They are being invited to the May 10 meeting to be recognized for their dedication to serving the community. As this memo was written, their availability to attend the meeting had not been confirmed. If they arc not available for the May 10 meeting, they will be recognized at the May 24 meeting. Resolutions of appreciation will be provided at the Council meeting COUNCIL ACTION REQUESTED: Motion to adopt the resolutions of appreciation for Mike Brown and Jim Cox to recognize their 40 years of dedicated service on the Long Lake Fire Department. J A RESOLUTION RECOGNIZING MIKE BROWN FOR HIS 40 YEARS OF DEDICATED SERV ICE AS A MEMBER OF THE LONG LAKE FIRE DEPAR I MENT RESOLUTION NO.5167 W'HEREAS, the City of Orono receives fire and rescue service from three volunteer Fire Departments; and and WHEREAS, the Long Lake Fire Department serves the largest portion of Orono; WHEREAS, the City of Orono and its citizens rely on the local volunteer Fire Departments for protection and assistance in emergency fire and rescue situations; and WHEREAS, the local Fire Departments are stalled by volunteers who contribute many hours of their time to ensure they are properly trained, and to respond to emergency situations; and WHEREAS, as the amount of time required for both training and emergency response continues to grow, along with the demands of work and family life, it is becoming more diffieult to rccru;t and retain volunteer firefighters; and WHEREAS, fortunately, there are those unique and special individuals who are driven to make volunteer firefighting a lifelong vocation; and WHEREAS, Mike Brown is one of those special persons who has devoted 40 years of his life to serving the community as a volunteer firefighter; and WHEREAS, Mike Brown has served in an officer capacity for at least 20 of his 40 years of service on the Long Lake Fire Department, including five years of distinguished service as Fire Chief. NOW, THEREFORE, BE IT RESOLVED that the Orono City Council does hereby recognize, and express its sincere appreciation to. Peterson, Mavor a MINUTES OF THE ORONO CITY COUNCIL MEETING Monday, April 26, 2004 7:00 o ’clock p.m. »4PrriNG MAY 1 0 2004 CITY OF ORONO ROLL The Council met on the above mentioned date with the following members present: Mayor Barbara Peterson; Council members Jim White, Jim Murphy, Lili McMillan, and Bob Sanseverc; City Attorney Thomas Barrett; Representing staff were City Administrator Ron Moorsc, Planning Director Mike Gaffron, Planners Melanie Curtis and Janice Gundlach, City Engineer Tom Kellogg. Public Service Director Greg Gappa, and Recorder Kristi Anderson. Mayor Peterson called the meeting to order at 7:01 P.M CONSENT AGENDA 1. FIRE CHIEF’S REPORT E.xtelsior Fire Chief Mark DiiCliarmc reported that the Navarre Fire Station should be ready for operation by May I*', once the Hennepin County Dispatch has completed the programming for the paging system. He stated that 3-4 more recruits have come forward for scheduled training in July. DuCharme indicated that the ne.\t step will be further discussion regarding the utility vehicle, once the financials are in place over the next couple of weeks Long Lake Fire Administrative Officer Tony Roc added that he had begun talking to several truck suppliers. White a.sked whether he had seen the Long l ake F'irc Department at a fire call in Minnetonka Beach Roc stated tliat they had received the call first, and provided mutual aid to Mound who actually covers the area. Moorsc complimented the Long Lake Fire Department on a successful pancake breakjast the previous weekend. PAGE 1 of 12 i MINUTES OF THE ORONO CITY COUNCIL MEETING Monday, April 26, 2004 7:00 o’clock p.m. FIRE CHIEF’S REPORT, Continued Roc stated that 700 people attended the breakfast. On another matter, he reported that resident Sam Marficid donated a 2001 pickup truck with only 7,000 miles to the department, which was greatly appreciated. Murphy stated that, as always, he is impressed by the relationship forged between these three communities and thanked the two for their commitment. He asked how the new firefighters were doing. DuCharme stated that the firefighters had completed their testing and the department is in a holding pattern awaiting the results. He was confident the outcome would be successful. APPROVAL OF MINUTES 5. Regular Council Meeting of April 12, 2004 Page 8, paragraph 2, the last line was amended to read, “He stated that in the past there was a lack of coordination efibrts from Long Lake.” While moved. Mayor Peterson seconded, to approve the Minutes of April 12, 2004, as amended. VOTE: Ayes 5, .Nays 0. PARK CO.M.MISSION COMMENTS - Debora llalvorson Halvorson thanked the Council for their support for increased use of Bederwood Park ball fields. She stated that the Commission would be meeting ne.xt week and continues to focus their efforts on prioritizing park needs and establishing long range park plans. With the likelihood that the conversion of the Dakota line will take place, Murphy suggested the Park Commission begin strategic planning for this trail. llalvorson staled that the Commission has started to identify areas for potential rest stops along the trail, including Old Crystal Bay Park and the planned park area north of the Navarre Fire Station. When available, Murphy suggested the Council and Commission hold a joint meeting to discuss these options. PLANNING CO>L%USSION COMMENTS - Jim LesUe Although he had nothing to report, Leslie stated that he would be available for questions. LMCD REPORT - Debora Halvorson Due to the imminent threat of zebra mussels contaminating Lake Minnetonka, Halvorson stated that an exotics subcommittee has determined w ith the DNR that increased inspections will take place over the summer months at many landings, including Gray’s Bay, Maxwell Bay, North Arm Bay, and Wayzata Bay landings. The inspections will begin May IS"" and run through September PAGE 2 of 12 MINUTES OF THE ORONO CITY COUNCIL MEETING Monday, April 26,2004 7:00 o’clock p.m. LMCD REPORT, Continued 19* during weekends. Halverson explained that the subcommittee has prepared a power point presentation to present to the 14 City Councils of the Lake area, which will educate and inform them of proposed action plans and ask for their support. White urged the LMCD and DNR to be proactive in this initiative. He was concerned that little enforcement accompanied the inspections and suggested that further signage be posted to educate the public. Sansevere commented that, although sad, he could foresee zebra mussels in the lake's future. Halvorson stated that efforts are being made to lobby for more money to further programs, create more education, and get the word out. McMillan stated that this is the best program that has been undertaken by the LMCD and DKR and will target high visibility weekends and traffic times. Although not 100% preventative, she was hopeful that the public would cooperate with the inspection process. Murphy suggested that further publicity be sought to educate the public about the threat posed by zebra mussels in our lakes. He felt that local television stations would be interested in broadcasting this message. McMillan added that, at a recent mayor’s meeting she ’d attended, the subject of milfoil har\ csting was broached by Deephaven, who'd like to see the Watershed District take o\ cr the har\ esting effort. She continued, noting that John Barton, of Hennepin Parks, was currently examining phosphorous levels. She commented that, in addition to City funding, it would be nice if the Watershed would contribute financially to the harvesting effort. McMillan reported that, at the mayor’s meeting, Deephaven also expressed concern about boat density on the lake. Halvorson stated that a new committee is studying the boat density study performed in the 1970’s, and will compile a new density study based on counts during lly-ovcrs at peak times this summer Murphy suggested that the City develop some type of action plan to address the numbers of trailers parking at launch sites during the .Memorial Day weekend, before the police department is bogged down writing traffic tickets over the holiday. PUBLIC CO.MMENTS Charles and Gerry Timm, 2KS5 6* Avenue North. Mr. Timm stated that his lawyer had recently received a letter from his neighbor about an Ordinance that would be in effect in the near future prohibiting him from keeping his commercial vehicle in his driveway. He asked the Council for an explanation, stating that he was merely trying to make a living as he ’d always done. Moorse explained that the City had adopted this Ordinance, and given Mr. Timm a 6 month stay, w hich will soon expire and compliance w ill be expected. He stated that he had not received any requests to reconsider the Ordinance. PAGE 3 of 12 MINUTES OF THE ORONO CITY COUNCIL MEETING Monday, April 26, 2004 7:00 o’clock p.m. PUBLIC COMMENTS, Continued Sanscvere expressed his concern that this Ordinance was put into place very quickly without consideration of how it might impact this resident’s right »o make a living. While he felt keeping a commercial vehicle in a tightly packed neighborhood was inappropriate. White suggested amending the Ordinance with an acreage minimum, acknowledging that Timm has several acres. Timm stated that 5 years ago his wife contacted the City and was told that they were in compliance and allowed to keep their dump truck on their property. Now the Ordinance has suddenly changed and they have been told they are out of compliance. Moorse stated that a 5 acre minimum was applied. Gaffron stated that staff had discussed 2-5 acre minimums. He added that cither w ay, the City may not be able to resolve the issues between the two neighbors. He suggested the dump truck be kept less visible. Timm stated that the neighbor’s views are not obstructed by the truck, nor can he hardly see it. It is only when Timm drives past the neighbor’s home via an easement that it is noticed. He maintained that he had been granted a 30’ easement for a dnveway across the neighbor’s property, which the neighbor has been increasingly narrowing to 10' in order to prohibit his access via the dump truck. Sanscvere asked whether there was a potential to move the driveway. Mrs. Timm stated that the garages and dnveway are .set up to face the current access. She pointed out that they have 2 '/i acres of land and this has caused them quite a hardship. McMillan asked if others had complained about the Ordinance. Gaffron stated that, while only one has come forw ard to date, he would not be surprised that others come forward due to the recent change in the Ordinance. He acknowledged that, in the past, people w'erc told they could have these vehicles on their property, and now the new Ordinance prohibits this. White noted that the resident had been granted an easement and is not being allowed to use it to the alloned allowance. White suggested that the Council consider an Ordinance appeal until they have had adequate time to address this issue. Sansevere indicated that it seems the neighbor is taunting the Timm’s, and their attorney, with the City ’s Ordinance. Murphy asked Timm what he wished the Council to do. Timm stated that he would just like to keep his livelihood in tact. PAGE 4 of 12 ...ii MINUTES OF THE ORONO CITY COUNCIL MEETING Monday, April 26,2004 7:00 o ’clock p.m. PUBLIC COMMENTS, Continued Since there is an apparent easement issue, Murphy asked staff what it would take to get a new driveway access solely on their property. Although the expense might be too much for them, Mrs. Timm stated that the Department of Transportation would also have to accept the request. Murphy stated that the Timm's need to take a hard look at how to get off the neighbor ’s land, taking away his leverage, and the City needs to reconsider the Ordinance. Sansevere suggested the Timm’s run their driveway along the length of the easement and work with staff to figure out the details. Mayor Peterson asked staff to assemble the Ordinance information and try to obtain comment from the DOT regarding a new access to discuss at the next work session. McMillan suggested getting the two parties together to air their differences. Moorse agreed, stating that the two parties view the situation completely differently, and it would behoove them to try to mediate the problems. Sansevere pointed out that a formal action must be taken prior to May 25, when the Ordinance takes effect, to extend the grace period while they discuss the Ordinance. Mayor Peterson asked that staff keep the Timm’s pasted of extensions, meetings, and moratoriums. ZONING ADMINISTRATOR'S REPORT *6. #04-2968 Cl’STO.M STRUCTURES LTD., 440 STUBBS BAY ROAD NORTH - FINAL PLAT - RESOLUTION NO. 5159 Murphy moved, White seconded, to adopt RESOLUTION NO. 5159, a Resolution approving a 2-lot subdivision in the RR-IB zoning district for the property located at 440 Stubbs Bay Road North. VOTE; Aye* 5, Nays 0. 7. #04-2993 CHRIS VALERIUS AND PHIL FISK, 2377 SHADYWOOD ROAD - CONDITIONAL USE PERMIT, COMMERCIAL SITE PLAN REMEW, VARIANCES - RESOLUTION NO, 5160 Gundlach reported that the applicants request the following to convert the existing reside.nce into a coffee shop/bakery/rcstaurant: 1. Commercial site plan review m order to obtain a building permit to construct an addition to uic existing building and to convert it from a residential use to a commercial use. 2. Parking setback variance to allow a drive through lane and parking spaces to be located within the required 30’ rear yard and within the required 20’ front yard. Building setback variance to allow a north side setback of 24’ when 35’ is required and 24’ currently exists. 4. Hardcover variance to permit 56% hardcover in the 500 ’-1000 ’ zone when 35% is normally allowed. 5. Conditional use penn't in order to operate a coffee shop/bakery/restaurant. While much of the Planning Commission discussion of March 15"’ centered on whether the applicant should be granted the variance needed to incorporate a drive-through, ultimately, the Commission approved the alternate site plan, which didn’t include a drive-through. For clarification, Sanscvcrc asked what the hardcover would be with and without the proposed drive-through. Gundlach pointed out that with the drive-through the hardcover is 56%; whereas, without the proposed drive-through the hardcover is 35% and a variance is unnecessary. Valcnus stated that their current drive-through plan uses pavers instead of blacktop, since they arc permeable, requires no curb and gutter, and is therefotc narrower than the ongmal dnve-through plan. She indicated that this plan would rcllect 45% hardcover, thus allowing them to retain more grcenspace and making the drive-through less conspicuous. Sansevere asked the applicant w hat heir hardship was to justify a hardcover variance. Valerius insisted that the site was a peculiar property, and the neighbor was allowed 50% hardcover. Sansevere asked w hat the hardship to their land w as. versus that of the neighbor. Valerius refened to other properties across the street which were granted greater hardcovers. Mayor Peterson stated that she did not support the neighbor’s hardcover requests, nor would she support theirs. Fisk stated that the hardship to their property is that they do not have parking close to their business, and in fact, have an easement and pay to use thr shared parking behind the residence. Since they only have two spots adjacent to their site, Fisk staled that they would like to give customers better access. Attorney Barrett concluded that in a conversion from residential to commercial, the City can require that all requirements be met. He pointed out that the property may have worked as a single family residence, but may not be appropnate as a business. Gaffron inteijcctcd, stating that it w'ould be a hardship if adequate parking was not available; however, they do have the ability to use the shared parking lot. PAGE 6 of 12 MINUTES OF THE ORONO CITY COUNCIL MEETING Monday, April 26, 2004 7:00 o ’clock p.m. 7. #04-2993 CHRIS VALERIUS AND PHIL FISK, 2377 SHADYWOOD ROAD - Comhtued Mayor Peterson confirmed among the Council that request 3, the north side setback request was not a problem. She continued, acknowledging that item 4, the hardcover request, would be unnecessary since the dnve-through was moot. Finally, item 5, although some of the Council members questioned the City’s responsibility to other businesses versus free enterpnse, seemed acceptable. Cox agreed that everyone deserves a chance to have a business; however, objected to granting the potential business owners variances to do so. Based on 19 years experience in the business, Fisk stated that they were well aware of what it takes to succeed and were not concerned about the level of risk or the economy. McMillan reiterated her concern about adequate parking. Fisk suggested signage be incorjwrated at a later date which encourages the park and ride users to park along the back row. Mayor Peterson moved, Sansevere seconded, to adopt Resolution No. ^160 approving the Commercial Site Plan Review in order to obtain a building permit to construct an addition to the existing building and to convert it from residential use to commercial use: to approve the CUP to operate a coffee shop/bakery/restaurant; to deny the hardcover variance for 56% hardcover; to approve the building setback variance of 24'; and to deny the parking setback variance to allow the drive-through lane and parking spaces to be located within the required 30' rear yard and within the required 20’ front yard for the properly at 2377 Shadywood Road. She pointed out that the Planning Commission voted unanimously to recommend that the boathouse be removed as the applicant provided no valid hardships to justify the granting of a variance. Sansevere voiced his concern that the City feels it must remove every boathouse from the lake. He argued that it is many of these boathouses that add to the charm and allure of the lake; therefore, should not all be removed. White concurred, urging staff to create an inventory of the boathouses that remain in the City in order to evaluate what is left, what is historically significant or part of our heritage, and should remain. He indicated that he was pleased that other Council members felt the same inclinations. Muiqihy agreed, though acknowledged that this particular boathouse had no significant character worth preserving. The plat preliminarily included 6 lots with a private roadway meeting all Zoning Ordinance regulations. As part of the Planning Commission's recommendation final engineering approval would ^ required prior to City Council review. During that period in between Planning Commission’s approval and City Council review the neighborhood petitioned the City to require preparation of an Environmental Assessment Worksheet (known as an EAW). The applicants then withdrew their application for a 6 lot plan due to the neighborhood resistance and, in turn, the neighborhood’s petitioner withdrew the EAW petition. As a formality the City denied the request to conduct an EAW based on the findings included in the resolution attached as Exhibit J, including withdrawals by both parties. The applicants are now proposing a 3 lot plan with private driveways instead of a roadway. The application has been given a new number and is considered a new application because the applicants officially withdrew their 6 lot plan. PRELIMINARY PLAT ANALYSIS Introduction and Conformance with Comprehensive Plan Bruce and Kris Paddock along with George W. Stickney are requesting preliminary plat approval for a 3 lot subdivision at 3250 Fox Street. The property is located at the southwest corner of Fox Street and Leaf Street. The current zoning on the property is LR - 1 A, One Family Lakeshore Residential District which requires two acre minimum lot si2es. The property is guided for Rural Residential in 2000 - 2020 Land Use Plan requiring a minimum lot size of two acres. Conformance with Zoning Ordinance The proposed lots meet all Zoning Ordinance regulations with respect to area, width, and i. i i I i i ^ i i «^04-3003 April 19,2004 Page 3 of6 setbacks. This will not affect whether the lots are conforming in area as they are twice as large as the Zoning District requires. Surrounding Development The preliminary plat to be known as Maxwell Day Estates is surrounded by residential property in all directions with Maxwell Bay of Lake Minnetonka to the direct south. Two acre minimum lot sizes with LR - 1A zoning are to the west, east and northwest with two acre minimum lot sizes with RR - ID zoning to the northeast. A church is located two parcels to the north. The applicants’ property is located off a private section of Fox Street with lots larger than two acres, although existing two acre lots can be found to the northwest and northeast. Lot Layout and Standards The plan in Exhibit C shows driveway locations in relation to the proposed property line layout. Three lots are proposed to be served off individual private driveways. Proposed Lot 3 will use the existing driveway that exits just outside the entrance monuments to the private section of Fox Street and proposed lots 1 and 2 will be served off the private section inside the gates. The driveways for proposed lots I and 2 are located within 40 ’ of each other due to site distance issues. Due to the low volume of traffic on this portion of Fox Street staff does not find that this will be of issue. The future buyers will not be required to use the exact driveway locations for proposed lots 1 and 2, although the 20’ setback for septic sites to driveways and the topography of the lots, the driveway locations will be very close to those shown on the preliminary plat plans. Proposed lot 3 will be required to keep the existing driveway cut that accesses onto the public portion of Fox Street Although, ideally the driveway would be best served inside the private gates, the topography, drainage of the lot, and existing wetland make the existing location most suitable. Future buyers should make attempts to locate the driveways in a manner that minimally disturbs the existing trees. 1 « r •. **•...111 t K Iiiii li M t /; #04-3003 April t9,2004 Page 4 of6 The plan in Exhibit C also shows building pad locations in relation to the required setbacks and primary and alternate septic locations. The applicants have shown that an adequate house can be placed on these lots and staff is satisfied with the lot layouts as proposed. These lots meet all required lot standards as shown in the table above and actually far exceed the required standards. The plan in Exhibit C also shows the average lakeshore setback line. Due to the location of the existing houses on both sides of the lot, the three proposed lots will be subject to a strict average lakeshore setback. The average lakeshore setback ranges from over 400 ’ on proposed lot 1 to 135 ’ on proposed lot 3. The building pad locations have been determined in relation to this setback line. Staff recommends that this line be adopted as the average setback for ail 3 lots and that the issue of which home gets built first will not affect the average setback for the rest. City Engineer Tom Kellogg has not submitted written comments regarding the proposed plans at this time. The City Engineer has been in contact with the surveyor regarding the methods of rate control of stormwater pre and post development and the methods the applicants are proposing to collect stormwater horn the site and ha.<; preliminarily approved the concept. However, the applicant will be required to meet all recommendations of the City Engineer prior to City Council review. Required Easements The applicant must dedicate the following easements: - Conservation and Flowage Easements over all delineated wetlands. - Drainage Easements over all proposed storm water ponds and stormwater collection areas (including the dry ponds proposed). - Standard drainage and utility easements around all lot boundaries. This consists of 10 ’ around the plat boundary lot lines and 5’ on the interior lot lines. Storm Water, Drainage, and Erosion Control The applicant is proposing a dry pond with a small berm and draintile approximately 80 feet from the lake on both interior lot lines. All lots will meet the required 2.0 acres of dry with these collection areas. All storm water will be routed to these areas through the method of swale construction along the property lines. The neighbor to the east submitted a letter expressing concerns regarding drainage (see Exhibit K). Also, attached are per and post drainage area maps showing the distribution of stormwater (Exhibit D). The City Engineer has not submitted written comments regarding the storm water and drainage plan at this time however, the applicant will be required to implement all recommendations of the City . ngineer prior to City Council review. The applicant has also proposed temporary and permanent erosion control measures which must be reviewed and approved by the City Engineer. At a minimum, silt fence will be required. The subdivision is subject to the Storm Water and Drainage Trunk Fee established by ♦ • •* 1 »’ J 3 f 1 I ii I 1^04.3003 April 19,2004 Pages of6 City Ordinance. The fee is established at $2,700 per acre, with a cap of 4.0 acres to be charged per lot. For this property, 3 4-acre+ lots are being created. Each would be charged a fee of (4.0 acres x $2,700 = $10,800 x 3 lots = $32,400 for a total fee). Tree Preservation The applicant has not submitted a tree preservation plan but has indicated that a private tree preservation covenant will be established under the title of all three lots. The Zoning Ordinance doesn ’t regulate tree preservation thus staff is satisfied with the applicants willingness to establish covenants privately. Archaeological Impacts The only historically significant features on the property, known to staff, are the entrance monuments, gates, and wall located at the read frontage. The applicants are proposing to preserve these features. If the applicant has not already done so, the State Historical Preservation Office (SHPO) should be contacted to inquire as to the need for an archaeological review to determine the possibility of American Indian burial mounds. Sewage Treatment Copies of the proposed septic plans were submitted with the preliminary plat. Septic inspector Matt Bolterman has reviewed the proposed septic plans and his comments can be found in the attached memorandum dated, March 25, 2004 (Exhibit E). He is recommending approval of the proposed septic systems, although proposed lots 1 and 2 should make every effort to utilize the septic sites on the street side of the proposed home rather than the lake side. Proposed lot 3 will be forced to use the septic sites on the lake side of the proposed home location due to the topography not yielding any other acceptable sites. It should be noted that all the sites shown on the plan meet both city and state requirements. The property is within the MUSA and staff is exploring the potential of providing sewer to the property. Elimination of septic systems would provide greater site flexibility. Park Dedication The property does not abut any public roads except at the very NE comer and does not abut any of the existing or proposed public trails shown on the City’s Comprehensive Trail Plan. A future trail is planned along the public portion of Fox Street. This subdivision proposal will be submitted to the Park Conunission for their review in early May, to determine whether land dedication is required or merely a park fee for the two new lots (Park Fee would be $5,550 per lot). Interim Period Plaiming Department staff have spoken to a potential buyer of proposed lots 2 and 3. This potential buyer has indicated that the existing house will be lived in for a period of time until a new house on lot 2 is constructed (lot 3 will remain vacant). Because the current mound (new in 1996) for the septic system overlaps onto lot 1. and because the potential buyer doesn ’t want to be forced to remove that system until a new house is built, the Planning Commission should consider allowing a temporary easement over the 4. This would have to include willingness of the future owner of lot 1. Staff does not find this to be problematic assuming the easement automatically expires at a defined time ^proved by the City. It should be noted however, the driveway locations for lots 1 and 2 may force removd of the mound earlier than construction of a home on lot 1. The Planning Commission should discuss if they are comfortable allowing a temporary easement, approved by the City, until any site grading occurs (including a driveway for lot 1). Issues for Consideration 1. Should the applicants be required to use the septic site located on the street side of the proposed house pads rather than the sites on the lake side even though they meet state standards? 2. Should proposed lot 3 be required to use the existing driveway that exists outside the private gates of Fox Street? 3. Should a temporary easement, during the interim period, be permitted for the cunent mound overlapping onto proposed lot 1? 4. Are there any other issues or concerns with this application? One of the lots has an existing house on it and the other two lots are vacant. The lot with the existing house currently has a code septic system that will be half on lot I and lot 2. If the current house will be continued to be lived in they will have to put in a new septic system that is on their property. The new septic system can be reused if they rebuild the house a future time. I recommend getting the septic sites as far from Lake Minnetonka as possible. Lot 1 The two septic sites by the lake should not be used. There is a site located on the north end of the property and testing should be done to find another site either just south of the building setback line or fmd another site north of where the house will go. Both sites north of the building setback line would be preferred. Lot 2 The two septic sites by the lake should not be used. There are 2 septic sites located north of the existing house that should be used. The septic site located furdiest from the house must be centered on the knob. Lot 3 The only septic locations on this lot are the two near Lake Mirmetonka. Septic code requires septic to be at least 75 feet from Lake Minnetonka. Both septic sites meet this requirement. RESOLUTION OF THE CITY COUNCIL NO. ^ ^ EQB Rules 4410.1100 Subpart 6 provide that the RGU shall order the preparation of an EAW if the evidence presented by the petitioners, proposers and otlier persons or otherwise known to the RGU demonstrates that, because of the nature or location of the proposed project, the project may have the potential for significant environmental effects. The RGU shall deny the petition if the evidence presented fails to demonstrate the project may have the potential for significant environmental effects. The City Council hu: reviewed the evidence presented by the petitioners, proposers and other persons as well as other mfoimation of record pertaining to the development. The Citizen Petition for an EAW has been formally withdrawn by the petitioners and due to the petition beirrg active for one year the City has determined that a decision shall be made regarding whether an EAW shall be required of the applicants. The Citizen’s Petition was reacting to a 6 lot proposal and such proposal has been withdrawn and a 3 lot proposal has been submitted which is looked at favorably by the petitioners. The proposal for a 3 lot subdivision significantly reduces the potential for significant environmental impacts. The environmental issues raised by the petitioners do not pose the potential for significant environmental effects, as discussed in the City Council memorandum dated March 4,2004. The City Council finds that the concerns raised in the Citizen Petition have been and will continually be addressed as the applicants continue through the subdivision process and preliminary and final approval will not be given until all issues are settled throu^ the Planning Commission ard City Council approvals. State Statute 412, et. seq. and State Statute 462, et. scq., to protect the health, safety, and general welfare of the citizens of the City and other members of the public within the City; and WHEREAS, the City shares concurrent jurisdiction over the primary harbor limit of the City of Orono with the Lake Minnetonka Conservation District and the Department of Natural Resources of the State of Minnesota; and WHEREAS, .he regulation of the navigable waters involves an exercise of police power of the State, LMCD, and the City of Orono, all of which have a >pted rules to ensure to all equal cnjo>Tnent of the public rights and equal protection from activity on or near the puolic waters and on the land within the City which, if unregulated, may be detrimental to the public health, safety and general welfare; and WHEREAS, the regulations of the DNR, LMCD, and the City of Orono regulate the property rights of the riparian owners both as to residential owneis and the commercial marina owners to the extent prohibiting any interference with the public waters adjoining their property. The LMCD, DNR and City of Orono must fulfill their trusteeship over the public waters by protecting against interference by anyone, including those who assert the commonlaw rights of riparian owners, whethei or not they be commercial marinas or residential owners; WHEREAS, as to Lake Miiuictonka, a mutual right of enjoyimcnt exists between and is shared by riparian owners and the public generally, no one riparian owner has exclusive privileges over Lake Minnetonka. The only additional private right that any riparian owner may have over the public generally is to construct one dock to the navigable depth of the public waters. There can be no dispute but that the public generally and each npanan ow'ncr to Lake Minnetonka has the right to use the entire surface area of Lake Minnetonka for all suitable purposes in common with all other riparian owners This right is a right not only to members of the public but the right to each riparian owner. The current benefit level is in the lower portion of the range of pension benefits provided by other area Fire Departments. I'hc recommendation is based on the pension benefit framework described below. Recommendation 'llie recommendation calls for the pension benefit to be increa.sed from $2,282 per year of serv’icc to $2,375 per year of service for 2003. and to be increased by 3% per year going forward. As indicated in the pension benefit framework below, the proposed level of increases does not require any contribution by the Cities. Pension Bene fit Framework The Long Lake Fire Commission has met with the City's Auditor and with Kelly Shaughnessy, repre.senting the Long L.ake Fire Relief As.sociation, to determine the current status of the pension fund, and to discuss the elements of a framework for determining pension benefit increa.ses. These discussions have provided the basis for developing a policy to guide pension benefit increases over the long term. The projections reflect the recent higher 2% State Aid due to higher insurance premiums, and due to the addition of the northwest comer of Orono to the Long Lake fire service area. The Auditor has prepared a funding projection that assumes an annual pension benefit incrca.se of 3%. This level of increase is related to the average annual pay increases provided by the Cities to their various employee groups. These pay increases have averaged about 3% for a number of years. B. The police department recently conducted an open hiring process which included advertising, a written test, an interview process, a physical agility test, and a thorough background. The police department made a conditional offer of employment to Anthony (Tony) Jeffrey White, pending his successful completion of psychological and medical testing. Tony has successfully completed all phases of the Orono Police Department hiring process. The OPD recommends hiring Tony as a fully licensed police officer working part time hours. Tony graduated from LeSueur-Hcnderson High School in 1999. He graduated from police skills school at the Alexandria Technical College in July 2003, and received a B.A. in Criminal Justice from St. Mary ’s University in December 2003. Tony completed an internship with the Wright County Sheriff’s Department which included visiting hundreds of businesses to update contact information. He has been described by citizens and supervisors as mature, helpful, and polite, responsible, and honest. Tony enjoys running, lifting weights, fishing, hunting and all sports. He currently resides in Buffalo. The agreement now needs to be formally approved by the Council. The five-year rolling agreement is very beneficial to both Cities. The agreement provides stability and continuity of service, and enables long term budget planning. It also provides stability in terms of the police officer staffing level, which is important to the success of the Police Department in recruiting new officers. COUNCIL ACTION REQUESTED: Motion to approve the five-year rolling police service agreement with Spring Park for the years 2005-2009. . AGREEMENT AND CONTRACT FOR LAW ENFORCEMEIST THIS AGREEMENT AND CONTRACT made and entered into this day of May, 2004, by and between the CITY OF ORONO, Minnesota and the CITY OF SPRING PARK, Minnesota, is made under and by virtue of Minnesota Statutes, Section 471.59. WITNESSETH; WHEREAS, the City of Spring Park is desirous of contracting with the City of Orono for the performance of law enforcement services within the City of Spring Park, and WHEREAS, the City of Orono is agreeable to render law enforcement services on the terms and conditions hereinafter set forth, and WHEREAS, a contract such as this is authorized under and by virtue of the provisions of Minnesota Statutes, Section 471.59. NOW, THEREFORE, the City of Orono agrees that it will provide law enforcement services for the City of Spring Park on the following terms and conditions and the City of Spring Park agrees as follows; 1.Deflnition of terms. For the purpose of this Agreement, the terms in this Agreement shall have the meanings given to them in this section. A."Contract year" means a 12 month period during which law enforcement services are to be rendered or were rendered to the Contract Cities by the City of Orono. All costs of equipment and apparatus acquisition and maintenance. 4. All non-prosecution consulting fees. 5. Holiday and severance pay. 6. Unemployment benefits paid. 7. Utilities. 8. Telephone Serv ice. 9. Gasoline and oil for police cars. 10 Books and periodicals. 11 . Wearing apparel. 12. Officer equipment. 13. Building operation, maintenance, and repair costs. 14. All other expenses normally and reasonably incidental to the operation of a nine full-time officer, Chief included, police department. 15. Administrative overhead charge of 10% of the City of Orono Base Police Budget to reflect the support provided to the Police Department by the City’s Administrative and Finance Departments. D. “Annual Budget Package” means a five-year budget projection that provides a not-to-exceed cost for each year of the five-year term of the agreement. The Annual Budget Package is updated each year based on updated costs and updated cost allocation formula results. The not-to-exceed costs cannot be increased without the consent of the Contract Cities, except if due to the cost allocation formula. (The Spring Park population and market value information used in the cost allocation formula will be frozen at the levels used for the 2004 cost allocation calculation for the duration of the initial five-year term of this agreement.) Public Image. The designation "Orono-Long Lake-Minnetonka Beach-Spring Park Police Department" shall be affixed to all marked police cars used by the Orono Police Department under the terms of this agreement and the City of Orono shall cause the listing for the Police Department for each Contract City to be inserted in the appropriate k Page 2 3. 4. telephone directories as may be distributed in the contracting cities. If another city contracts with the City of Orono for service, its name may also be added to the above. Level of Services. The quality and level of services rendered to the Contract Cities shall be the same as the services rendered to the City of Orono, except as hereinafter stated. A. C. There shall be one officer assigned to, and stationed in, the City of Spring Park 24 hours per day, seven days per week. The officers assigned to provide such service will be physically within the city limits of Spring Park at all times save for the following: 1.Responding to Necessary Calls which are defined as calls created by immediate necessity for police service, such as responding to a medical emergency, a crime in progress, an officer requiring immediate assistance, etc. These calls are similar to “mutual aid ” calls in which an officer in one police department assists an officer in another police department. Such calls will always be a part of the communications log of the Orono Police Department and the officer responding will have been directed by official communication to respond to the Necessary Call. Scheduled travel to and from the Orono Police Department Offices at the beginning or end of shifts, including the fueling of squad cars or emergency vehicle repairs. 3.Looping through Orono, using the streets that connect Spring Park and Navarre, west of County Road 19, as a part of regular patrol patterns for the City of Spring Park. The loops that are permitted will have been agreed upon in advance by Spring Park. 4.Transporting prisoners or intoxicated persons from Spring Park to the Orono Police Department, Hennepin County Jail, Juvenile Detention Center, Detox Center, or other locations as necessary. B. The City of Orono will schedule those officers requested by the City of Spring Park at all times, except when not possible due to scheduling problems. The City of Orono will provide a monthly tabulation indicating the reasons why officers stationed in Spring Park were called out of the City. Administrative Responsibility. The law enforcement services rendered to the Contract Cities shall be under the sole direction of the City of Orono, subject to the requirements of this contract; the degree of services rendered, the standards of performance, the hiring and discipline of the officers assigned, and other matters relating to regulations and Page 3 5. 6. 7. 8. 9. policies, shall remain in the control of the City of Orono. Any disputes between the parties to this agreement as to the extent of functions and duties to be rendered hereunder, or the level or manner of performance of such service, shall be resolved by the City Administrator of the City of Orono. If a Contract City disagrees with the resolution, the Contract City may appeal within thirty days of receipt of written notice of the resolution, by giving written notice to the City of Orono asking for arbitration, as provided in paragraph 17. The City Administrator of the City of Orono, through the Chief of Police, shall submit to the Contract Cities a monthly report of services rendered to the Contract Cities, as well as suggestions regarding any efforts or initiatives that may be helpful. Joint Advisory Committee. Each Contract City may appoint two volunteer members to a joint advisory committee and the name of such appointees shall be furnished to the City of Orono Administration. The Joint Advisory Committee shall meet not less than on an annual basis, to discuss and make recommendations regarding concerns or problems identified regarding the provision of police service, and to review and provide input regarding the proposed Police Department budget. Any Contract City may request a meeting of the Joint Advisory Committee. Upon such request, Orono will promptly schedule a meeting. Officers, Employees of the City of Orono. Officers assigned to duty in the Contract Cities shall be police officers of the City of Orono. The City of Orono shall assume all obligations with regard to workers compensation, PERA, withholding tax, insurance, etc. arising from the employment of such officers. The Contract Cities shall not be required to furnish any fringe benefits or assume any other liability of employment to any officer assigned to duty within the Contract Cities unless a Contract City employs officers directly, independent of this agreement, to provide special law enforcement services in the Contract City. In such event, all obligations and liabilities with respect to employment of special law enforcement officers shall be the complete responsibility of the Contract City. No such direct employment shall be entered into by the Contract City without first obtaining written approval of the City Administrator of the City of Orono which approval shall not be unreasonably withheld. Enforcement Policies. Enforcement policies within the City of Orono shall prevail as the enforcement policies within the Contract Cities. The enforcement philosophy and general enforcement polices of the City of Orono shall be provided in wTiting to the Contract Cities upon request. Enforcement of Ordinances of the Contract Cities, 'fhe City of Orono officers assigned to duty within the Contract Cities shall enforce the Ordinances of the Contract Cities, or equivalent state statutes, including without limitation liquor ordinances. All Officers to be Officers of the Contract Cities. The officers assigned duty within the Contract Cities shall be provided authority to enforce the several laws of the Cities by proper action to be taken by the governing councils of the Contract Cities. The Chief of Page 4 Police of the City of Orono shall furnish the names of all Orono police officers to the Clerks of the Contract Cities. 10. Offenses. All offenses shall be charged in accordance with the laws of the State of Minnesota or the laws of the Federal Government, or in accordance with the ordinances of tlie Contract City in which the offense occurred 11. Communications, Equipment and Supplies. The City of Orono shall furnish communication equipment necessary to perform the services which are to be rendered. The City of Orono shall provide the necessary equipment and vehicles and the Contract Cities shall provide any necessary supplies which must be specifically printed for the Contract Cities. 12. Cooperation and Assistance from the Contract Cities. With respect to the performance of this Agreement, and the services to be rendered under the Agreement, the City of Orono and the Contract Cities shall have full cooperation and assistance from each other ’s officers, agents, and employees. 13. Headquarters. Headquarters for the services rendered to the Contract Cities under the agreement shall be located at offices owned or leased by the City of Orono, and the citizens of the Contract Cities shall notify headquarters, or radio dispatch for services requested either in person or by some other means of communication. Services shall be rendered to the Contract Cities on a 24 hour basis. 14. Cost to the Contract Cities. A. Cost Sharing Formula for the Total Base Cost. For and in consideration of rendition of Law Enforcement services under this agreement, the Contract Cities shall pay a pro-rated share of the total base costs (net of town aid) determined by a two-factor cost-sharing formula for each contract year. The factors of the formula, which shall be weighed equally, shall be defined as follows: Population of Each Contract City: The population of each Contract City computed as of April 1, prior to each contract year from the then most recent Metropolitan Council estimate, except in a census year when therb is a new census figure available by August 1st, then that figure shall be used. Market Value of Each Contract City: The market value of each Contract City is the valuation related to the total real estate taxes due and payable for the year immediately preceding the contract year. The source of the market value data shall be the official figures of the Hennepin County Assessor ’s Department. The City of Spring Park agrees to participate with all Contract Cities that have signed a police service agreement with Orono in a pro rata share of all the Pages c. operating costs of the department's total base cost based upon a nine full-time officer, and four part-time officer department. It is understood that the formula for the allocation and distribution of costs is as set out above. *• The foregoing notwithstanding, the Spring Park population and market value information used in the cost allocation formula will be frozen at the levels used for the 2004 calculation for the duration of the initial five-year term of this agreement. B. Cost Sharing Among The Contract Cities As of January 1, 2004, the Orono Police Department had an authorized staffing level of eighteen full-time officers, including the Police Chief, and four part-time officers. The police costs that are allocated to the Contract Cities are limited to the cost of nine full-time officers, including the Police Chief, and up to four part-time officers. The 2004 cost allocation formula allocates these costs among the Contract Cities as follows; Mirmetonka Beach: Spring Park: Long Lake: Orono: 6.52% 10.57% 12.19% 70.74% In addition. Spring Park and Long Lake have requested additional officers, specifically stationed in their Cities, to provide the level of police service necessary to meet the needs of the Cities. The two cities pay 100% of the costs of the pay and benefits for these officers. Also, over the years, three additional full-time police officers have been added to the Orono Police Department to keep up with increased demand for police services throughout the Police Departmer.t ’s service area. Orono pays 100% of the costs of the pay and benefits for these officers. Cost to Spring Park - Additional Officers. The cost of additional officers above the base contract cost to the City of Spring Park, shall be determined as follows: A salary figure for the prevision of one officer assigiied to and stationed in Spring Park 24 hours per day, seven days per week shall be computed by calculating the average of all patrol officers’ salaries, and multiplying the average salary by four to obtain the salary figure. To this salary figure will be added that percentage of the total overtime budget for all officers calculated by dividing the number of officers assigned to the City of Spring Park by the numbe- of all officers, 88 hours holiday pay at the hourly rate, wearing apparel, hospuaiization, life insurance. Page 6 L Contract City, and the third to be appointed by the two so selected. The name of each arbitrator shall be submitted in writing to the other party. In the event that the two arbitrators do not appoint the third arbitrator within 15 days after receipt of written notice of appointment of either of the first two arbitrators, the Chief Judge of the District Court of Hennepin County shall have jurisdiction to appoint, upon application of either the City of Orono or the appealing Contract City, the third arbitrator to the Board. The third arbitrator selected shall not be a resident of either Contract City, and shall be a city manager or administrator. The arbitrators' expenses and fees, together with tlie other expenses, not including counsel fees, incurred in tlie conduct of the arbitration, shall be divided equally between the parties to the arbitration. Each party to the arbitration will pay its own attorney fees. Arbitration shall be conducted in accordance with the Uniform Arbitration Act, Chapter 572 of the Minnesota Statutes, and any decision shall be rendered within 60 days of appointment of the third arbitrator. Said arbitration shall be binding on both parties. 18. Annual Audit of Actual Costs. The Contract Cities understand and agree that it is impossible to project with complete accuracy the actual costs for labor and equipment as well as the service to be required by each Contract City for the forthcoming contract year, and therefore, agree to a yearly audit to adjust the prior year's estimated contract charge as set forth above to the actual contract charge based upon the actual costs for that contract year. The most obvious example is a natural disaster or other major catastrophic event that requires police service in Spring Park at a level well beyond the normal level, and results in police costs well beyond the level reflected in the budget package. On or about April 1 of each year, the City of Orono will tabulate the actual cost of providing law enforcement services for the prior contract year and will submit to the Contract Cities a summary of said costs. The actual costs set forth for the prior contract year may result in either a credit or a debit applied to the estimated police service costs charged to the Contract Cities. The determination of a credit is ba.sed on the final actual police expenditures and final actual police revenues. The credit is calculated by pro rating the amount of the budget surplus according to the cost allocation formula. If the Contract Cities are still participating in this agreement, and if a credit is due, the credit shall be applied in the third and fourth quarters, on a pro-rated basis, in each month of the third and fourth quarters, from the estimated police service cost payments required of the Contract Cities for the current year of service; and if a debit, the Contract City shall pay the additional sum to the City of Orono together with the estimated contract charge for the current year by applying the debit in the third and fourth quarters, on a pro-rated basis, to the monthly payments in both the third and fourth quarters. The allocation of the credit or debit shall be made pursuant to the same formula set forth above. If the a Contract City is not still participating in this agreement at the time the credit or debit amount is determined as set forth above, the Contract City shall receive from (in the case of a credit) or shall make to (in the case of a debit) the City of Orono a cash payment Page 8 19. 20. 21. in the amount of such credit or debit, one-half on the date that the September estimated police service cost payment would be due if this agreement was still in force and one-half on the date that the December estimated police service cost payment would be due if this agreement was still in force. Unforccasted Expenditures. Not withstanding any of the above, the Contract Cities shall have the right to approve any proposed capital expenditures and/or increase in number of officers not otherwise included in the armual budget. Notice of such proposed and non-budgeted capital expenditures and/or increase in the number of officers shall be given in writing to the Contract Cities prior to actual expenditure for such items and the Contract Cities shall thereafter have ur.til the later of their next Council meeting or 30 days after receipt of said written notice in which to approve and/or disapprove the same in writing or else it is agreed that such proposed expenditures may be made and the cost thereof shall be included in that year’s budget. In the event tlie Contract Cities shall disapprove such non-budgeted capital expenditure and/or increase in the number of officers, it shall not be liable to the City of Orono for any costs incurred by the City of Orono should the non-budgeted capital expenditure and/or increase in number of officers be made despite such disapproval. Furthermore, the cost of such disapproved capital expenditures and/or increase in number of officers shall not be computed in determining the "Base Cost" herein above set forth for each Contract City for the years in which the disapproved expenditure(s) is/are made. Proceeds from Forfeitures Handled by the Spring Park City Attorney. If a vehicle or other property is forfeited through a police action in the City of Spring Park, and the type of forfeiture requires the Spring Park City Attorney to handle the legal work involved in folio..ing through on the forfeiture; the City of Spring Park shall retain the portion of the proceeds from the disposal of the forfeited vehicle or property as prescribed by law, for use subject to the provisions of Minnesota Statutes Section 169A.63,609.5311, or other applicable law. Hold Harmless and Indemnification. As part of the Police Budget for each contract year, the City of Orono shall purchase liability insurance to insure the City of Orono against liability incurred in the rendering of law enforcement services to the City of Spring Park. The City of Orono shall maintain insurance covering its law enforcement services with limits of not less than $1,000,000 for general liability coverage and $2 million for excess liability coverage. The City of Spring Park shall maintain equivalent insurance coverage. Each policy procured by the City of Orono shall name the City of Spring Park as an additional covered party for claims arising out of or related to the provision of law enforcement services. Except to the extent the same arc the result of the negligent or wrongful intentional acts of the City of Spring Park, the City of Orono agrees to defend, indemnify and hold harmless the City of Spring Park from claims, suits, damages, losses, liabilities and costs however denominated arising out of or related to the provision of law Page 9 L 22. enforcement services by the City of Orono, its officers, agents, employees and contractors. Nothing in this Agreement shall be construed as any waiver by cither City of any statutory or common law immunities, defenses, or limits on liability. In no event shall this agreement be construed to fix upon the City of Orono any responsibility or liability to Spring Park which is greater or different in kind than the responsibilities and liabilities borne by Spring Park if it was providing law enforcement services through its own police .lepartment. It shall not be a violation of this agreement if the City of Orono, in the exercise of reasonable judgment, is unable to respond promptly or to respond with only limited officers and equipment, or is delayed in responding to a call. Prior Contract. Notwithstanding any language herein to the contrary, or in prior contracts between the parlies, any credit or debit due to the Contract Cities or to the City of Orono on account of prior agreements and contracts for law enforcement between the parties shall be payable in 2005 as provided herein for credit or debit payments payable in 2005 and thereafter. 23. Police Contract Service Explanation. The City of Orono will deliver 24 hour patrol and response throughout Orono, Minnetonka Beach, Spring Park and Long Lake; will conduct routine patrol throughout the cities as needed, will conduct periodic security checks of businesses, and will conduct such duties as requested by the Contract City's councils. The City of Orono will submit regular reports to the Contract City officials and appear at council meetings or any other special meetings as required by the council. This can be the Chief or any other member of the department as required by the council. One officer assigned to and stationed in Spring Park 24 hours per day, seven days per week, as set out in section 3A above, was requested by Spring Park and will be assigned to Spring Park by mutual agreement between the City of Orono Police Department and the Spring Park City Council. 24. Duration of Contract. 1 he initial term of this agreement is five years. In each year of this agreement that the Annual Budget Package is ratified by November 1 by the City of Spring Park, this Agreement will be renewed for a total term of five years beginning with the contract year following the year in which the Annual Budget Package is ratified, fhe elements of the Annual Budget Package so ratified will replace the elements of the previously ratified Annual Budget Package In the event that, in any contract year, the Annual Budget Package is not ratified by the City of Spring Park by November 1, then the amount previously ratified for the next year ’s budget, as part of the most recently ratified Armual Page 10 j Budget Package, shall become the Annual Operating Budget for that year, the term of this agreement will not be renewed, and the agreement will continue in force for the balance of the most recently ratified five-year term. If, in each of the five /cars of any five year term, the Annual Budget Package is not ratified by November 1, the agreement will terminate at the end of the most recently ratified five-year term. 25. Termination of Contract This Agreement may be terminated by the metho^. detailed in section 24, by mutual agreement of all Contract Cities, or for cause. In addition, if any one of the Contract Cities terminates their police services agreement with Orono, the City of Spring Park may renegotiate or terminate this Agreement, unless the cost to the City of Spring Park remains within the approved budget package amounts. In the event that the City of Spring Park terminates this agreement, the City of Spring Park agrees to pay to the City of Orono any of the reasonable extraordinary costs i curred by or within the Police Department of the City of Orono on account of such termination unless the termination is for cause. Tlie extraordinary costs include but are not limited to unemployment benefits paid because of the need to lay off existing police department personnel and severance pay as required by union contract. Termination for cause is defined as a material breach of the contract directly related to the provision of police services. The Contract City will provide a written notice of the alleged material breach to the Orono City Administrator identifying the specific breach, and providing a reasonable time for the City to cure the breach. If the breach is not cured in a timely manner, the termination process will proceed. The determination of whether the reason for the termination is a material breaeh will be made upon mutual agreement by the parties to this agreement. If the parties are unable to reach agreement, the matter will be submitted to arbitration in the manner provided by- paragraph 17 of this agreement. No termination costs shall be imposed unless and until authorized representatives of the parties hereto have met and such termination costs have been mutually agreed upon. In the event the parties are unable to reach agreement, the maiter shall be submitted to arbitration as provided in paragraph 17 of this agreement. Termination of this contract by either party shall not affect the obligation of either party to perform the contract prior to the time that such termination becomes effective. 26. No Discrimination. The City of Orono agrees that during the period of this contract, it will not discriminate against any employee or applicant for employment because of race, color, creed, sex, national origin, or ancestry and will include a similar provision in all subcontracts entered into for the performance hereof.
