Subdivision - David Butler, 4685 North Shore Dr. Variance 1 ■ CITY OF ORONO, MINNESOTA MINUTES OF A PLANNING COMMISSION MEETING HELD MAY 8, 1978 The Orono Planning Commission met on the above date with the Jollowing members present: Acting Chairwoman McDonald, Members Wilson, Hammerel and Hannah. Also present was Mike Gaffron, Septic Systems Inspector, and Jim Olson, the City Engineer. Chairwoman McDonald announced that this was the time and place for a public hearing on Lloyd Kelley Subdivision, 85 South Brown Road, Applicant Lloyd Kelley was present. A new sketch plan was presented to the Planning Commission showing four proposed lots with access road continuing through west end of property for possible future connection to adjacent roadway. Mike Gaffron brought up that the access road goes through a wetlands and should be made an outlot rather than an easement. Mr. Kelley stated that the existing road will remain the same. If the proposed road is developed there will be marsh wetlands to deal with. There were no comments or discussion from those attending the public hearing, therefore, the public hearing was closed at 7:45 P.M. Staff requested that no further action be taken until soil testing information is received. The roadway should also be clearly defined. Coninission Member Tom Frahm arrived. ATTENDANCE 7:30 P.M. i PUBLIC HEARING LLOYD KELLEY SUBDIVISION 85 South Brown Rd. (#372) 7:50 P.M. Jim Olson stated that in terms of a concept it is most acceptable and is in a position to be approved, however, because there are some specifics lacking it would be our recommendation that it be tabled until the next Planning Commission meeting at which time the applicant will have the opportunity to have his engineer supply more specific details on the drawing. He also stated that an easement should be taken at this time to Insure the future use of the road for the City. After further discussion, Gregg Hannah made a motion that we give conceptual approval to subdivision contingent upon the appropriate presentation of further detailed information which is not now available to us. IL MINUTES OF A PTJ^NNING COMl«lISSION MEETING HELD MAY 8, 1978 - PAGE 2 2. This detailed information includes: 1. Soil tests indicating adequate capability for waste disposal. Revised plan should show exact dimensions of lots and Include location of present structures and their distance from the lot line. The private road should be indicated as an outlot. An easement over that road (50' width) should be granted for future use of the City This project should be subject to the Park Dedication Fee. 3. 4. 5. There was concern regarding the location of the road and its relationship to the marsh area. Prior to final approval it will be required that the applicant make a firm presentation of how the road will be constructed and not interfere with the character of the marsh. Approval is contingent upon acceptable resolution of the marsh area questions. Jim Olson also stated that a topographic drainage plan with contours will be required. Tom Frahm seconded the motion. Unanimously approved. Applicant John Swanson was present at the meeting. He is applying for a conditional use permit to construct two additional living quarters as guest houses. At the last meeting the Planning Commission recommended that the applicant bring in new plans showing an addition rather than two additional units. Applicant presented plans showing an addition to the existing house without separate kitchen facilities or entrances. Planning Commission reviewed the plans and addressed whether variances were required for the proposed addition. PUBLIC HEARING LLOYD KELLEY SUBDIVISION 85 South Brown Rd. (#372 Continued) JOHN SWANSON 2785 Casco Point Rd, CONDITIONAL USE (#377) Gregg Hannah made the following motion: That it be approved based on the fact that this is an addition to a single family dwelling and that the variance is required because 80% of the lot width requirement is met and because the new downstairs walkout addition will continue the house line which is 9' from the lot line. Motion seconded by Hammerel. Motion carried. i minutes of a PIJ^NNING commission meeting held may 8, 1978 - PAGE 3 Applicants were not present. Mr, Gaffron stated that pursuant to a memo of April 28, 1978 Mrs. Konerza called Mr. Olson on May 5, 1978 and stated they would withdraw the application for variance and would send the City a letter to that effect. Mr. Hannah made a motion that this item be tabled pending further input by applicant. Motion seconded by Hammerel and unanimously approved. Applicant Dennis Holmquist was present as well as i^'e prospective buyer Kerry Gullickson. Applying f‘. r Int area and lot width variances for construction of a new residence on the subject property. Mr. Gaffron noted a memo of May 4, 1978, showing wetland area and permits for adjacent buildings. Applicant has been unable to buy adjacent land to make a larger lot. Planning Commission gave their opinion that they would like to see a minimum 2-acre lot in unsewered areas. Planning Commission also wanted a legal opinion on whether prior subdivisions must be honored even though code has changed, Wilson made the following motion: That the Planning Commission not approve this as a buildable site, unless our village attorney's opinion is that this is a grandfathered substandard building site and in his opinion it is a legitimate building site. If the lot is declared a building site, then the normal building permit requirements of soil testing and satisfactory evidence of legal access will be required. Motion was seconded by Hannah and unanimously carried. Mr. Kerry Gullickson questioned whether or not two 2-1/2 acre lots would be approved (i.e. acquisition of Bryant Property). Planning Commission stated this would be more acceptable. Steve Wilson also requested that the following be included in the meeting minutes: This issue of the legal status of the grandfathered lot is the same issue that came up two weeks ago in the Fartenwood outlets. He would like to see the village attorney, if he hasn't already done so, address this issue for the Planning Commission to give them some guidance so that when this comes up in the future they will have some direction. RICHARD KONERZA 245 Tonka Avenue VARIANCE (^i^371) DENNIS HOLMQUIST 135 Turnham Road VARIANCE (#373) minutes of a planning commission meeting held may 8, 1978 - PAGE 4 Application for variances to construct a 3-car detached garage. Applicant John Perkins was present. Mike Gaffron stated that notification had not been sent to adjacent property owners due to staff problems. Applicant stated that hardships to the lot included a hill to the west and some trees to the south of the proposed garage. Tliere was discussion as to other possibilities and congestion in the area. JOHN PERKINS 1265 Elmwood VARIANCE (#374) Mr. Wilson made the following motion: That the 3-car detached garage be approved,as the way the lot is layed out and with the hill and trees it appears to be the only way to solve the problem, conditioned on the following: 1. Neighbor on the north submit a written approval since he was not notified. 2. The existing garage be removed prior to the construction of the new garage. Motion seconded by Hammerel and unanimously approved. . Gregg Hannah made the following motion: Due to the fact that we have now been informed that none of the neighbors have been informed of the action being taken on these items, that the neighbors of these items be notified prior to taking action at the Council. Motion seconded by Mr. Wilson and approved. Application for variance from street setback requirement for approval to construct detached garage. Applicant Timothy Gagner was present. He stated that hardships to the lot were losing two trees and moving a well if garage was put within setback requirements. Jim Olson asked if the existing blacktop area was large enough to turn around in. Applicant stated that it was. TIMOTHY GAGNER 740 Tonkawa VARIANCE (#375) Hammerel made the following motion: That this application be approved for variance of street setback requirements for approval of construction of detached garage, variances approved of 27,220 s.f. lot area, 64 ft. lot width, and 24 ft. street setback. Frahm seconded the motion. Motion unanimously approved. 1 MINUTES OF A PLANNING COMMISSION MEETING HELD MAY 8, 1978 - PAGE 5 Tim Marr and Alex Mayer were present. They stated that approximately 1.5 acres or 0.3% of the total marsh area would be filled. The trail would be constructed to within 50 - 75 feet of the road right-of-way leaving wetland between road and trail. Jim Olson stated that drainage is probably of only slight concern and that culverts would be used. Applicants stated that they had approval of Watershed District and preliminary approval of DNR hinging on culvert sizing, and preliminary approval but no permit from the Corps, BIKE/HIKE TRAIL BAKER PARK RESERVE WETLANDS VARIANCE (#378) Applicants proposed use of construction fabric as a fill base to minimize uneven settling or mixing of fill materials. Jim Olson suggested that to minimize detriment to the marsh the trail could be moved toward the road or could be reduced in width. The discussion covered reducing the width, leaving out trees and fencing for the 1200 foot length across the marsh. Commission Members felt that unnecessary aesthetic value should not be created to detriment of the marsh. Jim Olson wanted to see soil borings and cross sections of trail. Gregg Hannah made the following motion: That this item be tabled pending input from the city engineer with particular attention to that portion of the trail which goes through the marsh with the intent of reducing the trail width or moving the trail closer to the road. Motion seconded by Tom Frahm. Unanimously approved. Planning Conmission requested notification of the time and place of the site inspection so members could attend if possible. Applicant is requesting a variance for construction of a private dock on Outlot A of the Partenwood Subdivision. JACK SAFAR 925 Partenwood Rd, SUBDIVISION (#381) MINUTES OF A PTJ^NNING COMMISSION MEETING HELD MAY 8, 1978 - PAGE 6 Applicants representative, Mr. George Johnson, was present. Mike Gaffron handed out the adopted LMCD Code which was received that day. Due to the late receipt of this code, the staff did not have a chance to review it prior to the Planning Commission meeting. John Hammerel made the following motionj That this variance be approved for the construction of no more than two private docks on Outlot A, Partonwood Subdivision, for the use of lake access for Lots 1 and 2, Block 3, in accordance with plat approval for Partenwood Subdivision, dated January 6, 1972, and gxisting covenants thereto. Motion was seconded by Gloria McDonald. Three Ayes - Hammerel, Hannah, and McDonald; 2 Opposed - Frahm and Wilson. The applicant proposed to expand his existing house over onto the adjacent lot which he has just purchased. Applicant David Butler was present. jfotion was made by Tom Frahm as follows i To approve variance of .37 acre lot area and 7.5 feet front setback due to hardship of topographic lot restrictions and safe access to County Road 19, contingent on the combination of Lots 77 and 78, including payment of any due taxes and proof of purchase or ownership. Motion seconded by Wilson, approved unanimously. JACK SAFAR 925 Partonwood Rd. DAVID BUTLER \ 4685 North Shore Dr. (#382) This is a proposed two lot residential subdivision. One new lot is being created with a private easement shown for access. The property is not sewered and is not assessed even though there is a sewer easement through the north lot. Due to confusion regarding the April 24, 1978 meeting which the Ruscianos did not attend, they were added to the agenda for the May 8, 1978 meeting. There was confusion regarding the lot line location as well as the actual location of the sewer easement. Jim Olson will make a site inspection with the applicant or their representative, Ms. Weinzeirl, who attended the May 8th meeting, to determine these items as well as whether or not the area of the creek should be should be included or excluded in the required minimum lot area.
