Lot size and location of existing structures are non-conforming. Mr. Dye would like to build a 12' x 24* addition to the rear of his existing residence. A 50 ft. rear yard setback is required in this district. The proposed addition would result in a 3 ft. encroachment of the 50 ft. setback requirement. A variance of 3 ft. would be necessary for approval. Since the one variance is necessary I would suggest we address the remaining non-conformities. The lot lacks 100 ft. in width and 68,970 sq. ft. in area. The existing garage is approximately 12% ft. from the road so a variance of 37% ft. is necessary. Our current procedures include sketch plan review by the Planning Commission. Therefore, we will not be able to schedule a public hearing on this proposal \uitil the Planning Commission has a chance to review the sketch plan and direct staff to schedule said public hearing. The entire parcel consists of approximately 17.4 acres. The survey indicates 2 wetlands areas of .55 acres and .60 acres as conservation and flowage easement areas. The proposal as submitted consists of dividing the original parcel into 4 lots - each exceeding the minimum lot area and width requirements in this zoning district (RR-lB - 2 acre area - 200 ft. lot width). Kelly - 85 South Brown Road Subdivision SKETCH PLAN REVIEW:This subdivision is a proposed lot line rearrange­ ment and subdivision resulting in three parcels where two now exist. Parcel A, 6.19 acres Including a drainage area along the west edge. Parcel B, with an existing house, 88,447 sf including some wetlands along Brown Road and up to the existing driveway. The area was holding water to within 18" of the drive on 4-4-78. Parcel C, with an existing house, 98,150 sf (up from 60,000 sf) including a drainage way along the west edge. Each parcel exceeds the minimum lot area, lot width and structure setback requirements. Staff has asked for copies of the torrens certificates noted on the drawing. I I believe three issues should be addressed: The relationship of this division to the other rec ^nt divisions to the west, particularly the Jackson redlvislon of the Kelly and Kelly division. Note that when the Kelly and Kelly division was first proposed, staff recommended a review of all of this property for continuity and good planning of roads, access, lot design, etc. Access is important. Parcel A at 6 acres could be redivided. I suggest further review of possible divisions and road location. The road should be an outlot with access available to all future lots. A real possibility is the connection of this road to the new cul-de-sac in the Jackson division along the route of the existing road which connects these houses to the nursery buildings. The "ravine" noted in earlier reviews is not that much of an obstacle. The wetlands and drainage areas should be identified and protected in the standard manners. (Mr. & Mrs. Dunkley) 2380 Shadywood - Conditional Use Permit New Horizon Enterprises is requesting a Conditional Use Permit to operate a child care center and several other services at the site previously known as the Calvary Memorial Church on Shadywood. Exhibit D Exhibit E Exhibit F I would suggest we review the proposal during our work session to determine if any additional material might be necessary. After receiving the data necessary, I would recommend we schedule a Public Hearing with regard to the proposal. PLANNING COMMISSION - March 27, 1978 Mr. Dunkley was present. He reviewed for the Commission the various child care programs they plan to offer. He also indicated they would be interested in obtaining a conditional use permit for accessory use of the church for rental by groups for weddings, receptions, movies, plays and at times would include alcohol on the premises. It was noted the property would have to be rezoned to B-1 if the intended use will include alcohol because that would be the only zoning district where a permit could be issued for alcohol. The Planning Commission indicated they would like additional information pertaining to the use of alcohol on the premises. Mr. Dunkley stated he would like to check further into the possibilities and requirements of allowing liquor on the premises before a public hearing is called. The Commission addressed busing. Mr. Dunkley informed them they have worked with the schools to drop off the children at their facility. Jim Olson, City Engineer, suggested the applicant locate the egress and ingress and the traffic pattern of the busses. Two alternates were submitted (P.R.D. and preliminary plat). Developer requested some direction as to what design the Commission might prefer. The Zoning Administrator reviewed the revised plans which had been submitted since the last Planning Commission meeting. He explained the request is for a subdivision rather than a Planned Residential Development. The Commission advised that the road should be addressed as a separate parcel. The Planning Commission called a Public Hearing for April 24, 1978. It was suggested the location of the existing shed should be noted on the plans. Also, that a review shouLd be made of soils and drainage. THE SKETCH PLAN Purpose and Requirements 1. Purpose. The Sketch Plan is an initial presenta­ tion of the subdivider's intention and serves as the basis for conceptual discussion between the city and the sub­ divider. 2. Requirements. A Sketch Plan Review shall be completed for each proposed subdivision prior to the city's accepting any Preliminary Plat application. Sketch Plan Application. Detailed application and drawing requirements are established and listed in Section 39.260 of these regulations. 1. Class 1 Subdivision. The Zoning Administrator shall review Class I Sketch Plans on a no-fee, no formal appplication basis subject to the following exceptions: (a) The Zoning Administrator may require Planning Commission Review of a Clas I Sketch Plan involving unusual circustances or topography or when the sub­ division classification is in doubt. (b) The subdivider may request Planning Commission review of any propossed Sketch Plan. (c) Before the Planning Commission review*- mts Class I Sketch Plan, the subdivider shall file /vm^Cftte application and pay all fees as required for review of Class II and Class III Sketch Plans. 2. Class II and Class III Subdivisions: The Planning Comfii'iRgien shall review Class II and Class 111 Sketch Plans based upon the subdivider's formal application. Incomplete applications will not be reviewed. Complete applications shall include the following: (a) Completion of all items on the Sketch Plan application form. (b) Map 1; a location map. (c) Map 2; a half-section map. (d) Map 3; a certificate of survey of the property, (provide 10 copies if this document exceeds 8 1/2 by 14 inches) (c 39.226 39.227 V.. Particular attention will be given to the location, arrangement and size of lots, the futher development of adjoining lands as yet unsubdivided, and the requirements of the Zoning Code and Comprehensive Land Use Plan. 2. Recommendations to te Subdivider. After reviewing and discussing the Sketch Plan, the Planning Commission and/or Zoning Administrator will advise the subdivider of the specific changes or additions, if any, which will be required in the layout, and the character and extent of required improvements and dedications which will be required as a prerequisite to the approval of the Prelimin­ ary Plat. The Planning Commission may re.iuire additional changes as a result of further study of the subdivision in final form. Said approval shall constitute authoriza­ tion to prepare and submit a preliminary plat application. Appeal to the City Council. Should any subdivider wish to appeal a recommendation of the Planning Commission to the City Council, the subdivider shall, within 10 days of the action by the Planning Commission, file a written apeal with the Zoning Administrator on forms provided for that purpose and pay an Appeal fee according to the current ffic schedule. Upon filing of an appeal, the Zoning Administrator shall have 10 days to prepare a report and place the appeal on the agenda of the next regularly scheduled City Council meeting. The City Council shall review the report and apeal and may concur with the Planning Commission or may instruct the Planning Commission to reconsider the application. Effective Period of Sketch Plan Review. Planning Commission recommendations concerning any Sketch Plan shall remain effective for 180 days after the date of Planning Commission review. Failure to file a complete Preliminary Plat appli­ cation within this time period shall be construed as formal withdrawal of the proposed subdivision. Renewal of any proposed subdivision after this deadline shall require a new Sketch Plan application including application form, material submittals and fee payme.nts. 39.230 39.231 C 39.232 THE PKELIKI?,7-.FV PLAT Purooso and P.eauirc-rr.ents. 1. Purpose; The Preliminary Plat is the second stage of the subdivision review process. During this stage, the subdivider details his proposals and the city details the platting requirements. All basic platting determinations are made before the city council will pass on the Preliminary Plat. 2. Requirements; The subdivider is required to furnish detailed surveying, engineering and legal infor­ mation sufficient to ensure compliance with the City's Comprehensive Land Use Plan and Zoning Code, and other local, state, federal, watershed or conservation district regulations. A Preliminary Plat Review shall be completed for each subdivision proposed prior to the city's accepting any Final Plat application. 3. Prerequisite: A Sketch Plan Review by the Zoning Administrator and/or Planning Commission shall have been completed within 180 days of the filing of any Preliminary Pat application. The subdivider shall be prepared to address or correct all problems, concerns, violations or pertinent comments included in the recommendations made as part of the Sketch Plan Review. (4) Where the subdivider owns property adjacent to that which is being proposed for the subdivision# the Planning Commission may require that the subdivider submit a sketch plan of the remainder of the property so as to show the possible relationships between the proposed subdivision and any future subdivision. In any event# all subdivisions shall be shown to relate well with existing or potential adjacent subdivisions. (5) Such other information as may be requested by the Zoning Administrator# City Engineer# City Attorney# Planning Commission or City Council. (j) The Preliminary Plat Review fee. 4. Application Deadlines. The subdividei: shall file a complete Preliminary Plat Application with the Zoning Administrator at least 30 days prior to the regularly scheduled Planning Commission meeting at which, a public hearing can be scheduled. Staff and Agency Review of the Preliminary Plat. The Zoning Administrator shall coordinate the review of Preliminary Plats by all appropriate city staff persons and governmental agencies. 1. Referral to Planning Commission. Upon receipt of a complete Preliminary Plat Application# the Zoning Admini­ strator shall place the application on the agenda of the next regularly scheduled Planning Commission meeting. The Planning Commission shall then begin reviewing the proposal. 2. Public Hearing Notice. The Zoning Administrator shall schedule a Public Hearing for the first available Planning Commission meeting. Notice of said hearing shall consist of the address of the property and a brief description of the proposal and shall be published in the r c officitil nowcj:r:oc-r at least ten (10) days prior to the hearing. V.’ritton notification of said hearing shall be nailed at least ten (10) days prior to all owners of land within three hundred fifty (350) feet of the boundary of the property in question. 3. Referral to City Staff; The Zoning Administrator shall refer the appliation to all appropriate city staff personnel for review and comment. Written evidence of review and recommendations from the Zoning Administrator^ City Engineer and Finance Director shall be entered in the minutes of the Planning Commission Public Hearing. Where appropriate^ review and recommendations shall also be entered from the Public Works Director, Chief of Police, Fire Chief, Building Inspector, On Site System Inspector or other city personnel. 4. Referral to Park Commission. Where the proposed plat includes provisions for the dedication of land to' the site for public parks purposes, trails or jointly used recreational facilities, the Zoning Administrator shall refer the application to the Park Commission which shall review the proposal and provide recommendations to the Planning Commission before the close of the Public Bearing. 5. Referral to other Agencies. The Zoning Administator shall contact other government agencies or jurisdictions as may be appropriate to seek staff assistance, information and comments as may be applicable to the proposal. These agencies may include, but are not limited to, the Minnehaha Creek Watershed District, Lake Minnetonka Conservation District, Minnesota Department of Natural Resources, Hennepin Soil and Water Conservation District, State or County Highway Department, local school districts and neignboring municipalities. No official action will be requested of these jurisdictions until after Orono Council action on the preliminary plat application. 6. Public Notice Posters. The City of Orono was at fault for the house being built without the proper setback from the lakeshore. I am requesting these costs be paid by the City of Orono or I will take the legal steps necessary to bring to the court's attention the illegal way the building permit was issued to 1020 Tonkawa Road and the setback violation. This has caused a loss of reasonable privacy and peace of mind for my family. The Mayor also noted that there was no survey submitted by Mrs. Gasch to support her argument that the site line was such that part of this property should be further to the rear. Mayor Van Nest continued by informing Mrs. Gasch that the Council felt that the setback as located was proper. That the City certainly had no ability to expend p»>blic monies simply because Mrs. Gasch felt that her property suffered a diminution of value or that she felt that she had lost some of her privacy. Mr. Hai-lmaim explained that the members of the association have been meeting on a regular basis for several months to discuss this problem. During these discussions, they established a set of common objectives - marsh disturbance, shoreline changes and total costs. He also stated that they did not want to establish a new pre­ cedent for wJiatever they do in the lagoon. Uicy found an agreenent as to what frontage in this lagoon is co,.nonly beneficial to all homeowners (channel is coinnonly bene­ ficial and the 340’ west wall which is abutting the narsh). They then came up with a formula to divide the lagoon frontage between each individual oivner. Their preferred solution to this problem is a combination of riprap and seawall; three menbers prefer riprap (Ellis, DeGregory, Crist), while four members prefer the seawall Olartmann, Blunt, Nelson, Reese). Mr. Hartmann stated that from an engineering standpoint ice would have a more damaging affect on riprap than it would on the seawall. Riprap would also require rerroval of the high bank. The cost of the riprap is much higher than the se^all. Another msnber of the association expressed his concern for the removal of a large nurber of trees that would be necessary if they were to riprap the entire area. The Planning Cemmission was not in favor of the iietal seawall and preferred riprap or a wooden replacement. Hweyer, this situation being unique because of the straight sides and depth of the seawall and future dredging would not be needed as soon as without rip­ rap we allow, the Commission felt the seawall was a solution to this situation. The Planning Commission was also concerned about the seawall from a public safety aspect. Mr. Hartmann stated that the Association would be willing to provide the necessary safety measures. Olson: As you know, the Hennepin County Park Reserve District Is proposing to construct a bike/hike trail around that portion of Baker Park Reserve which lies south of County Road 2k. The total length of the proposed trail, including the main loop and spur connection Is 7.1 miles. Of this total length, approximately 1.2 miles lies within the City of Orono. This distance Includes approximately 0.2k miles along Starkey Road for the spur connection to County Road 6. THOMAS B HUMPHREY, JR MAPLE PLAIN In order to complete the loop trail. It will be necessary to construct a fill adjacent to the Lake Katrina marsh at the point where the marsh is closest to the Right-of-Way of Highway #12. This fill will carry the bIke/hIke trail and the horse trail. Top of the fill will be wide and side slopes will be at 3:1. The fill will be located as close to the Right-of-Way line of Highway #12 as possible. The new fill will also make use of the existing horse trail fill which was partially completed several years ago. Surface of the trail through the fill area will be crushed limestone. I estimate that total quantity of fill required to be StOOO to 6,000 cubic yards. This material will be taken from a stockpile and borrow area located just to the west of the proposed fill. This fill is necessary so that this trail can be constructed as a loop around the park. It is desirable so that the experience of the trail user can be continuous. Our recent experience with the horse trail, which was never completed through this area, shows that there is a reduction in user satisfaction with a "dead end" situation. I r ! "J-m.r,’ Page Two Mr. A1 Olson, Planner Permits for this work have been applied for from the Minnehaha Creek Watershed District, the Minnesota Department of Natural Resources and the U. S. Army Corps of Engineers. To date we have received approval from the Minnehaha Creek Watershed District as shown on the attached letter. We feel that this proposed fill will be in the best interest of the public and will not be detrimental in any way to the objectives of the City of Orono. This project is part of the nearly 30 miles of bike-hike trail which will be constructed in our various park reserves this sumiaer under one of Govenor Perpich's trail programs. This trail is a loop around the south half of Baker Park Reserve. Access to the trail will be from County Road «f6. County Road i*19 and County Road 1^24, and a trailhead area near the Baker Beach. At the south end, the trail will run along the perimeter of the Lake Xatrlna marsh for a distance of about 1,200 feet. . i We propose to construct a fill adjacent to this marsh tc support the combined bike-hike and horsetrails. The new fill will be located adjacent to the horsetrail fill which was partially completed in 1973 We do not propose to sub-excavate before placing the fill. Absent: Lathrop. Also Present: Jim Olson, City Engineer and John Gerhardson, Public Works Coordinator, The minutes of the March 7, 1978 meeting were approved. A letter from Orono City Administrator, Dick Benson, dated 3/22/78, has assured the Park Commission that various projects which have been promoted by the commission are, in fact, scheduled to begin or continue in the upcoming construction season. ATTEKDA21CE MINUTES APPROVED LETTER FROM DICK ^SON Park Projects Will Be On Schedule Chairman Tomlinson, as directed by the conntiission, ACCEPTANCE OF TREE PLANTINGS has contacted Mr. Larry Gleason, whose property by Mr. Larry Gleason, whose is surrounded by Hackberry Park, regarding the property is surro\uided by location of transplanted trees in that park, Mr, Hackberry Park Gleason was appreciative of our concern and was willing to accept tree planting in the park wherever it could best serve the recreational and esthetic needs of the park. A drawing of the park, with tree planting priorities noted, has been sent to the city Public Works Coordinator as a guide for Hackberry Park plantings. Initial grading of Bederwood Park will begin when ground conditions allow. Mr, Otto Christensen, •- •ail planner for the Minnesota Department of Natural Resources, presented his department's plans for a replace­ ment bridge at the crossing of the Luce Line Trail and Orono Orchard Road. The proposed structure would bo a clear span arched bridge, 10 FT. pathway of steel construction with wood rails and trim. Primary reasons for considering a new bridge were: 1 . Inability of current bridge to accoronot^te road and drainage im­ provements without dismantling. * 2. Increasing cost of new bridge in future years if installation is delayed. 3. Difficulty experienced by trail users who must cross at road grade elevation. A motion by Tomlinson, seconded by Kelley, to recommend to the city council that DNR plans for a new bridge be favorably considered was unanimously passed. BEDERWOOD PARK GRADING NEW BRIDGE AT LUCE LINE TRAIL AT ORONO ORCHARD RD. Mr. Otto Christensen, from DNR, recommended witn com­ mission members to council. -1- JIEGULAR ]-2STIliG OF THE PARK COI3-1ISSION HELD APRIL kp 1978 Ilr. Alex Keyer and Mr. Tim Karr, of the Hennepin County park Reserve District staff, presented the district's plans for a bicycle trail around a portion of Morris T, Baker Park, One item of concern to the City is the plan to connect one spur of the trail by permitting bicycle and pedestrian travel along 1250' Tapproximately) of. Starkey Road, a road within and maintained by Orono. A second concern is the proposed filling along Highway 12 of a portion of the swampy low grotind near the outlet of Lake Katrina (aka Rice Lake) to accommodate another portion of the bike trail. In view of the advantages of ex­ tending bicycle trails connected to existing and proposed trails in Orono, the following recommenda­ tion is made to the council: Motion by Berglund, seconded by Erger: "It is recommended to the Orono City Covincil that every effort bo made to support the Hennepin County Park Reserve District in its endeavor to construct bike trails in Morris Baker Park, including the connecting sptirs on non-park property, provided: Approval based on thorough study is received from the city engineer, and Some type of release from public liability for that portion of the trail along the public road be secured from the park reserve district. Mr. Bruce Dayton, and his attorney, Mr. Louis Oberhauser, appeared before the commission to discuss Mr. Dayton's proposed donation of a certain parcel of Long Lake lakeshore and approx­ imately 10 acres to Orono for a public beach and park. Two considerations are foremost in the donor's stipulations regarding the property, namely: 1 2. Its use as a public facility shall not bo limited to persons for any reason re­ lated to place of residence, race, or creed. A home now situated at the corner of Old Long Lake Road and East Long Lake Road which is being given to the Spring Hill Conference Center, be permitted a variance to Orono zoning ordinances (2-acre min,) so that a logical property division can be made, giving the city the maximian land possible for park purposes. Mr. Safar has made an offer on Lot 1, Block 3 upon which he intends to erect a home. At the time of the plat approval for Partenwood on June 26, 1972, Outlot A was created as lake access for Lots 1 and 2, Block 3. See attached covenants which were in the City files. Current regulations prohibit construction of a dock on detached outlots; hence the variance request. No comments exist in the record concerning the proposed use of the outlot. Note the applicant's comments on the application form regarding overall shoreline density. Review of this application should also address future dock requests for Lot 2, Block 3. i.e., the outlot was obviously originally intended for use by two lots and up to four boats. Out-Lot A, therefore, may be used only by the owners of Lots One (1) and Two (2) of Block Three (3) and the use and enjoyment shall be subject to the following conditions, restrictions, limitations and covenants; A. B. C. There shall be no launching of power boats, pontoon boats or power craft, of any kind, from Out-Lot A. There shall be no docks erected or maintained within twenty feet of either side of Out-Lot A. There shall be no structures of any kind erected on Out-Lot A and this includes but is not limited to boat houses, on shore docking facilities, guest houses, anf! fish houses. Landscaping shall not be allowed without the approval of the Architectural Committee. D. E. There shall be no parking of vehicles of any kind on Out-Lot A. Out-Lot A shall not be used for any use or activity which is not compatable with the other lots in the Partenwood area. F.There shall not, at any time, be kept at Out-Lot A more than two watercraft by any one owner or resident, and no watercraft, of any kind, in excess of twenty- three (23) feet in length shall be moored, stored, or kept at the dock maintained on Out-Lot A. ' G.It is also intended that all of the other conditions, restrictions, and limitations with respect to type, placement, and color of docks, boats, watercraft, etc. shall apply to Out-Lot ^ the same as they apply to all other lots in the Partenwood Addition; except that, in the case of conflict the provisions of this Section IV shall prevail. H. A small sign designating Out-Lot A as private property shall be permitted upon said property. It is the overriding intention of the declarants herein that Out-Lot A is intended to serve the purpose of pro­ viding lake access for the owner or resident of Lots One (1) and Two (2), Block Three (3) of Partenwood Addition, and that any use of Out-Lot A must be consistent with the residential character of the Partenwood area, and it is intended that the use of Out-Lot A shall be a more re­ strictive use than that available to the other lots with­ in the area. It is also intended that Out-Lot A shall forever be kept, maintained and used only for the purposes outlined here­ in. Any violation of the provisions, conditions, or re­ strictions contained herein shall warrant the declarants or any other lot owner to apply to any court of law or equity having jurisdiction thereof for an injunction or proper relief in order to enforce same in the court, and, in its descretion, may award the plaintiff his court costs and reasonable attorneys fees.
