ISC. j #367 Mike Gaffron, Septic System Inspector May 16, 1978 SUBJECT: Septic Systems - Soil Testing, Stielow Subdivision A review of the soil testing information submitted by Hickock annssoclatS for the Stielow Subdivision leads me to the following conclusions: Lot 1 - Percolation rate 11 mln./inch; 5 at site; water table at 2-4 feet; mottled ‘■elow 3 f«t. «^ter table is too high for a standard system. Slopes ^ site arc too steep for a mound system. ^ ^ lot are: 1) a mound system in the secondary dralnfield area, 2) holding tanks; or 3) declare the lot as unbuildablc. Lot 2 - Percolation rate 24 min./lnch; 23 mln./inch at ^te waS table at 3-7 feet. Primary site is near or within existing dralnfield. Slopes of 0-67.. Due to high water table, TmounS system or shallow trenches would be necessary. Tot 3 - Percolation rate 83 rain./inch; 83 mln./inch at secondary ^te? wat« table at 3-7 feet; slopes of 6-12X. High indicates standard trenches will not be acceptable (so .1 mottling indicates stan ^ a high seasonal water table). sLpes «e too ^teep for a mound system, and P«= slow for shallow trenches. 1 believe it may be a mound to the southeast of proposed drainfields wh«e the p is more level. A walk-through the most northwesternly lot of the plat revealed watertable at or very near the surface. This lot may not be suitable for any type of soil absorption system, thus requiring holding tanks and a regular puinping schedule. Olson, Village Planner April 4, 1978 SUBJECT: Jurgen Stielow - 565 Loaf Street Subdivision SKETCH PLAN REVIEW: This is a proposed 13 lot residential subdivision of the former Andromeda property between Leaf and Bayside. The sketch plan is an opportunity for you to review and comment on the proposal at the conceptual stage. Items for discussion:Wetlands & flowage easements along shore and pond; riparian access; intentions for the existing church building on Lot 9 and foundation on Lot 7; should the road be public or private, and should . it be gravel or paved? Planning Commission 4-10-78 Planning Commission reviewed sketches indicated some objection to substandard area of lot 10 Bl. 1 and setbacks of existing structures from proposed lot lines.on alternate plan dated 4-6-78. Suggested developer revised plans to meet minimum area and setback requirements. Indicated preference and conceptual approval or original proposal. (Plan dated 3-27-78) Staff: Developer will be submitting revised plans for second sketch 4-18 plan review Planning Commission 4-24-78 Mr. Sclelow was present at this meeting and the Planning Commission reviewed his latest plan which is dated 4-20-78. This plan has been rearranged to show response to the concerns and questions of the Planning Commission at the last meeting. General dis cussion followed during which the Planning Connilssion noticed considerable work and Improvements over the previous plats. Most of the questions of the Planning Commission had been answered and no serious questions were uncovered at this meeting. A1 Olson noted that the County highway engineer had reviewed the plat and had approved the proposed location of the access drive. He also noted that the access for Lots 10 & 11, Block 1 should be a joint access on the common property line rather than separate access points. It should also be noted that this plat shows Outlot A the island lying to the southwest corner of the property. This outlot is mostly marsh land and is not separately buildable. It is meant to be owned by Lots 5 or 6, or perhaps a combination of those two lots. The Planning Commission moved conceptual approval of the sketch plan as presented in the 4-20-78 plan. Mr. Stielow was then advised that a public Information meeting would be scheduled-to review the preliminary plat upon receipt of engineering details forthe road profile and grade, and septic system testing information. / - \ 5<5 Indian Mound VVnyzala. Bonostroo, Rosene, Anderlik & Associates Inc, 2335 West Highway 36 St. Paul, Minnesota Dear Mr. Olson: This letter is confirm our telephone conversation of yesterday regarding the street design for the proposed Sticlow's Addition in Orono, Minnesota. The street will be 28 feet wide, full depth asphalt construction with a roll bituminous curb. The asphalt construction would consist of a five inch bituminous base on a compacted subgrade and a 2 inch bituminous wearing course. The base mixture will be according to Minnesota Highway Department Specification 2331 with asphalt content, 85 to 100 penetration. The wearing course would be according to Minnesota Highway Depart" ment Specification 2341 with 6% asphalt concentration, 85 to 100 penetration. We would be willing to meet any other reguirements which the City might have for street construction. I am enclosing two sketches, one is a copy of the street showing the typical section details, the second is a copy of a roll bituminous curb detail which we would propose to use. We have reviewed the above referenced plat and find it acceptable with consideration of the following conditions: 1. The location of the proposed access road - approximately 800 feet west of Leaf Street - is acceptable. 2. Jonnson SKETCH PLAN REVIEW This application is a proposed three lot split of property at North Arm Drive and Loma Linda. This identical request was reviewed and approved by the Council on November 26, 1973 subject to final plat draw ings, a park fee and certain easements to provide access to Lot 2. The division was never completed at that time due to then delinquent taxes. No park fee was ever paid. The property still exists as 11 separate tax parcels owned by the same party. The proposed three lots each meet the 140 ft. lot width requirement but are only 37,000 sq. ft. in area (.85 acre). The property was originally assessed for 5 sewer units. At the time of the previous approval, two units were waived. Three units remain. Taxes are delinquest to 1973. The retaining of water so that the wetland only has to deal with the nutrients from approximately 15Z makes this plan more appealing. I visualize our role as follows: (d) (e) We can retain the effluent water from the dredge in the Institute wetlands by sealing off the culvert which goes under Old Beach Road. We shall conduct daily determinations of the nitrogen, phosphorus and dissolved organic carbon in the wetland until concentrations are identical to Lafayette Bay water. At this point we shall.allow the water to return to Lafayette Bay. Fiske-Subbarow and Mlcro—Kjeldahl methods will be used for phosphorus and nitrogen determinations respectively. We shall measure turbidity by spectrophotometry. We expect the West Lafayette Bay Association to pay for liming and landscaping the spoils area. Seal of dikes Insured by compaction of D-6 going up Inside of dikes. The Spoil Area will have two berms with a total capacity of approx imately 70,000 cu. yds. This will provide retention of water and spoils for over 3 weeks. With normal evaporation and absorbtion there may be no discharge from the berms. (3 x 19607 * 58821 cu. yd.) Daily monitoring of dikes and possible water discharge will be done with lab tests three times per week as per MPCA requirements for any possible discharge from berms. With culvert from wetlands to Lake Minnetonka blocked, the water quality of the wetland will be tested to insure that the nutrients are less than Lake Minnetonka levels before any water discharges from the wetland are allowed to flow into the lake. Dredging will stop if any possibility of overflow seems possible from marsh. The soils originally mapped in the area are Hayden and Glencoe soils. According to the soils map the depression area consists of Glencoe silty clay loam soil. Although this area may have a watertable near the sur face for extended periods we do not consider this area a wetland. There are two reasons for this 1) Glencoe soils are basically mineral soils rather than organic; and 2) the vegetation present in this area does not seem to indicate the presence of a wetland. As for the dredging itself pemits fran the Department of Natural Re sources and the Corps of Engineers are necessary. These agencies slould probably be contacted to find out what their policy on a project like this will be. If you feel that we can provide any additional information please feel free to call me. The Board of Directors of the FBRF has agreed to accomodate the spoils on their land using all the technology available to ensure that the project is environmentally sound* This involves estab lishing a holding pond with -filtration of water into a wetland, followed by slow filtration from the wetland back into Lafaystte Bay. Ule propose to use a mud-Cat to take 2^ feet of silt out of the existing boat channel. Dredging the channel in this way should have little im pact on the ecology of the bay, in fact it may wall im prove the habitat for flora and fauna by increasing water circulation in this sheltered (sometimes stagnant) bay. Bearing in mind that the residents of Uiest Lafayette Bay and the FBRF have organized themselves in such a community project costing approximately 830,000, we urge you to help us and advise us on the protocols needed to begin this project as soon as possible. After a number of meetings, our community decided to embark on a dredging project to remove accumulated sediment from the existing bo«t channel by using the Mud-Cat (National Car Rental) technique. The Mud-Cat was chosen because it provides the method which causes least ecological damage. The Board of Director's of the Freshwater Biological Institute agreed that the dredge could be placed on their land taking all precautions to ensure that there is no return of nutrients to the lake resulting from this activity. We enclose photographs of the proposed dredging area and the proposed dredge retention site. Unfortunately, the dredge retention site is less than 1000 feet from the lake shore and would be in violation of an Orono City Council Ordinance on Dredging Spoils. Accordingly, we have designed the spoil area with a capacity to exceed the 7 day retention time required by the M.P.C.A. The spoil area as outlined on the rttached topography map will have a cross-sectional ar .‘a of 176442 souare Teet. By constructing a dike along sides 4 through 9 i > the 942 foot elevation, the average depth of the onn^ >'ould be 7.17 feet with a holding capacity of 46,900 cubic yards. Once dredging operations are started, an average of .75 feet of slurry would be deposited into the spoil area daily based on the following criteria. 1, Cross-sectional area of the spoils basin is 176442 sq. ft. 2, Estimate is based on pumping an average of 2000 gallons of slurry per minute, 8 hours per day. Based on the above, the spoil area would be filled to 70 percent of total c.^pacity after 7 days of pumping time. After 7 days of dredging we would begin to decant the water back to the lake through the pipe stand arrangement shown on the attached map. The decanting process would then be continued daily for the duration of the project. As you know, Vt. Cwcen, the Fresh Water Piolorlcal Institute has aggreed to assist us in our effort to ensure optimum water quality standards are met by continuously monitoring the suspended solids content of the return water. If their tests dictate, it will be necessary for us to cease dredging operations until water quality standards can be met. Upon completion of dredging ope: ations the spoil area will be drained of all water. The next step would be to level off and contour the dikes and dredged mater ial. By proper placement of the discharge pipe it will be possible to end up with basically the same ground contours as presently exist with a minimum of landscaping. The main difference will be that th' present ground contours will be approximately 2 feet higher in elevation. If you wish, however, we can place the material as shown in either of the proposals as drawn up by the Gordon R. Coffin Co., Inc. In summary, the spoil area will be large enough for us to pump 9 to 10 days before having to return any water to the lake, thus allowing ample settling time. During out studies on nutrient release from the spoils area we would also take the opportunity to examine run-off from Navarre (i.e. the Super Valu parking lot). We could examine both lead and oil contamination of the Institute wetlands while it is sealed off as a holding pond. This study will give us an idea of the sources of pollutants resulting from urban development of a small community such as Navarre. I I • The Cr.;juission reviewed these documents briefly. Mr, Novak also presented a map of the spoils disposal area with 7 irserts scaled to indicate the rise in elevation resulting from the spoils as they are deposited over a seven day cycle period. After a lengthy discussion the Commission tabled the issue for lack of time to review the latest documentation submitted. They also requested a more specific detailed schedule of procedures and precautions taken during the project. After the tabling action by the Commission, the association representatives requested the Commission for a consensus of opinions regarding the disposal project if all necessary documentation were submitted. This request was to assist the associatiou in determining whether they should proceed with submitting necessary applications with all other agencies. When the t. job is done*the area will be graded and seeded, and the- only difference you wil_ notice is that the area will be flatter than before. In preparing the area fcr this project, dikes will be built where necessary, s:that we will end np with a basin which will hold 7 day's jumping before any water runs back into the lake.This will ensure that all solids settled out, and the waier running back into the lakes meets Minnesota PCA sta-fards. The dikes will be built by pushing dii't from inside the disposal area. When the job is completed, tney will be levelled and contoured along with the other fill— The disposal area will -se only the high, grassy part of the meadow, and care will be taken to prevent any damage to nearby marshy areas, both during construction and afterwards. April 24, 1978 Hennepin County Park Reserve District Bike/Hike Trail, Baker Park Reserve #378 This is a conditional use permit and wetlands variance to fill some wetlands along Highway 6 for the purpose of constructing a bike/hike trail as it rings the Baker Park Reserve. The enclosed materials from the Park Reserve District explain what is requested and show the extent of filling on the maps. Planning Commission Meeting 4-24-78 At this meeting present were Mr. Tim Marr and Mr. Alex Mayer. They went through the materials and explained to the Planning Commission the extent of what was requested and the reasons for it. They showed a total of 7,1 mile trail around the entire park and including a 1.2 mile section of trail within the City of Orono. The trail would be asphalt surfaced except through the fill area we are discussing here, which across the marsh vould include a crushed lime stone surface. It is expected that snowmobiles would use the adjacent horsetrail in the winter but that the bike trail would only be used by skiers and other pedestrians at that time. Note that this has been before the Park Commission and that Commission on April 4, 1978 recommended approval of the trail as being in the interests of the Park Commission. The Planning Commission was interested in having all members completely review the facts and they did have one question of the Park Reserve District - that being as to how much of the marsh would be filled by this proposal. Planning Commission Meeting 5-8-78 Tim Marr and Alex Mayer were present. They stated that approximately 1.5 acres or 0.3X of total marsh area would be filled. The trail would be constructed to within 50-75 feet of road right-of-way leaving wetlands between road and trail. Jim Olson stated that drainage is probably of only slight concern and that culverts would be used. Applicants stated that they had approval of Watershed District, preliminary approval of DNR hinging on cu’veiL sizing, and preliminary approval but no permit yet from the Corps. Applicants proposed use of construction fabric as a fill base to minimize uneven settling or mixing of fill materials. Upon Planning Commission questioning of what could be done to minimize detriment to the marsh, Jim Olson suggested: 1) move trail toward the road or 2) reduce width. Commission members discussed reducing width, leaving out trees and fencing for the 1200 foot length across the marsh. Commission felt that unnecessary aesthetic value should not be created to detriment of the marsh. Jim Olson wanted to see soil borings and cross-sections of the trail. He informed the Commission that the Tnylors have lived on the property since 1925 and that there are two residtiu^es on the property, one of which has been sold to another party, Alsn, there are two sewer connections to the property. The suggestion was made that Lot 4 be combined with the north % of Lot 3 to make two buildable sites and request rearrangement of the lot lines. Mr, Quello stated he would discuss this with the applicants prior to scheduling a public hearing. The Planning Commission was concerned about creating two new sites, neither of which would comply with the lot size requirements in that zoning area. PLANNING COMMISSION - April 10, 1978 The Zoning Administrator informed the Commission that he had not received any word whether applicant had as yet researched possibility of obtaining the adjoining vacant land (north % Lot 3) to combine with subject property. Scheduling of Public Hearing would be delayed until such data is submitted. STAFF - May 9, 1978 Phone call to A1 Olson from Mrs. Taylor. She was concerned with delays in subdivision review and with new require” ment" to purchase adjacent lot. She says lot is understandably unbuildable but she cannot understand why she should be asked to acquire it - why she can't proceed with her substandard division. She was told that the Planning Commission meeting of March 27, 1978 was the first appearance of application and that her attorney was requested to submit information to the city regarding possible acquisition of the adjoining lot and that to date no contact had been made until her call. She was reluctant to purchase property because she would in effect have to "give" it to the purchaser of 22-29 as a gift. She did agree to send a letter to the City in response to the Planning Commission request and to try to have information available for the Planning Commission meeting of June 12, 1978, She requested the Public Hearing be scheduled for that date which I agreed to. Subdivision SKETCH PLAN REVIEW This is a proposed two lot residential subdivision (lot split). One new lot is being created with a private easement shown for access. The property is not sewered and is not assessed even though there is a sewer ease ment through the north lot. Zoning is RR-lB. Each lot meets the area and width requirements. Lot 1, 163,068 sq. ft. (3.74 acres ex cluding road. Including easement to rear lot). Lot 2, 87,312 sq. ft. (2 acres+ including creek). Staff recommendations include the required septic site testing on Lot 2 prior to preliminary approval and a flowage easement along the creek. Planning Commission may wish to see Lot 2 increased in area slightly to allow for the creek area. Planning Commission Meeting - April 24, 1978 Rusciano's were notified that they were on the agenda for the April 24th meeting (sketch plan). No representative appeared, hence the Planning Conmission tabled it. Planning Conmission Meeting - May 8, 1978 Mrs. Weinzeirl appeared at this meeting. Planning Commission suggested checking whether creek is subtracted for wetlands, and if it is change division line to keep the two-acre area. i^ecommended that a^tuaj^ location of sewer easement (as built) should be on the final plat. V Phillip Rusciano 2340 Watertown Road Subdivision Page 2 Staff Note - May 16, 1978 The creek is not identified on the wetlands map (it is a drainage course--not a pcading area). The City should expect a drainage easement over the creek. The bays are limited to an area of 20 square feet- Explain Request Relative to Requirements: The Building Inspector has Issued a building permit for the construction of my house on this property. To obtain the permit we adjusted the size of the house and the location on the site to comply with the side lot restriction of ten feet. One window bay on one corner of the house projects the allowable two feet (2') into the side lot set back. Tlie projecting bay is approximately ten (10) square feet in area. The building inspector issued the permit on the condition that the foundation under the bay be cut back to the ten foot set back line. The reason given for this requirement was that it did not qualify as a "bay” with a foundation under it. Neither the ordinance nor the Building Code provide a definition of a bay. The purpose Is to establish a reasonable boundary for the authorized dock use area required by LMCD and City of Orono regulations. The proposal was suggested to Mr. McCleary at the Orono Marina Committee meeting held on April 18, 1978. The revised dock use area will provide for 66 slips as per previous years licenses without the need for general harbor dreflging. The only dredging required under Application //294 would be a 30 ft. wide channel to the launching ramp. The result of this proposal is in concert with the Council direction given on March 30, 1978, with no adverse precedent established by the*down zoning. The issues of note: 1. 2. 3. 4. A specific determination of the nund>er of waterward slips. A possible determination of the maximum boat units to be stored on land similar to the North Shore Drive Marina Agreement. The Issue is whether or not the City would consider rezoning a small portion of the adjacent residential area to facilitate dock rearrangement in lieu of dredging or whether dredging will be permitted at all regardless of resulting dock layout. The proposed layout is similar to one submitted in a letter from Mr. McCleary's attorney, received 12-22-77. The Planning Commission last reviewed the dredging appli.catlon on 8-15-77. The Minnetonka Center of Arts and Education is faced with a problem of insufficient space and inadequate facilities to meet the demand of its students and members. Its concept of service, flexibility, adaptability, timeliness, effective ness, efficiency and economy are severeljr handicapped. In order to remedy this situation the Center plans to remodel its existing main building and to build an attached addition to the main building which will include space for a pottery studio, sculpture studio, a painting studio and additional office space. While the plan does envision additional student enrollment the main thrust of the building program is to make available more adequate facilities to our presently enrolled students. Per your request attached are 20 copies of the Architect's sketch showing use and location. The Center has employed the firm of Hammel, Green and Abrahamson, Inc. as its architect, well known in the twin cities with a fine reputation. The Center has also engaged the firm of Lovering Associates as the prime contractor, also with a fine reputation. The Center hopes the City of Orono will approve this contional use permit as soon as possible as in the case of all schools it is limited in time to schedule the renovation and building during the coming summer while classes are not in session. AN ORDINANCE TO A2-1END THE MUNICIPAL CODE OF THE CITY OF ORONO RELATING TO THE APPOINTMENT OF CHAIRPERSON AND VICE CHAIRPERSON AND VACANCIES OF THOSE POSITIONS FOR THE PLANNING COMMISSION, PARK COi-lMISSION AND HUMAN RIGHTS CONu-lISSION; AMENDING CHAPTERS 1, 9 AND 12 OF THE ORONO MUNICIPAL CODE BY ADDING CERTAIN SECTIONS THE CITY COUNCIL OF THE CITY OF ORONO ORDAINS: Section 1. Chapter 7 of the Municipal Code of the City of Orono is amended by amending Section 7.030 to read as follows; 7.030. Organization - Meetings. The coxincil shall appoint a chairperson and vice chairperson from among the appointed members for the term of one year commencing January 1st of each year. Any vacancy of the chairperson or vice chairperson shall be filled by appointment by the council for the unexpired portion of the term. The commission may create and fill such other offices and committees as it may determine. The commission shall hold at least one regular meeting each month. It shall adopt rules for the transaction of busi ness and shall keep a record of its resolutions, transactions, findings and determinations, which record shall be a public record. Expenditures of the commission shall be within amounts appropriated for the purpose by the City Council. Section 2. Chapter 9 of the Municipal Code of the City of Orono is amended by amending Section 9.040 to read as follows: 9.040. Organization - Meetings.
