This Included (1) City Engineer Jim Olson's report dated March 8, 1978, (2) Devel-.per's Engineer, Bruce Kelly's, reporr dated March 3,1978, (3) Developer's purchase agreement and riders, (4) Declaration of covenants, conditions, restrictions and easements, (5) LesT<iloper*s attorney, Steven Pflaum's letter to Bruce Malkerson dated Mar^'i 7, 1978. The questions raised ry the City Engineer were discussed. There appeared to be an agreement trst roost of these were technical Issues which could best be resolved by tae City Engineer. Steve Pflaum's letter was also discussed. Hie Planning Commission members were somewhar concerned whether these were conclusions agreed upon and approved by rhe City Attorney. A1 Olson stated that the City Attorney had approved and assured the members that he would obtain a report to this effecr before the Planning Commission meeting scheduled for March 13, 1978. Assurance of adequate on-site septic systems on all lots - possible conflict with City's position of no municipal sewering of this area After a lengthy discussion the Planning Commission agreed that many of the issues would have been resolved before approving the preliminary plat had they not felt rushed into a decision just before Christmas holidays. The Planning Commission tabled the proposal because many of the Important issues were unresolved for lack of data. The Planning Commission Instructed the Zoning Administrator to request of the City Administrator that this proposal be added to the agenda for the Council meeting scheduled for March 16, 1978. The Commission felt the urgency would require some direction from the'City Attorney and City Council. They requested some direction on the following issues: 1. 2. 3. 4. 5. 6. 7. Private road - width, surface, grade and drainage requirements Conservation and pasture easements - determination of boundaries and use On-site septic systems - necessity of soil borings and locating primary and alternate drain fields Private access easement between Lots 19 and 21 as alternate access for Lots 20 and 22 from private road, Outlot C - should this easement be indicated on plat or in title Pedestrian easement on Lot 7 to shoreline of Long Lake - extent and limits of use - possible conflict with City's policy of restriction of riparian rights for properties not located on shoreline Report from City Attorney confirming agreement with interpretations in letter from developer's attorney, Steven Pflaum, dated 3-7-78 Fence on wetlands - is variance necessary Chairwoman McDon*^ld suggested that one member of the Planning Commission attend the next Council meeting to represent the position of the Commission. The Planning Commission Informed Tim Adams that after obtaining direction on these Issues from the Council, the Commission would review the proposal again conditioned on developer providing the following additional material: 1. 2. 3. 4. Exhibit T - Road detail 2. Exhibit U - Location of existing buildings on Lot 19, Block 1 3. Exhibit V - Location of existing buildings on Lot 15, Block 1 All variances necessary regarding location of existing structures relative to proposed lot lines can be determined from these new surveys. Also enclosed is a copy of Al's memo regarding Council direction requested by the Planning Couunission. Mr, Adams informs me that a revised plan is now being prepared. The new plan will indicate some changes in pedestrian easements and more specifics in relation to pasture and conservation easements. Zoning Administrator March 17, 1978 SUBJECT: ^317 - The Farm at Long Lake Subdivision #31* RE; The Planning Commission special request for policy guidance from the Council as reviewed at the meeting held March 16, 1978 General Council concensus was that the function of staff and the Planning Commission is to review questions of policy and to make recommendations to the Council for final determination. . Notwithstanding this, the Council indicated the following: 1. 2. 3. 4. Private roads are desirable as an alternative .to public roads for visual and rural character reasons as well as maintenance responsi* billties, but all roads should be constructed to minimum standards and criteria for public safety and for permanent ease of maintenance. The City Engineer should make recommendations as to technical requirenents. The City has had continuing problems with unsupervised easements to lakeshore and has philosophical problems with extending lakeshore "rights” to inland properties. The staff can legally provide language to restrict any such easement to whatever use or intensity should be desired as a matter of policy. In this particular instance, and because the developer is agreeable, the issue may be avoided by physically stopping the easement at a reasonable distance from the shore, such as 5 ft. or 20 ft. or at the edge of the conservation easement, or? Conservation easements may include compatible uses and horse pasturage may be such a use in certain circumstances. The Planning Commission should make a finding as to the acceptability or lack thereof in each specific instance and recommend accordingly. If horses are allowed, a determination should be made as to proximity to the shoreline or other water course for protection against fecal pollution. Should horses be allowed, fences are obviously necessary to protect the animals and the neighboring properties. The Planning Comnission should note that a variance is required to pasture horses and erect fences, but the variance may not be contrary to ordinance intent. Stated that Planning Coemission was unaware of the engineer's connents when their action was made. Road to be private outlet. Requested soil evaluation by Hennepin Cointy Soil Conversation District and on-site evaluation by applicant's engineer. Tabled to meeting of Decenber 12, 1977 pending information. I contacted Gordy Coffin for several additional copies of the proposed subdivision so I can forward a copy to the Heni^in County Soil 8 Water Conservation District for a soil map and report. I'm including this item on the agenda as an action item if reports are received in time for Planning Comnission review and recoranendation. However, a recent discussion with Mr. James McCleary, owner of the marina, revealed a possible alternative to dredging. A small parcel of land on the north side of the site is riparian to Lake Minnetonka and is zoned residential. The parcel is owned by Mr. McCleary and is adjacent to the marina property. We have a sketch of the marina site with a proposed dock layout that can accomBK>date the presently licensed number of slips. The access to these dock slips would have to be from the parcel presently zoned residential. It is important to note that this alternative would eliminate dredging along the shoreline, with a possible exception for a launching ramp. this Alternative were to be implemented, it will be necessary for Mr. McCleary to submit a petition for rezoning of the small residential parcel. Because a rezoning of this parcel will alleviate many of the concerns of the City and DNR with regard to impacts on Lake Minnetonka, I am asking for your comments and review of the attached plan. If the City has no major objections to the alternative proposed, I will recom mend to Mr. McCleary that he make formal application to the City for rezoning, a prerequisite for permit issuance. If, on the other hand, there are relevant objections to a rezoning, I an asking the City to make a final decision on the dredging proposal as originally submitted. IV. >1 The owners of the property, Matthias and Raymond Fischer, intend to complete the continuation of Forest Arms Lane as per city and engineering require ments. Two alternates were submitted (P.R.D. and preliminary plat). Developer requested some direction as to what design the Commission might prefer. He Indicated a desire to utilize the existing road as an access to the other proposed building sites. The Planning Commission made several suggestions Including moving Che access road to simplify platting of the property. The Commission did not indicate any great objection to the P.R.D. proposal. They did, however, suggest eliminating one building site for lack of dry bulldable area reduced by Che area of the access road. The Planning Commission also suggested the developer Investigate current and projected use of existing utility easement over Lots 7 and 8. Also requested survey Indicating location of existing structures with reference to existing and proposed lot lines. Also suggested developer submit perc tests and location of primary and alternate dralnflelds for adequate septic facility for each lot. The proposal as submitted indicates no encroachment of required setbacks or reduction of any other existing non-conforming setbacks. The permit could probably be issued without first obtaining a variance. The addition would not exceed 50Z of the value. I am, however, somewhat concerned about issuing a permit without first obtaining a variance. A second story addition located only 12 ft. from the existing single story residence to the east might impose a hardship to this neighbor. The Johnsons are requesting a permit to expand and remodel their existing residence at the above location. Their lot is only 50 ft. wide with an area of approximately 6,723 sq. ft. The property is located in an LR-IC zoning district with a required lot width of 100 ft. and an area of 21,780 sq. ft. The existing house is currently located 4.1 ft. fi^oni the west property line and 11.6 feet from the east property line. The Johnsons are requesting approval to square off the void northwest corner of the residence for additional room, 'fhey would maintain the existing setback of 4.1 feet from the west property line. The expansion and remodeling on the east side of the house would consist of removing the existing attached garage and replace this with a new tuck-under garage at the same elevation. The front of the proposed garage would be in line with the front of the existing dwelling. The proposed addition would set back 10 ft. from the east property line. Above the proposed garage the Johnsons are requesting approval of 2 second story bedrooms and one bathroom. This addition would be setback a minimum of 10 ft. from the east property line. • We recently adopted the policy of not requiring variances for proposed additions that do not encroach on existing setbacks even if the setbacks and lot requirements are non-conforming. I'm still somewhat vague about this policy, however. Some of these proposals might result in problems to the City. I wouldn't want to be responsible without first consulting you. I'm enclosing a copy of the complete packet of material as submitted when the application was made. I am requesting some direction before making any commitments. The proposed addition vill make .lest use of the existing structure while changing the appearance to a coherent monostructura - not an add-on look. This vill result in a major neighborhood improvement. The third hardship deals with ph.j’Eical restrictions, l.e find it wculd be difficult to build in any other direction than proposed, the reasons being as follcusi 1. Northwest - The well is located near the center of the northwest wall epprorimately six feet from structure. There is also a large tree approximately 16 feet from structure, 2. Northeast - Although there is 25 feet of space between the two existing buildings, a deck on the garage building reduces this space to IS feet. Any structure added on between these two buildings would only allow six feet of space sepaiating them. 3. Southeast - The southeast wall is 28 feet from lot line which is insufficient space in which to build. The fourth reason is dealing with solar energy. In the proposed plan a gi*eat majority of the windows will be located on the southeast vail of the addition. These would be high efficiency, triple-glased windows ar.d will act as a passive solar col— • * lecting BystctTi. The walls of the ©Tieting stinicture will be heavily insulated aa will the walls and ceiling of the addition. This will contribute to energy efficiency of entire house. Locating the addition on any other area would greatly reduce the cajacity for this type of solar collection, and energ;,' efficiency. In conclusion, what we intend to do with this addition is to create a more com fortable, energy efficient home. Approximately two years later, realizing the existing for expanded child care on a full time basis, we opened the Brooklyn Park facility as an all day child care center. Within a few menus time, the Spring Lake Park facility, offering both nursery school and full day care for children was opened. In August 1977 we opened our Plymouth location offering a complete range of day care and nursery school services. In Plymouth, we purchased, renovated and utilized a church facility after obtaining a Conditional Use Permit. We are established in these fiva communities and have provided a very neces sary service. We will provide to you letters from each community attesting to our programs, our valued service and most importantly, the continued growing need for such facilities. Child care centers are educational programs that help a child become independent, inquisitive and learn to share, love and respect their peers and adults. They are structured similar to a kindergarten classroom but do not take the place of such. We work closely with each school district to see that our material correlates to theirs. Our day care centers are not babysitting services, we are educational schools where the children learn, grow and have fun in a structured atmosphere with certified teachers at the helm. Horizons, at the present time, in our existing facilities, has 40 employees, 24 of whom are certified teachers for the approximate 450 children now enrolled. New Horizons is a private school, licensed and governed in all its existing facilities by the State of Minnesota. We are federally certified for Title 20 children. r ? Ic Page 2. Our goal is to operate a complete child care and nursery school facility in accordance with the standards achieved in our other centers. Our services may also include night and weekend child care to meet the needs of parents working hours other than 6 AM to 6 PM Monday through Friday, and all such other times when such services may be needed, such as hospitalization of one parent, unexp'^cted trips, weekend vacation retreat for parents who wish to leave their child in a safe, responsible and educational environment. Our purchase agreement with the ualvery Memorial Church is contingent upon New Horizons obtaining a Conditional Use Permit on or about April 15, 1978 for our needs. Our research indicates a need in the community for the services we provide beyond the services provided by other facilities in the area. Curing this time 1 have cave to know the director, Ms Sue Ikinkley, along with the rest of her stal'f. I cannot praise the teachers and school enoiigh. They take a genuine interest in each and every child. Their concern for their welfare shows in everything they do. The program is a very veil rounded one. It has a good social atmosphere along with a learning period every day in addition to a muscle room and activities to use their motor skills. The children are involved in many special projects during the year leaxnimr about themselves*and people in the ccoaunity. They are introduced to books and music, have art projects and go on field trips. Last year my son attended The Learning Tree in Brooklyn Park. Ee never looked forward to going to school and I feel he got nothing oiit of it. Ee had three changes of teachers during the year due to management problems at the school. I could detect no enthusiasm among teachers. I was very disspi>ointed in the whole program but was initially sold on it because of the facility itself. I felt sorry fox the day care children there and mentally remarked to nyself that I would never leave a child of nine there all day every day of the week. There was Just no program for then and most of the day was spent in unorganized play. . j1 I can only wish Sue Dunkley the very best in any project involving her school or plans for a new facility or day care center. Ve have really needed a good nursery school in this area for a long time and under her direction it can only continue to grow and be the success that itls.
