MINUTES OF A PLANNING COMMISSION MEETING HELD ON NOVEMBER 27, 1978
Planning Coranisslon met on the above date. The
following members were present: Chairman Hassel,
Hurr, McDonald, Hannah, Frahm and Hammer el, Mabusth
represented the City staff. Mayor Van Nest was also
present.
ATTENDANCE
7:30 P.M.
Mabusth stated that she had the Affidavit of
Publication and Certificate of Mailing. Gregg
Mack represented the Park Reserve District.
He presented a map on the Park Reserve *s plan
for parks on Big Island and their recent decision
as to park boundary locations. He stated that
the purpose of the street vacations was to create
a bulldable lot to use In exchange for another
piece of property which the Park Reserve wants to
obtain. This property, located on the east Island
next to the veteran*s camp. Is a connecting link
between two pieces of park property, Denny Kllbane,
part owner of this parcel, was present. Discussion
ensued reg rdlng replattlng that would put all of
the public right-of-way Into a strip along the west
edge of the lot rather than vacating any right-of-way.
Hurr moved to table this Item pending further direction
and rationale on public benefits derived by vacating
public rl^t of way. They also requested calculation
of area of public land within the platted lots and
suggested that this be siibmltted as a replattlng.
Motion seconded by Hammerel. Vote: Ayes (6), Nays (0).
Motion passed unanimously.

The Nobles were represented by Robert Hoffman. Mr,
and Mrs. Noble and Mr. Charles Alexander were present,
^^o revised plans were presented. Mr, Hoffman stated
that the driveway to the east of the lot was formerly
County Road 15 (this was also verified by a neighbor
to the west of Noble). Previous variance applications
(McDonald #361 & Rovlck #77) were also discussed. Mr.
Hoffman stated that the pond was originally wetland
and was then filled because It was unstable. He also
stated that neighbors on both sides would rather have
the house closer to the lake so they would not have
to look Into their pool.

Planning Commission noted the nimiber of variances
r^uested, that many were severe variances, and
that the house plans were too ambitious for the lot.
Hassel moved to deny the application as no hardship
was established, too many extreme variances were
requested, and the amount of hardcover was too
^cessive for the lot. Motion seconded by Frahm.
D^ing discussion, Hassel Informed the Nobles that
they could submit revised plans rather than have
their present proposal denied, however, they
preferred to have a decision and go to Council as
soon as possible. Vote: Ayes (6), Nays (0).
Motion passed unanimously.

cut. Cy Lane, 1376 Park Drive, stated that all
other houses in the area are on combined lots
and that previously a larger lot than this proposed
lot was denied. Wayne Holmes, 1390 Park Drive
opposed the variance as he did not want a house
built on this lot as he would feel ’’packed in”.
^ahm moved to approve the variance as no other
land is available and there was previously a
house on this lot which was assessed and hooked
up to sewer, conditioned upon no further setback
variances being granted for construction of the
house. Motion seconded by Hurr. Vote: Ayes (4)
Hannah were opposed as they
felt the lot was ’’decidedly too small” to support
a single dwelling.

the Planning Comnission noted that the proposed
addition was in keeping with the neighborhood.
Hardship was the existing house location on the lot.
Hannah moved to approve the variance due to the
hardship of the house location conditioned upon
the addition not encroaching the 75* lakeshore
setback. Motion seconded by Frahm. Vote: Aves ^6^
# Nays (0). Motion passed unLimously.

Mr, Baxter was present. Applicant is requesting a
35* right yard setback and a 10* left side yard
setback as well as a lot area and width variance.
Discussion mostly concerned staff's request that
he reverse the side yard setbacks. Mr, Baxter
stated that although he would go along with- the
request, the topography of the lot made if more
feasible to build the proposed house as his plans
indicated. Hannah moved to approve the variances,
as originally aivvl tted, as the sitviation is improved
by the combining of four drastically substandard lots
into one building site due to the hardship of no other
land being available and the topography of the lot,
conditioned upon the combination of the lots. Motion
seconded by Hammerel. Vote: Ayes (6), Nays (0).
Motion passed unanimously.

Mr« Worre was present. Also present were his
neighbors to the south and across the street.
The request was for a 7* front yard setback and
a 10* side yard setback. Mr. Worre stated he
was now requesting a 10* front yard setback
instead of the 7* previously requested. Some
questions were regarding the height of the building,
numbers of zoosns proposed and their proposed uses.
It was stated that the existing garage would be
kept. Neighbors noted that there was a 4* X 6*
shed also located on the property. The main concern
of the neighbors was that they did not want the
addition so close to the south lot line as the
neighboring house is only 8* from the jnroperty line
and the proposed building would create a distance of
28* between the houses. Neighbors across the street
felt that the neighborhood was more "open” than
adjacent areas of Crystal Bay and was perhaps the
only area with those distinctive qualities - they
would prefer to keep this "openness". Planning
Commission also questioned the size of the addition
wondering if ^ would be feasible to make it smaller
thereby increasing the distances between the houses.
Mr. Worre stated that the size of the addition was
because of a landing and rtairs that would be needed
to get to the addition. It would also be used for
a breezeway and an access to the back yard*.

Planning Comnlsslon asked Mf« Worre to consider
making the breezeway smaller and requested a
survey showing "all structures" on the lot.
Hurr moved to table this Item pending submittal

and to give him time to consider reducing the
size of the addition. Motion seconded by Hammerel.
Vote: Ayes (6), Nays (0), Motion passed unanimously.

Sketch Plan Review - Mr. Mills and Mr. were
present. Mabusth presented the revised plan.
The following comments were made:
1. The 50* private road easement Is not designated
on the plan.

the exclusion of the driveway easement.
3. Existing Buildings: Lot 3 (existing cottage
and garage) At this time the applicant did not
know what would be done with these buildings.

Lot line should be moved so It Is only shown on
Lot 4.
Public Information Meeting has been scheduled for
Deceniber 11, 1978, Applicant was Instructed to
contact staff for the required Information needed
for that meeting.
Mr, Oberhauser was present. This request concerns
land In Orono and Wayzata. It was noted that the
land In Wayzata Is now 2 acres Instead of 4 acres
as originally submitted. Wayzata will first
address this application at their December meeting.
Applicant stated:
1, He has talked to the highway department and
they have agreed to the access on old Highway 12.
Talked with Wayzata and has made arrangements
for sewer for this property.
3. The location of these condominium units across
the city borderline was due to the topography as
there Is a large bluff area In both cities and to
be useful and bulldable the whole lot would have
to be used. It also gives a beautiful view of the

values,

Planning Commission made the following conments-
1. Requested marshland be designated on the drawings.
How much of the 8 acres is dry buildable?
2. Commented that when a development is golne to be
sewered a credit would be given for the wetlands in
determining the number of units allowed.
3. Possibility of a new amendment to the code to
allow attached dwellings in a PRD development in
a one-acre zone. This may be a possible, feasible
and/or a better idea than granting a variance. *
4. Requested information on sewer capacity of the
Wayzata system to determine future potential.
5. Advised applicant to contact staff if he wished
to continue with the appiic.ation.

Scott was present. No problems with the proposed
plat, Mike Gaffron, septic system inspector, advised
for, Scott that additional soil testing would be
required to determine water table. Mr. Scott agreed
staff to complete this requirement, A
Information Meeting scheduled for 1-8-79,
Mr, Olson was present. Mabusth noted that the
proposed division line is within 7* of the existing
pole bam and that possibly the division line should
be moved to comply with the 10* required setback for
accessory structures. Planning Commission requested
revised drawings showing the lot line realignment
and the compliance with the two acre minimum lot area
for'^1^^^78* Information Meeting scheduled
^rrections: Page 4, James Bloemendahl, Paragraph 2
ADD to the motion: DNR is responsible for policing
the park. Page 5, Fred Her fur th, DELETE: *'This
density ratio which must be a minimum or 1/2 acre per unit.*'
Hassel moved to accept the Minutes as corrected.
Motion seconded by Hammerel and passed unanimously.
