O’ Dear Mr. >!uhich: We have reviewed the information submitted by your office relative to the proposed subdivision request by Mr. Paul Raster at 2600 Casco Road and have inspected the site in the field. The proposed subdivision consists of creating two lots from Parcel 3000, Wlnshlp*s Division. The front or westerly parcel located adjacent to Casco Point Road has been identified as Lot A and the easterly parcel located adjacent to the lake has been identified as Lot B. Prior to approval, the following questions should be resolved. 1) The driven centerline of Casco Point Road crosses Lot A, inconsistent with the platted right-of-way. The existing right-of-way situation should be clarified as a part of the proposed subdivision. We recommend that a specific roadway easement be shown. 2) Access for Lot B is proposed along the north side of Lot A. According to the contour map Included with the data for review there are several very severe grades that the driveway for Lot B must cross. These existing grades are in the range of 247. on Lot A and 187. on Lot B. It may be necessary to either make sub stantial excavations on each building site or to fill the low area between the building sites to provide a proper driveway for Lot B. We recommend that the petitioner submit a plan indicating how a driveway for Lot B will be constructed. We further recomraent that the driveway e.. ement across Lot A be described and shown in the survey. 3) We understand that there is municipal water and sewer service on Casco Point Road. Record plans of these utilities are not available to us at this time so we cannot determine depth, size and location of service lines. We assume that there is one service line connection for the existing parcel. Another sewer service and water service line will then have to be installed. The contour map indicates that the low point between Lot A and Lot B is over 12 feet below the street level. Depending on the elevation of the sanitary sewer in Casco Point Road, it may not be possible to extend a gravity sewer service line to Lot B with adequate cover unless the area is filled. The subdivision con sists of creating two lots on the north side of Lake Clausen in Section 29. From the date submitted for our review, it appears that the proposed subdivision will be in the form of a plat. We offer the following conments for consideration: 1) The proposed plat, as submitted, indicates an access parcel for the two resultant lots which is identified as Ledstrom Circle. There are a number of questions relative to this proposed access that must be resolved: a) Is this access to be dedicated as public right-of-way as implied by the proposed plat? If so, it must be improved to City street con struction standards. b) If this access parcel is to be a private street or driveway, then the right-of-way must be identified as an outlot or as a separate lot within the proposed plat. c) Ledstrom Circle, as presented, extends over and across lots 1 and 2 of Rocky Knoll, two platted lots of record according to the Hennepin County half section maps. If Ledstrom Circle is to be either a dedi cated right-of-way or a separate parcel, then there must be a re platting of lots 1 and 2, Rocky Knoll in conjunction with the proposed subdivision. These questions must be resolved prior to approval and we suggest that they be re* viewed by the City Attorney. We recommend that the access be developed and main tained as a private street. We further recommend that the obligations and re sponsibilities for permanent maintenance be set forth in an appropriate legal instrument and be made a matter of recorded information relative to deeds and/or covenants for the two proposed lots. Any improvement or alteration of the access at Co. Rd. 6 will require the approval of Hennepin County. We recommend that no approval of the proposed subdivision be granted until submittal of evidence that an adequate soil absorbtion sewer system can be designed and Installed for proposed lot 2. There is an existing home on proposed lot 1 and we suggest that the existing sewer system and future alternate sites be reviewed by the building inspector. A con servation and flowage casement has been described in the proposed plat. The described easement basically follows the 971 contour line. In a letter dated January 10, 1978, Mr. John Holmquist of Hickok & Associates indicates that T-»ake Classen is a **—proposed retention basin for upper watershed run off storage** and recommends **—no building or land alteration below eleva tion 973—-**. We, therefore, recommend that the edge of the easement will follow as closely as practical the 973 contour line indicated on the pro posed plat. This revision will then include the area across lot 1 near Co. Rd. 6 from the wetlands to a culvert under Co. Rd. 6 at the northwest corner of the plat. Storm water is discharged from the culvert under Co. Rd. 6 and flows across lot I towards Lake Classen. Upon satisfactory resolution of the items reviewed above, we recommend approval of the proposed plat. Page 2. I discovered that a copy of the plat map section was missing. I'm enclosing a copy of the plat map with tliis memo as we do on all such proposals. In checking the plat map, some interesting questions came to my attention. Note the dotted line indicated by the arrow on the copy of the plat j»ap. I have not had the time to review exactly what this dotted line might indicate, but might request the applicant sutait some data to clarify the status of all this property. I'm sure the status will be cleared when the title opinion is reviewed by our attorney, but it would probably be less expensive and less time consuming now rather than after preliminary approval. I liaven't heard anything from the State Higliway Department regarding tliis proposal. I don't know whetlier Al has sent them a copy to review. The State Hi^way Dept, should be consulted. Diey might be interested in additional right of way. Yte might also consider easements for service roads or other access alternatives. h’e should also obtain some direction from the City Engineer for drainage from the property so we have no future problems when the residentially zoned area is develop^. We should provide for drainage easements at this time. In checking the plat map, I also remembered that utility services are not provided by Orono in this area. We should also require some clarification on this issue. Some of the properties in this area are serviced from Long Lake. These have all required the s^roval from the City of Long Lake. We must remember the current status of the Long Lake Sewer Plant (capacities, adequacy of sewer line sizes and such). Access to the properties should also be addressed. We should resolve any possible traffic problems befora making any determination on the proposal. The re zoning proposal appears favorable. The B-1 zoned area currently described splits the Bill Wear pr<^rty. It would seem to make more sense to follow a given straight Ipe for zoning purposes whenever it might be possible. If a given straight line is established today, I believe we would eliminate any future controversies with other property owners in the iimediate B-1 district. Erosion protection for this area should be a major concern be cause development could substantially increase the irmoff toward the highway. Before final grading plans are developed, we suggest the developer or his engineer contact our District Hydraulics Engineer, Mr. M. J. Spielmann, at 545-3761, extension 126 for additional information in regard ta the drainage. -The plat indicates commercial zoning adjacent to T.H. 12. Because of this, we would not anticipate any problems in regard to noise from the Highway. -Trunk Highway 12 serves as the main arterial through this area. Long range plans for T.H. 12 in this area are indefinate; therefore, efforts should be made to protect the safety and operating efficiency of the existing facility. One of the most efficient ways to accomplish this is continual review of any new proposed development and to make recommendations to avoid conflicts with the existing facility. In this light, we recommend the developer plan his development in such a way that direct access to and fron T.H. 12 be limited. This con be accomplished by construction of a frontage road as a part of the development. that consideration be given for a common intersection at Brown Road and Virginia Avenue. Mr. Diederlch presented to the Commission members two letters outlining briefly the specifications and procedures of the projected spoils disposal project. 4 Mr. Novak's letter dated December 28, 1977 explained procedures as follows: December 28, 1977 Dear Mr. Sween: As per your request, I am submitting the following^ explanation of how we propose to dispose the material dredred from your channel and the effects it would have on the disposal site. As you know, Mr, r>ween, it is essential that we con tain the dredged slurry for a period of time to allow the dredged mat^'rial to settle out of the water. Ade quate guidelines have been established by the Minn esota Pollution Control Agency to Insure water quality standards are met before returning the water back to the lake. Accordingly, we have designed the spoil area with a capacity to exceed the 7 day retention time required by the M.P.C.A. The spoil area as outlined on the attached topography map will have a cross-sectional area of 176442 square feet. By constructing a dike along sides 4 through 9 to the 942 foot elevation, the average depth of the spoil area would be 7.17 feet with a holding capacity of 46,9CO cubic yards. Once dredging operations are started, an average of ,75 feet of slurry would be deposited into the spoil area daily based on the following criteria. 1, Cross-sectional area of the spoils basin is 176442 sq. ft. 2, Estimate is based on pumping an average of 2000 gallons of slurry per minute, 8 hours per day. Based on the above, the spoil area would be filled to 70 percent of total capacity after 7 days of pumping time. After 7 days of dredging we would begin to decant the water back to the lake through the pipe stand arrangement shown on the attached map. The decanting process would then be continued dally for the duration of the project. As you know, p*r, Cwcen, the Fresh Water Plolorlcal Institute has aggrjed to assist us in our effort to ensure optimum wuter quality standards are met by continuously -onicoring the suspended solids content of the return water. If their tests dicthte, it will be necessary for us to cease dredging operations until water quality standards can be met. Upon completion of dredging operations the spoil area will be drained of all water. The next step would be to level off and contour the dikes and dredged mater ial, By proper placement of the discharge pipe it will be possible to end up with basically the same ground contours as presently exist with a minimum of landscaping. The main difference will be that the present ground contours will be approximately 2 feet higher in elevation. If you wish, however, we can place the material as shown in either of the proposals as drawn up by the Gordon R, Coffin Co., Inc. In summary, the spoil area will he large enough for us to pump 9 to 10 days before having to return any water to the lake, thus allowing ample settling time. I visualize our role as the following: (a) We can retain the effluent water from the dredge in the Institute wetlands by temporarily sealing off the culvert which goes under Old Beach Road. (b) For this small quantity of dredge we anticipate that water level in the Institute wetlands will only be elevated by a few inches. (c) We shall conduct daily determinations of the nitrogen and phosphorus levels in the wetland and release the water into Lake Minnetonka when phosphorus and nitrogen values fall to the pre dredging levels. (d) Fiske-Subbarrow and Micro-KJeldahl methods will be used for phosphorus and nitrogen determinations respectively. During out studies on nutrient release from the spoils area we would also take the opportunity to examine run-off from Navarre (l.e. the Super Valu parking lot). We could examine both lead and oil cont.aminatlon of the Institute wetlands while it is sealed off as a holding pond. Mr. Novak also presented a map of the spoils disposal area with 7 inserts scaled to indicate the rise in elevation resulting from the spoils as they are deposited over a seven day cycle period. I After a lengthy discussion the Commission tabled the issue for lack of time to review the- latest documentation submitted. They also requested a more specific detailed schedule of procedures and precautions taken during the project. After the tabling action by the Commission, the association representatives requested the Commission for a consensus of opinions regarding the disposal project if all necessary documentation were submitted. This request was to assist the association in determining whether they should proceed with submitting necessary applications with all other agencies. Although a vote was not taken, it appeared that the majority of the Commission were not opposed. She explained to me that time is of great importance because cost estimates were made on condition the project was started before February 13, 1978. Each pond would have a radius of 60’ for an area of approximately 11,300 sq. ft. or a total pond area of approximately 22,600 sq. ft. for both ponds. Although she did not tell me the exact distance from shoreline, scale dimensions seem to Indicate the ponds to be approximately 250 to 350 feet from the shoreline of Lake Classen. The projected location would be within the wetlands surrounding Lake Classen. Exhibit B is a plan of proposed project upon completion. I've transposed location of ponds from enclosed aerial map which Indicates pond location as projected by applicant. Qw Van Dale, Inc., has entered into a purchase agreement with Byrdie C, Robb, the owner of approximately 15.32 acre tract which is the subject of this application for rezoning, said purchase agreement being conditioned upon obtaining this rezoning. Van Dale, Inc., is the occupant of the properties on the Southeast corner of Highway 12 and Old Crystal Bay Road, just across the road to the East, from the subject property. The property includes approximately twenty acres owned by an affiliate, Veda, Inc. The Veda Property is presently zoned industrial and the properties are used for a manufacturing plant and associated offices and warehouse facilities. Van Dale intends to purchase this property for investment purposes and to facilitate future expansion of its operation. Exhibit B - Indicates location of subject property on plat map. ; Exhibit C - Proposed subdivision - 4 lots (Lot 1, Block 1 - Lots 1, 2 & 3, Block 2 and private road providing access to Liberty Acres Plat which was approved by Council December 13, 1976 (Resolution #733 - copy attached). Records will indicate that the County Public Works Department recommended and approved this location as access to the Liberty Acres Plat, I haven't been able to find any documentations on easements or association agree ments which probably should have been approved before releasing Resolution #733 (Exhibit D) which approved the Liberty Acres Plat. The resolution lists the conditions, but we don't have any documents confirming that these conditions were fulfilled. We will have to address this issue of access at this time. We might consider some type of association agreement which would include all parcels of Liberty Acres and Lot 1, Block 1 and Lot 1, Block 2 of the Karl Gardner Plat providing the City Attorney agrees with the suggestion. Copies of the proposal along with requests for comments have been forwarded to: Hennepin Covmty Public Works Dept. Minnehaha Creek Watershed District City Administrator City Attorney City Engineer City Public Works Director Schedules for meetings of Planning Commission and Council have been changed. Hereafter, the Planning Commission will meet the 2nd and 4th Monday of each month. Therefore, the Public Hearing relating to this issue has been scheduled for February 27, 1978 at 8:00 P.M. Muhich, Zoning Administrator Si ' February 3, 1978 • % SUBJECT: Dennis Platteter - 809 Bro\im Road North Variance - Stable Setback Variance & Conditional Use Permit For Horses Mr. Platteter has submitted the attached application for a variance to construct a stable which ^^70uld not conform to the setback requirements of 150 ft (Exhibit A). I have checked the file and found no record of a conditional use permit approved for the proposed animal unit use. Therefore, the conditional use permit for horses on the property must also be addressed. We might also address the maximum number of animal units, as the proposed barn would be 1,980 sq. ft. in area. Exhibit B (survey of property) indicates proposed location of stable. The required setback for a stable is 150 ft. from lot lines. This application would require approval of 2 setback variances as the location as proposed would be 130 ft. from the south property line and 90 ft. from the corner of the Lawrence property. Respective 20' and 60' variances would be necessary. Exhibit B also indicates property dimensions. The area is slightly lander 7 acres. Exhibit C - land contour and vegetation. Exhibit D - floor plan of proposed stable (7 stalls and 2 other bays). • Our ordinance requires 1 acre of pasture over and above the minimum lot area requirement for each animal unit. The lot area requirement in this zoning district is 2 acres. Since this parcel consists of almost 7 acres, five animal units could be considered for approval of the conditional use permit. If we approve the conditional use permit for more than five animal units we should address it as a separate variance along with the conditional use permit. We should also address security measures to protect the trees and foliage on the neighboring properties. We received numerous complaints from Mrs. Lawrence in the past. Horses owned by the previous owner had damaged most of the Lawrence trees within reach of the horses. We will start the fencing process to Increase the pasture size about the first of June. We should open a new pasture about June 15th if we have a good growing season providing the horses with the proper food. In the meantime I will keep the current pasture as clean as possible* We have built one tree protecting fence and will finish the project next week.
