The applicant is requesting a variance from front yard and side yard setback requirements for construction of a new garage. The location is over the existing parking area and away from several existing trees. The existing non-conforming garage is intended to remain. June 7, 1978 TO; FM; City of Orono Planning Commission John Proegler, applicant SUBJ: Variance request for 2208 Shadywood Road, Lot 12, Block 1, Wiley’s Park Addition The primary reason for the requested variance is to allow the erection of a‘20’x2l4.' double car garage without destroying or damaging three (3) large maple trees and one (1) ornamental plum tree. The University of Minnesota Horticulture Department has suggested and recommended that little or no excavation be made within the drip line of any large tree. Sketch number 2 (attached) shows the placement of the garage without a variance. This would eliminate the plxim tree; probably kill the maple tree in the middle of the yard; and damage the maple tree closer to the house. Sketch number one (attached) shows the current situation. The *U’ drive and parking area and outbuilding (near the house) combine to exceed the hardcover area desired (See Lakeshore Hardcover Calculations, 3U«'?02, attached). Sketch number three (3) shows the proposed final placement of the garage. This placement allows the saving of all trees; decreases hardcover surfaces to within desired limits; provides adequate parking and turnaround area for safe entrance/exit from Shadywood Road. In addition to the above, all homes on either side of our lot have garages, or other buildings closer than the 16' from the road lot line I am requesting. Our garage, with the variance will have the moat setback from the road. To date, the neighbors on either side of us have verbally agreed to the proposed variance. Olson, Village Planner July 18, 1978 #412 SUBJECT: f9^412 Subdivision Mrs. Roy Hollander, 255 Sixth Avenue North SKETCH PLAN REVIEW The applicant has two existing parcels totalling approximately 37 acres. Zoning District is RR-lB, 2 acre lot area, 200 ft. lot width. The eastern parcel contains a bam and two houses. The western parcel contains Mrs. Hollander's house. The proposal is to divide the properties into 15 residential lots. Biere is a considerable amount of wetlands on the property as shown on the sketch and our wetlands map. One of the proposed lots is noted as 1.6 acres dry and 1.1 acres wet. All other lots are at least 2 acres dry. A soil survey and individual septic testing will be necessary for proper review of the lot arrangement. The roadway is shown as a loop connection of 50 ft. right-of-way width. With this nund>er of lots, previous approvals have required 60 ft. ROW. ttie access location Is subject to county approval. The west access also serves existing houses and Is a separate ki>S tract. Ownership and other easement rights should be reviewed. Note that the existing eastern lot Includes two existing houses. The plan as shown places two houses on Lot 5 (the new Hollander house and an old rental house). This slttiatlon should be addressed at Sketch Plan. Alternatives Include a conditional use permit for guest house (If lot is enlarged), a conditional use permit for a non-conforming use, relocation of lot lines to provide a separate parcel or removal of the house prior to final approval. Olson, Village Planner 3 9411 DATE: SUBJECT; June 8, 1978 Subdivision (Lot line Rearrangement) Edward Mahoney, 2760 Pheasant Road SKETCH PLAN REVIEW The applicant is proposing a lot line rearrangement affecting four residential parcels and one vacant parcel. Lot “s been platted in such a way so as to separate Lots 15, 16, 17, & lo from the lakeshore those lots have always used. The proposal would rectify this legal problem dividing the shoreline among the existing property owners. Staff recommends approval of the concept subject to formal replatting and to a conservation easement over the wetlands (and/or the ®^tire Island portion of Ix)t 14). A Public Information Meeting should be scheduled for July 10, 1978. PIANNING COMMISSION MEETING - JULY 10, 1978 (PUBLIC INFORMATION MEETING) Present at the meeting was Mr. Mahoney, the ^r. B^stad, one of the owners of Lot 14, Mr. Hendrickson, 2705 Pheasant Road, and Mrs. Jacob, 2725 Shadywood Road. Planning Commission was advised that ten (10) parties have an interest In Lot 14 rather than only Mr. Mahoney as on the application. Several of those parties have non-lakeshore lots but apparently have for so^ time kept their boats in a small cluster dock at the end of Pheasant Rd. This small part of Lot 14 is occupied by six (6) slips, most with canvas covers, six boats and a small metal tool shed. There has never been a joint use dock license or an LMCD license for this multiple dock. At that meeting, several questions arose concerning ownership and use of Lot 14. The application was tabled pending receipt of the necessairy information. Per our telephone conversation today, please supply the following information to my office: (Upon receipt, this item will be put back on the agenda for further Planning Commission review.) 1. An up to date title opinion, addressed to the City, showing all parties possessing legal Interest in Lot 14 and all encumbrances on the property or other documents identifying ownership. A list of all persons claiming dock rights on the property and the length of time they have used a dock on the property. A certified copy of all recorded documents granting dock rights to the owner of any lot not abutting the lakeshore. A letter outlining the total extent regarding Lot 14 ownership, maintenance, etc. 2. 3. 4. X must advise you that the City of Orono does not now recognize "dock rights" for offshore properties. Any such "new" proposal is contrary to existing zoning regulations. Olson, Village Planner DATE:July 17, 1978 SUBJECT: Emergency Shoreline Protection Due to the extremely high water situation on Lake Minnetonka, many people have experienced severe flooding, lakeshore erosion, shoreline undermining and other related problems. Rip rapping has disappeared or been flooded over, banks have washed out, much debris is entering the lake and additional shoreland is threatened by continued high water and wave action. Because of this emergency situation, the City Council on July 11, 1978 authorized the staff to issue permits for emergency rip rapping and, where necessary, retaining walls or other shoreline stabilization. The purpose is one of preventing further harm to the shoreline and to the lake. No tree removal, unusual hardcover or unnecessary construction is included. Consequently, normal rip rapping applications are reviewed on an on-the-spot basis and will not be sent to the Planning Commission. The City Council will review staff permits after-the-fact. The City Council has also directed staff to draft a revision to the City Ordinances to provide for such typical and/or emergency permits to be Issued by staff on a permanent basis. cc; Iftr.
