Conmiissloner Hurr was absent. present in place of Hank Munich, Zoning Administrator, who was ill. attendance 7:30 P.M. Chairman Hassel announced this was the time and place for a Public Information Meeting on the petition of Joseph Whitney. The City Planner Notice of Public Meeting and the Affidavit of Publication. Mr. Whitney was present as well as the following neighbors: ^eve Raster, Denny Kumlin, and Joe Wiswell. The plats, dated 3-17-78, were reviewed. It was noted that they consisted of 7 lots all exceeding the minimum 2-acre, 200* width requirement. The Planning Commission recomended approval of the preliminary plat subject to the following items: plating of the road and^ drainage easements as outlets; completion of a develooers greement for the road and drainage construction; removal of fisting driveway when the new road is created- com­ pletion of septic system testing prior to final plat no^ri’ dedication fee, and orter Motion by Hannah, seconded by Hammerel, mot^n carried unanimously. ^ PUBLIC HEARING 7:30 P.M. JOSEPH WHITNEY 780 Old Crystal Bay SUBDIVISION (#360) MINUTES OF A PLANNING COMMISSION MEETING HELD ON APRIL 24, 1978 Chairman Hassel announced this was the time and place for a Public Hearing on the petition of American Rebullders. The City Planner presented the Notice of Public Meeting and the Affidavit of Publication. The applicant Mr, Herfurth was present as well as the following neighbors: Fred Keller and Jack Rosengren, a representative for Elmer Ties. A1 Olson read into the record a recommendation of the County Engineer regarding access and right-of-way on this property - Basically, the County would request an additional 10' of right-of-way along County Rd. 6 as has been standard procedure along this highway and that no more than two new access points to County Rd. 6 be granted. This last request would require at least one common access point along the three lots abutting County Rd. 6. The Public Hearing was closed at 7:58 P.M. Most of the Planning Coninlsslon discussion centered on the Highway Department's recommendation - they were not ready to limit access to two access points until the staff had reviewed it further. Jim Olson, city engineer, noted for the record that Lots 2, 3, and 4 were Just under 4 acres each and that due to the 2-acre zoning requirement they would not be further subdlvldable. The Planning Commission thereafter reconmended approval of the preliminary plat as shown on the drawings dated 2-9-78, subject to septic system testing prior to final plat approval, park dedication fee payment, conservation and flowage easements over the wetlands, and to the 10' additional right-of-way dedication along County Rd. 6 as shown on the preliminary drawings. Motion by Frahm, seconded by Hammerel, Ayes (6), Nays (0), motion carried. Mr. Wlttmer was present. It was noted that a letter had been received from Mr. Wlttmer revising the application. Frahm moved, Hassel seconded approval of the variance contingent upon maintaining the steps and omitting the deck. Motion, Ayes (6), Nays (0), motion carried. PUBLIC HEARING 7:51 P.M. (FRED HERFURTH) SUBDIVISION 2400 6th Avenue No, (#363) WALTER WITTMER 1420 Baldur Park Rd. VARIANCE (#368) MINUTES OF A PLANNING COMMISSION MEETING HELD ON APRIL 24, 1978 Mr. and Ifrs. Konerza were present. They advised the Planning Connnlsslon that due to rain they could not provide septic testing and requested tabling of the variance application. McDonald moved and Hammerel seconded to table this Item. Motion: Ayes (6), Nays (0), motion carried. McDonald moved and Hannah seconded approval of the minutes of the March 13, 1978 Planning CouHnlsslon meeting. Motion: Ayes (6), Nays (0), motion carried. Mr. Stlelow was present at this meeting. The fl^^mlng Commission reviewed a revised plan datwd April 20, 1978 which appeared to resolve all previous problems. The County access requirements are satisfactory with revised plat. AI Olson noted that the access for Lots 10 & 11, Block 1, should be a joint access on the common property line rather than separate access points. It should also be noted that this plat shows Outlot A the Island lying to the southwest corner of the property. This outlot Is mostly marsh land and Is not separately bulldable. It Is meant to be owned by Lots 5 or 6 or perhaps a combination of those two lots. Hannah moved and Hammerel seconded approval of the preliminary sketch plan subject to receipt of engineering details of the road profile and grade and septic system testing Information. Mr. Stlelow was Informed that a public Information meeting would be scheduled to review the preliminary plat. The sketch plan of Philip Rusclano was tabled as the applicant was not present. McDonald moved, Hannah seconded, motion carried. SUBDIVISION (#380) MINUTES OF A PLANNING COMMISSION MEETING HELD ON APRIL 24, 1978 WORK SESSION ITEMS SSIHiL opinion or decision without having specific facts. Hie applicant has the property for sale and intends to sell it. The Cit^ does not have any septic system information. Jim Olson, the cxty engineer, discussed the situation and was concerned about the unimproved road to the property and the lack of documented easements to the property. Staff recommended that no action be taken to applicant provides enough informationto thoroughly review the application. DENNIS HOLMQUIST 135 Tumham Rd. VARIANCE (#375) ^ s-A lh.at ,L j 1 i : MINUTES OF A PLANNING COMMISSION MEETING HELD ON APRIL 24, 1978 Mr. Jim Nossback was present. Considering that there were no complaints and this request is identical to that made previously, Hannah moved and McDonald seconded approval subject to the same conditions as last year, subject to renewal in 1979, Motion: Ayes (6), Nays (0), motion carried. ^h^. Swanson was present and explained his application that would Include the creation of two new apartments off an existing house, a mother-in-law apartment in the basement of the house, and a separate apartment over an attached double garage for his parents to live in for a part of the year. Each apartment as well as the house would have separate kitchen and bath facilities so you would in effect have a triplex if his proposal is approved. The Planning Commission was concerned with the effect of building an apartment unit in a single family zoning district, and noted that the guest house requirements would require a lot size variance because each separate guest house by the ordinance is required to have all the requirements of a single family house on each lot. In this case, the lot is large enough for one unit not three. Dick Hassel recommended review of the plans and redesign to accommodate the guests without separate facilities or separate entrances. Gregg Hannah also suggested separate wings would be alright if the access was through the house and not from an outside access. The Planning Commission suggested that if the house was redesigned to allow for this, a conditional use permit may not even be necessary and only an addition would have to be considered for the hoiise. HENNEPIN CTY VO-TECH 2950 6th Avenue No. CONDITIONAL USE PERMIT (#376) JOHN SWANSON 2785 Casco Pt. Rd. CONDITIONAL USE PERMIT (#377) Tim Marr and Alex Mayer were present. They went through the materials and explained to the Commission the extent of what was requested and the reasons for it. They show a total of 7.1 mile tiail around the entire park including a 1,2 mile section of trail within the City of Orono. The trail would be asphalt surfaced except through the fill area we are discussing which would include a crushed limestone surface across the marsh. This has been before the Park Commission and approved by them on April 4, 1978. The Planning Commission was interested in having all members completely review the facts and had a question as to how much of the marsh would be filled by this proposal. BIKE/HIKE TRAIL HENN. CTT PARK RESERVE WETLANDS VAR. MINUTES OF A PLANNING COMMISSION MEETING HELD ON APRIL 24, 1978 U Planning Conunlsslon reviewed proposal and the circumstances of prior approval as outlined by staff. A public information meeting was scheduled for May 22, 1978. EDWARD T. JOHNSTON 1340 No. Arm Dr. SUBDIVISION (#379) Mr. Safar and Mr. George Johnson were present. Mr. Johnson went through an explanation of the creation of this outlot along with the creation of the other lots within the Partenwood Subdivision noting that there were thirteen one-acre sites in a total area of 24 acres, eleven of those sites are actually riparian with two lots Inland. Those two lots being the subject of this variance. Outlot A which is where the dock is requested to be placed is now owned in fee by Mr. Johnson because he is also the fee owner of Lots 1 & 2, Block 3. Lots 1 and 2 each have a 1/2 undivided interest in Outlot A. Mr. Johnson argued against imposing higher restrictions today than those imposed when the lot was plated. Brad Van Nest noted that the City would consider granting a variance to build a dock under the current dock regulations, l.e. that the dock be no mere than 100' long and that no more than two countable boats be placed at the dock at any one time, and also that IMCD Multiple Dock License would be required due to the dock location on an outlot.
