ROLL
The Council met in a special meeting on the above-mentioned date with the following
members present: Mayor Barbara Peterson, Council Members Jim Murphy, Bob Sansevere
and Jim \^te. Representing staff were City Administrator Ron Moorse and Public Services
Director Greg Giqipa.

Mayor Peterson called the meeting to order at 5:30 p.m.
1. Award of BM - Navarre Fire Statkw Site Work
Murphy commented that the site plan n«^s to be amended to remove the ADA parking
space from the north side ofthe vehicle bay apron, and to get credit from the MCWD for
the reduced hardcover.
Murphy moved, and While seconded, to award the bid for the Navarre Fire Station
site work to F.F. Jedliclu, Inc., ip the amount of $304,719.50, per the Bonestroo letter
dated May 6,2003.
Vote: Ayes 4, Nays 0.
2. Declaration Regarding Covenants on the Navarre Fire Station Property to Meet
MCWD Permit Conditions
White moved, and Sansevere seconded, to adopt the Declaration attached to the
Request for Connell Action dated May 5,2003 placing covenants on the Navarre Fire
Station property to preserve the wetland buffer areas and grassed swales, to sweep
all bituminous surfaces at least once per year, and to maintain the stormwater
management facilities on the site.
Vote: Ayes 4, Nays 0.
ADJOURNMENT
Sansevere moved. White seconded, to adjonm the Orono City Council Special
Meeting of May 6,2003 at 5:43 p.m.

Item Description: Award of Bid-NavanO Fire Station Site Work
The City received four bids on the site work for the Navarre Fire Station. The tabulation of bids is
attached. The Engineer ’s cost estimate was $310,000. The low bid is $303,819.50, by F.F. Jedlicki,
Inc. It is recommended that the council accept the low bid of F.F. Jedlicki, Inc.
COUNCIL ACTION REQUESTED:
Motion to accept the low bid of F.F. Jedlicki, Inc., in the amount of $303,819.50, for the Navarre
Fire Station site work.

Item Description: Declaration of Covenants-Navaire Fire Station Property
A condition of the Minnehaha Creek Watershed District’s permit approval for the Navarre Fite
Station project is that the City agree to place covenants on the property to preserve the wetland buffer
areas and grassed swales, to sweep all bituminous surfaces at least once per year, and to maintain
the stormwater management facilities on the site. A Declaration is attached for Council
consideration.
COUNCIL ACTION REQUESTED:
Motion to adopt the attached Declaration placing covenants on the Navarre Fire Station property to
preserve the wetland buffer areas and grassed swales, to sweep all bituminous surfaces at least once
per year, and to maintain the stormwater management facilities on the site.

The Minnehaha Creek Watershed District Board of Managers reviewed the above mentioned
permit application at their Board meeting on April 24,2003. It was the action of the Board to
approve this application with the following conditions:
• Reimbursement of mailing costs in the amount of $49.84
• Submit a Declaration for the preservation of wetland buffers which must be executed and
recorded
Once the above mentioned fees have been paid and the other conditions have bee net staff will
issue the permit. You are reminded that work on the project cannot begin until the .ermit has been
issued. This permit expires one year from the date of this letter.

DECLARATION
THIS DECLARATION ( "Declaration") is made this
2003/ by City of Orono/ ("Declarant").

RECITALS
WHEREAS, Declarant is the owner of real property within the City of
Orono, Hennepin County, Minnesota, platted and legally described as:
TOWNSITE OF UNGDON PARK. LOT 001. BLK 009
(the "Property") and no one other than Declarant, [name additional parties
executing declaration of Consent and Subordination], has any right, title or
interest in the Property; and
WHEREAS, the Property constitutes the entirety of the land to which
Minnehaha Creek Watershed District Permit # 03-050 applies; and
WHEREAS, Declarant desires to subject the Property to certain conditions
and restrictions imposed by the Minnehaha Creek Watershed District as a
condition to issuance of their Permit # 03-050 for the mutual benefit of the
owners of the Property.
NOW, THEREFORE, Declarant makes this Declaration and hereby
declares that this Declaration shall constitute convenants to run with the
Property, and further declares that the Property shall be owned, used , occupied,
and conveyed subject to the convenants, restrictions, easements, charges and
liens set forth in this Declaration, all of which shall be binding on all persons
owning or acquiring any right, title or interest in Ihe Property, and their heirs,
successors, personal representatives, and assigns.

1. Wetland Buffer. The wetland buffer, measuring 16.5 feet in width
at all points surrounding the wetlands as delineated on the site plan for the
Property attached hereto and incorporated herein as Attachment A, shall be
maintained by Declarant in perpetuity free from mowing or other vegetative
disturbance, fertilizer application, yard or other waste disposal, the placement
of structures or any other alteration that impedes the function of the buffer in
protecting the quality of water in the wetland or buffering flows into the
wetland.
2. Street Sweeping. All bituminous surfaces and public ways within
the Property shall be swept at least once each year.
3.Unmaintained Grass Swales. The vegetated swales attached
hereto and incorporated in as Attachment A, shall be preserved by
Declarant in perpetuity.
4. Stormwater Facility Maintenance. The terms of Attachment B,
incorporated herein, shall apply to the stormwater management facilities
indicated on Attachment A, identified as follows:

5. The recitals set forth above are expressly incorporated herein.

ATIACHMENT B
STORMWATER FACILITY MAINTENANCE
These terms apply to the stormwater facilities constructed pursuant to Minnehaha
Creek Watershed District permit application number 03-050.
WHEREAS, application has been made for a permit from the MCWD pursuant
to MCWD Rule N, Stormwater Management; and
WHEREAS, the property that is the subject of the permit is legally described in
the Declaration into which this Attachment is incorporated, and the facilities on the
property to which these maintenance requirements apply are as follows:
Sump Catch Basins, Grasses Swales
WHEREAS, MCWD Rule N provides that a maintenance agreement shall be
submitted for stormwater treatment ponds, outlet structures for such ponds, culverts,
outfall structures and all other stormwater facilities, and that the maintenance agreement
shall specify methods, schedule and responsible parties for maintenance and must include
at a minimum, the elements contained in the District’s Maintenance Agreement Form.
NOW, THEREFORE:

1. The property owner shall inspect the grit chambers, sump catch basins,
sump manholes, outlet structures, culverts, outfall structures or other stormwater facilities
for the project in the spring and fall of each year. The property owner shall remove all
sediment and debris during the inspections such that ,he stormwater facilities operate as
designed and permitted.
2. Violation of the inspection and/or maintenance provisions of this
Agreement is a violation of the MCWD permit for the project for which the MCWD may
take action against the property owner.
4. "Property owner" as used in this Attachment means the owner of the
property on which is located the stormwater facility to which the obligations herein
apply.

NOTICE OF PUBLIC MEETING
Notice is hereby given that the Orono City Council will meet in a special Council meeting/work
session at 5:30 p.m. on Tuesday, May 6,2003, in the Orono City Council Chambers, 2780
Kelley Parkway, Orono, Minnesota. The purpose of the meeting is to award the bid for the site
woik for the Navarre Fire Station, and to discuss other issues of current interest.
This meeting is open to the public.
