OF THE ORONO CITY COUNCIL
Tuesday, December 16,2003
7:00 o’clock p.m.

The Council met in a special meeting on the above mentioned date with the following members
present: Mayor Barbara Peterson; Council Members Lili McMillan, Jim Murphy, Jim White, and
Bob Sansevere. Representing stall were City Administrator Ron MtKirse, Police Chief Stephany
Good, and Sergeant Kurt ilrickson.
Mayor Peterson called the meeting to order at 7:04 P.M.

This item was tabled at the December 8 Council meeting, due to an incomplete application. Chief
Stephany Good and Sergeant Kurt lirickstm provided background information regarding the status
of the liquor license application. Sergeant Erickson indicated he was comfortable recommending
approval of the liquor license, subject to Mr. Ode providing a permanent Workers Compensation
insurance binder. Mr. Ode indicated he should have the permanent binder in a few days.
Murphy moved, Sansevere seconded, to approve the Ou Sale Al>d Off Sale 3.2 Percent Malt
Liquor license for Paul Ode at Navarre Lanes, 3435 Shoreline Drive, effective January I,
2004 through December 31, 2004, wiih the stipulation that the license will not be issued until
the permanent Workers Compensation Insurance binder is provided.
VOTE: Ayes 5, Nays 0.
2.Amendments to the Plan Document for the Clfy’s. L'Scaible Spending Account Plan -
Resolution No. 5096
Moorse indicated two housekeeping changes and a change to allow reimbursement for over-the-
counter medications arc recommended to be made to the City's I'lexible Spending Account Plan.
The attached resolution provides for these changes to be made.
White indicated that the over-the-counter medication change is a gmxl deal for the employees. He
suggested the plan changes should be made. Peterson agreed, but suggested that a difTicult issue to
be addressed is how the purchase of over-the-counter medications will be documented if the items
arc nut itemized by name on the receipt.
White moved, Murphy seconded, to adopt Resolution No. 5096 adopting an amendment to
the City of Orono Flexible Spending Account Plan.
VOTE: Ayes 5, Nays 0.

Murphy moved, Sansevere seconded, to adjonm the Orono City ConneU Meeting of
December 16,2003 at 7:10 P.M.

After the public hearing held at their December 8 meeting. Council tabled action on the liquor
license application for Paul Ode and indicated action may be taken at a special meeting if all
required information was received.
Please refer to the attached memo from Sergeant Erickson outlining the status of the application
and receipt of the required insurance information.
Staff Recommendation
Staff recommends approval of the license, conditioned upon receipt of proof of continuing
coverage for workers compensation and the final background investigation remaining favorable.
If these conditions arc not met, action to rescind the license will be taken at the January 26,2004
regular Council meeting.
COUNCIL ACTION REQUESTED:
Motion to approve the application of Paul Ode for an On Sale and Off Sale 3.2 Percent Malt
Liquor license for Navarre Lanes at 3435 Shoreline Drive effective January 1,2004 through
December 31 ,2004, conditioned upon receipt of proof of continuing coverage for workers
compensation insurance and the final background investigation remaining favorable. If these
conditions arc not met, action to rescind the license will be taken at the January 26,2004 regular
Council meeting.

onicer Wittke is assigned to do the investigation on this application. He has been very busy with
criminal matters that are restricting his ability to expedite this application. In an elTort to
accommiHiatc Mr. Ode. I have spoken to the Wiser Insurance Agency in Mound. 1 hey
confirmed that a liquor liability policy was issued to Mr. Odc/PJM Tru.st. They stated a copy of
the policy was faxed to the city last week.
I have also spoken(12/l5/03) to the Minnesota Workers C ompcn.sation Insurers
AssiKiation(MWCIA). JelTKvam from MWCIA told me that Uerkley Risk Administrators
Company has been assigned the ODF7PJM I’rust account, fhere is incomplete information that
while not enough to turn down coverage is limiting the coverage to 30 days pending completion
of the application pnKcss.
Mr. Ode will therefore have 30 days of workers compensation coverage elfective 01/01/04 and
will have to furnish the rest of the missing info to continue coverage beyond the 30 days.
The raw background checks and finger print check that arc completed do not disclose any
disqualifying information. With the information I have been given so far. 1 believe the final
report will recommend approval.
Given the MWCIA binder that will give 30 days coverage I would suggest that the City mirror
that time frame and give Mr. Ode until the January 26''’ council meeting to have everylhing
finalized and proof of full coverage on the workers compensation issue and not just a binder for
30 days.
I believe that a motion should be made approving Mr. Ode's liquor license application elfective
01/01/04. the continuance of this license beyond January 26. 2004 is conditioned on Mr. Ode
having satisfactorily completed all outstanding issue's with obtaining full insurance coverage
before 01/26/04 and the finalized background investigation remaining favorable to the license
issuance. Mr. Ode must request the final approval for January ’ 26.2004 after obtaining issued
policies, not limited binders or applications for coverage, from his insurance providers and giving
them to the City for final consideration. If Mr. Ode fails to request or provide the requested
documents the liquor license will be rescinded on 01/26/03.
