Hassel will be late. ATTENDANCE 7:30 P.M. Hurr announced this was the time for a public hearing for the Baker Park Reserve Road Vacation application. Alan Olson, the City Planner, stated he had the Affidavit of Publication and Certificate of Mailing. Mr. Marr was present to represent the Park Reserve District. A neighbor, Mr.Laidlaw of 1195 Starkey Road, was present. Mr. Marr showed the exact location of the vacation. During the discussion, Mr. Laidlaw had several comments regarding the bike/hike trail, but did not object to the road vacation. Public Hearing closed at 7:50 r.M. Further discussion concerned the possible moving of a gate to the property line of Mr. Laidlaw, but he stated that would not be a problem to him. The only thing that could cause a problem would be people parking their cars at the gate. Wilson recommended approval of the vacation contingent upon the park reserve providing a private ease­ ment for existing utility lines. Hammerel seconded the motion. Vote: Ayes (4), Nays (0), Abstained (1) McDonald. McDonald did not see the public interest in vacating the road and was concerned that the gate would be moved to Mr. Laidlaw's property line after the road vacation. BAKER PARK RESERVE ROAD VACATION (#386) PUBLIC HEARING 7:30 P.M. ! * J Hurr announced this was the time for a public hearing on the Subdivision for R. L. Wenkstem. A1 Olson stated he had the Affidavit of Publication and Certificate of Mailing. The applicant was represented by Mr. Roger Reed his attorney. Mr. Reed stated that the Owner is making arrangements to connect to the sewer. It was discussed that by this application we would Just be increasing acreage and not establishing a new construction site. No public comments were heard. Public Hearing was closed at 8:07 P.M. Alan Olson stated if approved this could be handled by RLS as it is now recorded. Most of the discussion was regarding whether to have him comply with the two acres or with connection to the sewer. Dick Hassel Joined the meeting. 9:00 P.M. MINUTES OF A PLANNING COMMISSION MEETING HELD ON JUNE 26, 1978 PAGE 3 Wilson made the motion that the rezonlng request be denied as the dock configuration presented with the rezonlng application was found to Infringe tspon the rights of the Owner of Lots 24 & 25 and cause hardship to him. Motion seconded by Frahm. Vote: Ayes (6), Nays (0), motion passed. Hassel announced this was the time for a public hearing on the subdivision for Paul Eriglund. Alan Olson stated he had the Affidavit of Pidsllcatlon and the Certificate of Mailing. Mr. Englund was present but had no comments. No public were In attendance. Both lots meet zoning requirements Involved and are over foxir acres should future subdivision be desired. Staff has no problems with this siibdlvlslon, but Is waiting for septic system test results. Public Meeting was closed at 8:25 P.M. Hurr made a motion to approve this subdivision conditioned upon verification of adeqiiate septic system, approval of access for driveway from the County and the payment of the park dedication fee. Motion seconded by McDonald. Vote: Ayes (6), Nays (0), motion passed. STUBBS BAY MARINA (James McCleary) 3445 Bayslde Rd. REZONING (#390) PUBLIC HEARING (Cont.) PAUL ENGLUND 980 No. Shore Dr. W. SUBDIVISION (#385) PUBLIC INFORMATION MEETING 8:21 P.M. Hassel announced this was the time for a public hearing on the Road Vacation request for Richard Putnam. Alan Olson stated he had the Affidavit of Publication and the Certificate of Mailing. Mr. Putnam was not present at this time and no public were In attendance so the public meeting was closed at 8:30 P.M. The "road" Is a portion of Mr. Putnam's yard which was vacated many years ago but which apparently was never properly recorded. Frahm moved to approve this application as It Is Just a housekeeping request. Motion seconded by Hannerel. Vote: Ayes (6), Nays (0), motion passed. RICHARD PUTNAM 3045 Casco Point Rd. ROAD VACATION (#392) PUBLIC HEARING 8:26 P.M. minutes of a planning commission meeting held on JUNE 26, 1978 PAGE 4 Alan Olson stated that Ms. Fox called the office and Is considering withdrawing the variance request. She requested that the Item be tabled until we hear from her. He also stated that an error was made In the original request as listed In the memo - the requested size Is 792' not 1092'. McDonald made the motion to table this Item. Motion seconded by Hurr. Vote: Ayes (6), Nays (0), motion passed. BILL FOX 1095 West Femdale VARIANCE (#395) Mr. and Mrs. Elss were present. Alan Olson stated what was requested. The proposal Is to add on to the existing cabin, rebuild the cabin Into a two car garage, aixl have the driveway go around to the existing two car garage. The main discussion was concerning the amount of hardcover and drainage. All of the conqileted building would meet the minimum 10 ft. side setback requirement. It was also stated that the lot drainage Including all driveway drainage flows to the road and not to the lake. Hammerel moved that the Planning Commission approve the variance of lot size, lot width and hardcover based on the proposal submitted tonight Including the driveway, due to hardship of no additional available land and noting that hardcover Is mitigated because much of the drainage Including all driveway drainage flows to the road and not to the lake. Motion seconded by Hurr. Vote: Ayes (5), Nays (0), Abstained (1). Frahm (Hardcover). DAVE & HOLLY EISS 1790 Shadywood Rd. Variance (#396) Mr. and Mrs. Waldron were present. The request Is for a family room addition. Rear yard setback required Is 100' proposed setback Is only 77'* leaving 23 ft. (23% variance). Hardship Is the present location of the home making this the only applicable place for an addition. Wetlands setback Is met. No designated wetlands are on his property. Hurr moved to grant this variance as no more property Is available. Motion seconded by Hammerel. Vote: Ayes (6), Ndys (0), motion carried. STEVEN WALDRON 485 North Stubbs Bay Road VARIANCE (#397) kviMmmW IT. MINUTES OF A PLANNING COMMISSION MEETING HELD ON JUNE 26, 1978 PAGE 5 Applicant was not present. Staff read into the GEORGE MATCHETT record a comment from Brad Hays, 4100 Elm Street, 4055 Elm Street h® objected to the variance because he did not feel any hardships could be demonstrated. No additional land Is available as the adjacent parcels are occupied. No building site is shown on the plans, but it would have to meet all setback requirements. Hiere were questions raised concerning lot drainage. McDonald moved to table this Item. Motion seconded by Hammerel and passed unanimously. VARIANCE (#401) SKETCH PLAN REVIEW - Mr. Neslund presented a revised plan for twelve (12) lots including a new road location (private road would be agreeable to Mr. Neslund). Septic testing had been and is being accompliihed and Mr. Neslund will provide proof of septic system suitability on each proposed site. Staff noted that a brief review of the soils map indicated favorable siting, but that careful analysis must be done on Lot 12 which appears to have an abundance of poor soil. Public Information Meeting scheduled for July 24, 1978. Applicant was not present. Hurr moved to approve this application per DNR standard specifications. Motion seconded by McDonald Vote: Ayes (6), Nays (0), motion passed. At this time. Planning Commission requested a staff recommendation as to the procedure that should be used on rip rap applications. Mr. Allen was present. Hardship was the lot, lot size and the location of trees on the lot. Planning Commission moved to approve this variance due to the narrow lot and no additional land available. Motion seconded by Hammerel. Vote: Ayes (6), Nays (0), motion passed. COLPEPPER LAND CO. (Neslund) 40 No. Orono Orchard SUBDIVISION Rd. (#306) DAVID STANSLASKI 3550 North Shore Dr. RIP RAP (#402) BILL ALLEN 3475 Livingston Ave VARIANCE (#403) i 1: MINUTES OF A PLANNING COMMISSION MEETING HELD JUNE 26, 1978 PAGE 6 Mr. Bob Olson, Olson Concrete, the contrsctor was present. The difference In this application Is that It virles greatly In lot layout and building design. Previously the addition was in the front of the building with parking on the south side. The present application Is showing the addition on the south side with parkin^,, on the north side and front of the building. This application meets all setbacks and code requirements. TONKAWEST DEVELOPMENT 2477 Shadywood Road COMMERCIAL BUILDING & SITE PLAN REVIEW (#404) Frahm moved to approve this application contingent upon approval c>f the City engineer of drainage controls, legai combination for tax purposes of Tracts A & B prior to Issuance of the building permit, payment of one additional commercial water unit and three additional sewer connection units and Hennepin County Highway Dept, approval of driveway location and design. Motion seconded by Hammerel. Vote: Ayes (6). Navs (”0)motion passed. wy. Planning Conmlsslon reviewed a Sketch Plan proposal Including the one acre lot. Conments were generally favorable subject to the septic system review and to a variance application. GRAYDON MCCULLEY 4605 Watertown Road SUBDIVISION (#408) February 27, 1978 Hurr requested the following changes: Paragraph 2, Page 2: Should read The Council would have to amend the Comprehensive Land Use Plan and thus Indicate . . . . .Industry. APPROVAL OF MINUTES Paragraph 6, Page 2 : Change the first sentence to read: Hurr felt there were several questions as to the best use of this land. Hurr moved to accept the minutes In the amended form. Motion seconded by Hammerel and passed tmanlmously. APPROVAL OF MINUTES Minutes were accepted as amended unanimously. April 24, 1978 - Minutes approved as submitted. ^y 22. 1978 - Page 6, Paragraph 1 add: Mr. Wilson has previously represented the Minnetonka Center of Education and Arts, but had not for some time and felt no conflict. Page 3, Paragraph 1 - DNA should read DNR. Haninerel moved to accept the minutes as amended. Frahm seconded - unanimously approved. June 12, 1978 - page 6, Paragraph 1 - The last statement by Htirr should read: "noted that the Planning Comnlsslon is aware that this is not In keeping wfth the Park Reserve's plan for Big Island which has been endorsed by Orono, but to date nothing further has been done. Page 4, Paragraph 1: Change the motion to read: Haninerel moved to approve the variance for the bike/hike trail In its present location as designed by the Hennepin County Park Reserve as it is a dry area not a nesting area and does not destroy the marsh contingent upon receipt of a completed application for the City's files and the conditions stated in the letter from the Park Reserve, dated April 13, 1978, to the City.
