Representing staff were City Administrator Ron Moorsc, Planning Director Mike GaBron, City Attorney Tom Barrett, Zoning Administrator Paul Weinberger, Zoning Administrator Wendy Bottenberg, City Engineer Tom Kellogg, Public Services Director Greg Gappa, and Recorder Alissa WIntemheimer. Council Member Jim While was absent. Mayor Peterson called the meeting to order at 7:00 p.m. CONSENT AGENDA 1. Approve/Amend Items 14, 15, 16, 18, 19,20,21.23, and 25 were added to the Consent Agenda. Item 8 was removed from the Consent Agenda. Sansevere moved, and Flint seconded, to approve the consent agenda as amended. \'ote: Ayes 4, Nays 0. APPROVAL OF MINUTES *2. Regular Council Meeting of February 11,2002 Sansevere moved, and Flint seconded, to approve the Minutes of the Regular Council Meeting of February II, 2002. V’ote: .Ayes 4, Nays 0. PARK COMMISSION COMMENTS—PAULINE BOUCHARD, REPRESENTATIVE Bouchard mentioned the Park Commission’s support of the Mound skate park and noted that a resolution of support was on the agenda. She stated they had heard of some boards to surround a hockey rink that might be available cheap, and wondered if there was a place available to store them in the off-season should they be able to obtain the boards. Gappa stated the boards were in Fargo, so it would be difficult to get them back to Orono. Bouchard stated that the Star Tribune had run an editorial regarding Miruietonka Beach not allowing the public access to the Dakota Rail Corridor. She suggested that if ORONO CITY COUNCIL MEETING MONDAY, FEBRUARY 25,2002 PARK COMMISSION COMMENTS—PAVUNE BOUCHARD, REPRESENTA TIVE —Continued Minnetonka Beach had hired a lobbyist, then maybe Orono should as well. The Park Commission planned to draft a letter to the editor to show that Orono does not support Minnetonka Beach’s position. Sansevcrc stated he agreed with the letter. Flint stated he favored hiring a lobbyist to keep them informed of legislation that might affect the Dakota Rail. Sansevere stated he does not approve of hiring a lobbyist. Gabriel Jabbour stated that the cities of Orono, Spring Park, Mound, Minnestrista, and St. Bonifacius, as well as Hennepin, Carver, and McCloud counties all support the trail unanimously as an uninterrupted corridor. He stated that Representative Tom Workman gave him his word that he would not introduce legislation against the trail. A bill was posted on Friday and passed on Tuesday, with Minnetonka Beach the only group that testified. It was a lobbyist driven bill, and Orono ’s interests will not be served unless they have a representative on the floor. He also stated that the DNR, Hennepin County, and Met Council are on their side, and he suggested sending a letter to Met Council. Mr. Jabbour stated that Minnetonka Beach's comprehensive plan states in several places that the corridor should not revert to a transportation corridor, but should become a park available only to Minnetonka Beach residents. Flint stated that a lobbyist could cost up to $5,000 to keep the Council advised. He su'jgested making the money available to spend at the Mayor ’s discretion, but to not use it unles necessary. Flint moved, and Nygard seconded, to make up to $5,000 available for a lobbyist, to be used at the Mayor^s discretion. Vote: Ayes 3, Nays 1 (Sansevere). PLANNING COMMISSION COMMENTS—SANDY SMITH, REPRESENTATIVE None. LMCD REPORT—LILI MCMILLAN, REPRESENTATIVE McMillan spoke about the additional water patrol project over the 2001 boating season. There were no boating fatalities on Lake Minnetonka, a reduction of personal injury accidents by more than 50%, an increase in public contact, but lower citation count. The number of patrol hours by deputies was increased by 59% to 2,546 hours. She felt the program was a big success. 1 1 ----UJUtslkuUMI ORONO CITY COUNCIL MEETING MONDAY, FEBRUARY 25,2002 LMCD REPORT—LIU MCMILLAN, REPRESENTATIVE—C0nHnued McMillan stated that they were able to transfer out deputies, keeping the cost of the program down—only S52.000, versus the $100,000 originally budgeted. They plan to use the overpayment from 2001 to fund the 2002 program. They would also require some additional funds from the cities. Orono’s expense for 2002 would run about $600, because they are budgeting $60,000 for the 2002 program. She stated Minnetonka did not contribute last year, because of a disagreement over the payment formula. They will approach them again for this year, and they would like to have all fourteen cities with l^eshore involved. She stated they really appreciate the cities’ and communities’ support of the program. The DNR conducted a sur\ ey and found that people felt the quality of enforcement was good, constructive and helpful. PUBLIC COMMENTS None. ZONING ADMINISTRATOR’S REPORT 3. #01'2699 Jay and Kendall Nygard, 1386 Rest Point Road—Varia^,«.»s- Resolution No. 4757 Weinberger stated that the Nygard’s had requested a variance to permit a two story addition for an entry way and second floor living space. The addition would be 8 ’ from the east property line encroaching 2' into the 10 ’ required side yard setback. The variance would allow the addition to match the existing exterior wall on the house. When finished, the hardcover shall equal the current hardcover. The Nygard’s would place the addition over existing hardcover and remove part of existing rock garden to not have mere than the existing hardcover on the property. They would also remove all landscaping fabric and install a proper drainage system. Sansevere moved, and Flint seconded, to adopt Resolution No. 4757 granting variances to Municipal Zoning Code Section 10.22, Subdivision 1 and Section 10.56, Subdivision 16(L)(2) to permit an alteration to existing hardcover over 25Vo for a two-stor>‘ residential addition and variances to Section 10.24, Subdivision 5(B) to permit an addition 8’ from the side property’ line where a 10’ setback is required. Vote: Ayes 3, Nays 0 (Nygard abstained). rVrtM 1 i - ORONO CITY COUNCIL MEETING MONDAY, FEBRUARY 25,2002 *4. #01-2706 Richard Stark, 815 Partcnwood Road—Variance Review—Resolution No. 4758 Sansevere moved, and Flint seconded, to adopt Resolution No. 4758 granting variances to Municipal Zoning Code Section 10.22, Subdivisions 1 and 2 to allow the remodeling and expansion of the existing residence to include a four stall garage, construction of a screen porch 38* from the 929.4 OHWL mark by adding 57 s.f. to a lakeside deck, and adding 140 s.f. to a lakeside deck located 33* from the 929.4 OHWL where 75* is required; a hardcover variance of 4,233 s.f. (15.0%) where 5,815 s.f. (20%) is exbting and none is allowed. Vote: Ayes 4, Nays 0. *5. 01-2709 Richard and Anne Shull, 2285 French Creek Road—Variance— Resolution No. 4759 Sansevere moved, and Flint seconded, to adopt Resolution No. 4759 granting a variance to Municipal Zoning Code Section 10.56, Subdivision 16(CK1) to permit structure within 150* of a Natural Environment Lake, Section 10.56, Subdivision 16(LK1) to permit 3,830.25 s.f. (23.5%) of hardcover in the 0 - 75* setback area, and Section 10.56, Subdivision 16(C)(6) to permit the encroachment of 50* and 75* into the average lakeshore setback for construction of a three stall garage to the east end of the residence, a new entryway over existing steps and a cantilevered bay window. Vote: Ayes 4, N^ys 0. *6. #01-2730 Ace Properties, 3375 Crystal Bay Road—Variances—Resolution No. 4760 Sansevere moved, and Flint seconded, to adept Resolution No. 4760 granting variances to Municipal Zoning Code Section 10.25, Subdivision 6(B) to permit construction of a new residence on a property with a lot size of 6,690 s.f. (.15 acre) where 21,780 s.f. (1/2 acre) is required, a lot width of 50* where 100* is required, to permit a 19* rear setback where 30* is required and a 9.7* side setback where a 10* setback is required; Section 10.22, Subdivisions 1 and 2 and Section 10.56, Subdivision 16(L) 1 and 2 to permit 748 s.f. (23.8%) hardcover in the 0 - 75* setback where no hardcover is allowed and 2.062 s.f. (53.4%) hardcover in the 75 - 250* setback where 934 s.f. (25%) is allowed. Vote: Ayes 4, Nays 0. 7. #02-2746 Mark Finney, 3210 North Shore Drive—Variances Mark Finney was present. Weinberger stated that the property in question functions as a back lot. The Planning Conunission recommended approval of the plan with the condition that the addition be J ORONO CITY COUNCIL MEETING MONDAY, FEBRUARY 25,2002 7. §02-2746 Mark Finney, 3210 North Shore Drive—Variances—Continued shifted to be n;<sh with the existing house tine. They also recommended a proposed garage be reduced in size. Mr. Finney agreed to that and reduced the size in order to only require a 10 ’ setback. The final survey work on the revised plans was not yet in. In order to shift the addition and preserve yard space on the other side of the house, they made the addition longer and narrower, so that overall, it is the same size as the addition the Planning Commission reviewed. In addition to that, there is a proposed ground level deck and enclosed screen porch to be constructed on the front side of the house. They wish to increase the screen porch so that it can be accessed directly from the house. Hardcover would be reduced substantially, but would still be over the 25% allowed hardcover. Even with the addition shifted to match the current house line, there is a variance required for the side setback because the addition would sit 8’ from the side yard setback. The final sur\ey work is needed to locate a sewer line to make sure the proposed garage not be located over the sewer line. If it is not, then a utility easement would be required over the area of the sewer line. Most of the conditions made by the Planning Commission have already been met by the applicant’s revised plans. Weinberger stated the staff would be comfortable recommending approval subject to the final survey work and locating the sewer lines. Mr. Finney stated he would do whatever it takes to meet the City ’s requirements. Sansevere and Nygard stated they supported staffs recommendation. Moorse clarified that the screened porch would be fine as long as it stays under thel5% structural coverage maximum. Flint moved, and Mayor Peterson seconded, to approve the application subject to the final survey being completed, the sewer being located, and subject to the final resolution being drafted. Vote: Ayes 4, Nays 0. 8. #02-2747 Tonka Ventures, 3749 Livingston Avenue—Easement Vacation— Resolution No. 4761 John Gleason with Hillcrest Northwest Townhomes was present. He stated he was the builder, not the developer, with the project. Flint stated he removed it from the consent agenda because of the neighbor ’s concern over tree removal and replacement, and erosion that was depositing material on adjacent lots. Mr. Gleason stated that they need to follow an approved building plan, and until the last ORONO CITY COUNCIL MEETING MONDAY, FEBRUARY 25,2002 S. #02-2747 Tonka Ventures, 3749 Livingston Avenue—Easement Vacation- Resolution No. 4761—Continued building is finished, it will be difficult to control erosion. They are currently controlling erosion with a silt fence and hay bails. They have also planted trees as planned up to this point, but will need to complete the project before they can finish the plantings and landscaping. How soon they can finish the project will depend on the weather. The approved landscape plan is filed with the City and the City has a line of credit that will be held until the project is complete. Weinberger stated that the neighbors may have thought more trees would be going in than actually will. The final elevations wouldn't be complete until the project is complete and the backfill is in. Flint asked if the City Engineer would visit the site. Kellogg stated he would visit on Friday. Weinberger stated that if the Council did not adopt the resolution, then it would have to come back at the March 11"* meeting. Flint stated he would be willing to approve it based on the builder ’s \ erbal assurance that he would address the neighbors* concerns. Mr. Gleason stated he was looking for approval so that they could begin construction. Flint moved, and Sansevere seconded, to adopt Resolution No. 4761 vacating a dedicated drainage and utility easement within the plat of Lake Minnetonka Woods. Vote: Ayes 4, Nays 0. 9. #02*2749 Thomas P. Egan, 350,360,370 Big Island—Vacation Weinberger suggested the Council might want to discuss the role of the Planning Commission in relation to vacating land on Big Island. He stated that the applicant had phoned to say he would not be present because his neighbors were unable to attend, and he could not speak for them. Flint stated they should get the Parks Commission ’s input as a matter of policy on vacating public lands. He suggested the City may want to preserve part of the right-of- way as public access to the lake. Nygard stated that the area was comprised of bluffs and it was not a good access point. Flint moved, and Nygard seconded, to table item 9. Vote Ayes 4, Nays 0. Flint moved, and Nygard seconded, that vacation requests within the City should first be reviewed by the Parks Commission. ORONO CITY COUNCIL MEETING MONDAY, FEBRUARY 25,2002 *10. #02-2750 Edward and Michelle Winer, 2010 Shoreline Drive—Variance- Resolution No. 4762 Sansevere moved, and Flint seconded, to adopt Resolution No. 4762 granting variances to Municipal Zoning Code Section 10.22, Subdivision 1(B) and Section 10.56, Subdivision 16(CK6) to allow encroachment of 10’ into the average lakeshore setback to permit an addition and deck to existing residence. Vote: Ayes 4, Nays 0. *11. #01-2751 Mark Welsh, 3625 North Shore Drive—Variances—Resolution No. 4763 Sansevere moved, and Flint seconded, to adopt Resolution No. 4763 granting variances to Municipal Zoning Code Section 10.22, Subdivisions 1 and 2, Section 10.55, Subdivbion 8 and Section 10.56, Subdivisions 16(L) 1 and 2 to permit 615 s.f. (16.4%) hardcover in the 0 - 75 ’ lakeshore setback where 660 s.f. (17.6%) hardcover exists and no hardcover is allowed, and to permit 884 s.f. (51.6%) hardcover in the 75 - 250 ’ setback svhere 932 s.f. (54.4%) hardcover exists and 428 s.f. (25%) hardcover is allowed; Section 10.25, Subdivision 6(B) to permit new construction on the lot with a delined lot area of 5,462 s.f. where 21,780 s.f. is required and a lot width of 50 ’ where 100’ is required, and to permit a side yard setback of 5 ’ for the bouse where a 10’ setback is required; and Section 10.61, Subdivision 5(A) to permit one off-street parking space to be located 3 ’ from the adjacent property line where off-street parking in ’’R” districts is required to be set back 10’. Vote: Ayes 4, Nays 0. *12. #02-2754 Matthew and Kathy Dolliff, 2680 Pheasant Road—^Variance— Resolution No. 4764 Sansevere moved, and Flint seconded, to adopt Resolution No. 4764 granting variances to Municipal Zoning Code Section 10.22, Subdivision 2 and Section 10.56, Subdivision 16(b)(2) to permit 6,355 s.f. (34.19%) hardcover in the 75 - 250 ’ lakeshore setback where 6,355 s.f. (34.19%) hardcover exists and 4,646.75 s.f. (25%) is allowed to permit an addition and walk to the existing residence. Vote: Ayes 4, Nays 0. 13. #02-2755 Long Lake Fire Station—Cit>' of Orono, 340 Willow Drive North— Class 111 Subdivision, Variance and Conditional Use Permit Gaffron stated that the lot available to the fire station is about 6 acres, and the fire station was supposed to have about 3 acres available to it. The City was proposing a 2-lot plat, creating a lot for the fire station, a rear lot for potential residential use, and a road outlot at the south end that would continue to be ow'ned by the City for future use. Due to site ORONO CITY COUNCIL MEETING MONDAY, FEBRUARY 25,2002 13. #02-2755 Long Lake Fire Station—City of Orono, 340 fViiioiv Drive North— Ctass III Subdivision, Variance and Conditional Use Permit—Continued factors, the road right-of-way has been widened to 60’. There are wetlands on the property. Part of the area will be filled for the fire station. They will be meeting with the watershed district to approve the stormwater plans. The fire station itself comprises about 50% hardcover for the fire station. They would create a holding pond on lot 2 to mitigate for the wetland that is being filled on lot 1. The Planning Commission approved the preliminary plat as presented, subject to MCWD approval of the wetland mitigation and stormwater management plan. GafTron stated that widening the road to 60’ has resulted in the need for a 10 ’ setback variance to locate the fire station building 40* from the proposed road outlot, rather than the 50* required. The Planning Commission approved the setback variance, finding that the variance is supported by the hardships, and will have no impact on the neighborhood or adjacent properties, with the condition that if the 6“* bay is not built, the station must meet the required 50 ’ setback. The fire station building incorporated a hose tower that would be used for training purposes. The tower exceeds the 30’ allowed height by almost 5 ’. The Planning Commission denied the CUP for tower height because it would have a potential negative visual impact on the neighborhood, its use could become a nuisance in the residential neighborhood, the need for the excess height had not been demonstrated, and the potential impacts of the tower in the residential neighborhood could not be satisfactorily mitigated. Gaffron presented other issues for discussion. Staff recommended that park fees be waived for Lot 1 and deferred for Lot 2 until it is residentially developed. Council would have to decide whether Stormwater and Drainage Trunk Fees would be due for the plat. He suggested Council document allowable fire station uses. Staff recommended that Council consider platting Lot 2 as an outlot since it was uncertain how the lot would ultimately be used. He stated it would be most appropriate to dedicate the road corridor as a public road, and then name it. No application fees had been paid. Staff recommended that as a minimum, all out-of-pocket and consultant costs be charged. Moorse stated that he had received an email from the fire chief requesting that they approve the tower. Flint, Sansevere, and Mayor Peterson all stated that they were not convinced the extra 5 ’ of height was necessary. Sansevere stated he was comfortable with all of the staff s recommendations. Moorse stated they could approve the tower up to 30’ in height. Mayor Peterson asked about the ambulance portion of the fire station being the last add- altemate. Jabbour stated that the committee agreed they would build the ambulance portion, and that portion would not be subject to the cost-cap, and would definitely be 8 ORONO CITY COUNCIL MEETING MONDAY, FEBRUARY 25,2002 i3. Sansevere asked why the fire department seemed to be fighting the ambulance addition. Moorse stated that the only issue now was financial because the ambulance personnel would not have access to the fire station. They would have a separate entrance and all their needs met in a separate portion of the building. Nygard stated he had an issue with granting a variance on new construction. Flint stated that the variance was not required because of the b"* bay, but because of the wetland. He also stated that if they were to deny the 6"* bay, it should be through a direct approach, and not by means of denying the variance. Jabbour stated they had tried to push the building north, but there is a row of large, mature trees on the north edge of the property. Also, a temporary bridge for the highway construction will cut through the north comer of the property. With the wetlands to the east of the property, they cannot relocate the building on the property. Nygard moved, and Sansevere seconded, to approve the plat as presented. Vote: Ayes 4, Nays 0. Sansevere moved, and Flint seconded, to approve the 10’ setback variance. Vote: Ayes 3, Nays 1 (Nygard). Sansevere moved, and Flint seconded, to deny approval of the conditional use permit per Code Section 10.75, Subdivision 1 to allow a hose tower of 34.8*. Vote: Ayes 4, Nays 0. Flint moved, and Sansevere seconded, to waive lot fees for Lot 1, and defer fees for Lot 2. Vote: Ayes 4, Nays 0. MAYOR/COUNCIL REPORT Nygard stated that he felt there should be some sort of cubic foot ordinance for lot size to prevent the construction of large, boxy houses on small lots. He staled it was an issue for the Planning Commission to discuss. Mayor Peterson asked about the piles of dirt at 18S0 Brown Road. Weinberger stated that they had graded beyond what they were supposed to, and ordered to have it corrected by March S"*. They arc to remove the dirt and decompact the wetland soils. Mayor Peterson asked if everyone was aware of the Hollander property and the crows. Moorse stated that Hollander had been putting out large containers of cat food and it is creating a nuisance with the birds. Barrett stated they want to be careful not to make it illegal to feed birds. He felt the judge who is hearing the Hollander hazardous building case may be willing to direct him to stop putting out the food. Sansevere stated he was in favor of naming the road by the fire station after Gabriel Jabbour. Flint stated they don’t name roads after living persons as policy. Mayor Peterson suggesting asking stafT for recommendations. PUBLIC SERVICE DIRECTOR’S REPORT *14. The Planning Commission held public hearings on November 19.2001, January 22. 2002 and Februar> 19,2002 to review proposed amendments to the existing ordinance. Also, a joint work session with the City Council was held on December 20. 2001 to discuss amendments to the existing ordinance. As a result of the joint work session a change that was studied dealt with hardcover limits for non*shoreland properties less than 2 acres. The limit for how much hardcover would be allowed was not decided, and numerous limits were suggested. Staff put together a study and presented it to the Planning Commission. The study included four neighborhoods in the city where the lots are 2 acres or less in area. With these properties three scenarios were developed: allowing luirdcover s.f. at 50% of lot area allowing hardcover s.f. at 50% of buildable area and allowing hardcover s.f. at 80 % of buildable area. The Planning Commission reviewed the results and decided hardcover limits on non-shoreland properties less than 2 acres would not be appropriate. The Planning Commission recommended approval of the new lot coverage by structures standards at the Februaiy 10. 2002 meeting. The Planning Commission concluded the ordinance should retlect amendments that would include the following in lot coverage by structures calculations: 1. All roofed structures more than 6* above grade level. 2. Tennis courts, patios, decks and all similar “open” structures when partially or fully enclosed by fences, railings or walls more than 6' above grade level. 3. Building protrusions more than 6’ above grade level. 4. Bays or bay windows that act merely as a window will not be included. Those that increase the floor area (i.e. floor to ceiling) will be included. 5. Overhangs more than 2'. Summar>': Under the proposed amendment, in ground pools and their associated grade level patios would no longer be considered as structures for the purpose of calculating “lot coverage by structures.” The original lot coverage ordinance adopted in 1989 did not include pools in the calculation of lot coverage. The ordinance was later amended six months after its adoption to include pools and their associated patios. October 22,2001: City Council approved variance application to replace a home on Chevy Chase Drive. Indicating the lot coverage ordinance should be revisited, specifically regarding in ground pools. November 19,2001: Planning Commission recommended approval of changing the lot coverage ordinance to not include pools and associated patios in lot coverage by structures by a 4-3 vote. The majority camp supported the change, but only if accompanied by a new hardcover limitation on all non shoreland residential lots under 2 acres in area (50% was suggested). The minorit)' camp was against the proposed amendment stating pools and their associated patio/decks should continue to be calculated as lot coverage by structure and suggested that decks regardless of height should also be considered for inclusion as lot coverage. November 26,2001: City Council tabled lot coverage ordinance in order to review it in a joint work session with the Plarming Commission and City Council. December 20,2001: Joint work session with City Council and Planning Commission. The following points or changes came out of the work session: Low pools and patios that have no elements higher than 6* above grade should NOT be included in the calculation of lot coverage by structures. Lot Coverage Ordinance January 17,2002 Page 2 Structural coverage calculations shall include building protrusions more than 6' above grade, i.e. not just the building footprint but the vertical projection of any parts of the building that are more than 6* above grade. The outer 2' of roof overhangs shall not be considered as lot coverage. Open decks with any portion of railing above 6' will be counted as lot coverage in their entirety. Hardcover limits for non-shoreland area needs to be looked at closer. The limit was not decided • ideas included but not limited to; 50% hardcover limit, some other percentage or a percentage of the buildable area on a property. Analysis: Of the approximately 3,000 residential lots in Orono, 616 lots are non-shoreland and less than 2 acres in area. (Map-Exhibit E) A small sampling of these properties was looked at to develop scenarios in which to determine the potential impacts of a hardcover limitation. Three scenarios were developed- 50% hardcover on total lot area, 50% hardcover on buildable area and 80% hardcover on buildable area. Four different neighborhoods in the city were chosen where the lots are 2 acres or less in area Hackbeny Hill. Chevy Chase Drive, Webber Hills, and Chippewa Lane/Tumham Road. If a survey was on file for the property dated 1990 or later the property was included in the study. Each area contains lots that are substandard in area as compared to the zoning requirement. Note: Many of the properties did not have surveys on file because hardcover has not been an issue with non-shoreland properties or improvements have not occurred on the property. For example. Hackbeny Hill neighborhood has 20 properties and only 7 had surveys. Calculations of'total lot area" and “buildable area” (total lot area minus setbacks) were then completed for each property. The calculations are in table form (See Exhibits A-D). Hardcover calculations were then completed for each lot showing; a. Allowed hardcover s.f at 50% of lot area. (Scenario 1) b. Allowed hardcover s.f at 50% of buildable area. (Scenario 2) c. Allowed hardcover s.f at 80% of buildable area. (Scenario 3) d. The amount of hardcover existing on lot and percentage of total lot area. Included in the existing hardcover on lot calculation is the residence (including garage), detached garage, deck, pool, driveway and walkways. In many cases, the size of the driveway and walk were estimated because in the past hardcover was not an issue with these properties so vriien a survey was completed hardcover items were not included. i ;• Lot Coverage Ordinance January 17,2002 Page 3 The surveys are included (Exhibit F) to aid visualizing hardcover on the properties. Analysis Results: The analysis shows the following: a. No properties are approaching 50?^ hardcover based on total lot area, even for the small lots, most are less than 30%. b. Some properties have hardcover over or close to 50% buildable area. c. A large proportion of small lots in a large zoning district (See Tumham Road/Chippevva Lane) already have hardcover over 80% of buildable area, because buildable area is so small. Staff Recommendation: Reviewing the three scenarios: -Staff concludes that hardcover limited to 50% or 80% of buildable area does not provide equity to all property owners, because buildable area is so variable for a given size lot depending on the zoning district. -Staff concludes that limiting hardcover to 50% of total lot area is high. Of the properties reviewed, none were close to the 50% hardcover limit. -If 50% is the recommended amount, will property owners add improvements so half of their property is covered? Staff recommends using the total lot area and a percentage smaller than 50% for allowed hardcover, if a hardcover standard is needed at all. The ^frlp attached slows that the actual number of lots less than 2 acres and not in shoreland is a small percentage of the total lots in the city. Planning Commission Options: 1. Recommend hardcover percentage based on total lot area.(Staff suggests 35%, consistent with the 500-1000 ’ zone. 2. Recommend hardcover percentage based on buildable area. 3. Table the matter to a work session for further discussion; direct s*iff as to what additional information could be provided that will be useful. 4. The City Council of Orono ordains as follows: Section 1. Municipal Zoning Code Section 10.03, Subdivision 14, Item C "Lot Coverage" is hereby deleted and the following language substituted in its place: "C. Lot Coverage. In all zoning district, for all lots of 0-1.99 acres in total area, the total combined footprint areas of all principal and accessory ’ structures shall not e.\ceed 15% of the lot area. EXCEPTION: Regardless of lot area, every developed lot shall be allowed at least 1500 square feet of lot coverage by principal residence and garage structures. The following shall be included in calculation of lot coverage by structures: 1. All roofed structures more than 6' above grade level. 2. Tennis courts, patios, decks, and all similar "open" structures when partially or fully enclosed by fences, railings or walls which extend more than 6* above grade level (if any portion of such structures extends more than 6* above grade level, the entire structure shall count toward lot coverage). 3. Building protrusions which are more than 6' above grade, including the building footprint, and the vertical projection of any parts of the building more than 6* above grade. 4. Bays or bay w indows that increase the floor area (i.e. floor to ceiling) shall be considered lot coverage. Bays or bay windows that act solely as a window shall not be considered lot coverage. 5. They are requesting a hardcover variance (0-75') to allow a 216 s.f. deck and 20 s.f. shed located by the lakeshore to remain on the property. A portion of the deck has a roof, but is not enclosed. Discussion: January. 2002 the applicants received a permit to build a new residence on the property. Ihe new residence meets all standards for the LR-IB zoning district All that remains in the 0-75' setback zone are steps leading to the lake. deck. shed, and two retaining walls. '1 he topography of the property is fairly flat except approximately 45 ’ from the lakeshore. At that point it drops significantly to the lake. There is not a permit on file for the deck or shed, however it appears it has been there for many vears. Researching citv files, a boat house was located there at least until 1986. The zoning code allows stairways up to 4' wide, but landings no more than 32 s.f. in area. Decks and roofed shelters are not allowed. The shelter is painted white and is quite conspicuous against the brown retaining wall as viewed from the lake. Pertinent Code Section: 1. Section 10.22. Subd. 1 (B): Lakeshore Setback: No principal or accessory structure shall be located within 75 feet of the lakeshore. Variance Request: 1 o permit a variance to allow a deck to be within 75’ of the lakeshore. 2. Section 10.56, Subd. 16 (E,F): Water Oriented Accessory Structures/Stainvays Lifts and Landings: The only water oriented accessory structures that are allowed in the 0-75' setback zone are lock boxes up to 20 s.f area and no more than 4' high. Stairways up to 4' wide are allowed in the 0-75' zone with landings (i.e. decks) no more than 32 s.f in area. ^•1 PLANNING COMMISSION:f The Planning Commission recommended by a 4 to 2 vote to: The majority camp supported keepin*' the deck and shed wth the following conditions: 1. Allow the 216 s.f. deck to remain. 2. Allow the shed to remain as a lock box. The shed would need to be cut down to meet the 20 s.f. in area and no higher than 48 inches by code. 3. Paint the lock box brown to blend in with the environment. 4. The roof over the deck shall be removed. 5. The applicant is notified that the deck is nonconforming and if it needs to be repaired it will have to be brought into conformity. The minority camp was in agreement with all of the above, except the deck should be reduced in size, possibly to the same width as the dock. There is a limited amount of level land adjacent to the lakeshore. making access to the lake difficult without a deck or landing area. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variances will not adversely affect traffic conditions, light, air, nor pose a fire hazard or other danger to neighboring property; would not merely serv e as a convenience to the applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary’ to preserve a substantial property right of the applicants; and w ould be in keeping w ith the spirit and intent of the Zoning Code and Comprehensive Plan of the City. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City Start', comments by the applicants and the effect of the proposed variance on the health, safety and welfare of the community. CONCLUSIONS, ORDER, AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants variances to Municipal Zoning Code Section 10.22, Subdivision 1(B) and Section 10.56, Subdivision 16 (E.F) to allow a 216 s.f. deck and lock box by the lakeshore where a deck of 32 s.f. in area is allowed, subject to the following conditions: 1.Council approval is based on the site plan submitted by the applicants attached to this resolution as Exhibit A. The shed shall be turned into a lock box (20 s.f in area and no higher than 48 inches). 1 he shed/lock box shall be painted brown to blend in with the environment. 3.The applicant is on notice that the deck is nonconforming and when it needs to be repaired it will be required to be brought into conformity. 4.Authorities granted by the variances run with the property not with the applicants, but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or these variances will expire on that date (March 11.2003). 5.Violation of or non-compliance with any of the terms and conditions of the variances shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 6.The undersigned owners have read, understand and hereby agree to the terms of this resolution and on behalf of themselves, their heirs, successors and assigns, hereby agree to the recording of this resolution in the Chain of Title of the property. Researching city files, a boat house was located there at least until 1986. The zoning code allows stairways up to 4' wide, but landings no more than 32 s.f in area. Decks and roofed shelters are not allowed. The shelter is painted white and is quKe conspicuous against the brown retaining wall as viewed from the lake. The average lakeshore setback line sh^^be a straight line connecting the most lakeward protrusions of the residence buildings on the imm^iately adjacent lakeshore lots. D. Minimum Lowest Floor Elevations. All structures located within the Shoreland Overlay District which are subject to the flood plain regi^ons of Section 10.55 of this ordinance shall be placed at an elevation consistent with the requiiments of that section. The regulatory flood protection elevation shall be established as set forth in Se^n 10.55, Subd. 7 of this code. All structures constructed within the Shoreland Overlay District shall Htwe their lowest floor, including basement, placed at an elevation no lower than the regulatory flood protection elevation. Where the regulatory flood plain elevation cannot reasonably be determined, the inl^um elevation at which the lowest floor, including basement, may be placed shall be determined^follows: I. For lakes, by placing the lowest floor at a level at least 3^t above the highest known water level, or 3 feet above the Ordinary High Water Level, whichever i^gher. above the flood of record. 2. The only water-oriented accessory structure allowed to be located nearer the Ordinary High Water Level than the normal structure setback as specified in this section shall be a lock box no greater than 20 square feet in area and no higher than 48 inches in height. Stairways and lifts are the preferred alternative to major topographic alterations for achieving access up and down bluffs and steep slopes to shore areas. Stairways, li^ and la'«dings shall be allowed in the shore setback zone and must meet the following design requirements. 1. Stairways and lifts must not exceed 4 feet in width. 2. Landings for stairways and lifts shall not exceed 32 square feet in area. 3. Canopies or roofs are not allowed on stairways, lifts, or landings. 4. Stairways, lifts and landings may be either constructed above the ground on posts or pilings or placed into the ground, provided they are designed and built in a manner that ensures control of soil erosion. 5. Stairways, lifts and landings must be located in the most visually inconspicuous portions of lots, as viewed from the surface of the public water assuming summer, leaf- on conditions, whenever practical. 6. Facilities necessary to provide shore area access to physically handicapped persons shall be allowed provided that the dimensional and performance standards of subitems 1 > 5 are completed in addition to the requirements of the Miimesota Regulations, Chapter 1340. 7. A building permit shall be obtained for construction of stairways, lifts and landings regardless of whether such improvements are constructed above, at or below grade. G. Steep Slopes. The revised request is to allow hardcover in the 75-250* lakeshore setback to pemiit additions and remodeling to the e.xisting house. There are two proposed additions to the house. I'he first would replace an existing attached garage with a 32 ’ X 35' two stor>’ addition. The second addition would be a 20' X 30' attached garage with future living space located above the garage. The property owners only intend to keep the existing house and foundation. F.Applicants have requested to add to the existing house rather than build a new structure on the property. Owners have stated the existing foundation and building will not be removed or altered as part of the remodeling plan. Section 10.24, Subdivision 5 (B). To permit a 9.7' side setback for the residential addition located at the northeast comer of the new house. The property lines are slightly narrower by the street than at the lakeshore. This situation caused the corner of the house to encroach into the required setback. It was not until after the house was designed and drawn on the survey that the encroachment was discovered. Section 10.03, Subdivision 14 (C). The proposed lot coverage by structure is 2,612 s.f. (15.6%). The Zoning Code permits up to 15% of the lot area to be used for structure on the property. The total lot area is 16,750 s.f., which allows a total of 2,513 s.f. (15%) of lot coverage by structure on the property. Lot coverage by structure ordinances were adopted to preserve space between buildings and regulate the massing of structures. Additional structure also contributes towards additional hardcover which can negatively impact water quality by not allowing storm water to run across natural ground surjace. The concept is to allow storm water to be slowed and to infiltrate into the ground. Staff had requested Gronberg and Associates, surveyor/engineer, to reveriff their final calculations to determine the actual size of the proposed house. The total structure was confirmed to be 2.612 s.f which is 99 s.f more structure than the property is allowed Statement of Hardship Applicant has included a hardship statement that is included as part of Exhibit A. To summarize the hardship the property owners state they are expanding the house to be comparable to other houses in the neighborhood, and they arc adding to the existing house closer to lake rather than towards the street to protect an 80 year old oak tree. Site Drainage Staff received the final site grading and drainage plans on February 14* and have not had an opportunity to complete review as of the date of this memo. Moorse on behalf of the City of Orono (hereinafter the “subdivider") in February 2002 filed a formal subdivision application with the City of Orono (hereinafter “the City”) for approval of a two lot plat of property legally described as: All that part of the Southwest 1/4 of Section 34, Township 118 North, Range 23 West of the Sth Principal Meridian, described as follows: Beginning at a point on the West line of said Southwest 1/4 distant 1876 feet North of the Southwest comer thereof; thence North along said West line 387.8 feet; thence East parallel with the South Ime of said Southwest 1/4 a distance of 693 feet; thence South parallel with said West line 387.8 feet; thence West 693 feet to the point of beginning. The proposed plat creates a 2.04 acre lot (Lot I) to accommodate the proposed new Long Lake Fire Station; a 3.42 acre outlot (Outlot A) to be retained by the City of Orono for potential future residential use upon replatting; and dedication of right-of-way for a new public road to serve the subdivision. The plat will also dedicate 33' of right-of-way for existing Willow Drive North. The plat will be served with municipal sewer and water service extending westward from Long Lake at the east boundary of the site. An easement corridor 40* in width bisecting Outlot A will be dedicated to accommodate the sewer and water extension. There are no City-protected wetlands located on the property. A preliminary wetland delineation has been completed for the property and has confirmed that linear wetlands protected under the Wetland Conservation Act (WCA) exist along the southerly and easterly borders of the property, such wetlands being approximately 0.58 acres in area. The net property area exclusive of Willow Drive right-of-way and exclusive of WCA-protected wetlands is 5.30 acres. Proposed Lot 1 contains approximately 1.90 acres of non-wetland area and 0.14 acres of wetland. Proposed Outlot A contains approximately 3.05 acres of non wetland area and 0.37 acres of wetland. In order to accommodate the proposed Fire Station, approximately 0.20 acre of wetland, primarily in Lot I, will be filled. Mitigation meeting or exceeding the required 2:1 ratio for this filling is planned to occur within Outlot A south of the existing drainageway, by creating new wetland from existing upland. This plan is subject to final approval by the Minnehaha Creek Watershed District. Stormwater ponding to serve the Fire Station will be developed in Outlot A, north of the existing drainageway and south of the proposed sewer and water easement corridor. The area planned for this proposed pond is large enough to allow some expansion to serve future development within Outlot A. If the future Page 2 of8 9. 12. 13. development of Outlet A results in the need for expansion greater than can be accommodated south of the utility corridor, a second ponding cell could be developed to the north of the utility easement. The area of Outlet A that will be undevelopable due to casements for existing wetlands, wetland mitigation, stormwater ponding and sewer and water utilities is approximately 1.74 acres, leaving 1.68 acres in Outlet A for future development. A portion of the 0.38 acre area of the utility corridor could be usable for roadways or driveways serving development in Outlot A. Although the property has not yet been rezoned to conform with the 2000-2020 Community Management Plan, proposed Outlot A is large enough (exclusive of the necessary easements to accommodate wetlands, wetland mitigation, stormwater ponding and utility easements) to accommodate reasonable future residential development at the guide-planned density of 2-3 residential units per acre. Lot 1 will access directly west to Willow Drive per the approved Fire Station site plan, and will also gain access to the new public road south of Lot I. Outlot A will gain access to Willow Drive via the the new public road south of Lot 1. The City expects that in the future the new public road will be extended into Outlot A either as a public road or a private driveway as part of a future development. There is no intent at the present time to extend the new’ road eastward to connect with roads in Long Lake, however, the “outlot" status of Outlot A allows for decisions on the ultimate road configuration to be deferred until Outlot A is developed. Because the Fire Station is a municipal building which creates no new impact on park use or park needs, it is appropriate to waive the Park Dedication requirement for Lot 1. Because the future use of Outlot A is not determined. Park Dedication requirements for Outlot A should be deferred until such future time that Outlot A is developed. Because the Fire Station site -will be approximately 60% hardsurfaced, the station will have stormwater impacts potentially even greater than if the site was used for residential development. Ther"'ore, the Fire Station shall be subject to the Stormwater and Drainage Trunk «e per Orono Municipal Code Section 3.22. Page 3 of8 Because the future use of Outlet A is not determined, the Stormwater and Drainage Trunk Fee for Outlet A should be deferred urtil such future time that Outlet A is developed. 14.Because required improvements to the property are being completed as a Joint project of the Cities of Long Lake and Orono, the standard requirement for Developers Agreement and Financial Security should be waived. NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of the findings noted above, the City Council of the City of Orono hereby approves the preliminary plat application of Ron Moorse on behalf of the City of Orono per the preliminary plat drawings by Thomas J. Steams, a licensed surveyor of SEH, Inc, dated February 1, 2002, subject to the following conditions: I.Applicant shall dedicate on the plat 33' of public right-of-way for Willow Drive North per the above-referenced preliminary plat drawing. Stormwater, drainage and wetland mitigation: Prior to final plat approval applicant shall provide a final wetland delineation report for the property id'' *ifying the boundaries of WCA protected wetlands and showing the wetland buffers required by the Minnehaha Creek Watershed District. Drainage easements shall be designated over all wetlands, draliiageways and stormwater ponding areas as shown on the preliminary plat drawings. The City will not grant final plat approval until the site grading, drainage, stormwater and wetland mitigation plans have been approved by the Minnehaha Creek Watershed District. Applicant shall construct all stormwater and drainage improvements and wetland mitigation according to the approved plans and adhering to Best Management Practices for Protecting Water Quality in Urban Areas. The Park Dedication requirement for Lot I is w'aived. The Park Dedication requirement for Outlot A is deferred until such future time that Outlot A is developed. Lot 1 is subject to the Stormwater and Drainage Trunk Fee per Orono Municipal Code Section 3.22. The amount of such fee shall be $13,220 (calculated as 2.04 acres x the commcrcial/industrial rate of S6.480 per acre per the 2002 Orono Fee Schedule) and shall be paid upon final plat approval and prior to filing of the subdivision with Hennepin County. The Stormwater and Drainage Trunk Fee for Outlot A is deferred until such future time that Outlot A is developed. The standard requirements for Developers Agreement and Financial Security in relation to site improvements are hereby waived. It is the Council's intent in approving this preliminary plat to accommodate the needs of the citizenry of Orono, Long Lake and Medina by providing a site for a new Long Lake Fire Station; however, because of the location of the site in a rural residential neighborhood, it is imperative that the character of that neighborhood be preserved to the greatest extent possible. Ancillary elements of the Fire Station use such as lighting and signage could have negative impacts on the neighborhood if not developed in a subdued, low-key manner. Therefore, the applicants are advised to work with City staff in ensuring that the lighting, signage and other elements of the Fire Station use are developed in a manner sensitive to the surrounding area. Pages of 8 9.Subdivider is hereby advised that preliminary subdivision approval will expire within one year of the date of Council approval, March II, 2003. Should the subdivider fail to complete the filing of the final plat application within the year deadline, it shall be necessary for the subdivider to file a new preliminary subdivision application with the City. Final Plat Submittals: The following list of final submittals must be submitted to the Zoning Administrator two weeks prior to the regularly scheduled Council meeting on the second and fourth Mondays of the month. The property is located within the RR-IB Single Family Rural Residential Zoning District requiring a minimum of two acres of contiguous dry buildable land within each newly created residential lot. The property is guided by the 2000-2020 Orono Community Management Plan for single family residential use at a density of 2-3 units per acre. Municipal buildings are a Permitted Use in the RR-1B zone, and the Fire Station to be constructed on Lot 1 is considered by definition as a municipal building. Lot I will contain land totaling 2.04 acres in area. There are no City-protected wetlands located on the property. However, a preliminary wetland delineation completed for the property has confirmed that linear wetlands protected under the Wetland Conservation Act (WCA) exist along the southerly and easterly borders of the property, such wetlands being approximately 0.58 acres in area. Lot 1 will contain approximately 1.90 acres of non-wetland area and 0.14 acres of wetland. The Orono Planning Commission reviewed this application on February 19,2002 and recommended approval of the variance by a vote of 6 to 0, finding that the variance is supported by hardships as stated in the staff memo dated February 15,2002 and that the variance will have no impact on the neighborhood or adjacent properties. Planning Commission recommended that approval be revoked, however, if the sixth bay of the Fire Station is not constructed, thereby making the building smaller and negating the need for the variance. 6. The City Council hereby makes these additional findings of fact: The site plan for the Fire Station has been developed by the joint Fire Station Committee and reviewed by both City Councils. Site layout has been significantly influenced by a number of factors including: Page 2 of? 2) the necessary north-south building orientation to allow for direct fire apparatus'*xit onto Willow Drive without requiring additional turning movemenis; driveway aprons required on east and west sides of the building bays to allow for fire apparatus ingress/egress, necessitating that administrative and training spaces be located on the north or south ends of the building; road / driveway access to the rear of the building must allow for the necessary wide turning radius of fire apparatus; proximityto the existing/future Willow Drive bridgeover the RR and the new Highway 12 route; site limitations imposed by width of the site, as well as by the location of existing linear wetlands on the site, and the need to create a road corridor to provide access to the rear of the property for future residential use; soil conditions which require extensive soil correction work and which limit use of the southerly portion of the site for building purposes. The setback variance for the fire station is directly attributable to the occurrence of linear wetlands along the south property boundary. These wetlands must be preserved to the greatest extent possible, and a 16' buffer is additionally required. Due to minimum City requirements for road and shoulder widths, the road/driveway corridor had to be widened to 60' as it enters the site from Willow, and even wdder to minimize wetland impacts toward the rear of Lot I. Nevertheless, a road corridor is necessary to access the rear of the site. A road corridor along the north lot line would be undesirable from a safety starapoint due to proximity to the Willow Drive Bridge over new 1 2 coupled w’ith the dual fire apparatus return access and residential use this corridor must serve. The most feasible location for the road corridor is south of the station, and the characteristics of the land dictate the location of the corridor. Page 3 of? 8. The location of the fire station is relatively fixed based on the need for parking lot access and parking stalls on the north end of the building, minimum setback requirements, and the required length of the building to serve the needs ofthe fire department. Moving the building an additional 10'northward to avoid the variance would have resulted in re-design of the site plan and the building. The planned construction of a temporary bridge over the new Highway 12 corridor which will impact a significant portion ofthe northwest comer of the site, makes it impossible to shift the building to the north. Also, a stand of mature coniferous trees would be destroyed if the building was moved to the north. The basis for a 50' side street setback requirement for institutional/municipal buildings is to minimize the impact on the surrounding neighborhood. The fire station will be situated 100 feet from the south lot line of the property, and the road will be moved further off the lot line to avoid impacting the linear wetlands. Both factors tend to minimize impact of the variance on the only directly affected neighboring property, the Mi Her residence to the south. That residence is located approximately 100 ’ from its north lot line, or about 200' from the fire station building. The City Council finds that the conditions existing on this property and in relation to Lot 1 are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air, nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserv'e a substantial property right of the applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City Staff, comments by the applicants and the effect of the proposed variance on the health, safety and welfare of the community. Page 4 of 7 CONCLUSIONS, ORDER, AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Municipal Zoning Code Section 10.20, Subd. 3 to permit the construction of the Long Lake Fire Station at a setback of 40* from the south line of Lot 1 rather than the SO' setback required, subject to the following conditions: 1. Council approval is based on the site plan submitted by the applicant attached to this resolution as Exhibit A. Any amendments to the site plan may require further Planning Commission and City Council review. 2. In the event that the sixth bay of the Fire Station is not built, this variance approval shall become null and void and a SO* setback shall be met. 3. Authorities granted by this variance run with the property not with the applicants, but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or this variance will expire on that date (March 11,2003). 4. Violation of or non-compliance with any of the terms and conditions of this variance shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 5. The undersigned applicant has read, understood and hereby agrees to the terms of this resolution and on behalf of himself, his heirs, successors and assigns, hereby agrees to the recording of this resolution in the Chain of Title of Lot I immediately upon filing of the plat creating Lot I. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, FINDINGS This application was reviewed as Zoning File #02-2755. The property is located within the RR-IB Single Family Rural Residential Zoning District requiring a minimum of tw o acres of contiguous dry buildable land w ithin each newly created residential lot. The property is guided by the 2000-2020 Orono Community Management Plan for single family residential use at a density of 2-3 units per acre. Municipal buildings are a Permitted Use in the RR-IB zone, and the Fire Station to be constructed on Loi 1 is considered by definition as a municipal building. Lot I is located in a rural residential neighborhood, with the nearest residence being approximately 200 ’ directly south of the proposed Fire Station building. The proposed flat roof of the hose tower will extend approximately 12' above the 23 ’ flat roof height of the majority of the Fire Statioi> building. The Orono Planning Commission reviewed this application on February 19,2002 and recommended denial of the conditional use permit by a vote of 6 to 0, based on the following findings: The proposed hose tower is intended to be used for training purposes and will have a potential negative visual impact on the neighborhood due partially to the non-residential character of the tower. Its use for training purposes has a potential to become a nuisance in this residential neighborhood, especially if it becomes a training center for other departments. Page 2 of 5 c) The need for the excess tower height has not been demonstrated, and there may be otiier options, such as building it 5' further into the ground. d) The potential impacts of the tower in this residential neighborhood cannot be satisfactorily mitigated. 6. The City Council hereby makes these additional findings of fact: The City has consistently denied building height variances for homes and institutional buildings in single family zones. Two most recent examples are the Minnetonk.T Art Center, and the Burton residence on Rainey Road. The Fire Station is being located in a neighborhood setting rather than a ‘town center’ setting. Reducing the visual impacts of the building is important to ensure its successful integration into residential character of the neighborhood. Although the 20' x 22' area of the tower covers just under 3% of the total roof area of the station, and although it is in the southeast or rear comer of the station, the tower if constructed will still have a visual prominence that is out of character with the surrounding residential neighborhood. Because a primary purpose for the excess hose tower height is for firefighter training, the tower if constructed would contain stairways, windows, a door to the roof, etc. which w ould allow for a variety of realistic firefighting and rescue scenarios to be staged. The impact of such activity occurring at such a visually prominent location and height as that proposed would potentially have a negative impact on the neighborhood. The negative impacts on the neighborhood associated with the excess tower height cannot be successfully mitigated by the mere imposition by the City of requirements or limitations in regards to screening, building material selection, lighting, color scheme, etc. The City Council finds that no methods or measures for mitigating the negative impacts have been brought forward, and approval of the tower height conditional use permit would not be in the best interests of the City of Orono or the residential neighborhood surrounding the Fire Station. The City Council finds that granting a conditional use permit for the excess tower height as proposed would not be appropriate because: a) the proposed location of the conditional use is not in accord with the objectives of the Zoning Chapter and the purpose*: of the RR-1 B residential district in which the site is located; b) the proposed location ofthe conditional use and the proposed condition under which it would be operated or maintained would potentially be detrimental to the public health, safety or welfare, or materially injurious to properties or improvements in the vicinity by potentially depreciating property values; and, c) the excess tower height would not be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City of Orono. 8. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City Staff, comments by the applicants and the effect of the proposed conditional use pemiit on the health, safety and w elfare of the community. CONCLUSIONS, ORDER, AND CONDITIONS Based upon one or more of ne above findings, the Orono City Council hereby denies the request of the Cities of Long Lake and Orono for a conditional use permit per Municipal Zoning Code Section 10.75, Subd. 1 to const, jct the hose tow er at the Long Lake Fire Station at a height of 35’ above grade. The tower may be constructed at a height not exceeding 30' above grade. MN 55323 Dear Ron: In September 2000, the LMCO with the help of some of the mayors from the LMCD member cities proposed adding two additional full-time Deputies for the 2001-2002 summer boating seasons on Lake Minnetonka, to be partially funded by the 14 cities for a two-year period. As a city that authorized a two-year voluntary payment for the project, we want to thank you for your support, report what happened, and ask for your reduced payment in 2002. Note on the attached spreadsheet, the amount we are asking the City of Orono is over 75% less than what you agreed to and budgeted for 2002. Three key points were identified that justified the need for increased presence: 1) a cultural change, less courtesy by boaters. 2) significantly reduced availability of on the water patrol time due to the increased complexity of processing violators, particularly BWI. 3) the need to prepare for the Special Deputy litigation that was being reviewed by the Minnesota Suprenre Court that may cause more need for the licensed deputy's functions. From mkJ-May to mid-October, two additional full-time Deputies were assigned to Lake Minnetonka. Feedback received oi* the project included: • Lt. Brian Johnson of the Water Patrol has reported the program as being a big success • Lt. Brian Johnson has reported that their presence contributed to a safer and better 2001 boating season. • There were no fatalities on Lake Minnetonka in 2001. • There was a reduction of personal injury accidents by more than 50%. • There was an increase in public contact but a lower citation count • The LMCD received anecdotal feedback that the higher water patrol presence resulted in more courtesy by boaters and an increase in the quality of the lake experience. The project was originally estimated at $100,000 per season with a financial breakdown of: • 50% from Hennepin County • 30% from the LMCD Member Cities • 20% from the LMCD 'Save the Lake* Fund. Voluntary payments of $24,000 were received from 13 of the 14 LMCD member cities for 2001. Although the City of Minnetonka philosophicjyiy agreed with the project they decided not to financially contribute to it because they had concerns with the LMCD funding formula. 1l)e funding formula has been addressed and the LMCD will be asking the City of Minnetonka for a voluntary contribution in 2002. The good news is that the total cost for the project in 2001 was $52,290, which was substantially below the budgeted figure of $100,000. The budget was partially based on needing significant overtime. Breakdown of the project costs were as follows: • Hennepin County Share (50%)* $26,145 • LMCD Member Cities Share ((24%)- $12,551 (excludes City of Minnetonka) • LMCD "Save the Lake' Fund Share (26%)- $13,594 (includes City of Minnetonka which was made up by a special contribution to STL) The attached spreadsheet provides an overview of last year's voluntary contributions received from the 14 member cities showing a $30,0(X) budgeted share, the $24,000 actual payment, the $12,551 actual used, and the $11,449 overpayment. The estimate project cost for 2002 is $60,000, and the LMCD proposes the same funding formula as in 2001 ; • Hennepin County (50%) $30,000 • LMCD MemberCities (30%) $18,000 • LMCD Save the Lake Fund (20%) $12,000 The LMCD recommends that for 2002 the 13 contributing member cities direct their 2001 overpayment ($11,449) to be used against the costs for 2002 plus making a smaller additional payment of $6,551 for 2002 ($18,000 • $11,449 = $6,551). Therefore, the cities payments from their 2002 bu^t will be more than 75% less than their payments 2001 . One of the agreed upon goals of this project was that the funding formula which called for 30% contribution from the cities would be a temporary, two-year project, and that all efforts would be made to have funding come 100% from Hennepin County by 2003. We are working towards this goal. The events of Sept 11 and the potential budget shortfalls may complicate this goal. You will be updated on the future status of this project. At this time we are recommending award of all the policies as presented. The City will continue to carry an umbrella excess liability policy of $2 million and will not waive the statutory limits established under Minnesota law. The LMCIT has specifically requested that Council adopt a resolution stipulating whether the City will or will not waive the statutoty limits under the law. . estimated cost for all policies for 2002 is $173,659 compared to $160,428 for 2001, .d $141,984 for 2000. The City will place all coverage with the LMCIT program. Worker Compensation Coverage: The renewal premium quotation for worker compensation insurance reflects a gross initial premium for 2002 of $56,992, which is adjusted by our experience modification of 1.13, increasing the premium to $64,401, and finally adjusted by a premium discount of 8.76%, resulting in a net initial premium of $58,758. This is an increase of $8,980, or 18.04% greater than the 2001 initial premium. The higher premiam is due to an increase in the City’s experience modification rating, which is affected by the number and severity of worker compensation claims in recent years. The premium increase is also affected by the increase m the total estimated payroll of $123,400, and by an overall increase in the rates applied to the worker compensation class codes. March 11,2002 2002 Insurance Policy and Worker Compensation Insurance Policy Premium Tabulation and Award Recommendations, page 2 Liability Insurance Packaye Policy and Excess Liability The package policy and excess liability policy premiums total $114,937 for 2002, compared to $110,450 for 2001, and S107,192 for 2000. The increase from 2001 to 2002 is $4,487, or 4.1%. The premium increase is comprised of property value adjustments to offset inflation and rate increases in vehicle and excess liability coverages. Staff recommends the award of the 2001 insurance coverage as presented in the attachment and the adoption of the attached resolution. COUNCIL ACTION REQUESTED: (1) Award of the 2002 insurance package effective January 1, 2002 to the League of Minnesota Cities Insurance Trust for worker compensation coverage, $58,758; comprehensive municipal property and casualty package, $90,406; umbrella excess liability, $20,313; petrofiind reimbursement, $246; open meeting law, $880; boiler and machinery, $1,652; surety bonds, $977; and golf course liquor liability, $563. As a comparison, interest earned in 2000 was $582,547, and interest earned in 1999 was $497,411. These amounts exclude all HRA investment earnings. The average yield for 2001 was 5.56%, e.\cluding all URA investments held by the Trustee. This compares with an average yield of 6.29% for 2000, and 5.77% for 1999. The investment portfolio, at cost, on December 31,2001, was $9,539,145, compared to $10,233,994 on December 31,2000, and $9,787,546 on December 31,1999. On December 31,2001, the investments in trust for the HRA debt issues included $413,232 for the 1998 HRA Refunding Bonds. During 2001 the various HRA debt investments earned interest of $73,844. The interest on the loan for the year 2001 is $22,210. When the interest from the loan is added to the investment interest the total interest earned for the year is $132,033. Officer Carlson and other responding officers used a defibrillator and administered cardio-pulmonary resusitation until an ambulance arrived, saving the life of Mrs. Alice Brown. On 12/25/2000, the family of Lawrence and Alice Brown of Golden Valley sent a letter of thanks and a cash donation which was designated “to be used a$ your organization sees fit, possibly for the purchase of a deribrillator”. On 2/25/02, the Police Department received a donation in the amount of $1,000 from the family of Lawrence and Alice Brown of Golden Valley, again with a note thanking Officer Carlson.
