The deck encroaches to within 64 ft. of the shore and well in front of the adjoining homes. SPECIAL NOTES:The home is a converted simmer cottage on i 50' x 190' (9500 sf) lot and is located 4.23 ft. from the west lot line, Tliere is no foundation under the existing porch and questionable foundation under the remainder. Remodeling in excess of 50% of the market value ($14,600 7 2 = $7,300) would also require variances to 34.552, lot area and lot width. Box 66 Crystal Bay, Minnesota 55323 Members of the Planning Coniinisslon: In accordance with your wishes verbally glv.n to me at the Planning Commission meeting on April 10, 1978. I am, by this letter, reapplying for a variance in accordance with the plans that you reviewed at the April 10 meeting. The property is at 1420 Boulder Park Road. However, in resubmitting I herewith agree to delete the front deck from the lakeside of the home and further agree that the steps that I reconstruct will be no larger in length, width or height than those presently existing. Since the April 10 meeting, I have spoken with Mr. A1 Olson from the building Inspector's office who indicated to me that this was a proper method to resubmit for variance, and I herewith request that action be taken on this variance at your next regularly scheduled meeting on April 24, 1978. VARIANCES:34.842 lot area and lot width, front and side setbacks. Requirements: 2 acres (87,120 sf) and 200 ft, width, 50 ft. front and 30 ft. side setback. Actual: 12,525 sf acre) and 100 ft. width; 35 ft. front, 10 ft. and 37 ft. side setbacks. Variances: 74,595 sf (86%) area, 100 ft. (50%) width; 15 ft. (30%) front setback and 20 ft. (667») side setback. SPECIAL NOTES:1) The adjacent lots 5 & 6 are also vacant though ovmed by another party. If all 4 lots 3-6 were to be combined into one building site, a lesser lot area variance would be required (25,050 sf = ^ acre = 72% variance), and no lot width variance or side setback variances would be necessary. 2) Other houses on this block are located on lots ranging in size from 12,525 sf to 18,750 sf. 3) This area has had a severe septic system problem due to the soils and relatively dense development. P. Olson, Village Planner DATE: April 20, 1978 RE:Phillip Rusciano, 2340 Watertown Rd. Subdivision SKETCH PUVN REVIEW Tills is a proposed two lot residential subdivision (lot split). One new lot is being created with a private easement sho\^i for access. Tlie property is not sewered and is not assessed even though there is a sewer ease ment through the north lot. Zoning is RR-lB. Each lot meets the area'and width requirements. Lot 1, 163,068 sq. ft. (3.74 acres ex cluding road, including easement to roar lot). Lot 2, 87,312 sq. ft. (2 acres+ including creek). Staff recommendations include the required septic site testing on Lot 2 prior to preliminary approval and a flowage easement along the creek. Planning Commission may wish to see Lot 2 increased in area slightly to allow for the creek area. '1 TO:Bruce D. Malkorson, City Attorney FROM:A. P. Olson, Asst. Zoning Administrator DATE:March 3, 1978 SUBJECT: 73-1 Easement Rusciano - 2340 Watertown Road Zoning:Tlie property as plattcdhas 5.76 acres and is approximately 325 ft. wide. RR-lB zone requires 2 acres and 200 ft. lot width. Therefore, this parcel coi’.ld be divided once into two lots with the sewer easement having no effect upon the platting. If the property were to be serviced with the sewer and rezoned to R-IA, the parcel could be divided into 5 lots each exceeding 1 acre and 140 ft. lot width. Assessments would have to be levied for lateral and unit charges. The easement would not affect the platting possibilities due to the shape of the parcel, the minimum zoning requirements and the easement location. As-built location: I walked the line today and compared the manhole (sewer centerline) locations with property corners and tht proposed easement description. My recommendation is to have a surveyor accurately locate the as-built pipe location and provide a revised easement description accordingly. I've added the dotted lines to indicate approximate location of the means of access to the property. The unimproved access road starts at the south end of Turnham Rd. and continues south to the Luce Line Ti'cail. At this point the road turns east along the north border of the Luce Line over what appears to be parcel 7/5800 to the east end of parcel #3360 (indicated as the Lathrup Co., Inc. property). At this point it crosses the Luce Line trail and continues south to the subject property. This road serves as the access to several other neighboring residences but no documentation of their existence has been submitted. The property is located in RR-lA zoning district (5 acre or 217,800 sq. ft.) Approval of this application would require the following variances: 1. Lot area - 173,810 sq. ft, 2. Lot area - 30,000 sq. ft, 2. Lot width - 77' 3, Street setback - 25' 4, Side setback - 7' Applicant obtained staff approval for an addition to the existing residence about a year ago. This was shortly after the adoption of our current policy. Council waived variance procedures for additions which would not encroach existing setbacks. Henry Muhich, Building & Zoning Administrator, read into the record the Planning Commission Minutes of April 18, 1977, regarding a conditional use permit for a crop program for Hennepin County Vo-Tech; CONDITIONAL USE PERMIT Vo-Tech #247 Mr. John Lobben was present. The Zoning Administrator stated ^hat since the work session at the last meeting, Mr. Lobben has submitted some plans for a bridge going over the existing creek for access for the farm equipment from the Medina area, Pro£>osed bridge would be a flat bed, 24’ long and 8' wide, to be constructed by the students. 'Dicy found an agi'cenont as to wliat frontage in this lagoon is conmaily beneficial to all homeowners (channel is coi:nonly bene ficial and the 340* west wall which is abutting the mirsh). They then came up with a fonnula to di\dde the lagoon frontage between each individual owner. Their preferred solution to this problem is a combination of riprap and seawall; three rcirbers prefer ripnip (bills, DcGregory, Crist), while four menbers prefer the seawall (Hartmann, Blunt, Nelson, Reese), Marti;iann stated tliat from an engineering standpoint ice would have a rore damaging affect on rijuap tlian it would on the seawall. Riprap would also require reiroval of the high bank. Tlie cost of the riprap is inucli higlier than the seawall. Aiother nc*irf)er of the association expressed his concern for the removal of a large nui'ber of trees that would be necessary if they were to riprap the entire area. The Planning Consnission was not in favor of the retal seawall and preferred riprap or a wooden replacement. Hoever, this situation being unique because of the straight sides and depth of tJie seawall and future dredging would not be needed as soon as without rip rap we allow, the Coi.mission felt tlie sea-wall was a solution tc this situation. The Planning Commission was also concerned about the seawall from a public safety aspect. Mr. Hartmann stated that the Association would be willing to provide the necessary safety measures. After some discussion, Pesek moved, Hosfield secontled, to recoirtnend approval of a combination of riprap and aluminum seawall for protection of the lagoon and channel subject to the folleaving conditions: (1) 'Ihe City*s receipt of revised, detailed plans indicating exact location of riprap and ser\ all ns preferred by indi\Tldual renhers of the Association. (2) A written statement of approval frojn all projx?rty owners and underlying fee o\sner of lagoon and channel. The total length of the proposed rail, including the main loop and spur connection is 7>1 miles. Of this total length, approximately 1.2 miles lies within the City of Orono. This distance includes approximately 0.2l| miles along Starkey Road for the spur connection to County Road 6. THOMAS e HUMPHf«V,J« MAKE PLAIN In order to complete the loop trail, It will be necessary to construct a fill adjacent to the Lake Katrina marsh at the point where the marsh is closest to the Right-of-Way of Highway #12. This fill will carry the bike/hike trail and the horse trail. Top of the fill will be 3^*. fset wide and side slopes will be at 3:1- The fill will be located as close to the Right-of-Way line of Highway #12 as possible. The new fill will also make use of the existing horse trail fill which was partially completed several years ago. Surface of the trail through the fill area will be crushed limestone. I estimate that total quantity of fill required to be 5,000 to 6,000 cubic yards. This material will be t.'*;en from a stockpile and borrow area located Just to the west of the proposed fill. This fill is necessary so that this trail can be constructed as a loop around the park. It is desirable so that the experience of the trail user can be continuous. Our recent experience with the horse trail, which was never completed through this area, shows that there is a reduction in user satisfaction with a "dead end" situation. i j Page Two Mr. A1 Olson, Planner Permits for this work have been applied for from the Minnehaha Creek Watershed District, the Minnesota Department of Natural Resources and the U. S. Army Corps of Engineers. To date we have received approval from the Minnehaha Creek Watershed District as shown on the attached letter. We feel that this proposed fill will be in the best interest of the public and will not be detrimental in any way to the objectives of the City of Orono. PROJECT The Hennepin County Park Reserve District is preparing plans and specllicatlons for the construction of approxiieately 7.2 miles of asphalt paved bike-hike trail within Baker Park Reserve in Western Hennepin County. This pioject is part of the nearly 30 miles of bike-hike trail which will be constructed in our various park reserves this summer under one of Covenor Perpich’s trail programs. • This trail is a loop around the south half of Baker Park Rffserve. Access to the trail will be from County Road ^6, County Road fl9 and County Road and a trallhcad area near the Baker Beach. At the south end, the trail will run along the perimeter of the Lake Katrina tnarsh for a distance of about 1,200 feet. We propose to construct a fill adjacent to this marsh to support the combined bike-hike and lorsetrails. The new fill will be located adjacent to the horsetiail fill which was partially completed in 1973. We do not propose to sub-excavatc before placing the fill. Ve anti cipate that some settling may occur during the first years. The surface of the trail in this area will be crushed limestone, rather than asphalt. We estimate that approximately 6,000 cubic yards of fill will be required. The proposed structure would bo a clear span arched bridge, 10 FT, pathway of steel construction with wood rails and trim. Primary reasons for considering a new bridge were: 1 , Inability of current bridge to acconmodate road and drainage im provements without dismantling. Increasing cost of new bridge in future years if installation is delayed. Difficulty experienced by trail users who must cross at road grade elevation. A motion by Tomlinson, seconded by Kelley, to recommend to the city council that DNR plans for a new bridge be favorably considered was unanimously passed. One item of concern to the City is the plan to corinoct one spur of the trail by permitting bicycle and pedestrian travel along 1R50’ Tapproximately) of. Starkey Road, a road within and maintained by Orono, A second concern is the proposed filling along Highway 12 of a portion of the swampy low groxmd near the outlet of Lake Katrina (aka Rice Lake) to accoinnodate another portion of the bike trail. In view of the advantages of ex tending bicycle trails connected to existing and proposed trails in Orono, the following recommenda tion is made to the council; Motion by Berglund, seconded by Erger; "It is recommended to the Orono City Council that every effort bo made to support the Hennepin County Park Reserve Distf'ict in its endeavor to construct bike trails in Morris Baker Park, including the connecting spurs on non-park property, provided: 1. Approval based on thorough study is received from the city engineer, and Some type of release from public liability for that portion of the trail along the public road be secured from the park reserve district. Variance 34.440, 31.310 The applicant is requesting a variance for construction of a private dock on Outlot A of the Partenwood sub division. Mr. Safar has made an offer on Lot 1, Block 3 upon which he intends to erect a home. At the time of the plat approval for Partenwood on June 26, 1972, Outlot A was created as lake access for Lots 1 and 2, Block 3. See attached covenants which were in the City files. Current regulations prohibit construction of a dock on detached outlets; hence the variance request. No comments exist in the record concerning the proposed use of the outlot. Note the applicant's comments on the application form regarding overall shoreline density. Review of this application should also address future dock requests for Lot 2, Block 3. i.e., the outlot was obviously originally intended for use by two lots and up to four boats. Gaffx'on DATE:April 28, 1978 SUBJECT: Preliminary Septic & Soils Evaluation of Proposed Konerza Building Site, 245 Tonka Avenue On April 25, 1978, I met with Jim Anderson of the Soil Conserva tion Service. A soil boring made on the above property revealed black sandy clay muck to a depth of about eight inches and very sticky brown cl?y below it to a depth of at least 16 inches. I was ahlt'’ to roll a clay ribbon about eight inches long and *5 inch diameter. This generally indicates a percolatic rate over 60 minutes per inch, thus requiring a mound or other alter nate sewage system. The water table was located at about 8-12 inches below the surface. The general soils map of Orono shows Kilkenny and Hamel soils on the site, both of which are considered unsuitable for standard systems. hfy recommendation is that before this lot is approved as a building site the applicant should demonstrate that a mound system can be located on the site within the code requirements.
