Petition for Building Permit for contigous property Described as:
Tracts A/ft,tract S,T,and U from Certificate of Title # 403248 and
431807, which I own and are so registered.
1
k/R was acquired in 1966 and S,T,U in 1968,and developed with the plan
to be sold,at a future date. These lots have never been considered legally
part of the homestead lots adjacent and south upon which is located
■my home:' -Vj-', 4--,
•When purchased in 1966 a nominal mortgage was placed on B fit Q. None
e>d.sts on A/fe , S,T,and U. Mortgage held ly 1st National Bank of : , ; -
Mayzata for $13,000 plus. ■
2. Homestead credit applies to B/Q only, see tax copy enclosed.-
3. Tax freeze of 1973 base has applied to B/Q only.
A drainage area for A/ft,S,T,U consists of (for sewage disposal) coneiirtB of
approximately 39,556 square feet utilizing easement areaof S(T) and U,
and of S(hywy 51) and area adjoining West leased by me from Burlington- ;
Northern which is an extension of the lawn on 35 feet of their right-of-way.
Work sheet is attached. This constitutes 2.06 acres ; ^
This is the largest building lot area of 9 homesites on,which 8 homes . -
now exist.
These lots,are landscaped; I planted 30 beautiful Spruces.trees which shut-off
51 on the north,in 1966-68, and a hedge of 16 Siberian pines East shutting ■
off all traffic lights;traffic is not visible due to heij^t of lots,
and the viow, is almost all of Smith's Bay,Minnetonka. The lots' area has, room ^
for house, tennis court and swimming pool without cutting a tree.
The acquisition of T & U & S in 1968 gave shoreline to A/ll and I would assume
increases the ^ainage area by extending thru RYWY 15 on East to the lake
and establishes a claim for additional area to middle of Hyi'fY 51 •
DENSITY.. Basic area odf A/k is 63,858 sq.ft plus 35*t. x 121 West<of R; .r i
^ ^ : i^ lawn and leased from Burlington Northern R.R.' or 4,235 sq.ft. (2)
Using ^ of S(hywy // 51 = 33ft.x541^b. for 17,853 sq.ft.(3) .
Tract U,oast of T =66ft.x 134 for 10,184 sq. ft. (4)and there are :
10 ft. of shoreline(hi^water mark) for 1,340 sq.ft, for a total
• drain area which is,not:open to construction. Grand total of . ’
' ,97,470 sq.'feet' or;,2.2;acres., ■ v,;
JIow'b/Q,homestead and dwelling,.contains 51,392 sq. ft. plus leased area from
; Burlin^on-Northom and integral part of ,lawn, is 35 x 104.48 for 3,640 sq.ft,
and using easement HH-/AY 15,lakewsido-& dockside is 115 x 66 or 7,590 sq.ft,
for a total of 62,622 sq.ft.drainagq area or1.4 acres. The;two building areas
would then bo 3.6 acres or 90^ of a 4 acre requirement for a variance _i,.
Legally I do not see how you can penalize the tracts making up a
a contiguous 'parcel Uke: A/k/T/tJ tfor o shortage of space-to-meet-
your now requirement's-
to own them both. By the same reasoning you could hold mo res
for the other seven r'aore lots this „4a.
