The City should expect a drainage easement over the creek. The Planning Commission should make a policy recommendation to the Council as to whether or not this area should be Included In the lot area calculation. Public Information meeting scheduled for June 12, 1978. PLANNING COMMISSION - May 22, 1978 Reviewed procedures with Mrs. Rusciano. Moved that the drainage course (creek) will require a drainage easement but the area of the easement should be included in the calculation of minimum lot area, therefore no relocation of the proposed dividing line is necessary. Staff noted that the pending sewer easement can be platted on the final record plat but that the pipe must be accurately located to ensure proper description of the easement. Olson, Village Planner #370 DATE; May 25, 1978 RE;Revised Conditional Use Permit and Variance Stephen Towle 3980 Watertown Rd. PLANNING COMMISSION WORK SESSION - May 22, 1978 Mr. Towle was present. He explained that 17 to 25 horses are boarded on pro­ perty he controls, including this parcel plus 50+ adjacent acres being purchased ‘‘^y Contract for Deed. Planning Commission was concerned with traffic and expansion of a conditional use. Planning Commission called for a Public Hearing to be held on June 12, 1978. STAFF - May 24, 1978 A conditional use permit for a riding stable was issued for this property on April 26, 1971. (Section 34.026) Attached are copies of the Planning Commission and Council Minutes from that time. Also attached is a section map showing the land holdings available. Note that Orchard Park Lot 8 is an unapproved subdivision of previously combined properties. Mr. Towle is advised of the requirement for City approval of same. Suggested is a revised conditional use permit tying the maximum number of horses to available pasturage. (50 acres = an allowed 47 horses by code), I I . Absent; nongoske. Frank Child represented himself in an application for a conditional use permit for purposes of a riding stable at 3930 Water- town Road, Section 32, Parcel 2900. Poisson read memos on the conditional use permit and s>)oived signatures of adjacent residents who iiad no objection. Drought out in the evaluation to allow the permit was that t!ie number of horses kept on the premises varied from 7-25, that the property '/as purchased prior to the a<’ontion of the zoning ordinance and that tiie usage prior to that time was substantially the same as now, that the stable would be used ns a riding arena during inclement weather by the owner and people boarding horses there, that the land area was approximately 4h acres. After discussion on ordinance interpetation and non-conforming usage. Kuhlemcier moved, Gasch seconded, that it be recommended that the conditional use permit be allowed. Willard Greenwood represented himself in an application for a variance from Municipal Ordinance 31.201, which prohibits the placement of accessory buildings before a principal building is constructed. The land consists of 15,6 acres in Section 31, Parcel 1185 and fronts on Sixth Avenue North, Mr. Greenwood stated that he wished to build a combination stable and garage to house four horses of a rare breed owned by him and that tiie stable \/ould be for private use only to conduct wJiat lie termed a hobby for himself. Kuhlemeier moved, Gasch seconded, that since Mr. Greenwood has owned this property and an adjacent 80 acres since 1941, had horses on the property at previous times and that the stable would be practically concealed from view, a stable and garage combined for private use only should be allowed. The property is currently occupied by 2 residences. The residences were purchased individually by 2 separate parties. Prior to these transactions, I notified several parties of the problems that might result from situations such as this. Some of our own staff members were interested in this property. Olson, City Planner DATE:May 17, 1978 SUBJECT:Variance - John Hannah 2608 Mapleridge #388 The applicant proposes to construct a new house on a lot created by subdivision (Kem Hoppe, et.al.) last year. Normally, variances are not considered for new buildings on newly created lots. The request here arises because Mr. Hannah's architect interpreted our setback requirements differently than we do. He has designed a home with a comer (he terms it a "bay") projecting to 8 ft. from the property line. The original plan submitted for permit, had several corners encroaching the side setbacks. The only current encroachment is the one corner noted. Variance 34.452 10 ft. required; 8 ft. actual - Variance 2 ft. The property consists of 7 separate parcels under common ownership surrounded by platted undeveloped public roads. Total acreage 1.65. Variance required: Section 34.842, .35 acre - VJ%, Approval should be conditioned upon legal lot combination, meeting all setbacks and performance standards and proper septic system design. Planning Commission Meeting - May 22, 1978 Work Session. Planning Commission discussed perimeter roads and lack of adjacent vacant land. City would likely not vacate roads due to Big Island policy of ultimate public ownership, but if roads were vacated, sufficient land would be available for building without a variance. Mike Gaffron was expecting to review the septic site in person. Present was Mr. John Uran and his attorney, Mr. Jim Penberthy. ; - RESOLUTION NO. A RESOLUTION APPROVING THE PLAT OF RASTER COVE WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City of Orono has adopted subdivision regulations for the orderly, economic and safe development of land within the City; and WHEREAS, the City Council has considered the application for a subdivision plat by Paul Raster the subdivider; and WHEREAS, the subdivider has completed all requirements of the platting regulations of the City, Including Completion of all the requirements of Resolution No. 388. The purpose is to establish a reasonable boundary for the authorized dock use area required by LMCD and the City of Orono regulations. The proposal was suggested to Mr. McCleary at the Orono Marina Comnittee meeting held on April 18, 1978. The revised dock use area will provide for 66 slips as per previous years licenses without the need for general harbor dredging. The only dredging required under Application iS^294 would be a 30 ft. wide channel to the launching ramp. The result of this proposal is in concert with the Council direction given on March 30, 1978, with no adverse precedent established by the down zoning. The issues of note: 1) A specific determination of the number of waterward slips. 2) A possible determination of the maximum boat units to be stored on land similar to the North Shore Drive Marina Agreement. 3) A specific determination of the dredging required: location, width, length, depth and spoils removal method. 4) A legal lot combination of the currently separate parcels (Lots 7, 21 and 22) should be considered. My neighbors who own lake lots 16, 17 and 18, and I recently discovered that a small portion of land exists between our platted lots and Lake Minnetonka. This small portion of land and a larger body of water is platted as Lot 14, Pheasant Lawn. 1 have now purchased Lot 14 on behalf of my neighbors and myself to insure that we legally have the lake access we thought we owned. I am attaching a sketch showing the parts of Lot 14 which we would like to subdivide for the benefit of Lots 15, 16, 17 and 18 respectively. I am also attaching legal descriptions for the subdivision prepared by Mr. Gordon Coffin, surveyor, and approved by the Hennepin County Torrens Office. I am requesting approval of the subdivision of Lot 14 to assure legal lake access to Lots 15, 16, 17 and 18. This subdivision will result in no new construction and no new access to Lake Minnetonka. It will solve a technical legal problem for existing lakeshore homes. I would like to avoid formal replatting, if possible. Such a procedure would be costly and time consuming and would not appear necessary because of the very small amount involved. The purpose is to establish a reasonable boundary for the authorized dock use area required by LMCD and the City of Orono regulations. The proposal was suggested to Mr. McCleary at the Orono Marina Comnittee meeting held on April 18, 1978. The revised dock use area will provide for 66 slips as per previous years licenses without the need for general harbor dredging. The only dredging required under Application iS^294 would be a 30 ft. wide channel to the launching ramp. The result of this proposal is in concert with the Council direction given on March 30, 1978, with no adverse precedent established by the down zoning. This small portion of land and a larger body of water is platted as Lot 14, Pheasant Lawn. 1 have now purchased Lot 14 on behalf of my neighbors and myself to insure that we legally have the lake access we thought we owned. I am attaching a sketch showing the parts of Lot 14 which we would like to subdivide for the benefit of Lots 15, 16, 17 and 18 respectively. I am also attaching legal descriptions for the subdivision prepared by Mr. Gordon Coffin, surveyor, and approved by the Hennepin County Torrens Office. I am requesting approval of the subdivision of Lot 14 to assure legal lake access to Lots 15, 16, 17 and 18. This subdivision will result in no new construction and no new access to Lake Minnetonka. There is an existing double garage on the lot. The existing house is almost entirely within the 75 ft. conservation zone. Much of the landscaping is graveled areas underlaid with black plastic film, effectively also hardcover. Variances required: 34.201 75 ft. setback required 65 ft. setback proposed 10 ft.
