SKETCH PIAN REVIEW
This Is a very rou^ sketch plan provided for your initial review
and cooment. The proposal is to divide the existing lots used by
the Texaco Station and a rental house along Central Avenue for
purposes of sale.
The attached plat map shows property ownership:
Tourangeau, Lots 7-14, 20, 24-26 (1-3/4 acre) plus
5300 on the lakeside, all separate parcels.
Fahlin, Lots 1-3, 6 (3/4 acre), 22-23 (1/4 acre) plus
5100 on the lakeside, all separate parcels.
Halgren, Lot 15 only (6000 s.f.).
Stinson, Lots 16-19 cond>ined (1/2 acre).
Stowe, Lots 4-5, 21, separate parcels.
Zoning:All RR-lB 2-acre residential except the easterly 70 ft.
of Lots 24 and 25 which are B-1 commercial.
The proposed division would include variances to lot size and
possible rezonlng to make the station property all commercial.

The attached survey and application for subdivision (lot line
rearrangement) and variances have been received and a Public Meeting
is scheduled for 7:30 P.N., August 14, 1978.

The subdivision proposal involves a combination of four (4) platted
lots and a newly located division line resulting in two parcels.
The proposed Lot 1 contains an existing house. The proposed Lot 2
contains an existing service station. Not shown are the remaining
Tourangeau lots (7-13 & 20) which contain the existing Tourangeau
house on 47,300 s.f. (1.09 acre).

The existing B-1 zoning description Includes a portion of both
pi^oposed lotSy being described as the easterly 70 ft. of Lots 24
& 25. The division as proposed does not follow the zoning district
boundary. My reconmendatlon is that the Planning Comnisslon review
this zoning discrepancy and that a rezoning application be required
prior to final plat approval. I reconmend that all of proposed
Lots 1 and 2 be zoned RR-IB with the station becoming legal-nonconforming
or, if the B-1 district Is to remain, that all of proposed Lot 2 be
zoned B-1.

Most of the variances are large percentage-wise, but it must be remembered
that this is an existing situation and is a lot line rearrangement meant
to inqprove the existing situation of having two structures and mixed
occupancies on the same lots. The rear yard building setback on Lot 2
meets building code requirements if one small window in the station
storeroom is bricked shut. Hardships include lack of additional
available land and existing structure location.
Hennepin County has been asked to review the plat and the existing
accesses on County Road 15. Existing sep(ic systems will be inspected
by the City with reports Included at the public meeting.

Ihe preliminary plat was approved on March 16, 1978, by Resolution
No. 89C. At this time all conditions have been completed to the
satisfaction of the staff.
Referring to Resolution No. 890: Item #7 - Mr. Gardner has delivered
recorded easements executed at the time of the Liberty Acres plat
providing for roadway maintenance without the necessity for a
homeowners association; Item #9 - There was great difficulty finding
suitable septic sites on Lots 1 & 2, Block 2, but this has now been
accomplished.
I recommend final plat approval according to the attached resolution.

A RESOLUTION APPROVING THE PLAT OF GARDEN GROVE
WHEREAS, the City of Orono is a municipal corporation
organized and existing tinder the laws of the State of Minnesota; and
WHEREAS, the City Council of the City of Orono has adopted
subdivision regulations for the orderly, economic and safe development
of land within the City; and
WHEREAS, the City Council has considered the application for
a subdivision plat by Karl Gardner the subdivider; and
WHEREAS, the subdivider has completed all requirements of
the platting regulations of the City, including:
Completion of all the requirements of Le5.olution No. 890.
Dedication of required drainage and util' .y easements.
Dedication of public streets and roads.
Dedication of access easements underlying private roads.
Payment of a park dedication fee of $1,000.
NGW, THEREFORE, BE IT RESOLVED, that the City Council of
the City of Orono hereby approves the plat of Garden Grove, Hennepin
County, Minnesota; sxibject to,the following conditions:I
The aforesaid plat shall be filed with the Hennepin County
Recorder's Office on or before Febrtiary 15, 1979, together
with a certified original copy of this Resolution, and
executed copies of the road and utilities easement.
The approval granted by this Resolution shall expire if the plat has
not been filed by the date specified above. In that event, it will be
necessary to file a new application with the City of Orono for subdivision
review.

existing under the laws of the State of Minnesota; and
WHEREAS, the City Council oJ the City of Orono has adopted subdivision
regulations for the orderly, economic and safe development of Ian

the City Council;

SUBJECT:Soil Testing £or On-Slte Sewage System
Karl Gardner Subdivision, 2885 Sixth Avenue North
A report o£ soil testing and dralnfleld suitability £or the Gardner
Subdivision was received by sta££ on June 22, 1978. The results
o£ this testing Indicate that areas of perched water table exist
throughout the proposed subdivision. In addition, lowland soils
occur over much o£ Lot 2, Block 2.
Lot 1, Block 1 - Average perc rate 12 min/inch. Secondary £leld
has perched water table at 4 £t. Based on the data submitted,
a standard system would be satisfactory for the primary field
and shallow trenches in the secondary field.
Lot 1, Block 2 - Average perc rate 9 min/Inch. Perched water table
to the northeast. One additional boring and two additional perc
tests within secondary field will be required to show that the
secondary field can support an on-slte system.
Lot 2, Block 2 - A suitable dralnfleld area has not been located on
this lot. Water table was found to be too near the surface for
an on~slte system to function correctly. Additional exploratory
testing would be necessary to locate a suitable dralnfleld area on
this lot.
Lot 3, Block 2 “ Existing system will be Inspected by staff as soon
as possible.
6-27-78 Inspection of Existing Septic System
The septic system at 2885 6th Avenue N. consists of 1 tank flowing
through a draintile line outletting to the ditch along 6th Avenue.
The system is classified as non-conforming. The inspection report
and orders to repair system within 90 days were sent to the o%mer
on June 27, 1978.

Mr. Plank was present. Mr. Joseph Sawchuk was present and had comments
regarding drainage, but who did not object to the present proposal.
Planning Comnlsslon reconmended approval of the preliminary subdivision
subject to park dedication fee. conservation and drainage easements,
and dedication of the Watertown Road right of way. Planning Comnlsslon
deferred action on the variance proposal, requesting a more detailed
survey and plan for the proposed house.
Staff Note - August 7. 1978
Mr. Plank has submitted a revised sketch of proposed Lot 2 showing
the requested location of a 24' X 50* house.
Front Setback variance required:
34.742 Required setback: 100 ft.
Proposed setback: 75 ft.
Variance: 25 ft.257.
The house as located has a front line on a contour 6' below the road.
If located at the 100 ft. setback, the front line would be 10 ft. below
the road. The septic testing was done In a range of 6 ft. to 14 ft.
below the road (959 to 951) idiich indicates that a gravity system could
be Installed with the house in the proposed location, but that a pumped
system would most likely be required If the setback requirement was met.

Dear Al,
We have reviewed the proposed subdivision of Michael Plank on Watertown Road,
consisting of two proposed lots. Subject to verification of adequate primary
and secondary sites for drainfield, there appears to be no engineering problems
associated with the proposed plat.
This subdivision represents a change from an early proposal which had four Iocs
and a street location south of Watertown Road. The earlier proposal raised the
question of the extension of Chippewa Lane easterly through the proposed sub
division to connect with the proposed street. The combination of Turnham Road
and Chippewa Lane is over 2900 lineal feet in length or about 0.55 miles. Long,
dead-end streets present an element of risk to the abutting property owners and
to the City's ability to deliver essential municipal services due to potential
Interruption. When reviewing the street pattern in the area, it appears that
Turnham Road should eventually be extended either westerly or southerly to enhance
traffic circulation.
It does not appear feasible to extend Chippewa Lane easterly through the proposed
Plank subdivision to Watertown Road due to the extreme difference in elevation
along the boundary line. The topography drops over 30 feet in about 150 feet
which would result in a very steep grade. The question of maximum criteria for
the length of dead end streets has not yet been resolved, but a cul-de-sac of
1/4 mile with very low density appears reisonal>le, based on past development
policies of the City. This, of course, assumes that Turniam Road will one day be
extended to connect with another through street. .4 photc copy of the proposed

We reconmend approval of the proposed, two lot subdivision for Michael Plank sub
ject to verification of on-site drainfield facilities and subject to conservation

supply store, in the vacant McCharles building at this location.
The business is stated as being primarily wholesale in nature
with limited retail trade.
The property is zoned B-5, Limited Neighborhood Business District
The property is 13,450 sq. ft. in area and 100 ft. wide. The
B-5 District provides for certain "permitted" and certain
"conditional" uses, but auto parts is not specifically listed in
this or any other district. Tlie last use of this building was
for a retail/manufacturing outlet for redwood burl products.
This use was approved by the Council on April 26, 1976. At that
time, the property was zoned B-4, Office and Professional Business
District.
Review of this application must include a determination of the
suitability of this proposed use within this use district.
Side issues include traffic generation and parking requirements,

#416 Conditional Use Permit - Dredging
West Shore Lafayette Bay Association
The homeowners association has made an application for some
additional dredging which is beyond the scope of the previous
permits.
This extension is a proposal to dredge the channel and lagoon on
the Morris, Hannah and Baumgardner properties. The method
is to be the same as that used in the main channel with the
suction dredge used to remove muck down to elevation 924 + 6”.
Surface area: approximately 10 ft. X 90 ft. channel
approximately 75 ft. X 100 ft. lagoon
Pond depth at completion: 4 ft. - 5 ft.
Estimated 400 - 600 cu. yards of spoils to be deposited in the
FWBI spoils pond.
There is an existing walk bridge over the channel which is to be
removed and then replaced upon completion of the work. With
this bridge inplace, there is no navigable access to the lagoon.

To date, the City engineer and I have inspected the existing
dredging operations several times and have no adverse comments.
We have not, however, received any of the monitor reports on
water quality. Perhaps these should be required prior to expansion
of the permit.

A RESOLUTION APPROVING CERTAIN DREDGING AND SPOILS
DlSroS;}/FOR THE WEST SHORE lAFAYETTE BAY ASSOCIATION
WHEREAS, the City of Orono is a municipal corporation
organized and existing under the laws of the State of Minnesota; and
WHEREAS, the City Council Is concerned about the problems
created by unregulated dredging In and adjacent to Lake Minneto^,
which problems affect the Lake and all the property adjacent thereto,
and
WHEREAS, the City Council Is concerned that permanent
habitat of the City; and
WHEREAS, because of the above noted concerns and for the
protection of the health, safety and general welfare of
Sf Orono, the City Council has established and edited regulations
providing for strict control of dredging In and adjacent to the
lake and^strlct control of filling or alteration of wetlands, marshes,
dralnageways and land adjacent thereto; and
WHEREAS, the Planning Oomnioslon and City Council have
reviewed at length an application by the West Shore Lafayette Bay
Association for certain maintenance ^edging of a “ naterlals

NOW, THEREFORE, BE IT RESOLVED, that the City Council
hereby makes the following findings of fact;
1. Th? channel dredging Is located in Lafayette Bay, Lake Minnetonka,
as shown on Eidilblt A attached.
2.The channel dredging is required to maintain riparian access to
nine residential properties within the City of Orono.
3.The channel to be maintained was previoxisly dredged under proper
state permits.

4. The dredging will only remove silt from within the .existing
channel and will not affect the hard lake bottom.
5. The dredging will be done according to the conditions of the
MNIRIR permit No. 78-6325 attached hereto as Exhibit B.
6. The dredge spoils will be deposited on property owned by the Fresh
Water Biological Research Foundation as shown on Exhibit C attached.
7. The Hennepin Soil and Water Conservation District has determined
that the disposal site Is dry land and not wetland or marsh land.
8. Ihe spoils disposal will be a settling basin behind earthen dikes
as noted on Exhibit D attached and as regulated by MPGA state
disposal system permit (application attached as Exhibit E).
9. The effluent from the disposal area will be contained within
the large FWBI wetlands and the wetlands water quality will be
dally monitored by FWBI staff as a research experiment as noted
on Exhibit F attached.
AND, BE IT FURTHERMORE RESOLVED, that based upon the above
noted findings of fact, the City Council of the City of Orono does
hereby grant to the West Shore LaFayette Bay Association a Conditional
use Permit for dredging and spoils disposal subject to the following
conditions:

1. DUch construction shall be subject co a building permit, which
permit may be Issued by staff upon receipt of permits by the
MCMD and MPCA and upon payment of the building permit fee.
2. Dike Construction shall be stibject to the approval of the City
engineer prior to the start of any dredging.
3. The culvert under Old Beach Road (between the FWBI marsh and
Lake Minnetonka) shall be sealed to the satisfaction of the
City engineer prior to the start of any dredging.
4. Dredging may not begin until receipt by the City of permits from
the MNDNR and KCWD and until at least 24-hour notice be given to
the City Inspector.

6. Prior to the start of dredging, the FWBI shall sample the waters
.of LaFeyette Bay and the FWBI marsh for turbidity and for nutrient
levels and shall sid>mlt a report of same to the City.
7. During the dredging operation, the FWBI shall daily monitor
turbidity of LaFayette Bay water and shall submit weekly reports
of same to the City.
Prior , to discharge of marsh water to the lake, the FWBI shall
monitor the concentrations of nitrogen, phosphorus and dissolved
organic carbon In the FWBI marsh, shall weekly submit reports of
same to the City, and shall prohibit discharge of marsh water to
LaFayette Bay until concentration levels are equal to or lower
than LaFayette Bay levels.
After completion of the dredging and release of the marsh water
to LaFayette Bay, the FWBI shall prepare a conq>rehensive report
including conclusions gained from the study and shall stdmilt same
to the City, the MNDNR and the MPCA.
If, at any time during the dredging operation, the nutrient levels
in the marsh water or outlet to LaFayette Bay rise to a point
determined by the City to be detrimental to Lake Minnetonka, the
City reserves the right to enforce a stop %iork order prohibiting
further dredging activity until the nutrient levels are reduced.

liq>ounded waters, the disposal site shall be recontoured and
landscaped, including removal of the dike, sodding, seeding and
tree or shrub planting to prevent erosion and to return the area
to a natural state, vdilch landscaping shall be at the applicant's
cost and for which the applicant shall post with the City a letter
of credit for $3,000.00 to ensure performance.
12. Ihe West Shore Lafayette Bay Association and the Fresh Water
Biological Institute shall review this Resolution and agree
to the conditions contained herein prior to this permit being
effective, which agreement shall be indicated by execution of
