Zieaaers This letter la in response to your inquiry regarding City requiresmnts for a septic syatee if you construct a residence on the above referenced property. As you correctly noted, the property is within an area the City is considering for potential installation of municipal sewers. Because there is a potential that the property may be provided with ■uncipal sewer in the relatively near future, connection of a new house to the existing septic systee is a reasonable request. It would seen unfair to have you spend perhaps as much as $4,000 to $8,000 on a septic systesi and then require you to pay assessments for and connect to a municipal sewer a year or two later. However, at this point in time there does not seem to be any real push by the City Council nor the affected property owners to initiate a project, and no meetings to discuss the issue are currently scheduled. It would seem that even if meetings and hearings did commence this fall, and if a decision was made to proceed, actual hook-up availability would likely not occur until late 1989 or 1990. Given this lack of a definite timetable, the City’s concerns with your request are two-foldt a) Hill the existing septic system continue to function adequately for an interim period until sewer is available? B) If sewer does not become available within a reasonable time period, can the property support installation of a new conforming septic system? We have very little information on the design of the existing system, and our past inspections have indicated that there appear to be two tanks of unknown design and capacity, and only one known drainfield line of about 60* in length. This system would undoubtedly be categorised as quite sub­ standard in design and capacity under current codes, and would not be considered as acceptable for a new house on the property except on a short­ term, interim basis. Prior to issuance of a building permit for the new house, owner must provide a full site evaluation and design for a new conforming septic system, both primary and alternate drainfield sites, in order to confirm the suitability of the lot for permanent usage of septic systems should sewers never become a reality. 2. The interim period during which the existing system could be used is defined as followst a) Maximum of 18 months from date of occupancy, renewable after that on a 6 month periodical basis only if a Council decision to install municipal sewers appears to be shortly forthcoming. b) Should the existing system fail prior to a decision on sewer installation, the system must be replaced with a totally conforming system. c) Likewise, if a decision to not make sewer available to the property is forthcoming, the system must be replaced with a fully conforming system within 6 months of the Council decision, regardless whether the existing system is functioning adequately. d) If sewer becomes available, the property must be connected to it as soon as it becomes available. e) At any time during the interim period, if the house is sold the system must be replaced with a totally conforming system. This approval Is not transferable to a new owner. 3. The City is in no way certifying that the existing system is capable of functioning acceptably during the interim period. The property oimer bears the responsibility for maintaining the system so it does not become a health or safety hazard, nor a public nuisance. A contractual agreement would have to be signed by you, agreeing to the above conditions before a building permit would be issued. This would be filed in the chain of title of the property.
