Present were Chairman Hassel, Hurr, McDonald and Wilson. Alan Olson represented the City staff. Hassel annovmced this was the time and place for a Public Information Meeting on A. J. Tourangeau's subdivision request. Olson stated he had the Affidavit of Publication and Certificate of Mailing. Mr. Tourangeau and Mr. Robert Reuttman (lessee of the service station) were present. No public conanents were heard. The Planning Commission reviewed the existing situation with two buildings on common lots and the proposed lot line rearrangements to create separate parcel Identities. It was noted that service stations are conditional uses In the B-1 zone, that this station has been existing and operating for many years, but that there was never any formal conditional use permit or application on file. Parking was discussed noting that the code calls for seven (7) spaces for this station. Mr. Reuttman noted that the station only has "parking problems" when the marina customers use the property on the weekends. He stated that the marina (Paul's Landing) does not have any authorization from him to use this property for marina parking. Staff has reviewed the septic systems and although they are substandard they are functioning and are acceptable to the staff. Olson presented into the record a letter from the Hennepin County Department of Transportation stating their requirements and recommendations. Mr. Reuttman was agreeable to the County requirements for curb cuts and driveway controls; agreeable to providing a landscaping plan and Improvements, and agreeable to the building code requirements to brick closed the one station window. ATTENDANCE 7:30 P.M. A.J. TOURANGEAU 1960 Shoreline Drive SUBDIVISION Public Info. Meeting 7:30 P.M. - 7:45 P.M. (/M14) There was discussion concerning the existing zoning and In regards to the lakeshore parcel. All parties agreed that a zoning boundary change is desirable. It was noted that the station's fuel tanks are located under Lot 26 the residentially zoned comer lot. A formal application be made for a condi­ tional use permit per 35.022 for operation of the "motor fuel station". This permit to set out in writing all landscaping, curb cut, parking, etc. conditions per 38.500. 2. A formal application be made for a rezonlng to revise the existing district boundaries to coincide with the proposed lot division; all of Lot 1 to be RR-IB and all of Lot 2 to be B-1, such rezoning to be pursuant to all required reviews and hearings and to be effective only upon recording of an approved final plat. 3. Concurrence with the Hennepin County Dept, of Transportation requirement to close access to County Road 15 except for one commercial driveway approximately 120 ft. north of Central Avenue. 4. Applicant to provide a landscaping plan and schedule of completion for review with the condi tional use permit prior to final plat approval. 5. Combination of the remaining Tourangeau residential lots (7-14 & 20) for tax purposes. 6. Closing of the rear station window per State Building Code requirements. A.J. Approval of all variances necessary to accomplish the above finding hardships of no additional land available and existing structure locations. ^fotlon was seconded by Hurr. Olson stated that all requirements have been met and the staff now recommends approval. NOTE: Wilson raised some legal concerns regarding the format of our resolutions for plat approval and wondered If staff should Investigate a more efficient method to ensure proper recording of required documents. Olson stated this was an interim problem and what the City attorney intends to do in the adoption of the ordinance is to have the City, in the presence of the applicant, do the recording. Hassel moved to approve the final plat in accordance with the attached resolution. Motion seconded by Wilson. Vote: Ayes (4), Nays (0). Motion passed unanimously. Mr. Kelley was present. Olson stated that the preliminary plat has been returned in the final form and all technical requirements have been met. Hurr recommended approval of the final plat in accordance with the attached resolution. Motion seconded by McDonald. Vote; Ayes (4), Nays (0), motion passed unanimously. KARL GARDNER 2885 Sixth Ave, No. FINAL PLAT (#356) LLOYD S. KELLEY 85 South Brown Road FINAL PLAT (#372) Mr. Plank was present. The preliminary plat was approved at the last Planning Commission meeting. The location of the septic system was discussed in great lengths. Planning Commission was very concerned with having to issue a setback variance on a 5-acre lot particularly when the lot is newly subdivided. After a couple of unsuccessful motions and considerable discussion regarding the physical problems and alternative solutions, Hassel moved to approve the variance in that the hardship appears to be contour and configuration of the land and wetlands and the designated site for the septic system. It was felt that because of slope of the ground and low areas on the lot, there would be drainage problems, access problems (driveway grade) and possible drainfield operation problems if the house was moved 25 ft. further from the road which would justify this variance. Motion was seconded by Wilson. Vote: Ayes (4), Nays (0). Motion passed unanimously. MICHAEL PLANK 4145 Watertown Road VARIANCE (#399) r ! MINUTES OF A PLANNING COMMISSION MEETING HELD ON AUGUST 14, 1978 Page 4 Walter Wolfe Jr. and Mrs. Walter Wolfe Sr, were present. No public comnents were heard. Planning Conmlsslon discussed the proposal and existing situation. It was noted that there was quite a bit of equipment, machines, auto parts, etc. as well as an old boat and a vehicle with out-of-date license tabs on the property. The Wolfes said these Items would be stored In the new garage. Hurr moved to approve the 84% variance for the garage finding the hardship as the location of the existing foundation and driveway access, with the condition that the garage be a single story, used only for residential accessory use and that all debris, equipment, etc. be stored Inside upon completion. Motion seconded by Hassel. Vote: Ayes (4), Nays (0). Motion passed unanimously. Mr. Zltzloff and Mr. McCharles, building owner, were present. Mr. Zltzloff explained the operation of his business. Planning Commission discussed major concerns with traffic and parking and Indicated that some curb cut work will be required as a condition of approval. Mr. Zltzloff is to return with a site plan showing parking, access. Intended landscaping plus a floor plan showing the store itself regarding retail/wholesale floor space divisions. Dewey Lindsay (dredge operator) and Mr. Hannah (property owner) were present. Other owners Mr. Hepp and Mr. Morris have supplied written approval of the proposal. USE PERMIT (#415) WORK SESSION ITEM WEST SHORE LAFAYETTE BAY ASSOCIATION Conditional Use Permit (#416) WORK SESSION ITEM Mr. Lindsay noted that he does not intend to dredge the channel but only the lagoon Itself. He said the DNR has tenatlvely approved expansion of the other permit to include this work and that the MCWD will review the application on August 17, 1978. They requested Immediate action because approval would allow work to continue while the dredge is in the vicinity while delay would make the project unfeasible. Proposal is for esthetic Improvement only and not for riparian access. Mr, Hannah Intends to keep the bridge In place and to place an aerator In the lagoon during the summer. 1 • » MINUTES OF A PLANNING COMMISSION MEETING HELD ON AUGUST 14, 1978 Page 5 Planning Conmlsslon was concerned with Hannah's house construction and the excavated material being left near the lagoon. Planning Conmission was also concerned whether dredging for esthetic purposes was reasonable or not. They were concerned that FWBI had not supplied any test reports on the existing project. After lengthy discussion and several motions Wilson moved and Hassel seconded to take action at work session and to pass cn to the council a recommendation for approval of the request to dredge the lagoon with the suction dredge as an extension of the West Shore Lafayette Bay Assn, permit finding that the proposal was beneficial to the landowners with no adverse effects upon the environment (due to the existing disposal system); finding that this is for esthetic purposes and not for riparian access; finding that the lagoon will be dredged to remove muck down to elevation MSL 924 + and that the channel will not be dredged; finding that the lagoon is not a docking area; all on the condition that the FWBI submit to the City all test reports required by Resolution 913 and that those reports show that such dredging is not detrimental to the lake. Vote: Ayes (2), Nays (2) - McDonald and Hurr voted against the motion because there were no FWBI reports available to review, because action was requested at the work session, and (McDonald) because of existing erosion from Hannah excavation into this lagoon has not been controlled. WEST SHORE LAFAYETTE BAY ASSOCIATION Conditional Use Permit 0U16) WORK SESSION ITEM 6" Minutes were approved as submitted.APPROVAL OF MINUTES Meeting of 7/24/78 Hassel and members present dlscusred the joint meeting held on Thursday, August 10, 1978 and found such a meeting very beneficial. Regarding the joint planning committee, all members present expressed desire to serve. It was decided that Chairman Hassel would confer with the absent members regarding the committee and that final choice of Planning Commission members would be made on or before the August 26, 1978 Joint meeting.
