Lot 1, the developed lot shall continue to achieve access ISP'Via Tract E of RLS #1418. The owner of Lot 4 has never developed an access off of Tanglewood Road. Lot 1 will remain a through lot.^ All RR-IB area and setback standards have been «’»-*-isfied for the existing structures on proposed Lot 1. All exi - structures and septic drainfield area meet the required setbac/c jf the shore land dis^i<^. Each of the lots meet the required width of 200' at the rear of the L front street setback of 50'. As already noted above. Lot 2 will achieve access via Tanglewood and will be subject to all the private covenants currently in effect. The new curb cut or access at Tanglewood will require approval of the Public Works Director. ■:« Review Exhibits D and E 1-2. Weckraan's memo confirms that each site has adequate area for development of conforming on-site septic systems.,^ % Staff has included the road section for Tanglewood and the preliminary and final subdivision resolutions granting approval of the plat (Exhibits I, J and K). Note that in 1978 the paving of private roads was not required. Portions of the road have been paved by individual property owners. As the enclosed resolutions note, there are private covenants for maintenance purposes in place and the City had obtained the necessary access and utility easements over the road outlet. b!i-■ ,f, . '■■■■ -.*.r Lot 1 will meet the area requirements for a guest house use as Lot 1 is shown at 4.42 acre. The guest house is currently served by the existing septic system that serves the residence and alternate septic testing confirms that the guest house will continue to be served by a shared system. In reviewing the records (Exhibits M ^Dd N), staff notes that the guest house was constructed in 1967 and the current residence in 1960. The code at that time would have required a conditional use permit for a guest house. Staff is not clear as to the relevance of the information written out on building permit for guest house as RLS #1418 was not approved until 1976. At any rate, no subdivision would have had an impact on the guest house use because of its proximity to the principal structure. Staff should have required a conditional use permit. The Planning Commission must make a recommendation concerning the need for applicant to file a current conditional use permit for the guest house. The pond on Lot 1 has existed on the property for many years and was probably installed by the original owner. In the past, the City has always asked for a drainage easement over the defined or existing retention areas. Staff would recommend that the City obtain a drainage easement over the pond area. ' V. K. Mabusth, Building & Zoning Administrator Stephen Weckman, On-Site System Manager July 14, 1992 SUBJECT: Subdivision #1749, Jim Lawerence - Septic Review ^ I have reviewed the proposed septic system testing and " design for this property and would make the following coiiunents. iv LOT 1 -I f £:A This lot has an existing residence with an on-site sewage treatment system. The system is listed as a substandard system which includes two 800 gallon concrete block septic tanks and approximately 300 s.f. of drain field trenches. The septic system was installed in 1960 and no problems have been noted to date. Soil testing has been provided indicating alternate drainfield site suitable for a four bedroom and a one bedroom guest house. Specific septic system details are included below: - Depth of seasonal saturation (mottling) is 1', requiring a mound. Slope is 0%. The percolation rate averages 8.1 minutes per inch at 12 inches. Topographic location and site drainage is adequate. All setbacks meet city code. '1 Soil testing and septic design have been approved for a five bedroom home including primary and alternate drainfield sites. Both sites meet MPCA rules Chapter 7080 as well as Orono City Code Section 12.30 requirements. Specific septic system details are included below: Depth of seasonal saturation (mottling) is 1' to 2' for both primary and alternate drainfield sites. Slope at the primary and alternate drainfield sites is 3% and 3% respectively. Planning & Zoning Administrator July 15, 1992 Proposed Zoning Code Amendment - Styrofoam Dock Flotation # '* >m-m As a result of complaints by lakeshore property owners and at the request of the Lake Use Committee, staff has drafted an ordinance providing for the elimination of non-encased bead type styrofoam used for dock flotation purposes. The problem with such material is that the styrofoam beads break off in chunks or individually from the styrofoam blocks, and float around the lake typically accumulating on the windward shorelines. This creates an aesthetic nuisance^ although the MPCA doesn't seem to think this creates any degradation of water quality. The proposed ordinance provides for a 3 year phase-out of unencased styrofoam used for docks. mIdst of Exhibits A - Proposed Ordinance Draft B - Letter from MPCA 4/10/92 , C - Product Literature on One Possible Alternative (This is not an endorsement) D'lscmssion The impetu ' for the proposed ordinance is the styrofoam bead accumulations wiwhich a number of lakeshore property owners have had to contend. Tb'. most visible sources have been fro Minnetonka Boat Works and Lakesid- Marina, with lesser amounts apparently coming from Windward Marina. The bead accumulations resulting in complaints have been mainly in Tanager Lake and the south shore of Maxwell Bay. There are likely a number of private docks also using styrofoam. h There are foam products on the market that are not formed from expanded polystyrene beads. Generally, these homogenous foams as urethane foam or isocyanurate foam, do not break down into individual beads or chunks of beads, and have not become apparent as a problem. The MPCA end the DNR have not concluded that ingestion of the beads a'^d subsequent elimination causes any problems for the wildlife. To remedy the problem, a number of choices might include: Replace the bead styrofoam with some other form of flotation. Coat or encase the styrofoam blocks in a protective covering which eliminates their introduction to the water. This might include some sort of protective spray coating, placement of the blocks within some type of bin or barrel structure, or even reuse of the existing styrofoam in bead or chunk form within some watertight barrel or case. The following comments from various parties, including Orono marina operators, are offered for Planning Commission's consideration; There are various grades of bead styrofoam, and use of the higher grades might reduce the magnitude of the problem. Replacement of an entire marina dockage system is an expensive proposition, and the January 1995 ".imeframe proposed is not realistic for the two marinas (Lakeside and Minnetonka Boat Works) which have recently constructed new docks supported by bead styrofoam. The 3 year phase-out is unrealistic, in that at the time a dock owner chooses to replace the flotation, entire dock sections must be done at once due to the high probability that any replacement product will have different flotation characteristics (the docks will have hills and valleys) As currently drafted, all private and commercial docks would be subject to the ordinance. Various parties have suggested that in addition to docks, the ban should also include any other floating structures such as swim platforms, walkways, etc. * •-k The 3 year phase—out language was constructed such that^ the City does not need to do an inventory up front. Rather, at any time after each incremental deadline a dock was found to exceed the maximum allowable proportion of styrofoam bead flotation, such dock would not be in compliance. In the event that a dock had multiple fingers or slips, for instance say 6 fingers, it would be reasonable to expect that 2 of the 6 fingers would be replaced each year, rather than 1/3 of each finger each year. (This question came up at a Lake Use Committee meeting.) Wm zjsm* ,v m >' Memo July 15, 1992 Page 3 | Issues for Discussion The Planning Commission should answer the following questions in determining whether the proposed ordinance as drafted is necessary and ^appropriate: 1. Should all future use of non-encased styrofoam for dock flotation be banned? Should existing users of such product be required to eliminate non-encased styrofoam? If so, what is an appropriate and reasonable time table for removal to occur? Should there be one final deadline date, or is the incremental reduction appropriate? Should the ordinance apply to private as well as commercial docks throughout the entire City? Does Planning Commission have any recommendation as to the degree of enforcement this subject deserves? i.e. Is an annual survey of docks needed (extremely time consuming), or would this be enforced only or a complaint or "catch—as— catch can" basis? Staff RecoBOnendation Planning Commission is advised to review the proposed ordinance and, if the ordinance is determined to be appropriate, recommend any changes which you feel might make it more appropriate, reasonable, and fair to both those who must ultimately replace docks and those who must put up with their litter. my. Because the disintegration of styrofoam dock flotation blocks leads to floating styrofoam beads washing up onto the shoreline, causing a visual blight on the shoreland landscape, and thereby creating a public nuisance, the use of non—encased styrofoam blocks or sheets for dock and platform flotation is prohibited subject to the following regulations: 1."Non-encased styrofoam" means any brand of expanded polystyrene beads molded into a block, sheet or other shape that does not have a permanent casing, covering or coating which would eliminate disintegration of the molded block or shee^ in ‘ndividual beads or chunks as a result of ice act -i : <':"'imals or normal activity by dock users. This ordinance applies to all new, private and commercial dock construction, regardless whether such dock is permanent or seasonal in nature, occurring after the date of adoption of this ordinance. The owners of any existing permanent or seasonal dock constructed with non-encased stY£of.£a.S! shall discontinue use of the non-encased styrofoam as a flotation device per the following compliance schedule: No more than 2/3 of the length of a given dock may be supported by non-encased styrofoam after January 1, 1993. Based upon the inspector's observations at the site, it appeared the structure couId be located within the 75' setback area. Applicant was asked to provide a survey on file for the necessary building permit. Applicant filed a variance application as Zoning File #1752 July 9, 1992 Page 2 30on as it was realized that portions of the deck were located within the 0-75* setback area. There is a 6' encroachment of the lakeshore protected zone and 105 s.f. of structural hardcover located within the 0~75' setback area. Applicant has just recently purchased the property in April of this year and p^ to complete other rennovations within the interior of the structure Upon a site inspection, members will note remnants of a former gravel drive that was located within the street yard. Mr. Kalweit plans to complete the restoration of the grassed yard as soon as the interior improvements are completed. Based on staff's review of the hardcover within the 75—250' setback area, it appears that no hardcover variances are necessary for the structural repairs of the deck outside of the 75' setback area. Review Exhibit B, technically applicant is also required to seek approval of an average lakeshore setback variance as entire structure is located in front of the average setback line of the adjacent flag lot to the immediately north. A commons out lot abuts the lot to the Immediate south. Deck structure has no impact on the lakeshore views of the flag lot nor on the house to the immediate south of the Commons lot. Staff has enclosed copies of the grading and drainage plans and plat for North Arm, Exhibits G and H. It is staff's understanding that the applicant wants the City to address their concern regarding a drainage problem along the south side lot line. An underground PVC pipe outlets within the lakeshore yard of the applicant. The plat. Exhibit H, shows the City did not obtain the necessary drainage ana utility easements along the oouth side of the lot. Staff inspected the site and can confirm that theie is no rip rap at the outlet nor was there any sign of any improvement to minimize erosion. Ir- |jb|; The subject guest house will be formally recognized as a non~ conforming structure in the approval resolution of the final plat for the applicant* Based on the information submitted with preliminary survey, the guest house appears to be completely located within the 100' setback. Any major structural repa5.rs for any expansions located within the protected area will require variance approvals. It should be noted that the non~conforming setbacks did not result from the lot lines created with this three lot subdivision. The guest house shall continue to be used by applicant, guests or hired help. i* r?‘ :vi ■ During the preliminary review of the subdivision, applicant's saptic consultant provided additional information confirming that there is adequate area for alternate septic sites for both residence and guest house. It is the intention of the City to require the installation of a new septic system if guest house use is to be continued. The City has also asked for confirmation of additional areas suitable for septic expansion. Mark Gronberg has advised that the original test site can be used for the installation of the primary system and that the area can be expanded as an alternate site to serve both residence and guest house at a future date. The issue as to when the new system was to be installed was never specified during the preliminary subdivision review. The staff memo suggested a deadline of one year from the date of final plat approval. Review Exhibit E, Weckman's memo requests ninety days from the date of Council's approval of the conditional use permit to be consistent with requirements of septic code. Staff Recommendation CuT.- To approve the conditional use permit for the continued guest house use of the secondary residential structure on the property located at 1685 Fox Street finding that all area requirements for the guest house use have been met. This approval is subject to the following conditions; Guest house structure is considered a non-conforming structure. As per our discussion, best way to acheive adequate sites for sewage treatment would be to have one alternate site for the guest house while extending the other alternate site already designated to make it large enough for both the main residen - as well as the guest house.
