RESOLUTION APPROVING THE PLAT OF DENNIS KUMLIN WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Cornell of the City of Orono has adopted subdivision regulations for the orderly, economic and safe development of land within the City; and WHEREAS, the City Council has considered the application for a subdivision plat by Dennis Kumlin, the subdivider; and WHEREAS, the stjbdlvlder has completed all requirements of the platting regulations of the City, including: 1. Dedication on the plat of ri^ts of way for public streets and roads, shown as Fox Street. 2. Dedication to the City of a Flowage and Conservation Easement (Erfilblt A) providing for limitations on the use of wetlands and/or drainageways described therein. 3. Payment to the City of a Park Dedication Fee in the amount of $500.00. The dredging operation will cover a 26' X 28' area removing 18" of sand to a 3' depth, approximately 200 cubic feet of material to be removed. Mayor Van Nest seconded, to approve the variance request of Glenn Upton, 1015 Linden Lane, per the Planning Commission recommendations of September 19, 1977. Motion, Ayes (4) - Nays (0). Mr. Alan Olson, Assistant Building 6 Zoning Administrator, entered into the record the following memo concerning a lot area and front setback variance for Darrell Stewart, 3185 North Shore Drive, dated August 24, 1977, which states: y^VRlANCE ^185 North Shore Drive «302 Darrell Stewart The applicant is requesting a variance for construction of an addition to his existing home which is located approximately 20 ft. from the County road right of way. The proposed addition would not reduce this setback, but it would follow along the road for some 60 ft. at the same 20 ft. setback. The proposed remodeling would relocate the garage from the present location to an area farther east where there is less of a view obstruction. The new curb cut would require County approval. The proposal requires Tracts G & H to be combined, application for which was made June 9, 1977, as part of the previous determination of the buildabillty of Tract G. 1 •J Variance:Lot area required: 43,560 sq.ft. Mr. Olson stated that he is requesting a variance for construction of an addition to his existing home located aj^roximately 20 ft. from the County road right of way. The two tracts, as shoi« on the survey, have been combined. The front area of the existing house is used for parVing. This is rather restricted because to the west there is a large hill that bloclcs the view and make a dangerous entrance in and ait. Moving the driveway further to the cast will improve the access. Any new access would require County approval. Mr. Stewart explained to the Comnission that by keeping the addition in line with the existing house he would be preserving the natural habitat of the area. The Comnission felt that the addition would be in keeping with the area. McDonald moved, Guthrie seconded, to recommend approval of the variance on the basis that the addition is in keeping with the area, proposed location would require the lease amount of tree removal and the turn around driveway would be an added safety measure. Motion - Ayes (4), Nays (0). Mr. Olson stated that this request is for a conditional use to construct a second grecniiouse on this property. Tlie area is zoned residential and a greenhouse is a conditional use in that zone. A conditional use permit was issued pre­ viously for the one greenhouse already existing on the property. Mr. Holasdc was present. The proposed greenhouse would meet all tlie required setbacks. The greenhouse would be in keeping with the atmosphere of this rural area. Guthrie moved, Hannah seconded, to recommend approval of the application for the conditional use to permit the construction of the greenhouse. It is in the 5 acre zone riiich supports this type of operation. Motion - Ayes (3), Nays (0), Abstain (1). Mr. Filkins was present. He is requesting approval of a variance for construction of a new house and attached garage. Applicant siimitted a letter from a soils engineer. Mr. Olson informed the Commission that the septic system would need to be reviewed by tlie City engineer.
