A RESOLUTION AUTHORIZING THE TAKING OF LAND BY
EMINENT DOMAIN FOR ROAD, TRAIL, DRAINAGE AND UTILITIES
EASEMENT PURPOSES RELATED TO THE SAGA HILL PARK AREA
WHEREAS,the City Council has ordered preparation of a resolution authorizing taking of
land by eminent domain for road, trail, drainage and utilities easement purposes at the location
hereinafter specified, therefore,
BE IT RESOLVED, by the City Council of Orono:
1. That it is hereby determined that the taking of the two parcels of land set forth in paragraph
3 hereof is necessary for the public good in order that said parcels shall be devoted to road,
trail, drainage and utilities purposes.
2. That the City shall take by right of eminent domain for road, trail, drainage and utilities
easement purposes, the land described in paragraph 3 hereof, and the City Attorney be
hereby authorized and directed to commence proceedings in the District Court of Hennepin
County for appointment of Commissioners to determine the damages, if any, sustained by
the respective owner and interests of the parcel affected by such taking,as authorized by law.
3. A permanent easement for road, trail, drainage and utilities purposes for the benefit of the
public, over, under, and across the Property in Section 7, Township 117, Range 23 legally
described as follows: Beginning at a point distant 2224.4 feet southerly from the north line
of the section along a line running from a point in the north line thereof distant 402.5 feet
east from the northwest corner thereof to a point in the south line of the northwest quarter
distant 396.5 feet east from the southwest corner thereof; thence southerly along said line to
the north line of Bergquist and Wicklund's Addition to Bergquist and Wicklund's Park,
Hennepin County, Minnesota; thence westerly along same and along the north line of
Bergquist and Wicklund's Park,Hennepin County,Minnesota,to the west line of the section;
thence north along said section to a point in a line running west parallel with north line of
section from point of beginning; thence east to beginning, except road, Hennepin County,
Minnesota, according to the plat thereof on file or of record in the office of the Registrar of
Titles in and for said County. The easement area is that portion of the Property lying east
and south of the following described Line A; Commencing at the northeasterly corner of the
Property;thence south along the east lot line of the property a distance of 122.61 feet to the

point of beginning of Line A; thence southwesterly along an assumed bearing of S 70° 31'
45" W a distance of 54.69 feet; thence deflecting to the left along a curve with R=90.00,
L=16.06, Tan=8.05, 0=10° 13' 28" and thus terminating on the southerly lot line of the
Property.
and
A permanent easement for road, trail, drainage and utilities, for the benefit of the public,
over, under and across the Property, legally described as Lot 6, Bergquist and Wicklund's
Addition to Bergquist and Wicklund's Park, Hennepin County, Minnesota, according to the
plat thereof on file or of record in the office of the Registrar of Titles in and for said County.
The easement area is that portion of the Property lying east and south of the following
described Line A; Commencing at the most southeasterly corner of the Property; thence
northwesterly along the southerly lot line of the Property a distance of 15.3 feet to the point
of beginning of Line A; thence northeasterly along an assumed bearing of N 20° 05' 40" E
a distance of 91.71 feet; thence deflecting to the right on a curve with R=90.00, L=47.30;
Tan=24.21, A=30° 06' 47" and thus terminating on the northerly lot line of the Property.
