pole bam. Hardships following code
requirements to the letter would result in an unusual and odd shaped
lot. The pole bam is 8' from Anderson's south property line (IW
required for a bam - 10' required for an accessory building). The
pole bam is 2,400 s.f., the State Building Code Requires 10 setback
from the lot line or the building must be structurally altered to
meet code. A one hour fire wall is required and all openings within
the wall enclosed. The lot line could be moved 2 to the north along
building line and a compensatory southern shift in line could give
the necessary two acres. The septic inspector will inspect the
existing systems. Park fee to be determined.

Mr. Anderson was in my office recently inquiring why his plat was denied recording
at the County. I explained to him that when I received the County*s request to
confim the subdivision approval, I found he had never paid his Park Dedication
Fee so I informed the County that all conditions were not met for plat aj^roval.
In reviewing his plat, I discovered several irregularities:
1. The split of 10 acres into 2 sites in a 2-acre zone - one of the
lots does not meet the 2 acres.
2. No final plat on record.
3. The bade 8 acres appears landlocked.
4. Accessory building (pole bam) on large lot without main
structure.
5. Bam does not meet required ISO* lot line setback.
6. No Park Dedication Fee paid. .
When I found this I suggested he submit a new plan. He was quite tq>set and refused,
so I took the material to the Planning Cormission for reconanendation to Council for
some direction. The Planning Comnission reconmended this proposal be resubmitted.
I'm enclosing copies of the Planning Conroission and Council ininutes from 1973 and
1974 when this prcq;)Osal was originally made.
COUNCIL MEETINS - April 27, 1977
Directed Staff to inform Mr. Anderson to resubmit subdivision application. New
proposal must meet zoning requirements and eliminate landlocked area tc the rear.
Current park dedication fee and ^jplication fee.

Mayor Brad Van Nest noted that these structures
would require a variance, as well as a building
permit in that this would create more than one
permanent structure on one lot, again, expanding
storage areas at marinas which would seem to be
unreasonable. Mayor Van Nest concluded that there
appears to be many questions that remain unanswere
and staff will require additional time to research
all the information required to justify Mr. Hork*s
request.
Mayor Van Nest moved, Welsh seconded, to table
the request of the North Shore Marina for a
structure with boat racks until the
May 9, 1977 Council meeting. Motion, Ayes <3) -

Mr. George Johnson, 835 Partenwood Road, addressed
the City Council stating that there are some
concerns that the Council should address themselves

temporary construction.
If the City of Orono should allow Mr. Hork
to install the racks, the City is inviting
a lawsuit.
Mr. George Johnson felt that there was much public
concern in allowing the marinas to expand their
operation at this time.

waive special assessments, until the Council

There was some discussion to consider denying any duck
pond proposals. The Planning Comission felt that
removal of aquatic vegetation in any marsh area would
destroy the filtration of storm water provided by
marshes.
The CcHnmission considered setting up standards and
clarification of parks. The Conmission determined that
(parks) as a permitted use in residential districts
is too broad a term. Ordinance should be amended.
After a brief discussion, the Cccinission determined this
was definitely a commercial operation, and there are
commercial zones for an operation such as this in Orono.
Hannah moved, Dunlap seconded, to recommend against
amending the ordinance for dog boarding or kennels in
any residential zone. Motion - Ayes (5), Nays (0).
Menber Dunlap submitted her comnents to the Zoning
Administrator. Other members stated that their comments
would be forwarded soon.
Richard TiJthill and Richard Hassel presented a preliminary
plan and model of the 21 unit PRD concept over 21 acres
of land in Minnetonica Beach and Orono. This location is
north of County Road #15 and east of the Texaco Station
at the intersection of County Road #19 and #15. The
proposed density would not exceed the zoning requirements.
The preliminary model indicated that there would be
approximately 3-5 inits in Orono.
The ^jplicants presented the proposal in order to get
some direction from the Planning Commission, Other
than determining the actual location of the structures,
the Coninission indicated general approval of the concept.
The proposal would require platting, detailed plans for
PRD approval and joint agreement with the City of
Minnetonka Beach.

Fred Curtis moved, Paul Pesek seconded, that the Minutes of t
April 15, 1974, Planning Commission meeting be approved. Ayes
Nays (0).
Chairman VanNest opened the Public Hearing at 7:42 P.M. regard
ing a subdivision of 2 acres off from a 10 acre tract legally
described as Plat 41560, Parcel 1412. The Zoning Administrator
presented the Notice of Public Hearing, the Certificate of Hall'
Ing, and the Affidavit of Publication.
The Planning Commission agreed that a simple subdivision with a
variance for the setback of the barn and for a 1.9 acre lot Is
justified and all future property owners will buy the property
with full knowledge of the location of this barn. If Hr. Ander
son were to comply with the strict letter of the law, he would
create a lot with an unusual and undesirable shape. After all
persons were afforded an opportunity to be heard, the Public
Hearing was closed at 7:45 P.M.
Kullberg moved, Curtis seconded, that the simple subdivision
with a variance for allowing a 1.9 acre lot and a variance from
required 150* setback fc>* a stable be granted conditioned

Chairman VanNest opened the Public Hearing at 7:45 P.M. for the

The Zoning Administrator explained to the Planning Commission
that the staff felt that it was essential that a public right-
of-way be provided to the proposed 2.5 acre parcel, and that
the narrow strip of land which provides lake access should be

It was the opinion of the Planning Commission
members that minimum lot size in areas that do
not have public utilities will not be more than
two acres per lot. In addition, it was felt
that the ISO* setback for stables did not apnly
in this situation. The interpretation was that
the 150’ setback requirement was passed^ to prevent
one property owner from infringing on t«ie rights
of another, and not to limit someone from dividing
their property when the setback is acceptable to
all affected property owners.

The Freshwater Biological Research Foiindation has submitted the
final report conducted by the Gray Freshwater Biological Institute
concerning the monitoring of water qxiality during the West Shore
Lafayette Bay dredging project. The enclosed letter states that
the project is complete, the required leveling and seeding has
been done. The City hold a letter of credit for $3,000 that the
foundation requests be released.
Staff inspected the site on Noveirf>er 7, 1973. We found the leveling
to be satisfactory, but it was inq>ossible to determine whether the
required seeding had been done. The DNR permit had required mulching
along with the reseeding, but we found no sign o." mulching.

Our recommendation would be to hold off on the release of the letter
of credit until spring. At this point, an adequate determination
cannot be made of the original reseeding or if additional seeding
may be required.
COUNCIL MEETING - NOVEMBER 14, 1978
Council reviewed the FWBI report and commented on the grading.
Council took no action to release the letter of credit preferring
to wait until formal written request for release is received and
until the required reseeding proves to be acceptable next spring.

West Shore Lafayette Bay Dredging Project
From July 7th to August 29th a dredging project was monitored on the
West shoreJ.ine of Lafayette Bay, Lake Miinetonka. Approximately 16,000
cubic yavda of silt was dredged from the existing boat channel using a
suction dredging technique operated by Dewey Lindsey, UAWAPADCO. The
spoils were retained in two dans which were prepared adjacent to the wetlands
on Freshwtaer Biological Research Foundation property at Navarre.
A report on the Engineering part of the project has already been
submitted by Mr. Lindsey. This report deals with a study of water quality
in Lafayette Bay and in the Wetlands. This study was conducted before.
during and after the dredging project was completed. The effect of both
suction dredging and traditional dredging on the water quality of Lafayette
Bay is compared. Analyses were conducted during the period for total
phosphorus, total carbon, and total nitrogen. In addition, turbidity.
chlorophyll levels, and secchi disk measurei.'ents were made throughout the
summer season. The results of this study are presented in Table 1 (Lafayette

Bay), II (Foundation Marsh) and III (Seascout Survey of Lake Minnetonka, 1978).
The detailed technical methodology used in this study can be obtained from
the Freshwater Biological Research Foundafion upon request.
Conclusions
Suction dredging caused very little change in Lafayette Bay during the
Entire project. At all times the nutrient balance was seen to be significantly
better than the natural conditions in the bay reported in 1972 by R.O. Megard,
Journal of Limaology and Ocenaography, Volume 17, p. 68-87. However, in the

first week in August Bill Niccum was employed to dredge part of the 1934 boat
channel using the traditional dredging approach. Immediately we observed a
doubling in total carbon in the water column, and a significant increase In
total nitrogen (see data in Table I from August 1st onwards). Clearly,
suction dredging for channel maintenance is much less deleterious to the
body of water than traditional dredging practices.
The dams which were constructed to hold the spoils from Lafayette Bay
were so well constructed that the water pumped with the spoils was mostly
lost through evaporation as Mr. Lindsey predicted. Most of the changes in
the marsh could be accounted for by rainfall causing increased urban run
off, except on July 28th when a visiting student from Harvard who was studying
crawfish In the wetlands Inadvertently stirred up sediments in the wetland
close to our sampling points (Table II).
Measurements taken by the Seascout Project on Lafayette Bay (Table III)
show the results of a typical season of algal succession, except that this
year Lafayette Bay was much cleaner than last year, and is showing a great
improvement in terms of nutrient loading. This could be due to two reasons:
(1) the removal of sewage effluent from the bay and (2) closure of the boat
access at the comer of County Road IS and Old Beach Road. It is clear that
high powered boats entering shallow bays, ^such as Lafayette Bay, stir up a
large amount of sediment whi^h increases the concentrations of soluble nutrients
in the water column.
