The Council met on the above-mentioned date with the following members present: Mayor Barbara
Peterson; Council Members Bob Sansevere, Jim Murphy. Jim White, and Lili McMillan; City Attorney
Thomas Bannett. Representing Staff were City Administrator Ron Moorse, Planning Director Mike
Gafiron, Planner Janice Gundlach; Engineer Tom Kellogg, Public Service Director Greg Gappa, and
Recorder Jackie Young.
Mayor Peterson called the meeting to order at 7:02 p.m., followed by the Pledge of Allegiance.
PUBLIC COMMENTS
Nancy Anderson, 1260 Spruce Place, stated on September 4,200S, the Gty’s lift station in her
neighborhood failed for the third time in five years causing a considerable amount of destruction to their
residence. Anderson indicated they do have back flow valves installed at thtir residence but the valves
were unsuccessful in stopping the flow of sewage into their house. Anderson stated the sewage
completely ruined their master bedroom, bath, office, three closets, hallway, and ran into their heating
system and crawl space. Anderson indicated their residence had to be cleaned by an environmental
cleaning crew.
Anderson commented they have resided in their home for the past 32 years and that they did not design or
engineer the City's sewer system and were not consulted about the lift station in their area. Anderson
stated they are required by law to be connected to the City sewer and arc required to pay for this service
on a monthly basis.
Anderson stated they experienced their first problems with sewer backing up into their home in 1990 and
in 1992. At that time the City paid for the cleamq> and the necessary repairs to their home and the homes
of several neighbors. Anderson indicated in 1992 they installed their first backflow valve system, which
is monitored on a tegular basis. Anderson stated they also experienced sewer backups in Apiil 2001 and
June 2003, which the City assumed responsibility for.
Anderson stated despite the reasonable efforts they have undertaken, they have been unable to stop this
fiom occurring and that they were informed by City Administration that the City is not responsible for
this last incident of sewage backup into their residence. Anderson stated they have requested the City
instell a bacloq> power source at this lift sUtion since 1992 and that this lift station experiences a
tremendous amount of water infiltration during rainstorms.
Anderson requested the City take some action to correct this problem and acknowledge that the City has a
moral duty to correct this situmion.
Sansevere inquired who ftom the City said the City is not responsible.

Mooree indicated the first several times this occurred the City admitted some responsibility for the back
up of the sewer system, but that since that time the City has installed a SCADA system, which
automatically notifies the City when there is a problem at a lift station. Moorse stated in this instance all
of the City’s systems functioned properly and that the Public Works Department arrived at the residence
within approximately one-half hour of the backup. Moorse indicated due to the quickness of the backup,
there was nothing the City could have done to prevent this situation. Moorse stated the City has done a
number of things over the years to try to correct the situation.
Sansevere commented the outcome was still the same regardless of the efforts the City has taken.
Anderson staled tfiey did suggest a backup generator be installed back in 1992 and other times, which has
still not been done.
Sansevere inquired whether the City’s insurance company has stated that the City is not accountable for
this. Sansevere stated if that is the case, it is not accepuible.
Peterson commented it is not the individual’s private septic system that has backed up into the resideiKe
but rather the City’s sewer system. Peterson stated she also has a difficulty accepting the rationale of the
insurance company.
Barrett stated it is possible the insurance company is claiming they are not responsible due to the
measures already taken and that it is the responsibility of the City to remedy the situation.
Murphy concurred that the City needs to take steps to see if this problem can be corrected in some fashion
and that the present situation is intolerable. Murphy inquired whether a gate valve has been installed.
Anderson staled they have an older residence and they have now installed a gate valve but it is not fail
proof. Anderson stated having a gate valve is also a major iiKonvenience because everything needs to be
dnit off whenever they leave the residence for a period of time.
Anderson staled her mother lives next door in a four-year old home and she also experienced a small
amount of sewage backup into her basement as well as two other neighbors. Anderson stated
approximately 10 homes have been added to Spruce Street in the last few years.
Murphy corranented this is a City sjrstem and that the residents are paying for the use of this system.
Murphy slated the inad«|uacy in the Cit>' system appears to be causing this trouble.
Moorse stated the lift station gets overrun, which can result in a backup.
Gappa stated the nuijority of the City sewer system has been installed after the homes were constructed
and that there are weak spots in the system. Oappa indicated a generator has now been placed at that lift
station but that there still is the potential that this could happen again due to the low elevation of the
residence in comparison to the sewer system.

White stated he would like to hear ftom the insurance company on this item.
Sansevete commented the homeowner has the right to assume that their sewer system will not back up
into their residence whenever they use the system. Sansevere stated the City has to be aware of the
possibility that someone who experiences this type of sewage backup could come down with a medical
condition, which would cause a much bigger problem and that the City and the insurance company cannot
turn a blind eye to the situation.
Anderson stated she would like to take care of this situation as soon as possible.
Murphy inquired what cleanup still has to be done.
Anderson indicated an environmental cleanup crew called Quantum was called out to their residence the
day the backup happened and that the residence has been gutted. Anderson stated her husband and
nephew are in the process of putting the residence back together.
Peterson indicated the Council was not aware of this situation until tonight.
Anderson stated die representative fiom the insurance company was not very helpful and attempted to
place the blame on them for this backup. Anderson inquired what steps she should take to prevent this
from happening again.
Gappa stated the City does have some options they can consider, such as putting in a backup generator or
a new lift station.
McMillan recommended the City look U this particular situation as soon as possible.
Peterson inquired how long it would take Gappa and Meorse to review the City’s options to remedy this
situation.
Sansevere requested the City Engineer look at this situation tomorrow and that this item be put on
Tuesday’s work session ageiida.
Gappa indicated they are in the process of obtaining prices for a new lift station.
It was die consensus of the City Council to discuss this item at their November IS* work session.
Miapby stated the City would get back to die Andersons by Wednesday aftonoon.
Anderson distribuled documentation going back to die 1990 ’s regarding this problem to the Cotmcil,

PARK COMMISSION COMMENTS - LAURIE ESAU, REPRESENTATIVE
Laurie Esau stated the two major items discussed at the last Park Commission meeting was to request a
joint meeting with the Council and the paving of the Dakota Trail. Esau stated Three Rivers Park has
proposed paving of the trail and half of the Park Commission indicated they were in disagreement with
die paving.
Mayor Peterson thanked Esau for her update.
PLANNING COMMISSION COMMENTS - J. MARC FRITZLER, REPRESENTATIVE
Fritzler stated he had nothing to report, but would remain for questions.
PUBUC COMMENT, CONTINUED
Edward Callahan, Orono Woods, 2040 West Wayzata Boulevard, indicated he is pleased with the actions
being taken by the Council regarding the Veteran's Park on Big Island.
Callahan stated he resides in the apartment complex located on Brown Road and Highway 12 and that to
ins understanding the Council is in the process of reviewing plans for the adjacent Carlson property.
Callahan indicaled it was his incorrect understanding that thm would be a public road or service road

located through the adjoining property which would use the driveway of the apartment complex as part of
the public road. Call^um stat^ he and other tenants of the apartment complex still have concerns with
the road being opened up for other public use other than by the tenants. Callahan stated there is a fair
amount of pedestrian traffic in this area and that in his view it is inappropriate to allow construction traffic
on that road.
Callahan requested that the Council give serious consideration to limiting construction traffic on that
road.
Murphy stated he has spoken with Mr. Callahan and the City Administrator regarding this situation and
that it is dieir belief that construction traffic will be limited on that road. Murphy commented in hindsight
the layout of the roadway and parking in that area is not the best design but that it might be too late to
change it at this time.
ZONING ADMINISTRATOR’S REPORT
#3. #05-3142 CHRISTOPHER AND EMILY CHAPMAN, 3775 BAYSIDE ROAD -
VARIANCE
Christopher Chapman, Applicant, was present.
Chapman stated at die Platming Commission meeting there was a discussion regarding the trading of
nonstructural hardcover for structural hardcover. Chapman pointed out this lot is oddly shaped and has
approximately 480 feet of lakeshore. Chapman stated in his opinion the Plaruiing Commission at some
point should consider blight on landscape or blight on neighbors when dealing with ztming. Chapman
pointed out diat 40 sheds could be constructed across his property and that he would like to only construct
one shed. Chapman indicated the location being proposed for the shed does not impede the vision of the
neighbors.
Chapman stated they would like to construct a one-story cape style shed, which would resemble the
houM, and that in his view his request is not unreasonable. Chapman indicated the shed would be used
for storage.
Oundlach stated the applicant is here tonight proposing construction of a 12’ by 12’ shed, which requires
a hardcover variance to permit excess hardcover within the 0-250’ zone. The applicant is proposmg
hardcover removals so as to not increase the amount of hardcover on the property, nor will any additional
hardcover be located widiin 75 feet of the lake. In additimi, a second variance is required to permit a shed
to be located 21 feet from the fient property line where 50 feet is normally required. Gundlach indicated
the 21-foot setback is proposed so that die shed is not located closer to the street or the front lot line than
the principal residence.

Gundloch stated the application does meet the intent of the code and does not propose any new hardcover,
wid) all sedMcks being met except for the setback from the front property line. Gundlach stated this
application was submitted prior to the City’s new wetland ordinance taking effect, but noted that the
applicant is in compliance with the new rules.
The Planning Commission, on a motion to deny, voted 4-1, with the dissenting commissioner stating
support for a 10’ by 10’ shed pending removal of equal amounts of hardcover. The main issue discussed
during the public hearing was the trading of nonstructural hardcover for structural hardcover and the issue
of die applicant wanting to install stcppingstones rather than a full paved sidewalk.
Gundlach stated the minimum standard for a sidewalk width is two feet. The applicants would like to
install steppingstones, which total 22.S square feet and account for a reduction of 97.S square feet of
existing sidewalk hardcover. Based on the length of sidewalk, if constructed to the minimum width of
two feet, the sidewalk hardcover would equal SI .5 square feet or account for a reduction of 68.S feet of
existing sidewalk hardcover.
Chapman stated the two>foot sidewalk would allow a shed consisting of 118.S square feet in area or
qtproximately 10 by 12’.
Staff recommends that the Council discuss the policies of trading non-structural hardcover for structural
hardcover and weigh that discussion against the reasonableness of the request.
Sansevere inquired whether the applicant has seen Staffs recommendation.
Chapman stated he has reviewed Staffs report
Sansevere inquired whether die applicant is okay with the secrnid recommendation.
Chapman stated he is okay with the recommendation. Chapman indicated he has recently found out that
the front of his yard is really defined as the front lot line rad that the City owns the strip of property going
to the lake.

White indicated he also concurs with recommendation two.
Chapman stated he is thrilled to live in this area and has paid a substantial amount of money for the
property and that he would like to place one 12’ by 12’ shed on the lot, which in his opinion is reasonable.
Murphy inquired why the applicant did not consider adding onto the residence.
Chapman stated they did consider that but that the shed would acc

Murphy commented the lot is unique and that he is not opposed to the second recommendation of Staff of
a 10’ by lO’shed if the shed resembles the house.
Muiphy noted the lot to tfie west has a dock on it with a jet boat parked next to it.
Chapman stated there is a 30*foot driveway going down to the lake and there is an easement down to the
water. Chapman indicated he did offer to buy the City’s land in order to increase his acreage but was told
that the City would not be interested in selling the corridor.
Gaffron confirmed that the City is not interested in selling the 30-foot corridor and that an outlot was
created to the west as part of a subdivision a number of years ago.

GATE HEIGHT APPEAL CONTINUATION
Paul Zisla, Attomey-at-Law, and Jim Anthony, Representative of Simply Automation, appeared on behalf
of the Applicant.
Mwfdiy noted a hearing has been scheduled for November 21" in front of the Planning Commission.
Gundlach stated there is a zoning amendment hearing scheduled for November 21 ” on the new ordinance.
Barrett stated in his opinion the appeal and the zoning ordinatKe amendment are two separate items.
Barrett stated to his understanding the property owner had proceeded to construct the monuments and had
apparently bought the gates on a special order. Barrett stated he had misunderstood that initially and that
it was his understanding that the applicant had approached the City to inquire about what their statutes
allowed.
Barrett stated this is a diflerent situation in his view since the landowner has proceeded in what is
probably a pretty reasonable interpreution of the code. Barrett stated he requested Attorney Ziska to
write a letter to the Council laying out the facts. Barrett encouraged the Council to test the facts asserted,
and if the Council is satisfied that those facts are true, then it would be reasonable to say that the City did
not have a direct lefereiKe to gate height in our ordinaiKcs at the time the application was submitted.
Barrett stated if the Council finds that the City did not have a direct refereiKe in their ordinance referring
to height of gates, then the new ordinance would qrply to future qiplications and not to this homeowner.
Murphy stated it was his understanding that the reason the Council agreed not to pursue this application
was the fact that the City had a discussion pending about gate heights.

McMillan state** it was an application to appeal an existing code interpretation.
Barrett stated it was his recollection that the CouiKi] thought it was good to spend some time discussing
height of gates as a policy matter, but at the time the application originally came before the Council, there
was no reference to gate height in the City's ordinaiKes.
White commented the Council also wanted information on whether the gates could be modified.
Peterson noted they were also unaware that there were two gates involved.
Gundlach pointed out the City’s ordinance does not address the number of gates that would be allowed.
Munihy inquired whether the Council should approve the application since there is no referetKe to gate
hei^t restrictions in the current city ordinance.
Barrett stated the City should accept the qrpeal since it is a reasonable request and that the current city
ordiiumce does not contain any restrictions on gate height.
Sansevere inquired whether the property owner reviewed the City’s ordinances prior to ordering the gates.
Zisla stated he does not know whether the owner reviewed the ordinances pirior to ordering die gates.
Zisla indicated he is in agreement with the City Attorney.
Barrett noted if the heif^t of the gate is changed after the appeal is granted, it would require a variance
and ttiat the law covering this qiplication is the law in existence at the time the application was submitted.
McMillan awved, Murphy seconded, to grant the appeal and to allow the coastmetion of the gates
as reqnaitod la the bnlMlag permit application far the property located at 1535 Bohn’s Point Road,
with the understanding that thb app^ should not hnpede the City’s soon to be adopted ^tc
ordinance. VOTE: AyesS,Nayst.
MAYOR/COUNCIL REPORT
Sansevere stated he would like to receive regular updates fitim City Staff on complaints by the citizens.
Sansevere noted he was totally unaware of the situatian being experienced by (' : Andersons and that it
would have been hel|rfbl to be infbrmed about it prior to tonic’s meeting.
Sansevere requested that the City Administrator assist the Mayor in the drafting of the letter to the CEO
of the maurance company regarding this matter. Sansev ere stated if the City does not receive satisfaction
from their insurance company on this matter, diat the City should consider changing companies.

Barrett indicated he would be willing to draft the letter.
Moorse recommended a representative of the insurance company attend the City Council work session.
Sansevere suggested the CEO of the company be requested to attend.
Moorse stated the City’s insurer is the League of Cities Insurance t rust.
Murphy commented in his view the insurance company is there as a backup to the City when something
goes wrong and that the insurance company should not be dictating to the City what the City should or
sho'ild not be doing.
Murphy indicated he has spoken with Mr. Post regarding Old Crystal Bay Road and that he has viewed
the road three times today. Murphy stated approximately one-half of the road has been blacktopped from
Fox Street to Watertown Road and that the blacktopping is expected to be completed sometime next
week, which ^ipears to have satisfied Mr. Post.
Murphy noted a meeting to discuss ribbon cutting of the Old Crystal Bay Road bridge is scheduled for
1:00 p.m. on November IS"*, and that the work is proceeding as anticipated
Murphy stated he received a flyer on Thursday the week before the election and that he called City Hall in
response to the flyer. Murphy stated he inquired of City Staff whether school board information is
contained on the City’s wd> site and was told that it is not.
Mur|rfiy stated he was unable to teach Mr. Hoyt, the gentlenum that distributed this flyer, on either his cell
phone or house line. Murphy stated he was finally able to leave a message indicating that the information
contained in the flyer is iiuccurate and that the City is not responsible for the information contained in the
flyer. Murphy commented that citizens should take steps to insure that information they distribute is
accurate.
White noted the referendum only lost by approximately 60 votes.
Sansevere ^ted he did speak with the gentleman and that Mr. Hoyt was told specifically that the
information contained in the flyer was inaccurate.
White concurred that the information in the flyer is inaccurate.

lease the property from the HRA for the duration of the bonds; at which time the lease will
terminate, and the City will have title to the property unencumbered by any HRA interest. A

PUBLIC PROJECT REVENUE BONDS, SERIES 2005 ANDOF$l,
AUTHORIZING THE EXECUTION AND DELIVERY OF LEASE AND
PURCHASE OPTION AGREEMENT AND
CERTAIN DOCUMENTS RELATED THERETO
WHEREAS, this Council has detennined that it is necessary and expedient that the City
finance the acquisition of land for conservation and park purposes and demolition of the
buildings therein (the “Project") under a Lease and Purchase Option Agreement (the “Lease") to
be entered into between the City and the Orono Housing and Redevelopment Authority (the
“Authority”);
WHEREAS, the Authority is to have a leasehold interest in the land upon which the
Project is to be located pursuant to a Ground Lease between the City and the Authority (the
“Ground Lease”);
WHEREAS, there has been presented to this Council an Official Statement relating to
the offering of the Bonds for sale, the Lease, the Ground Lease and a Trust Indenture between the
City and U.S. Bank National Association (the ‘Trust Indenture”).
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Orono,
Minnesota, as follows:
1. The Mortgage Trust Indenture and the financing of the Project by the issuance of
the Bonds described therein are approved. The offer of______________(tfie “Underwriter”)
to purchase the Bonds as hereinafter described is hereby found and determined to be the best
proposal received and acceptance of such offer by the Authority is approved.
2. The Lease and the Ground Lease (the “City Documents”) are hereby af^roved,
and the Mayw and the City Clerk are authorized to execute and deliver the City D^uments on
behalf of the City, in substantially the forms on file, but with all such changes therein, not
inconsistent with applicable law, as may be ^>proved by the officials executing the same, which
execution shall constitute conclusive evidaice of the approval thereof
3. The City Administrator, City Clerk and Finance Director are authorized and
directed to prepare and Aindsli to the purchaser and to the attorneys approving the Bonds
certified copies of all proceedings and records relating to the City Documents and to the right,
power and authority of the City and its officers to execute and deliver the same, and said certified

copies and certificates shall be deemed the representations of the City as to all matters stated
therein.
4. The Mayor, City Administrator and other City officials and staff are authorized
and directed to take all other actions and do all other things necessary to assure the expeditious
completion of die construction of the Project and the financing thereof as contemplated hereby,
including without limitation execution of a grant agreement with the State of Minnesota and
other instruments relating to the fiiumcing of the purchase, and to pay all fees and expenses
incurred in connection with the transaction.
5. The Official Statement relating to the Bonds, on file with the City Clerk and
presented to this meeting, is herdiy s^roved and the furnishing thereof to prospective
purduners of the Bonds is hereby ratified and confirmed. The Continuing Disclosure Certificate
attached to the Official Statement is hereby approved and shall be executed by the Mayor and
City Clerk. The Omtinuing Disclosure Certificate constitutes a contractual obligation of the
City.

reductions originally proposed.

TO MUNICIPAL ZONING CODE
SECTIONS 78-1288 AND 78-305

WHEREAS, Christopher W. Chapman and Emily P. Chapman, husband
and wife (hereinafter **the applicants”) are the owners of the property located at 3775
Bayside Road within the City of Orono (hereinafter the “City ”) and legally described as
follows:

(hereinafter the “property”); and
WHEREAS, the applicants have made application to the City of Orono
for variances to Orono Municipal Zoning Code Sections 78-1288 and 78-305 to allow
construction of a 12* x 12* shed where hardcover in the 0-250* zone is proposed at 30%
where 0% is normally permitted in the 0-75* zone and 25% is normally permitted in the
75*-250* zone and 30% in the 0-250* zone currently exists and was approved by variance
in June of 2004, and a street/rear yard setback variance to permit the shed to be located
21* from the property line where 50* is normally required and the existing home was
permitted by variance to be setback 21* from the property line.
NOW, THEREFORE BE IT RESOLVED by the City Council of
Orono, Minnesota:

This application was reviewed as Zoning File 05-3142.
The property is located in the LR - I A, One Family Lakeshore Residential
Zoning District, which requires a minimum lot area of 2.0 acres and a
minimum lot width of200* at the shoreline and required 75* lake setback.
3.The Planning Commission reviewed this application at a public hearing
held on October 17, 2005 and recomme^ed denial of the requested
variances based on a City policy of not allowing trading of non-structural

hardcover for structural hardcover. The City Council review this
application at their meeting of November 14, 2005 and recommended
approval of the variances based on the following findings:
a. The proposed hardcover level in the 0-2S0* zone will have a net
decrease of 3.5 s.f. of hardcover and remain unchanged at 30%.
b. No new hardcover is proposed within the 0-75* zone.
c. The shed will not be located any closer to the road than the existing
home.
d. Lot coverage by structures remains conforming at 6.4%.
e. The proposed location of the shed is in conformance with all wetland
regulations.
f. The proposed location of the shed will not impact adjacent residence’s
views to the lake.
g. The shed will be screened by existing coniferous trees located partially
v^thin the applicant’s property and the right-of-way of Bayside Road.
h. No other more conforming location exists on the property.
i. The flndings and conditions of variance Resolution #5198, approved in
June of2004, will not be impacted.
The City Council has considered this application including the findings
and recommendation of the Planning Commission, reports by City staff,
comments by the ^plicants and the public, and the effect of the proposed
variances on the hMlth, safety and welfare of the community.
The City Council finds that the conditions existing on this property are
peculiv to it and do not apply generally to other property in this zoning
district; that granting the variances would not adversely affect traffic
conditions, light, air nor pose a lire hazard or other danger to neighboring
property; would not merely serve as a convenience to the applicants, but is
necessary to alleviate a derntmatrable hardship or difficulty; is necessary to

preserve a substantial property right of the applicants; and would be in
keeping with the spirit and intent of the Zoning Code and Comprehensive
Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby
grants variances to Orono Municipal Zoning Code Sections 78-1288 and 78-305 to allow
construction of a 12 ’ x 12* shed where hardcover in the 0-250 ’ zone is proposed at 30%
where 0% is normally permitted in the 0-75 ’ zone and 25% is normally permitted in the
75 ’-250 ’ zone and 30% in the 0-250 ’ zone currently exists and was approved by variance
in June of 2004, and a street/rear yard setback variance to permit the shed to be located
21 ’ from the property line where 50 ’ is normally required and the existing home was
permitted by variance to be setback 21 ’ from the property line, subject to the following
conditions:
1. Council approval is based on the site plan submitted by the applicants and
annotated by City staff, attached to this Resolution as Exliibit B. Any
amendments to the site plan which are not in conformity with City codes will
require further Planning Commission and City Council review.
2. Hardcover in the 0-75 ’ zone shail not increase above the level of 3.5%.
Hardcover in the 75 ’-250 ’ zone shall be limited to 11,430 s.f. or 20% and
hardcover in the 0-250 ’ zone shall be limited to 30% per the proposed plan and
hardcover allowance summary as depicted on Exhibit B. Applicants are advised
that any future requests to increase hardcover or change the nature of
existing/approved hardcover shall require City approval, and increases in
hardcover will not likely be approved without concurrent reduction in existing
hardcover.
3. Applicants shall remove all plastic or fabric liner material from the decorative
landscape beds on the property to ensure their pemieability as non-hardcover
surfaces.
4. Required removals of hardcover shall be completed by the first required building
inspection for the proposed shed, unless a removal timeline has been accepted by
Zoning staff and/or Um Building Official/lnspector.

S. Authorities granted by this resolution run with the property not with die
applicants, but are permissive only and must be exercised by obtaining a building
permit for the new construction within one year of the date of Council approval,
or the variances will expire on that date (November 28,2006).
6. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a misdemeanor.
7. The undersigned applicants have read, understand and hereby agree to the terms
of this resolution and on behalf of the applicants and the applicants’ heirs,
successors and assigns, hereby agrees to tte recording of this resolution in the
chain of title of the property.

The Planning Commission reviewed this ordinance amendment at their November work session and
held a public hearing at their November 21, 2005 regularly scheduled meeting. The Planning
Commission discussed the existing language as it relates to the Ordinance appeal for 1535 Bohn’s
Point Road, the intent of the City in regulating entrance monuments, and the need for establishing a
gate height maximum. The Planning Commission determined that if the existing ordinance permits
entrance monuments to be 8’ in height that the gates attached to the monuments should also be
permitted to be 8’ in height. Secondly, the Planning Conunission discussed that if the entrance
monuments themselves were not 8’ that the gates attached to them could be no taller than the
monuments. Lastly, the Planning Conunission determined that if the gates maintained a certain level
of opacity, that the height impacts would be alleviated. Therefore, the opacity level whereby the
gates would maintain a transparency effect was established at 25%.
Please refer to the proposed ordinance amendment and attached memorandum to the Platming
Commission dated 11-1^05.
Plaaning Commission Recommendation
On November 21, 2005, the Planning Commission voted 6-0 to recommend approval of the
proposed amendments to Section 78-1405 (8) with regard to Entrance Monuments.
Staff Recommendation
Review the proposed amendments of Section 78-1405 (8), attached as Exhibit A, and determine if
the proposed language accomplishes a maximum gate height and closes any other potential ’’loop
holes” of the existing ordinance.

AN ORDINANCE AMENDING THE CITY OF ORONO ZONING CODE
SECTION 78-1405
REGARDING NONENCROACHMENtS
The City Council of Orono ordains as follows:
Section 1: Municipal Zoning Code Section 78-1405(8) is hereby revised as follows:
Sec. 78-1405. Noncncroachmcnts.
Entrance monuments, defined for the purpose of this section as a nearly
permanent physical structure or object, natural or artificial, used to depict an
entrance to the property, erected in all residential zoning districts are considered
nonencroachments when they conform with the following standards:
a. Each monument, with a maximum of two per approved driveway access, shall
be limited to a single pillar with a footprint measuring no larger than 25
square feet and no length to exceed 5*;
b. The monument must be setback a minimum of 5* from all property boundaries
and never fewer than 10’ from the edge of the paved, traveled roadway;
c. Plans and/or elevation views of the proposed monuments are required to be
submitted for approval by the Planning Director;
d. All signage proposed for the monuments must comply with Section 78-1467;
e. The monuments are limited to 8’ in height including any appurtenances. Any
monument exceeding the maximum height must meet principal structure
setback requirements;
f. When more than one monument is proposed, and serving two or fewer
residences, a minimum horizontal width of 43^ is required between them;
g. When more than one monument is proposed, and serving three or more
residences, a minimum horizontal width of 22* is required between them:

discretion of the Planning Director.

05*3162: Proposed Entranee Monument Ordinance Amendment
This amendment is in response to a recent appeal of a staff interpretation of the entrance
monument ordinance (as we recently amended the non*encroachments section in May of
2004). The attached amendment includes revisions requested by the City Fire Marshall
and also discussion by the City Council, at a September work session, and also the
discussion that took place at your work session of November 2,2005.
This amendment aims to clarify maximum gate height, when attached to entrance
monuments, and also to establish revised horizontal widths between monuments for
emergency vehicle access.
The Commission should review the proposed revisions, hold a public hearing, and make
a recommendation to the City Council.

Ames Construction on behalf of property owner Charlie James (representing Thomas L. James
Realty LLLP) has tfiproached the City requesting permits to allow site grading and stockpiling
of fill on this 17-acre property at the southwest comer of Highway i 2 and Old Crystal Buy Road.
This site is guided in the 2000-2020 CMP for a mix of single and multi-family residential uses at
a density of 2-4 units per acre. The property was the subject of a sketch plan review (/^04-3027,
Brenshell Homes) in 2004, although no developer has made any tq>plications for development of
the site at this time.
Staff believes that due to the flat nature of this site, regardless of how the site eventually
develops, fill will likely be needed at a minimum for building pad construction and for perimeter
beiming to meet (Conservation Design goals.
The property owner has been working with Ames Construction to procure fill from the Highway
12 Reroute project. The location of the property adjacent to the Highway 12 Corridor is a
potential win-win-win for Ames, the property owner, and the City, in that Ames has a location to
dispose of earth material that requires little or no trucking and saves costs and time; the property
owner acquires fill that will likely be necessary for any future development of the property, at
low cost or no cost; and the City foregoes the pleasure of having hundreds of dumptruck trips on
its roadways on two occasions (i.e. hauling it out of the City now and hauling it into the James
site in the future).

The amount of earth movement proposed, in the range of 123,(X)0 cubic yards in total, far
exceeds the 500 cubic yard maximum allowed without a Conditional Use Permit. Applicants
propose to do a two-step land alteration process: 1) strip 21,000 cubic yards of topsoil and
stockpile it on the site during December, priew to freeze-up, and 2) haul in 102,000 cubic yards of
fill material for perimeter berms and potential future development use (staff has indicated that fill
to create walkout building pads might not be approved with any future development plan).

Ames requests q)ecial approval to commence Step 1 prior to completion of the CUP review
process. Ames would like to be moving fill material onto the site (Step 2) in late January, and
the topsoil must be removed prior to bringing in fill. The earliest possible CUP approval would
be at the City Council on January 23.
The property owner and a Todd Planting of Ames have met with staff, and an application for the
land alteration CUP was submitted on November 23. Ames is requesting that staff be authorized
to issue a land alteration permit prior to the CUP approval to allow stripping and stockpiling of
topsoil. In Older for this to occur, the applicant will need to submit to the City for staff &
engineer review a detailed plan indicating temporary fill placement and stockpile areas, and
provide a stormwater management and erosion 0000*01 plan. An MCWD erosion control permit
will be required.
Note that the plan submitted on 11/23 shows perimeter berms at a height of approximately 4 feet.
It also indicates a **No Fill in Wetland” area that appears to not include the entire wetland. This
”No Fill” area will have to be revised, and staff would expect a much more detailed plan by a
surveyor/engineer with survey work defining the delineated wetland boundaiy and required
buffers, prior to issuing the initial topsoil stripping permit.
Staff Rccommcadation
Due to the existence of wetlands on the property, and because there is no set development plan
for the site, care will have to be taken with respect to erosion control, wetland protection, and
finished appearance of the stockpiles, as we have no indication how soon actual development of
the property will occur. However, the benefits of the owner acquiring fill when it is available
immediately adjacent to the site, are compelling.
Staff recommends iqiproval of a staff-issued land alteration permit for the topsoil removal and
stockpiling, subject to the following being submitted and approved by City Engineer prior to
issuance of this initial permit:
1) Complete application for CUP.
2) Detailed plan indicating temporary fill placement and stockpile areas.
3) Detailed Stormwater Pollution Prevention Plan (SWPPP) • required because more than one
acre of land is being disturbed.
4) MCWD erosion control permit and stormwater plan approval.
COUNCIL ACTION REQUESTED
Authorize staff to issue land alteration permit subject to staff recommendation and the process
described above.

Cherry Place Emergency Generator
This lift station was installed in 1973 as part of the Saga Hill sewer project and serves the eastern
side of Forest Lake. This is a major lift station that handles flow from three upstream lift stations and
also has very limited eirergency response time in the event of a lift station malfunction because of
several low basement elevations in relation to the lift station. In the event of power outages the City
currently has to bring in oortable generators to operate lift stations which is not adequate for this
station because of the high flows and limited emergency responr' time available. This 60 KW
natural gas generator will be equipped with an automatic emergency start up system, battery charger,
cold weather etKiosure, and electric jacket water heater to facilitate winter startups.
We have solicited quotations for this emergency generator purchase and installation and are
recommending acceptance of the quotations from Ziegler Power Systems and Electric Resource
Contractors. This generator is stock at the company ’s Shakopee faculty and is available for
immediate delivery. The other two companies that we received quotations from require a 12 to 14
week time period for ordering and delivering the generator. There is an adequate cash balance in the
Sewer Fund to pay for this project, and r ar recommendation is to fund this project from the Sewer
Fund.

The Three Rivers Park District has prepared a master plan for the development of a trail along
the Dakota Rail Corridor, and has requested feedback regarding the master plan. A resolution
supporting the trail development, and requesting an opportunity to meet regarding the surface
material of the trail, is attached for Council consideration.

OF THE THREE RIVERS PARK DISTRICT
REGARDING THE DEVELOPMENT OF A
CONTINUOUS REGIONAL RECREATIONAL TRAIL
ON THE DAKOTA RAIL CORRIDOR
WHEREAS, the City of Orono has been a strong supporter of the development of a
continuous regional recreational trail on the Dakota Rail Corridor; and
WHEREAS, Three Rivers Park District has developed a master plan for the development
of a trail on the Dakota Rail Corridor; and
WHEREAS, the City has reviewed the trail master plan; and
WHEREAS, the City is strongly supportive of the overall trail master plan, but has
questions regarding the trail surface; and
WHEREAS, the City sees the advantages of an aggregate surface, including a closer fit
with the City’s rural character, a more forgiving surface for runners, a surface more suited to
cross-country skiing, and a surface that tends to limit speeds of bicyclists; and
WHEREAS, the City understands there are pros and cons to both the a^^gregate surface
and the bituminous surface.
NOW, THEREFORE, BE IT RESOLVED, that the Orono City Council does hereby
indicate its strong siq>port for the development of a continuous regional recreational trail on the
Dakota Rail Corridor, as well as its support for the overall trail master plan developed by Three
Rivers Park District; and does also request a meeting with Three Rivers Park District trail staff to
discuss the pros and cons of the aggregate surface vs. the bituminous surface.
Adopted by the City Couitcil of the City of Orono, Miimesota at a regular meeting held
on NovembCT 28,2005.

DISCUSSION:
The police department has a web site that was set up by Stephanie Grande. Stephanie has arranged a
doamion of software that was used to create and maintain the police web site. The software
manufacturer has a special sale in progress that will allow us to tr^e in this old software for the
current version. Without the donation of the old software, the City's cost to purchase the software
would be about S750. With accepting the donation of the old software and having the intention of
trading it on the new software, the City's cost is reduced to about $350. The donation Stephanie has
arranged will thus save the City about $400. The City will then own the software necessary to
support and maintain the police department web site.
COUNCIL ACTION REQUESTED:
A motion to accept the donation of Dreamweaver Ultradev software from Stephanie Grande.

MINNESOTA LAWFUL GAMBLING APPLICATION FOR EXEMPT PERMIT
OF THE ORONO pro FOR
A ONE DAY GAMBLING PERMIT
WHEREAS, tiie Orono PTO has sulmiitted an q>plication to conduct lawful
panbling activities; and
WHEREAS, die Orono PTO has proposed to conduct a one day gambling activity
(raffle) as part of its annual Mid-Winter FUn Fest at tM Orono Middle School on February 4,2006;

WHEREAS, the Orono PTO is required to obtain ^iproval of the one day gambling
die city in v^ch the activity will occur, and
WHEREAS, the City of Orono has no objection to the conduct of lawful gambling by
the qipUcant, in accordance with law, at the designated location.
NOW, THEREFORE, BE IT RESOLVED, that the Orono City Council does

UPON MOTION by Mike Bash, seconded by Dick Lewis, the consent agenda was
approved as follows:
approved the minutes of September 26,2005 and Octdwr 10,2005, regular
meetings;
- accepted the resignation of Sara Engel, Orono High School teacher on
mobility leave, effective October 31,2005;
accept^ the resignation of Dalah Smith, Orono High School guidance
office cleric, effective August 25, 2005 and, approved her appointment as
Orono Middle School guidance office secretary, effective August 26,2005;
• approved the appointment of Lisa Curtis as a part-time guidance clerk for
Orono Hi^ School, effective September 26,2005;
• apiMToved the appointment of Tarruny Lowery as a qiecial education
paraprofessional at Orono Intermediate School, effective October 17,2005;
approved the Activity Fund Quarterly Report, 3"* quarter, July-Septembw
2005;
iqiproved the bills as covered by vouchers 143434 through 143816 and
office checks 7300 through 7316.

REFERENDUM UPDATE: Dr. Orcutt thanked John Malone, Dick Lewis, Mark
Engebretson and Jack Veach for their passionate and compelling presentations at the
October 10,2005 public meeting. She stated that there was still a lot of woric to be done
to disseminate data to the public. Letters would be going out to the taxpayers and
community in the following weeks. Mr. Neal Lawson demonstrated new web site graphs
produced by Ehler’s, the district's financial advisors. He explained the property tax
impact and demonstrated how the graphs showed the needs of the school district.
Discussiem ensued and Mr. Lawson answered questions by the Board for clarification
purposes. Board members John Malone and Martha Van de Yen reported on the big
commitment being made by volunteer community members. Dr. Orcutt thanked the
entire Board for all their hard work on this “Referendum of Hope”.
TECHNOLOGY REPORT: Aaron Ruhland updated the Board regarding NWEA
(Northwest Evaluation Association). The NWEA kickoff was sensational and very well
received by the participating administration and faculty.
Ms. Penny Pease and Mr. Ruhland reported to the Board on how the district is utilizing
new techriologies to enhance instructional practices, studoit learning, and home/school
communication.

ADMINISTRATIVE REPCMtT: Dr. Oicutt welcomed Dr. Patricia Wroten, Orono
Middle School Principal, and, Bucky Mieras, Middle School Dean of Students,
congratulating them on a |rfienomenal start to the 200S>2006 school year. Dr. Wioten and
Mr. Mieras presented an overview of the efforts of the Orono Middle School to address
the needs of adolescent learners. The middle school uses a current version of This We
Believe (NMSA. 2003).
Di. Wroten invited the Board to attend one of the NASA and Honeywell shows being
presented on October 26,2005. FMA Live! is a hip hop science education program. It is
a program formed to get middle school students more excited about studying math and
science and to encourage them to consider careers in engineering and other technical
disciplines.
